		<section id="HCAA0084D66944ADDAA5F8C35D52F72BA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Opportunities for Success Act of
			 2013</short-title></quote>.</text>
		</section><section id="HCD366984C48E4F33949DBF3B0EF5F7CD"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="HCEB85D5D8670462E9ABC4583DA412D5B"><enum>(1)</enum><text>Internships are
			 increasingly important to the ability of college students to gain skills, make
			 professional connections, and find jobs after graduation.</text>
			</paragraph><paragraph id="HCD01348713DB4DF39BACEEC2C302C2D8"><enum>(2)</enum><text>In 2011, according
			 to the National Association of Colleges and Employers, employers offered
			 full-time positions to 61.2 percent of their interns with an acceptance rate of
			 86.5 percent.</text>
			</paragraph><paragraph id="HF78B31CEDD744FD2B21FDB46BA18A3F4"><enum>(3)</enum><text>Many students
			 struggle to make ends meet; 66 percent of young community college students
			 dedicate more than 20 hours a week to an outside job, and the need of many
			 students to maintain a part-time or full-time job reduces or eliminates the
			 time available for an internship.</text>
			</paragraph><paragraph id="H1BAD32395DEB4A0EA45DDD0077B4F2EE"><enum>(4)</enum><text>Internships often
			 require significant time commitments or temporary relocation, which many
			 students are unable to afford; these additional living expenses include
			 housing, meals, and travel, and these costs make unpaid internships with
			 employers like non-profit organizations and government even more inaccessible
			 for those with low and middle incomes.</text>
			</paragraph><paragraph id="HC7B396BE1FBA4ABB97B76802FBA00835"><enum>(5)</enum><text>In 2011, 46
			 percent of students who had completed an internship were offered jobs, compared
			 with 31 percent of students who did not complete an internship; more than 76
			 percent of employers rank relevant experience as the most important quality
			 when hiring.</text>
			</paragraph><paragraph id="H80EB29C4BAB24A988A0A9A7C7CF02E41"><enum>(6)</enum><text>Many university
			 officials and employers acknowledge that participating in an undergraduate
			 internship is extremely helpful for finding meaningful employment in today’s
			 job market.</text>
			</paragraph></section><section id="HC462E2720E3A451D87F8BD5ADB8B772F"><enum>3.</enum><header>Opportunities for
			 success program</header>
			<subsection id="H9FD0D6B2A0514063A97C9C6001EBCF3D"><enum>(a)</enum><header>Program
			 authorized</header><text display-inline="yes-display-inline">From the amounts
			 made available to carry out this Act, the Secretary of Education shall
			 establish a grant program to award grants to qualifying educational
			 institutions in accordance with this section in order to support eligible
			 students attending such institutions during internships.</text>
			</subsection><subsection commented="no" id="H48A596A8735F44C6B125F2FDD5ECF5F4"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">To receive a grant under this section, a
			 qualifying educational institution shall submit to the Secretary an application
			 at such time, in such manner, and containing such information as the Secretary
			 may require.</text>
			</subsection><subsection id="HB3C04D491D8449AA9E28D6CDB390E8C8"><enum>(c)</enum><header>Use of funds by
			 qualifying educational institutions</header><text display-inline="yes-display-inline">A qualifying educational institution
			 receiving a grant under this section shall use the grant funds in accordance
			 with the following:</text>
				<paragraph id="HD38F6BE42A1547D0BE9A04CF65DE8294"><enum>(1)</enum><header>Activities</header><text display-inline="yes-display-inline">Such institution may only use the grant to
			 fund internship awards in accordance with this section to eligible students
			 enrolled at the institution.</text>
				</paragraph><paragraph id="HA737ACF449C84D8C838D57E4012E1C4B"><enum>(2)</enum><header>Administration
			 of internship awards</header><text>Internship awards made from the
			 grant—</text>
					<subparagraph id="H433F43EBA06042688B3E3A6BD0B00255"><enum>(A)</enum><text>shall be
			 administered by the financial aid office of such institution; and</text>
					</subparagraph><subparagraph id="H0BAD4818C7F84AD9BA8B10A4D25125F9"><enum>(B)</enum><text>may be
			 administered in conjunction with the career development office and career
			 center of such institution.</text>
					</subparagraph></paragraph><paragraph id="H02CE1A420875429787E4B9A0C1AB63A4"><enum>(3)</enum><header>Prohibition on
			 alteration of financial aid</header><text>A student’s receipt of an internship
			 award from a grant under this section shall not be taken into account in
			 determining the need or eligibility of the student for financial assistance
