			</subsection></section><section id="HABD6DC785B344F09ADE6EAC4CEC81192"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H286E8137E09C472B97BA1B11EFB7A588"><enum>(1)</enum><text>On September 11
			 and 12, 2012, terrorists attacked the United States Special Mission compound
			 and Annex in Benghazi, Libya.</text>
			</paragraph><paragraph id="H1BBC9DF9680E4FEC8206A09866BA6F15"><enum>(2)</enum><text>The attacks
			 resulted in the deaths of Ambassador John Christopher Stevens, Sean Smith,
			 Tyrone Woods, and Glen Doherty, in addition to severely wounding other United
			 States personnel and Libyan guards.</text>
			</paragraph><paragraph id="H5B6A294DAABB4476B0A250CD5C5A27C3"><enum>(3)</enum><text>The United States
			 personnel in Benghazi performed bravely in protecting their colleagues despite
			 the scale and intensity of the attacks.</text>
			</paragraph><paragraph id="H0F75C523BE3547A19DE7E7EEA6616290"><enum>(4)</enum><text>An Accountability
			 Review Board chaired ably by Ambassador Thomas R. Pickering and vice-chaired by
			 Admiral Michael Mullen, former Chairman of the Joint Chiefs of Staff, was
			 subsequently convened to examine security failures leading to the
			 attacks.</text>
			</paragraph><paragraph id="HD899F66F13464F60B655C88AB61B85AB"><enum>(5)</enum><text>The Board found,
			 in particular, the following:</text>
				<subparagraph id="H945587FDCC8F4C7F81D3A196D8F91341"><enum>(A)</enum><text>Systemic failures
			 in leadership and management at the Department of State led to inadequate
			 security and unclear lines of responsibility for security considerations in
			 Benghazi.</text>
				</subparagraph><subparagraph id="H376EC702C59045F799CBA219E6B82992"><enum>(B)</enum><text>Physical security
			 at the site was inadequate and local Libyan responders failed to adequately
			 respond to the sudden penetration of the mission.</text>
				</subparagraph><subparagraph id="H5B0A1FD19D9A4E5B9E0FC2FEBBADC3B2"><enum>(C)</enum><text>There were no
			 immediate, specific tactical warnings of an attack although officials were
			 aware of intelligence gaps on militia activity in Libya and the threat such
			 activity posed to United States interests.</text>
				</subparagraph></paragraph><paragraph id="HB151F3B3DFDB4A079ABE286A69456ECD"><enum>(6)</enum><text>The Board made 29
			 recommendations for the Department of State, including—</text>
				<subparagraph id="H841FC8B15D93453CB6D3A63C2E269D07"><enum>(A)</enum><text>enhancing security
			 in high risk, high threat posts and reviewing the balance between the risk and
			 benefits of a particular post;</text>
				</subparagraph><subparagraph id="HCC59B1C4B5654DE1858C6882782C37AE"><enum>(B)</enum><text>reexamining
			 organization and management with a focus on security planning in the Bureau of
			 Diplomatic Security;</text>
				</subparagraph><subparagraph id="HD3765636DD9D4B98BE60DAD114DAFB45"><enum>(C)</enum><text>establishing
			 minimum security standards for temporary facilities, such as Benghazi, in high
			 risk, high threat environments; and</text>
				</subparagraph><subparagraph id="HE4B492C5D7B34057ADDADE35CB4DFC2A"><enum>(D)</enum><text>improving training
			 for personnel serving in high risk, high threat posts.</text>
				</subparagraph></paragraph><paragraph id="H3FA8B64F60BC45A89179C8DFC41F1886"><enum>(7)</enum><text>Former Secretary
			 of State Hillary Clinton accepted all of the Board’s recommendations and
			 directed that they be implemented.</text>
			</paragraph><paragraph id="H97834E12AD92410C970F114D5678EB1D"><enum>(8)</enum><text>United States
			 public servants work in dangerous places around the world to advance United
			 States interests and values, and it is not possible to conduct robust
			 diplomatic and development efforts without inherent risk.</text>
			</paragraph><paragraph id="HFAEE474C6BF7465FA42DFAE4E9F65536"><enum>(9)</enum><text>The dedicated men
			 and women of the foreign and civil service are worthy of a serious and
			 sustained commitment to enhancing security and better protecting them when they
			 serve in hostile environments.</text>
			</paragraph></section><section id="HC487167388184907879018637FA70AC7"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H0B74CF81622C46B882FA4220C6F7DC2D"><enum>(1)</enum><header>Appropriate
			 congressional committees</header><text>The term <term>appropriate congressional
			 committees</term> means the Committee on Foreign Affairs of the House of
			 Representatives and the Committee on Foreign Relations of the Senate.</text>
			</paragraph><paragraph commented="no" id="H6BB711620432423197021C958543E340"><enum>(2)</enum><header>High risk, high
			 threat post</header><text>The term <term>high risk, high threat post</term>
			 means a United States diplomatic or consular post, as determined by the
			 Secretary of State, that, among other factors, is—</text>
				<subparagraph commented="no" id="H476CC5B4BD434430B8C6FD5AE6BC0B96"><enum>(A)</enum><text>located in a
			 country—</text>
					<clause commented="no" id="HBC6B1C993BA4491F98DD041FF25C06E9"><enum>(i)</enum><text>with high to
			 critical levels of political violence and terrorism; and</text>
					</clause><clause commented="no" id="HB2054A2B1D8141288940964F8C7D4F7E"><enum>(ii)</enum><text>the government of
			 which lacks the capacity or willingness to provide adequate security;
			 and</text>
					</clause></subparagraph><subparagraph commented="no" id="H887443ADA6FB4B5F9D46BD75D3343943"><enum>(B)</enum><text>with mission
			 physical security platforms that fall below the Department of State’s
			 established standards.</text>
				</subparagraph></paragraph><paragraph id="H91F72E829B954E888462E1982D584E55"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of State.</text>
