		<official-title>To require the Army Corps of Engineers to notify the
		  public of certain flood predictions regarding the Missouri River System, and
		  for other purposes.</official-title>

		<section id="HD74BB7280C0443BD9C46D82682F38318" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Army Corps of Engineers Communications
			 Accountability Act of 2013</short-title></quote>.</text>
		</section><section id="HE5EE462F6FFD42B1A85F9F427BA7BA68"><enum>2.</enum><header>Notification and
			 consultation requirements</header>
			<subsection id="HCCC509702E1D4789826102D75F532F51"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">If the Chief of
			 Engineers makes an upper quartile determination or an upper decile
			 determination, the Chief of Engineers shall notify the public of such
			 determination, and consult with affected governments, in accordance with this
			 section.</text>
			</subsection><subsection id="H21B3D0F208D64073BBD8F3FA2BAFF417"><enum>(b)</enum><header>Notification</header><text display-inline="yes-display-inline">Not later than 7 days after making a
			 determination described in subsection (a), the Chief of Engineers shall notify
			 the public that such determination has been made.</text>
			</subsection><subsection id="H954BC5AEE58B43298F4CD12263C6E0A5"><enum>(c)</enum><header>Consultation</header>
				<paragraph id="HEBDD844F11354E5380DB1AD4701B540B"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">If the Chief of
			 Engineers makes an upper decile determination, an affected government may
			 request a consultation with the Chief of Engineers.</text>
				</paragraph><paragraph id="H5ED97BFE39074E4580FEF9F050C75A73"><enum>(2)</enum><header>Deadline</header><text display-inline="yes-display-inline">If an affected government requests a
			 consultation under paragraph (1), the Chief of Engineers shall provide such
			 consultation not later than 7 days after receiving the request.</text>
				</paragraph><paragraph id="H42059723362740FE8BA8E33444E80E39"><enum>(3)</enum><header>Contents</header><text display-inline="yes-display-inline">The Chief of Engineers may provide in a
			 consultation under this subsection—</text>
					<subparagraph id="HDF70386F6AB1467888D31DE7823D24AB"><enum>(A)</enum><text>information
			 regarding expected water levels;</text>
					</subparagraph><subparagraph id="HC57B4E160345436688AAD7F1A93D5AE2"><enum>(B)</enum><text>advice regarding
			 appropriate preparedness actions;</text>
					</subparagraph><subparagraph id="H3FC3A1F5ABA14A11B5C409B340D22252"><enum>(C)</enum><text>technical
			 assistance; and</text>
					</subparagraph><subparagraph id="H5D3FE11E577245FBA5A8CD270F692735"><enum>(D)</enum><text display-inline="yes-display-inline">any other information or assistance
			 determined appropriate by the Chief of Engineers.</text>
					</subparagraph></paragraph></subsection><subsection id="H940DD9A4B2734C1281B5B3545F933C87"><enum>(d)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H0676FB0F1F2E4A0E9B15D6A7AD0A7243"><enum>(1)</enum><header>Affected
			 government</header><text display-inline="yes-display-inline">The term
			 <term>affected government</term> means a State, local, or tribal government
			 with jurisdiction over an area that will be affected by a flood occurring in
			 the Missouri River System, as determined by the Chief of Engineers in an upper
			 decile determination.</text>
				</paragraph><paragraph commented="no" id="H061DCF9D5DD146E4A17BAD28E178A1D4"><enum>(2)</enum><header>Annual operating
			 plan</header><text>The term <term>annual operating plan</term> means a plan
			 prepared by the Chief of Engineers that describes potential water conditions
			 scenarios for the Missouri River System for a year.</text>
				</paragraph><paragraph commented="no" id="HD2BE5691902148C4BD353E7A14612BF1"><enum>(3)</enum><header>Upper decile
			 determination</header><text>The term <term>upper decile determination</term>
			 means a determination that runoff conditions in the Missouri River System are
			 likely to reach the upper decile scenario specified for a year in an annual
			 operating plan.</text>
				</paragraph><paragraph commented="no" id="HA86BD3849EDC4A89B6AF28C1E936104F"><enum>(4)</enum><header>Upper quartile
			 determination</header><text>The term <term>upper quartile determination</term>
			 means a determination that runoff conditions in the Missouri River System are
			 likely to reach the upper quartile scenario specified for a year in an annual
			 operating plan.</text>
				</paragraph></subsection></section></legis-body>