			 under title IV of the Higher Education Act of 1965 (20 U.S.C. 1070 et
			 seq.).</text>
				</paragraph><paragraph id="H48A0403450D8462783AEE5C97846FEF2"><enum>(4)</enum><header>Supplement not
			 supplant</header><text>Funds made available to carry out this section shall be
			 used to supplement, and not supplant, other Federal and State funds available
			 to carry out the activities described in this section.</text>
				</paragraph><paragraph id="H60ABF01A36F04DACAA201217B6688CAF"><enum>(5)</enum><header>Deadline for
			 summer internships</header><text>Such institution shall make an award for a
			 summer internship under this section by June 30 of a calendar year preceding
			 the first day of the summer internship for that year.</text>
				</paragraph></subsection><subsection id="H62F566EACFA84F9595C15745AED02E17"><enum>(d)</enum><header>Calculating
			 award amounts</header>
				<paragraph id="H75329DF0AA854F8290371E1A48C16750"><enum>(1)</enum><header>Amount to
			 qualifying educational institutions</header>
					<subparagraph id="H32903F6177D841E8BBBE19EDAC2A3AC6"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In determining a
			 grant amount for a qualifying educational institution under this section, the
			 Secretary shall ensure that the institution’s grant is equal to an amount that
			 bears the same relationship to the total funds available to carry out this
			 section for a fiscal year as the number of eligible students enrolled at the
			 institution (as determined by the Secretary on the basis of the most recent
			 satisfactory data) bears to the total number of eligible students enrolled at
			 all qualifying educational institutions, as so determined.</text>
					</subparagraph><subparagraph id="H98DF21DAF04F4BEB86251028FD010121"><enum>(B)</enum><header>Reallocation</header><text display-inline="yes-display-inline">If a qualifying educational institution
			 does not receive funds under this paragraph, the Secretary shall reallocate
			 such funds to other qualifying educational institutions in the same proportion
			 funds are allocated under
			 <internal-xref idref="H32903F6177D841E8BBBE19EDAC2A3AC6" legis-path="3.(c)(1)(A)">subparagraph (A)</internal-xref>.</text>
					</subparagraph><subparagraph id="H5655F9E24AF145E991124C7728AB067D"><enum>(C)</enum><header>Exception</header><text>In
			 the case of a qualifying educational institution that does not award all of the
			 grant funds received under this section for a fiscal year to eligible students
			 in accordance with this section, the Secretary, in awarding grants under this
			 section for the succeeding fiscal year—</text>
						<clause id="H29E07A7C0E254B229E9396E876B142C4"><enum>(i)</enum><text display-inline="yes-display-inline">shall reallocate the unused funds to other
			 qualifying educational institutions in the same proportion funds are allocated
			 under
			 <internal-xref idref="H32903F6177D841E8BBBE19EDAC2A3AC6" legis-path="3.(c)(1)(A)">subparagraph (A)</internal-xref>; and</text>
						</clause><clause id="HFE1B403AF5064FF9861D6B4C7F11183F"><enum>(ii)</enum><text>may
			 award such institution a grant in an amount that is less than the full grant
			 amount such institution would have otherwise received under
			 <internal-xref idref="H32903F6177D841E8BBBE19EDAC2A3AC6" legis-path="3.(c)(1)(A)">subparagraph (A)</internal-xref> for such year.</text>
						</clause></subparagraph></paragraph><paragraph id="HFDEA02D1B4924AEFAB8D0F5C27372D32"><enum>(2)</enum><header>Student award
			 parameters</header>
					<subparagraph id="HEE703FE0E50B47E585FA4BECE58B94EC"><enum>(A)</enum><header>Maximum student
			 award</header><text display-inline="yes-display-inline">A student receiving an
			 award of funds from a grant to a qualifying educational institution under this
			 section may not receive—</text>
						<clause id="H6DA4E15C71FE45CB8FABC6252E574C8A"><enum>(i)</enum><text display-inline="yes-display-inline">more than $5,000 from such grant if the
			 award is for a full-time internship; and</text>
						</clause><clause id="H466CFC6A1E7D4EAAAFAB3B75AA585790"><enum>(ii)</enum><text>more than $2,500
			 from such grant if the award is for a part-time internship.</text>
						</clause></subparagraph><subparagraph id="H75D7255EBC364287806DBA944F9E5673"><enum>(B)</enum><header>Calculation of
			 student award</header>
						<clause id="HB47293BDDE674AB38418FB04A9ED5ADC"><enum>(i)</enum><header>Unpaid
			 internships</header>
							<subclause id="H5DD8EB72D82F482DAEC4DC4486A4CB5C"><enum>(I)</enum><header>Awards for
			 in-school students</header><text display-inline="yes-display-inline">Subject to
			 subparagraph (A), in the case of a student receiving an award for an unpaid
			 internship that occurs during a period of enrollment at the awarding qualifying