			</paragraph></section><title id="H550FDC2060E54340A4908BE3D8C961ED"><enum>I</enum><header>Review and
			 planning requirements</header>
			<section id="H8375631CF12F499A9B9CF1C7704A7CC3"><enum>101.</enum><header>Designation of
			 high risk, high threat posts and working groups</header>
				<subsection id="H3088368E302A43EBB3A6E9BC5878B08B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title I of the
			 Omnibus Diplomatic Security and Antiterrorism Act of 1986 (22 U.S.C. 4801 et
			 seq.; relating to diplomatic security) is amended by inserting after section
			 103 the following new sections:</text>
					<quoted-block id="H8C29AABF67574EF08AD961C70FFF0ACC">
						<section id="HCE1BEB6C799E45ECB8C3B2D5A6C76475"><enum>104.</enum><header>Designation of
				high risk, high threat posts</header>
							<subsection id="HB78EB1E543B84D4884C58339E8E95072"><enum>(a)</enum><header>Initial
				designation</header><text display-inline="yes-display-inline">Not later than 30
				days after the date of the enactment of this section, the Secretary shall
				submit to the appropriate congressional committees a report, in classified
				form, that contains an initial list of diplomatic and consular posts designated
				as high risk, high threat posts.</text>
							</subsection><subsection id="H40AF2CC8C8E745989EBFDA05249AD704"><enum>(b)</enum><header>Designations
				before opening or reopening posts</header><text display-inline="yes-display-inline">Before opening or reopening a diplomatic or
				consular post, the Secretary shall determine if such post should be designated
				as a high risk, high threat post.</text>
							</subsection><subsection id="H899F1000326E4984A3681498D22817BC"><enum>(c)</enum><header>Designating
				existing posts</header><text display-inline="yes-display-inline">The Secretary
				shall regularly review existing diplomatic and consular posts to determine if
				any such post should be designated as a high risk, high threat post if
				conditions at such post or the surrounding security environment require such a
				designation.</text>
							</subsection><subsection commented="no" id="H4D9DC9F0AE784CA6993C973F0C5EF7D5"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section and section 105:</text>
								<paragraph id="H9DB4B04837AF468AB691CC5DAC9193EF"><enum>(1)</enum><header>Appropriate
				congressional committees</header><text>The term <term>appropriate congressional
				committees</term> means the Committee on Foreign Affairs of the House of
				Representatives and the Committee on Foreign Relations of the Senate.</text>
								</paragraph><paragraph id="HDC747254BFF249638FCA5449A05DE4B3"><enum>(2)</enum><header>High risk, high
				threat post</header><text>The term <term>high risk, high threat post</term>
				means a United States diplomatic or consular post, as determined by the
				Secretary, that, among other factors, is—</text>
									<subparagraph commented="no" id="H54A86AD490614C6A875DD70A53229EC0"><enum>(A)</enum><text>located in a
				country—</text>
										<clause commented="no" id="H996089FD917D484C94E1FBCC55008B3F"><enum>(i)</enum><text>with high to
				critical levels of political violence and terrorism; and</text>
										</clause><clause commented="no" id="H5780C4B296934B9C9B323022A49AFA47"><enum>(ii)</enum><text>the government of
				which lacks the ability or willingness to provide adequate security; and</text>
										</clause></subparagraph><subparagraph commented="no" id="H135A06171CD84D4BBAD1935DDF15C830"><enum>(B)</enum><text>with mission
				physical security platforms that fall below the Department of State’s
				established standards.</text>
									</subparagraph></paragraph></subsection></section><section id="HFBA014AF37D74EF1AB7C97D3579AE3CF"><enum>105.</enum><header>Working groups
				for high risk, high threat posts</header>
							<subsection id="HA3EF10E91ECE4855836D2E4AF74ACAF6"><enum>(a)</enum><header>Establishment</header><text>Before
				opening or reopening a high risk, high threat post, the Secretary shall
				establish a working group that is responsible for the geographic area in which
				such post is to be opened or reopened.</text>
							</subsection><subsection id="H7AEF403D3D774E48AED76A7EC3272012"><enum>(b)</enum><header>Duties</header><text>The
				duties of the working group established in accordance with subsection (a) shall
				include—</text>
								<paragraph id="H31ADDF5434E64A70A939D6A237197F85"><enum>(1)</enum><text>evaluating the
				importance of the objectives of the proposed post to the national security of
				the United States, and the type and level of security threats such post could
				encounter;</text>
								</paragraph><paragraph id="HEDE46C7F917640BABB4B82F46B32BE9A"><enum>(2)</enum><text>completing working
				plans to expedite the approval and funding for establishing and operating such
				post, implementing physical security measures, providing necessary security and
				management personnel, and the provision of necessary equipment; and</text>
								</paragraph><paragraph id="H73BE1FA4B2EB4B38ADC3B03EA55D2819"><enum>(3)</enum><text>establishing
				security benchmarks that would determine specific action, including enhanced
				security measures or evacuation of such post, based on the improvement or
				deterioration of the local security environment.</text>
								</paragraph></subsection><subsection id="H4E52379D221044BC9606924FD7E1C363"><enum>(c)</enum><header>Composition</header><text>The
				working group may be composed of representatives of the—</text>
								<paragraph id="H25F34FAFEB794095A5A361F458F8F44E"><enum>(1)</enum><text>appropriate
				regional bureau;</text>
