		  encourage the adoption and use of certified electronic health record technology
		  by safety net providers and clinics under the Medicaid

		<section id="HF471D1CF5E834EAEB3C90639EE72DAC1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medicaid Information Technology to
			 Enhance Community Health Act of 2013</short-title></quote> or the
			 <quote><short-title>MITECH
			 Act</short-title></quote>.</text>
		</section><section id="HBBDD683BC44A40F39B362E524DDAFD7F"><enum>2.</enum><header>Incentives for
			 adoption and use of EHR Technology by safety net clinics and
			 providers</header><text display-inline="no-display-inline">Section 1903(t) of
			 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(t)</external-xref>) is amended—</text>
			<paragraph id="H581A15B3099040D9A3E260E66D39EB86"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
				<subparagraph id="HC9DB723E745A45A4973766A4B6568893"><enum>(A)</enum><text>in subparagraph
			 (A)—</text>
					<clause id="HB01CEA3BDE67456C9D889F091496098F"><enum>(i)</enum><text>in
			 clause (i), by inserting <quote>or QSNC-based</quote> after
			 <quote>hospital-based</quote>;</text>
					</clause><clause id="HCE6EBD6EED004C18AD7F486769104894"><enum>(ii)</enum><text>in
			 clause (ii)—</text>
						<subclause id="H16C5082D04544C7687400142CEECF41A"><enum>(I)</enum><text>by inserting
			 <quote>or QSNC-based</quote> after <quote>hospital-based</quote>; and</text>
						</subclause><subclause id="H5A2B3B9F22024126A31E2123EF1EC4A9"><enum>(II)</enum><text>by striking
			 <quote>and</quote> at the end and inserting <quote>or</quote>; and</text>
						</subclause></clause><clause id="HF91C6C5E4C8D4ABD83474C12B5D4C750"><enum>(iii)</enum><text>in
			 clause (iii), by striking <quote>who practices predominantly in a Federally
			 qualified health center or rural health clinic</quote> and inserting
			 <quote>subject to paragraph (11)(C), who practices predominantly in a Federally
			 qualified health center, rural health clinic, or qualified safety net
			 clinic</quote>; and</text>
					</clause></subparagraph><subparagraph id="HF4D4619ED5094E2C8533C68AEF585BA7"><enum>(B)</enum><text>in subparagraph
			 (B)—</text>
					<clause id="H03451043A70B48149B7499273AD9C897"><enum>(i)</enum><text>in
			 clause (i), by striking <quote>or</quote>;</text>
					</clause><clause id="H09E6482EA64147D08722BCA4949DE4E8"><enum>(ii)</enum><text>in
			 clause (ii), by striking the period at the end and inserting <quote>,
			 or</quote>; and</text>
					</clause><clause id="HCBB8A4036A724349971E645D264078C7"><enum>(iii)</enum><text>by
			 adding at the end the following new clause:</text>
						<quoted-block display-inline="no-display-inline" id="H65AD989D693E48D7A66A620B0C3173A8" style="OLC">
							<clause id="HFD844C16D5A94909A82DC56BF7329FF8" indent="up2"><enum>(iii)</enum><text>subject to paragraph (11), a
				qualified safety net clinic (as defined in paragraph
				(3)(G)).</text>
							</clause><after-quoted-block>;</after-quoted-block></quoted-block>
					</clause></subparagraph></paragraph><paragraph id="HBFE07BC2C3314C4199178944B5A77C90"><enum>(2)</enum><text>in paragraph
			 (3)—</text>
				<subparagraph id="H97C964A8FC0745FCB972E1628E80690F"><enum>(A)</enum><text>in subparagraph
			 (B)(v), by striking <quote>rural health clinic</quote> and all that follows
			 through the period and inserting <quote>rural health clinic, Federally
			 qualified health center, or qualified safety net clinic that is led by a
			 physician assistant.</quote>; and</text>
				</subparagraph><subparagraph id="H7BEBB33122F24AD0ADE3E816A586576B"><enum>(B)</enum><text>by adding at the
			 end the following new subparagraphs:</text>
					<quoted-block display-inline="no-display-inline" id="H7814E0EDA1784765B7479CCA39A80306" style="OLC">
						<subparagraph id="H5980204E0B5944D3B9616519D3838123" indent="up1"><enum>(G)</enum><text>The term <term>qualified safety net
				clinic</term> means a clinic or network of clinics that is operated by a