			 educational institution, the amount of the award shall be, to the extent
			 practicable, an amount based on the higher of—</text>
								<item id="H43D6A36F7CBB4F35BB1697BB4D562AB5"><enum>(aa)</enum><text>the
			 applicable Federal minimum wage by each hour of the internship; or</text>
								</item><item id="H02BFCFBAE75442568F5365D2B28DBD82"><enum>(bb)</enum><text>the
			 applicable State minimum wage of the State in which the institution is located
			 by each hour of the internship.</text>
								</item></subclause><subclause id="H38F42149E14949C9911934065C583697"><enum>(II)</enum><header>Awards for
			 students during summer and winter terms</header>
								<item id="HDA7576419B404EA49D72029EDE5AF006"><enum>(aa)</enum><header>In
			 general</header><text>Subject to subparagraph (A), in the case of a student
			 receiving an award for an unpaid internship that occurs during a period of
			 nonattendance at the awarding educational institution, the amount of the award
			 shall, to the extent practicable, be an amount that covers reasonable cost of
			 living expenses for the student.</text>
								</item><item id="H4C13DC94E7E149879C4D69CB02EE92F6"><enum>(bb)</enum><header>Reasonable cost
			 of living expenses</header><text>For purposes of item (aa), <quote>reasonable
			 cost of living expenses</quote> shall include considerations of—</text>
									<subitem id="H69A1609FE61244DF9C5B28F015D7A9BB"><enum>(AA)</enum><text display-inline="yes-display-inline">the location of the internship;</text>
									</subitem><subitem id="HBBE5F7B1043D451BAF6ABFA89893FFB9"><enum>(BB)</enum><text>the length of the
			 internship;</text>
									</subitem><subitem id="H65DBC06532ED4C6BAFA3010AB98BDBE1"><enum>(CC)</enum><text>travel costs
			 associated with the internship;</text>
									</subitem><subitem id="H4088BF6CCD9D42FB975CB10BB4350A04"><enum>(DD)</enum><text>housing costs
			 during the duration of the internship;</text>
									</subitem><subitem id="HF400579A5B0C417591BD504DD8757349"><enum>(EE)</enum><text display-inline="yes-display-inline">meal costs during the duration of the
			 internship; and</text>
									</subitem><subitem id="HD6FCAF1959F04DEE80EB7622BA18D6B5"><enum>(FF)</enum><text>whether the
			 internship is full-time or part-time.</text>
									</subitem></item></subclause></clause><clause id="HE5A8123A74234EA9A6D27E0412C4D1DA"><enum>(ii)</enum><header>Paid
			 internships</header><text>In the case of a student receiving an award for a
			 paid internship, the amount of the award shall be determined by reducing the
			 amount such student would receive for an unpaid internship as calculated under
			 clause (i) by the amount of income that the internship will provide to the
			 student.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H001B266E7BFB40368018DDFDDD5FB2CA"><enum>(e)</enum><header>Awards
			 non-Taxable</header><text>An award received by a student under this section
			 shall not be considered taxable income.</text>
			</subsection><subsection id="H22E15ED6EEE44138A42D860E10891ACD"><enum>(f)</enum><header>Carry-Back
			 authorized</header><text display-inline="yes-display-inline">A qualifying
			 educational institution receiving a grant under this section for a fiscal year
			 may use such grant funds to make internship awards under this section prior to
			 the beginning of the fiscal year, but after the end of the previous academic
			 year.</text>
			</subsection><subsection id="HEF919D47524A44548ACBDF6B9729ACAE"><enum>(g)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act and each succeeding year in which the Secretary makes
			 grants under this section, the Secretary shall submit to Congress a report
			 detailing, with regard to grants made under this section for the previous
			 academic year—</text>
				<paragraph id="HC4CED4A1787B4D56A30193586B90942B"><enum>(1)</enum><text display-inline="yes-display-inline">the percentage of students receiving
			 internship funds from grants under this section who, not later than 2 years
			 after graduating from a qualifying educational institution, are hired in a
			 field related to the internship for which the students received such
			 funds;</text>
				</paragraph><paragraph id="H1851EFB50EE5440897C21F93BFA55189"><enum>(2)</enum><text>the number of
			 qualifying educational institutions receiving grants under this section;</text>
				</paragraph><paragraph commented="no" id="HF562C69E621546A3A6CCA9B3CB28E6FA"><enum>(3)</enum><text>the categories of
			 qualifying educational institutions (such as 4-year public institutions, 4-year
			 private, nonprofit institutions, 2-year public institutions, and 2-year
			 private, nonprofit institutions) receiving grants under this section;</text>
				</paragraph><paragraph id="HB33FB31DC9EC4DD588B43D0FC2265AEB"><enum>(4)</enum><text>the number of