								</paragraph><paragraph id="HF9C4F9EA9DB640D8AA6F1714A767CD34"><enum>(2)</enum><text>Bureau of
				Diplomatic Security;</text>
								</paragraph><paragraph id="HA2E646EEB50D45F690F9CD00D2F30EBA"><enum>(3)</enum><text>Bureau of Overseas
				Building Operations;</text>
								</paragraph><paragraph id="H7D282AA37F3048E589C7C8449FC4A5AC"><enum>(4)</enum><text>Bureau of
				Intelligence and Research; and</text>
								</paragraph><paragraph id="H467E35B08F8B498DAC73E5A2DE40E474"><enum>(5)</enum><text>other bureaus or
				offices as determined by the Secretary.</text>
								</paragraph></subsection><subsection id="H3F5F1C0D52AF4A8AB13E6199C2F12C8B"><enum>(d)</enum><header>Congressional
				notification</header><text>Not less than 15 days before opening or reopening a
				high risk, high threat post, the Secretary shall notify the appropriate
				congressional committees in classified form of—</text>
								<paragraph id="HE4DAEE344D2F41BDBED78A0DE2E5D668"><enum>(1)</enum><text>the decision to
				open or reopen such post; and</text>
								</paragraph><paragraph id="H3ED8FC57C0D14AF3BFA4DE3F34850BC9"><enum>(2)</enum><text>the results of the
				working group under subsection
				(b).</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HDAEB1B135B8D4567BEDEABCC24DB4C0C"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents of the Omnibus Diplomatic
			 Security and Antiterrorism Act of 1986 is amended by inserting after the item
			 relating to section 103 the following new items:</text>

				</subsection></section><section id="H464A73011A504764984332DEFD665D87"><enum>102.</enum><header>Contingency
			 plans for high risk, high threat posts</header><text display-inline="no-display-inline">Section 606(a) of the Secure Embassy
			 Construction and Counterterrorism Act of 1999 (<external-xref legal-doc="usc" parsable-cite="usc/22/4865">22 U.S.C. 4865(a)</external-xref>; relating to
			 diplomatic security) is amended—</text>
				<paragraph id="H43370D16AA5144D8955CE0715528877A"><enum>(1)</enum><text>in paragraph
			 (1)(A)—</text>
					<subparagraph id="HF7E0BA53D5FF4F87AEC96CA18E93504F"><enum>(A)</enum><text>by inserting
			 <quote>and from complex attacks</quote> after <quote>attacks from
			 vehicles</quote>; and</text>
					</subparagraph><subparagraph id="HFDB008C405984833B34098366A219500"><enum>(B)</enum><text>by inserting
			 <quote>or such a complex attack</quote> before the period at the end;</text>
					</subparagraph></paragraph><paragraph id="HF6EA3055F41D4474BB57511DCF12938D"><enum>(2)</enum><text>in paragraph (7),
			 by inserting before the period at the end the following: <quote>, including at
			 high risk, high threat posts (as such term is defined in section 104 of the
			 Omnibus Diplomatic Security and Antiterrorism Act of 1986), including options
			 for the deployment of additional military personnel or equipment to bolster
			 security and rapid deployment of armed or surveillance assets in response to an
			 attack</quote>.</text>
				</paragraph></section><section id="HE5E0C986D4034E4B81CDCD80B19C0830"><enum>103.</enum><header>Sense of
			 Congress regarding strategic review of Bureau of Diplomatic Security</header>
				<subsection id="HEB73F2C8C91B489AB3314717411FE8CC"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">It is the sense of
			 Congress that the Secretary of State should complete a strategic review of the
			 Bureau of Diplomatic Security of the Department of State to ensure that the
			 mission and activities of the Bureau are fulfilling the current and projected
			 needs of the Department of State.</text>
				</subsection><subsection id="HABE365A75CE94EE19BB17501BDB49062"><enum>(b)</enum><header>Contents of
			 review</header><text display-inline="yes-display-inline">The strategic review
			 described in subsection (a) should include assessments of—</text>
					<paragraph id="H2C4D33C77EF542E4B93E89BA3BABC56D"><enum>(1)</enum><text>staffing needs for
			 both domestic and international operations;</text>

			 with the necessary language skills for assignment to overseas posts;</text>
					</paragraph><paragraph id="HEF67020D9CC242EEAFE90D093FC7AD3A"><enum>(4)</enum><text>programs being
			 carried out by personnel with the necessary experience and at commensurate
			 grade levels;</text>
					</paragraph><paragraph id="H44516FAC757B4C0BB5B35A361AFD09A5"><enum>(5)</enum><text>necessary security
			 training provided to personnel under chief of mission authority for expected
			 assignments and objectives;</text>
					</paragraph><paragraph id="H6C6068F4418C49A8B028A5EC8E5AFA68"><enum>(6)</enum><text>balancing security
			 needs with an ability to carry out the diplomatic mission of the Department of
			 State; and</text>
					</paragraph><paragraph id="HE20525B191714C4B9A1CF20E18BD2306"><enum>(7)</enum><text>the budgetary
			 implications of balancing multiple missions.</text>
					</paragraph></subsection></section></title><title id="HED256433FF74456984A4F437B201EB4F"><enum>II</enum><header>Physical security
			 and personnel requirements</header>
			<section id="H3D1DB2CD8F904B7E80775E3BFE7F55BD"><enum>201.</enum><header>Capital
			 Security Cost Sharing Program</header>
				<subsection id="H989B22D137C9439E8F0B19F309FBD748"><enum>(a)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated for fiscal year 2014 for the Department of State
			 $1,383,000,000, to be available until expended, for the Capital Security Cost
			 Sharing Program, authorized by section 604(e) of Secure Embassy Construction
			 and Counterterrorism Act of 1999 (title VI of division A of H.R. 3427, as
			 enacted into law by section 1000(a)(7) of <external-xref legal-doc="public-law" parsable-cite="pl/106/113">Public Law 106–113</external-xref>; 113 Stat.