				private non-profit or public entity and that has at least 30 percent of its
				patient volume (as estimated in accordance with a methodology established by
				the Secretary) attributable to needy individuals (as defined in subparagraph
				(F)).</text>
						</subparagraph><subparagraph id="H9B59B8DFF80A48FCB69944ED27F2C820" indent="up1"><enum>(H)</enum><text>The term <term>QSNC-based</term>
				means, with respect to an eligible professional, an individual who furnishes
				substantially all of their professional services in a qualified safety net
				clinic and through the use of the facilities and equipment, including qualified
				electronic health records, of the clinic. The determination of whether an
				eligible professional is a QSNC-based eligible professional shall be made on
				the basis of the site of service (as defined by the Secretary) and without
				regard to any employment or billing arrangement between the eligible
				professional and any other
				provider.</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HED48A5FCC7C2491CA1B10338BA8DD1D8"><enum>(3)</enum><text>in paragraph
			 (5)—</text>
				<subparagraph id="H2CC048CE27124BDE9CEAAA8C0EE19CAE"><enum>(A)</enum><text>in subparagraph
			 (A), by inserting <quote>clause (i) or (ii) of</quote> before <quote>paragraph
			 (2)(B)</quote>; and</text>
				</subparagraph><subparagraph id="H0830B115D3BC4C8E9AFCB9CF92460CC5"><enum>(B)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H95365C947AC1425CA7D60D70792AE87C" style="OLC">
						<subparagraph id="HA3D0AA0D6CFB41569AF149DC1F2DE7E9" indent="up2"><enum>(E)</enum><text>For purposes of payments described in
				paragraph (1)(B) to a Medicaid provider described in paragraph (2)(B)(iii), the
				Secretary shall establish a methodology for determining the maximum amount of
				payment permitted for each such
				provider.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H9E1DE4049C234CD0909671BF2411111D"><enum>(4)</enum><text>by adding at the
			 end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HFD50C1B5A4C0457B820FB08BADD58BEE" style="OLC">
					<paragraph id="H6CEE307F01194C568061F37A770A425E" indent="up1"><enum>(11)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HF24D95852AFD4DC4846952B2B2A1C9BF"><enum>(A)</enum><text>Not later than January
				1, 2015, the Secretary, in consultation with States and other relevant
				stakeholders, shall promulgate regulations to establish a procedure through
				which a qualified safety net clinic may demonstrate meaningful use of certified
				EHR technology by such clinic for purposes of satisfying the requirement
				described in paragraph (6)(C)(i)(II).</text>
						</subparagraph><subparagraph id="H325044E32AD64FE78805A22F39EF09C7" indent="up1"><enum>(B)</enum><text>A qualified safety net clinic shall
				not be eligible to receive payments described in paragraph (1)(B) before the
				date on which the Secretary establishes the procedure described in subparagraph
				(A). On and after that date, a qualified safety net clinic may receive such
				payments if the qualified safety net clinic notifies the Secretary that the
				qualified safety net clinic elects to receive such payments in lieu of the
				Secretary making payments described in paragraph (1)(A) to the eligible
				professionals who practice predominately in the qualified safety net
				clinic.</text>
						</subparagraph><subparagraph id="H8A6E5A8829F844FB84DE2F1F471AEC17" indent="up1"><enum>(C)</enum><text>On or after the date that the
				Secretary establishes the procedure described in subparagraph (A), an eligible
				professional who practices predominately in a qualified safety net clinic, as
				described in paragraph (2)(A)(iii), shall not be eligible to receive payments
				described in paragraph (1)(A) if the qualified safety net clinic receives
				payments described in paragraph
				(1)(B).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