			 students receiving internship funds from grants under this section, and the
			 degrees such students are pursuing;</text>
				</paragraph><paragraph id="H60906A8501A5453B9FFE06746E02587B"><enum>(5)</enum><text>the number of paid
			 internships, and the number of unpaid internships, funded by such
			 grants;</text>
				</paragraph><paragraph id="H5E2A6892B7E14765BC15F9112E775899"><enum>(6)</enum><text display-inline="yes-display-inline">the locations of internships funded by such
			 grants;</text>
				</paragraph><paragraph id="HF461B7B66F464861BCEE04BCCC6755DC"><enum>(7)</enum><text display-inline="yes-display-inline">the number of students who used internship
			 funds awarded under this section to complete an internship more than 60 miles
			 from the qualifying educational institution that made such award or that
			 required the students to temporarily relocate for the duration of the
			 internship; and</text>
				</paragraph><paragraph id="H4B771DBACE144E968960D2E4CC6398C4"><enum>(8)</enum><text display-inline="yes-display-inline">the types of internships (such as full-time
			 summer internships, part-time summer internship, or part-time semester
			 internships) completed by students receiving awards funded by such
			 grants.</text>
				</paragraph></subsection><subsection id="HC9F99BF43EDE40218F7C0AE1768B50B2"><enum>(h)</enum><header>Regulations</header><text>The
			 Secretary shall prescribe such regulations as may be necessary to carry out
			 this section, including regulations that provide guidance to qualifying
			 educational institutions on how to determine whether an internship meets the
			 requirements of subclauses (I) through (III) of subsection
			 (i)(1)(F)(vi).</text>
			</subsection><subsection id="HC50437FB9E4D45DAADB5AAE5329E29AC"><enum>(i)</enum><header>Definitions</header><text>For
			 purposes of this section:</text>
				<paragraph id="H3B7372CF720C4477AD0A517F76F73E44"><enum>(1)</enum><header>Eligible
			 student</header><text display-inline="yes-display-inline">The term
			 <quote>eligible student</quote> means a student who—</text>
					<subparagraph id="H6C60620155E84291AA11211AD66C5288"><enum>(A)</enum><text>is a full-time or
			 half-time student (as such terms are defined in <external-xref legal-doc="usc" parsable-cite="usc/34/668">section 668.2</external-xref> of title 34, Code
			 of Federal Regulations (or a successor regulation));</text>
					</subparagraph><subparagraph id="H5D0AEA6E74784541ADBE90AE4E2C246F"><enum>(B)</enum><text display-inline="yes-display-inline">is eligible for a Federal Pell Grant under
			 section 401 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a et seq.</external-xref>);</text>
					</subparagraph><subparagraph id="H6CA9158EAC2146BDACB75327F88853C8"><enum>(C)</enum><text display-inline="yes-display-inline">is enrolled at a qualifying educational
			 institution in a program of study that leads to an associate’s or bachelor’s
			 degree;</text>
					</subparagraph><subparagraph id="H2015EAB1FC4846A1AE9D6CC178096D1C"><enum>(D)</enum><text display-inline="yes-display-inline">if the student has accepted an internship
			 during a period of nonattendance at a qualifying educational
			 institution—</text>
						<clause id="H251E7557A56D4AB68A87F82592D68667"><enum>(i)</enum><text display-inline="yes-display-inline">demonstrates that the student is planning
			 to re-enroll at such institution for the next period of enrollment at such
			 institution by registering for such period of enrollment at the institution or
			 accepting the institution’s offer of admittance for such period of enrollment;
			 and</text>
						</clause><clause id="HFC32C254675042ADA9DA13372F146FDA"><enum>(ii)</enum><text>will be eligible
			 for a Federal Pell Grant under section 401 of such Act (20 U.S.C. 1070a et
			 seq.), for such period of enrollment;</text>
						</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H8996A86CB3AE4C949E91EEA13E05180A"><enum>(E)</enum><text display-inline="yes-display-inline">has not, while pursuing the same degree
			 that such student is currently pursuing, previously received an award that
			 included funds granted under subsection (a) to a qualifying educational
			 institution; and</text>
					</subparagraph><subparagraph id="HB98FF952565B41CF965FF92E3E39B17A"><enum>(F)</enum><text display-inline="yes-display-inline">has received an official internship offer,
			 as defined by the Secretary in regulations, for an internship that—</text>
						<clause id="H6F62EFEF37EC42FEB88EDDCA5903D275"><enum>(i)</enum><text>is
			 located within the United States;</text>
						</clause><clause id="H89EA2E1F42A34A5E9AF1F7EA71769BD4"><enum>(ii)</enum><text display-inline="yes-display-inline">in a case in which the internship employs
			 (as defined under section 3(g) of the Fair Labor Standards Act (29 U.S.C.