				</subsection><subsection id="H04B211C046074005A2FBCBDD3D9BCBD3"><enum>(b)</enum><header>Sense of
			 Congress on the Capital Security Cost Sharing Program</header><text>It is the
			 sense of Congress that the Capital Security Cost Sharing Program should
			 prioritize the construction of new facilities and the maintenance of existing
			 facilities at high risk, high threat posts.</text>
				</subsection><subsection id="H4913B5968D0E41C3A1ACEDEF0DCA827E"><enum>(c)</enum><header>Restriction on
			 construction of office space</header><text display-inline="yes-display-inline">Section 604(e)(2) of the Secure Embassy
			 Construction and Counterterrorism Act of 1999 (title VI of division A of H.R.
			 3427, as enacted into law by section 1000(a)(7) of <external-xref legal-doc="public-law" parsable-cite="pl/106/113">Public Law 106–113</external-xref>; 113
			 Stat. 1501A–453; <external-xref legal-doc="usc" parsable-cite="usc/22/4865">22 U.S.C. 4865</external-xref> note) is amended by adding at the end the
			 following new sentence: <quote>A project to construct a diplomatic facility of
			 the United States may not include office space or other accommodations for an
			 employee of a Federal department or agency if the Secretary of State determines
			 that such department or agency has not provided to the Department of State the
			 full amount of funding required by paragraph (1), except that such project may
			 include office space or other accommodations for members of the United States
			 Marine Corps.</quote>.</text>
				</subsection></section><section id="H7A63E4134EBA49438B4782A29E24ADD2"><enum>202.</enum><header>Local guard
			 contracts abroad under diplomatic security program</header>
				<subsection id="H8DB5C152EC534FC9A4689C2EBCC07E4C"><enum>(a)</enum><header>In
			 general</header><text>Section 136(c)(3) of the Foreign Relations Authorization
			 Act, Fiscal Years 1990 and 1991 (<external-xref legal-doc="usc" parsable-cite="usc/22/4864">22 U.S.C. 4864(c)(3)</external-xref>) is amended to read as
			 follows:</text>
					<quoted-block id="H7932D00FF77A40608A57DB380D4AF89C" style="OLC">
						<paragraph id="H30EB85CDAFCB49019B5BB17A1C7A6F2F"><enum>(3)</enum><text>in evaluating
				proposals for such contracts, award contracts to technically acceptable firms
				offering the lowest evaluated price, except that—</text>
							<subparagraph id="H5D5CCF934B4D48EA942197AC2D361513"><enum>(A)</enum><text>the Secretary may
				award contracts on the basis of best value (as determined by a cost-technical
				tradeoff analysis); and</text>
							</subparagraph><subparagraph id="H113743AEED6A473C9480E3E04A798981"><enum>(B)</enum><text>proposals received
				from United States persons and qualified United States joint venture persons
				shall be evaluated by reducing the bid price by 10
				percent;</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H33DB4B21B54E422C935FBA00401C3931"><enum>(b)</enum><header>Report</header><text>Not
			 later than 1 year after the date of the enactment of this Act, the Secretary
			 shall submit to the appropriate congressional committees a report that
			 includes—</text>
					<paragraph id="H7C6B919A6BC54739AEA1653EFD9023CD"><enum>(1)</enum><text>an explanation of
			 the implementation of paragraph (3) of section 136(c) of the Foreign Relations
			 Authorization Act, Fiscal Years 1990 and 1991, as amended by subsection (a);
			 and</text>
					</paragraph><paragraph id="H0D71C4B7781E4D3D944927958F37BFE8"><enum>(2)</enum><text>for each instance
			 in which an award is made pursuant to subparagraph (A) of such paragraph, as so
			 amended, a written justification and approval, providing the basis for such
			 award and an explanation of the inability to satisfy the needs of the
			 Department of State by technically acceptable, lowest price evaluation
			 award.</text>
					</paragraph></subsection></section><section id="HC3F159D136BD4349A5579A3E2A39CC7A"><enum>203.</enum><header>Transfer
			 authority</header><text display-inline="no-display-inline">Section 4 of the
			 Foreign Service Buildings Act, 1926 (<external-xref legal-doc="usc" parsable-cite="usc/22/295">22 U.S.C. 295</external-xref>) is amended by adding at the
			 end the following new subsections:</text>
				<quoted-block id="HCADBFFC472884817AC1E83B7A5BE9F07" style="OLC">
					<subsection id="H7FB4C2997DF04A93AF1D08D4951AAF72"><enum>(j)</enum><text display-inline="yes-display-inline">In addition to exercising any other
				transfer authority available to the Secretary of State, and subject to
				subsection (k), the Secretary may transfer to, and merge with, any
				appropriation for embassy security, construction, and maintenance such amounts
				appropriated for any other purpose related to the administration of foreign
				affairs on or after October 1, 2013, as the Secretary determines necessary to
				provide for the security of sites and buildings in foreign countries under the
				jurisdiction and control of the Secretary.</text>
					</subsection><subsection id="H954A1B3E2B794B4A9E5F5E47202B6374"><enum>(k)</enum><text>Not later than 15
				days before any transfer of funds pursuant to subsection (j), the Secretary of
				State shall notify the Committees on Foreign Relations and Appropriations of
				the Senate and the Committees on Foreign Affairs and Appropriations of the
				House of Representatives of such
				transfer.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HE2D0CF8EA7C4469290EA3AACB3856F19"><enum>204.</enum><header>Physical
			 security of certain soft targets</header><text display-inline="no-display-inline">Section 29 of the State Department Basic
