		<official-title>To amend the Immigration and Nationality Act to promote
		  the economic survival of seasonal small businesses by ensuring that the wages
		  paid to H–2B nonimmigrants are fair and reasonable.</official-title>

		<section id="H750BBC5C6A1E41B1B0069FB9C0AF511B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Save Our Seasons Act of
			 2013</short-title></quote>.</text>
		</section><section id="H2893357282B7463DAAB9383C241B4AE2"><enum>2.</enum><header>H–2B
			 wages</header><text display-inline="no-display-inline">Section 214(g)(9) of the
			 Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)(9)</external-xref>) is amended by adding at
			 the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HA7D3500F246F4127AF556B32D9861229" style="OLC">
				<subparagraph id="HB0358EB1FEC549099CFBE1D1B239FB39"><enum>(D)</enum><header>Wages</header>
					<clause id="H97BF91D5C47B4F97B8D3F454A0C196C0"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">The wages paid to
				nonimmigrants under section 101(a)(15)(H)(ii)(b) employed by an employer shall
				be the greater of—</text>
						<subclause id="HE62043B3315C4D7B8C1DDCF874F72023"><enum>(I)</enum><text>the actual wage
				level paid by the employer to other employees with similar experience and
				qualifications for such position; or</text>
						</subclause><subclause id="HF5445E4FE9954D5BB931F8D4500FECC7"><enum>(II)</enum><text>the prevailing
				wage level for the occupational classification of the position in the
				geographic area of the employment, based on the best information available as
				of the time of filing the application.</text>
						</subclause></clause><clause id="H4F5BC51778CF4CF79C0AFD56A6C76732"><enum>(ii)</enum><header>Best
				information available</header><text>The term <term>best information
				available</term>, with respect to determining the prevailing wage for a
				position, means—</text>
						<subclause id="H06597E3CBF614DE48EFB6C9072FFDF37"><enum>(I)</enum><text>a controlling
				collective bargaining agreement or Federal contract wage, if applicable;</text>
						</subclause><subclause id="H5375101FBD054AEAB5F1537ED4E88146"><enum>(II)</enum><text>the wage level
				commensurate with the experience, training, and supervision required for the
				job based on Bureau of Labor Statistics data; or</text>
						</subclause><subclause id="HAFF94E29AD86443B8DEF4E51193DDA76"><enum>(III)</enum><text>if the data
				referred to in paragraph (2) is not available or the best information
				available, a legitimate, recent private survey of the wages paid for such
				positions in the metropolitan statistical
				area.</text>