			 Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2701">22 U.S.C. 2701</external-xref>) is amended, in the third sentence, by
			 inserting <quote>physical security enhancements and</quote> after <quote>may
			 include</quote>.</text>
			</section><section id="HEF46673E15D04588933B3BF7867A74C9"><enum>205.</enum><header>Reemployment of
			 annuitants</header><text display-inline="no-display-inline">Section 824(g) of
			 the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4064">22 U.S.C. 4064(g)</external-xref>) is amended—</text>
				<paragraph id="H62A52DB958B642A9994B72EBCD826DB2"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="H45A65F553CE741228AC363A5F4FB70F8"><enum>(A)</enum><text>in subparagraph
			 (B), by striking <quote>to facilitate the</quote> and all that follows through
			 <quote>Afghanistan,</quote>; and</text>

			 certain protest procedures for non-compete contracting in exigent
			 circumstances</header><text display-inline="no-display-inline">A determination
			 by the Department of State to use a procurement competition exemption under
			 <external-xref legal-doc="usc" parsable-cite="usc/41/3304">section 3304</external-xref> of title 41, United States Code, in order to meet emergency
			 security requirements shall not be subject to challenge by protest under either
			 sections 3551 through 3557 of title 31, United States Code, or section 1491 of
			 title 28, United States Code.</text>
			</section><section id="H6F784EF52D70474FA18DE697F50F85D4"><enum>207.</enum><header>Sense of
			 Congress on minimum security standards for temporary United States diplomatic
			 and consular posts</header><text display-inline="no-display-inline">It is the
			 sense of Congress that—</text>
				<paragraph id="H5EB67F8500B04AE2A4B148F441D62863"><enum>(1)</enum><text>the Overseas
			 Security Policy Board’s security standards for facilities should apply to all
			 facilities regardless of the duration of their occupancy; and</text>
				</paragraph><paragraph id="HE2DD2E6B4F2A485CA7C0628E801A6DD8"><enum>(2)</enum><text>such facilities
			 should comply with requirements for attaining a waiver or exception to
			 applicable standards if it is in the national interest of the United
			 States.</text>
				</paragraph></section><section id="HC324213BFFF44207B5138B205CA78B25"><enum>208.</enum><header>Sense of
			 Congress on assignment of personnel at high risk, high threat
			 posts</header><text display-inline="no-display-inline">It is the sense of
			 Congress that the Secretary of State should station key personnel for sustained
			 periods of time at high risk, high threat posts in order to—</text>
				<paragraph id="H0C8339230DF649768029DD1F2B3F8C42"><enum>(1)</enum><text>establish
			 institutional knowledge and situational awareness that would allow for a fuller
			 familiarization of the local political and security environment; and</text>
				</paragraph><paragraph id="H1407F7C75DAF49B5A70BC072DFAC68CB"><enum>(2)</enum><text>ensure that
			 necessary security steps are implemented.</text>
				</paragraph></section></title><title id="H9E41B252700C48A8BF596E5BDF812AF0"><enum>III</enum><header>Security
			 training</header>
			<section id="H08B13901BFB848CFAA6831A01B6D9F3C"><enum>301.</enum><header>Security
			 training for personnel assigned to high risk, high threat posts</header>
				<subsection id="HC1C66ABA861440198C5B15292651F479"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title IV of the
			 Omnibus Diplomatic Security and Antiterrorism Act of 1986 (22 U.S.C. 4851 et
			 seq.; relating to diplomatic security) is amended by adding at the end the
			 following new sections:</text>
					<quoted-block id="HF84C9905C58241E6B7F9F74744AF2890">
						<section id="H316D97EC3D474140883CCDD26190233D"><enum>416.</enum><header>Security
				training for personnel assigned to a high risk, high threat post</header>
							<subsection id="H2FBB6EE0F9A44A3AABEB5CAF82DC3C79"><enum>(a)</enum><header>In
				general</header><text>Individuals assigned permanently to or who are in
				long-term temporary duty status as designated by the Secretary at a high risk,
				high threat post shall receive security training described in subsection (b) on
				a mandatory basis in order to prepare such individuals for living and working
				at such posts.</text>
							</subsection><subsection id="HEFF8798024F8488482BAD60A225157E7"><enum>(b)</enum><header>Security
				training described</header><text>Security training referred to in subsection
				(a)—</text>
								<paragraph id="HE425765DA0734174AD96B4CD8CFD48ED"><enum>(1)</enum><text>is training to
				improve basic knowledge and skills; and</text>
								</paragraph><paragraph id="HB772191BF4FD4D328FC2715BA6CE0405"><enum>(2)</enum><text>may
				include—</text>
									<subparagraph id="H90E5FA3CFE8642D4B1B3243C86B5E732"><enum>(A)</enum><text>an ability to
				recognize, avoid, and respond to potential terrorist situations, including a
				complex attack;</text>
									</subparagraph><subparagraph id="H815F280057E34384B726757CD7DF6C37"><enum>(B)</enum><text>conducting
				surveillance detection;</text>
									</subparagraph><subparagraph id="H6820E6B644894D7EAFCB98E91EB625A2"><enum>(C)</enum><text>providing
				emergency medical care;</text>
									</subparagraph><subparagraph id="HCF4B7DD7E8E545A7B8BA72083621649B"><enum>(D)</enum><text>awareness of
				improvised explosive devices;</text>
									</subparagraph><subparagraph id="HCB2EB72596344309BBA4E9146A1511A2"><enum>(E)</enum><text>firearms
				familiarization; and</text>
									</subparagraph><subparagraph id="H0BA106888CA2480D8B165404981BA592"><enum>(F)</enum><text>defensive driving
				maneuvers.</text>
									</subparagraph></paragraph></subsection><subsection id="HBFFE6F1239A34228817B0F75D089E088"><enum>(c)</enum><header>Effective
				date</header><text>The requirements of this section shall take effect beginning
				on the date that is one year after the date of the enactment of this
				section.</text>
							</subsection><subsection id="HEFADE9EE5F0E46829C20B630D056BB5D"><enum>(d)</enum><header>Definition</header><text>In
				this section and sections 417 and 418, the term <term>high risk, high threat
				post</term> has the meaning given such term in section 104.</text>
							</subsection><subsection commented="no" id="H311250562A3A40CCBC24C293569816F9"><enum>(e)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated such sums
				as may be necessary to carry out this section.</text>
							</subsection></section><section id="H9C2DF9271EE44B43812D43C7BFDFEDF9"><enum>417.</enum><header>Security
				management training for officials assigned to a high risk, high threat
				post</header>
							<subsection id="HBEEF9421F7FF444A9EA0C63EEC986BA8"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Officials described
				in subsection (c) who are assigned to a high risk, high threat post shall
				receive security training described in subsection (b) on a mandatory basis in
				order to improve the ability of such officials to make security-related
				management decisions.</text>
							</subsection><subsection id="HC5E80BE91A4744CDB0D828FCD3BC84A6"><enum>(b)</enum><header>Security
				training described</header><text>Security training referred to in subsection
				(a) may include—</text>
								<paragraph id="H5799573439CD4781A1B2875BF7A74A70"><enum>(1)</enum><text>development of
				skills to better evaluate threats;</text>
								</paragraph><paragraph id="HF43592D46AFF4970A69F2E8346E3B838"><enum>(2)</enum><text>effective use of
				security resources to mitigate such threats; and</text>
								</paragraph><paragraph id="H110098B5BCC94FF0A8BCAB3752082811"><enum>(3)</enum><text>improved
				familiarity of available security resources.</text>
								</paragraph></subsection><subsection id="H635F9FAE6260485690DFB6DC94114E6C"><enum>(c)</enum><header>Officials
				described</header><text>Officials referred to in subsection (a) are—</text>
								<paragraph commented="no" id="HA4BF4EEB69F84967AF314CEE96C4F539"><enum>(1)</enum><text>members of the
				Senior Foreign Service appointed under section 302(a)(1) or 303 of the Foreign
				Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3942">22 U.S.C. 3942(a)(1)</external-xref> and 3943) or members of the Senior

				personnel assigned permanently to or who are in long-term temporary duty status
				as designated by the Secretary at a high risk, high threat post should receive
				language training described in subsection (b) in order to prepare such
				personnel for duty requirements at such post.</text>
							</subsection><subsection id="H4D9E57EE3B5A435FA40118389239CB8A"><enum>(b)</enum><header>Language
				training described</header><text>Language training referred to in subsection
				(a) should prepare personnel described in such subsection to—</text>
								<paragraph id="H829E8086005D496689E601DB54F5D3DE"><enum>(1)</enum><text display-inline="yes-display-inline">speak the language at issue with sufficient
				structural accuracy and vocabulary to participate effectively in most formal
				and informal conversations; and</text>
								</paragraph><paragraph id="HBB927B46EA8940108F88E810CF7440D8"><enum>(2)</enum><text display-inline="yes-display-inline">read within a normal range of speed and
				with almost complete comprehension.</text>
								</paragraph></subsection><subsection commented="no" id="H31831DF03783410DA79B8D2A69F72D1E"><enum>(c)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to carry
				out this section such sums as may be
				necessary.</text>

			 months after the date of the enactment of this Act, the Secretary shall submit
			 to the appropriate congressional committees a report on the implementation of
			 this title.</text>
			</section></title><title id="H56EAC8DEB4864E978B4237CC360C91CD"><enum>IV</enum><header>Death
			 gratuity</header>
			<section id="H8BC0782135C44B9A816AEF92064F4B9B"><enum>401.</enum><header>Death
			 gratuity</header><text display-inline="no-display-inline">Section 413 of the
			 Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3973">22 U.S.C. 3973</external-xref>) is amended—</text>
				<paragraph id="HA6188FCE9BEA4A7F874465850205534E"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote>at the time of death</quote> and inserting <quote>at level
			 II of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5313">section 5313</external-xref> of title 5, United States Code,
			 as in effect at the time of death, except that for employees compensated under
			 local compensation plans established under section 408, the amount shall be
			 equal to the greater of either one year’s salary at the time of death, or one
			 year’s basic salary at the highest step of the highest grade on the local
			 compensation plan from which the employee was being paid at the time of
			 death</quote>;</text>
				</paragraph><paragraph id="H1DFA2E807F344D57B6D458251B92412D"><enum>(2)</enum><text>in subsection (b),
			 by adding at the end the following: <quote>The Secretary may waive the
			 requirement that the survivor be entitled to elect monthly compensation under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/8133">section 8133</external-xref> of title 5, United States Code, if the survivor would otherwise be
			 entitled to payment under this section and the Secretary determines such waiver
			 is appropriate under the circumstances.</quote>;</text>
				</paragraph><paragraph id="H81AD5458EEF34265B084F0AD3F8280E9"><enum>(3)</enum><text>by amending
			 subsection (c) to read as follows:</text>

			 by striking <quote>and</quote> after the semicolon;</text>
					</subparagraph><subparagraph id="H7CA57693A9B84FA88BBE255CBE38AEF0"><enum>(B)</enum><text>in paragraph (2),
			 by striking the period and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph id="H78AA2C8DCBCA4BE4B099E997B0772AF9"><enum>(C)</enum><text>adding at the end
			 the following:</text>
						<quoted-block display-inline="no-display-inline" id="H74C75893F081415B82689D6BEE30C98B" style="OLC">
							<paragraph id="H0879B5F93BC04405A737210BC117D5C7"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>familial designee</term>
				means the eligible family member whom the decedent has designated as the
				recipient of this benefit under regulations of the Department of
				State</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H5E560F4322FA4DA4867BD1E844FCFF73"><enum>(5)</enum><text>by redesignating
			 subsections (b), (c), and (d) as subsections (d), (e), and (f); and</text>
				</paragraph><paragraph id="H1196166EB06843408414989A6751449B"><enum>(6)</enum><text>by inserting after
			 subsection (a) the following new subsections:</text>
					<quoted-block id="H910E7E8303A7488D9B75DA36F268BA89" style="OLC">
						<subsection id="H9D638F2CB3A242C785223BD5DCCDC93E"><enum>(b)</enum><header>Payment to
				survivors of employees of agencies</header><text>The head of an executive
				agency shall, with the concurrence of the Secretary of State, make a death
				gratuity payment authorized by this section to the survivors, as set forth in
				subsection (e), of any employee of that agency who dies as a result of injuries
				sustained in the performance of duty abroad while subject to the authority of
				the chief of mission under section 207.</text>
						</subsection><subsection id="H9D753B79934F47C69BFC2E812B5856B1"><enum>(c)</enum><header>Payment to
				survivors of interns</header><text display-inline="yes-display-inline">The
				Secretary may make a death gratuity payment of up to $500,000 to the survivors,
				as set forth in subsection (e), of an intern serving at a United States
				diplomatic or consular mission abroad without a regular salary who dies as a
				result of injuries sustained because of an act of terrorism occurring while on
				duty abroad, and who is not otherwise compensated under this
				section.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H2A7FC960BDCD4109B40619E4E5176D4D"><enum>402.</enum><header>Increased group
			 life insurance and survivors’ educational benefits applicable to those killed
			 in terrorist attacks</header>
				<subsection id="H2304BD1A813E4071A347DC1A366BD5BC"><enum>(a)</enum><header>In
			 general</header><text>Chapter 4 of the Foreign Service Act of 1980 (22 U.S.C.
			 3961 et seq.) is amended by adding at the end the following new
			 sections:</text>
					<quoted-block id="H7A0C8BB4E5BF4899B8BCD49DE3DF021C" style="OLC">
						<section id="H8784A786FD954491B135A9331B71F855"><enum>415.</enum><header>Group life
				insurance supplement for those killed in terrorist attacks</header>
							<subsection id="HF106D7EEC27041FCA1276B1BF0C2237E"><enum>(a)</enum><header>Foreign Service
				employees</header><text>Notwithstanding the amounts specified in chapter 87 of
				title 5, United States Code, a Foreign Service employee who dies while on duty
				abroad as a result of injuries sustained because of an act of terrorism
				occurring while on duty abroad shall be eligible, at the Secretary’s
				discretion, for an additional payment from the United States in an amount equal
				to the difference between that employee’s employer-provided group life
				insurance policy coverage (if any) and $400,000, except that for employees
				compensated under local compensation plans established under section 408, the
				amount shall be determined by regulations implemented by the Secretary and
				shall be no greater than $400,000. This payment shall be made to the
				beneficiary designated under the employee’s employer-provided group life
				insurance policy. If no beneficiary is named, the payment shall be made
				according to the order of precedence specified by the Office of Personnel
				Management under <external-xref legal-doc="regulation" parsable-cite="cfr/5/870.801">section 870.801</external-xref> of title 5, Code of Federal Regulations (or
				successor regulation).</text>
							</subsection><subsection id="H2F6CB9EAC93248D4A611991589F6F398"><enum>(b)</enum><header>Employees of
				other agencies</header><text display-inline="yes-display-inline">The head of an
				executive agency shall, with the concurrence of the Secretary of State, provide
				the additional payment authorized by this section, consistent with the
				provisions set forth in section (a), with respect to any employee of that
				agency who dies as a result of injuries sustained because of an act of
				terrorism occurring while on duty abroad and while subject to the authority of
				a chief of mission under section 207.</text>
							</subsection><subsection id="HA0C46FC71A354A68941FFC5E8F1DD4E0"><enum>(c)</enum><header>Terrorism
				defined</header><text>In this section and section 416, the term
				<term>terrorism</term> has the meaning given that term in section 140(d) of the
				Foreign Relations Authorization Act, Fiscal Years 1988 and 1989 (22 U.S.C.
				2656f(d)).</text>
							</subsection></section><section id="HA69550F3614E492C804B1A6F7F6DD3C9"><enum>416.</enum><header>Educational
				assistance for survivors and dependents</header>
							<subsection id="H1BC6886E908847CE81F249866F58B53A"><enum>(a)</enum><header>Survivors of
				Foreign Service employees</header><text>The Secretary shall provide educational
				assistance to a widow, widower, familial designee, or child(ren) of any United
				States national Foreign Service employee who dies while on duty abroad as a
				result of injuries sustained because of an act of terrorism occurring while on
				duty abroad, to meet, in whole or in part, the expenses incurred by that widow,
				widower, familial designee, or child(ren) in pursuing a program of education at
				an educational institution, including subsistence, tuition, fees, supplies,
				books, equipment, and other educational costs.</text>
							</subsection><subsection id="HF63738D8C846448BABD8193DBBE34062"><enum>(b)</enum><header>Survivors of
				employees of other agencies</header><text>The head of an executive agency
				shall, with the concurrence of the Secretary of State, provide educational
				assistance authorized by this section to a widow, widower, familial designee,
				or child(ren) of any employee of that agency who dies as a result of injuries
				sustained because of an act of terrorism occurring while on duty abroad and
				while subject to the authority of a chief of mission under section 207.</text>
							</subsection><subsection id="H8C6537CAD188496EB95A3FBF66EB4F5F"><enum>(c)</enum><header>Limitation on
				amount of assistance</header><text>Educational assistance under this section
				may be made available up to the amounts provided for in section 3532 of title
				38, United States Code, as adjusted by <external-xref legal-doc="usc" parsable-cite="usc/38/3564">section 3564</external-xref> of title 38, United States
				Code, and for an aggregate period of not more than 45 months.</text>
							</subsection><subsection id="HE8559849A87047EAB871BB779BED3051"><enum>(d)</enum><header>Definitions</header><text>For
				purposes of this section, the terms <term>program of education</term> and
				<term>educational institution</term> have the meanings given those terms in
				<external-xref legal-doc="usc" parsable-cite="usc/38/3501">section 3501</external-xref> of title 38, United States
				Code.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H4CFF8CCD42F949439CFF130EDD70BA9F"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of contents in section 2 of the Foreign
			 Service Act of 1980 is amended by inserting after the item relating to section
			 414 the following new items:</text>

				</subsection></section><section id="H60929CF1E2644B3B89A6208E6CF32272"><enum>403.</enum><header>Retroactive
			 payment</header><text display-inline="no-display-inline">At the discretion of
			 the Secretary of State, and notwithstanding any other provision of law,
			 sections 413, 415, and 416 of the Foreign Service Act of 1980 may apply in the
			 case of a Foreign Service employee, executive branch employee subject to the
			 authority of the chief of mission under section 207 of the Foreign Service Act
			 of 1980, or intern serving at a United States diplomatic or consular mission
			 abroad without a regular salary, who died on or after April 18, 1983, and
			 before the date of the enactment of this Act, as a result of injuries sustained
			 because of an act of terrorism, as defined in section 140(d) of the Foreign
			 Relations Authorization Act, Fiscal Years 1988 and 1989 (<external-xref legal-doc="usc" parsable-cite="usc/22/2656f">22 U.S.C. 2656f(d)</external-xref>).
			 Any retroactive payments made under this section shall be reduced by the amount
			 of any death gratuity or employer-provided group life insurance payment
			 previously provided by the United States to any widow, widower, familial
			 designee, child(ren), or other beneficiary based on the same death.</text>
			</section><section id="HAC710837A4EF40DFA60C3ACE61B1CCC9"><enum>404.</enum><header>Authorization
			 of appropriations</header>
				<subsection id="H0A32605DFB604A31B1CAD085CB8C982D"><enum>(a)</enum><header>Funding from
			 agency accounts</header><text>Any benefit or payment made available under this
			 Act by an agency of the United States shall be paid from available funds of
			 that agency.</text>
				</subsection><subsection id="H8707F1D4913540249053912BFCDD2754"><enum>(b)</enum><header>Department of
			 State funds</header><paragraph commented="no" display-inline="yes-display-inline" id="H914F540F90BA43A49B5CCD7294CF82A8"><enum>(1)</enum><text display-inline="yes-display-inline">Amounts made available to the Department of
			 State pursuant to the sixth proviso under the heading <term>Department of
			 State–Administration of Foreign Affairs–Diplomatic and Consular Programs</term>
			 in title I of the Department of State, Foreign Operations, and Related Programs
			 Appropriations Act, 2008 (division J of <external-xref legal-doc="public-law" parsable-cite="pl/110/161">Public Law 110–161</external-xref>) are authorized to
			 be used by the Department of State to pay benefits or payments made available
			 under this Act.</text>
					</paragraph><paragraph id="H946EBD55DF814FF0BDFE4A8DBABF0FEE" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">To pay benefits or payments made available
			 under this Act, the Secretary of State may merge with the funds described in
			 paragraph (1) unobligated balances of funds appropriated under the heading
			 <term>Department of State–Administration of Foreign Affairs–Diplomatic and
			 Consular Programs</term> in an appropriations Act for fiscal year 2013 or for
			 any fiscal year hereafter, until not later than the end of the fifth fiscal
			 year after the fiscal year for which such funds were first appropriated or
			 otherwise made available.</text>
					</paragraph></subsection></section><section id="H1F407A80F4904F32A040D56A29DCEEB7"><enum>405.</enum><header>Conforming
			 amendment</header><text display-inline="no-display-inline">The table of
			 contents of the Foreign Service Act of 1980 is amended by inserting after the
			 item relating to section 414 the following new items:</text>