			 203(g)) the student, meets the requirements of such Act (29 U.S.C. 201 et
			 seq.);</text>
						</clause><clause id="HE48FA119B4AA49B48FDAB0830EE00136"><enum>(iii)</enum><text>is
			 a full-time summer internship, a part-time summer internship, or a part-time
			 semester internship;</text>
						</clause><clause id="HDBE4B0B7BEF94BD6AD1423D32D6152A1"><enum>(iv)</enum><text>is
			 not less than 4 weeks in duration, and is not greater in duration than the
			 shorter of—</text>
							<subclause id="HB08B46EB0BC6403D93A7E118637B3677"><enum>(I)</enum><text>the length of a
			 standard academic period at the qualifying educational institution; or</text>
							</subclause><subclause id="HB7BAF79AD6FE40AD9BACA63B00E3A24B"><enum>(II)</enum><text display-inline="yes-display-inline">in the case of an internship that occurs
			 during a period of nonattendance at the awarding qualifying educational
			 institution, 10 weeks, or in the case of an internship that occurs during a
			 period of attendance at the awarding qualifying educational institution, 12
			 weeks;</text>
							</subclause></clause><clause id="HA668174DB8FF41E181FAC1FD26B31D5D"><enum>(v)</enum><text display-inline="yes-display-inline">is—</text>
							<subclause id="H8FB53C21945A43108349EB2904F119DD"><enum>(I)</enum><text>an unpaid
			 internship; or</text>
							</subclause><subclause id="H79874B600F534210B2A9BC07A489CC41"><enum>(II)</enum><text>a paid internship
			 that, according to the determination of the qualifying educational institution,
			 without an award under this section such student would otherwise be unable to
			 afford participating in such internship; and</text>
							</subclause></clause><clause id="H02262A3D035747DFA56403B39BAB1674"><enum>(vi)</enum><text>is
			 determined by the qualifying educational institution to be an internship
			 that—</text>
							<subclause id="HC757F919BE33482288DBDAEE4B6DF17A"><enum>(I)</enum><text>is of good and
			 reputable quality;</text>
							</subclause><subclause id="HE6C47FD838EC44728B5DCC66754C97DA"><enum>(II)</enum><text>affords adequate
			 educational or skill-building opportunities; and</text>
							</subclause><subclause id="H08D11DCE6D074EDA950A1AABE9A92539"><enum>(III)</enum><text display-inline="yes-display-inline">is reasonably associated with the student’s
			 course of study at a qualifying educational institution.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="H7A7891AA59E84F6FA2342307FF71A8FA"><enum>(2)</enum><header>Full-time</header><text>The
			 term <quote>full-time</quote>, when used with respect to an internship, shall
			 be defined by the Secretary in regulations.</text>
				</paragraph><paragraph display-inline="no-display-inline" id="HE9132CB3BF0A42A78C11BE13214E9B07"><enum>(3)</enum><header>Qualifying
			 educational institution</header><text display-inline="yes-display-inline">The
			 term <quote>qualifying educational institution</quote> has the meaning given
			 the term <quote>institution of higher education</quote> in section 101(a) of
			 the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text>
				</paragraph><paragraph id="H91796B0D2ABE4950AFCC7412055D1B39"><enum>(4)</enum><header>Part-time</header><text display-inline="yes-display-inline">The term <quote>part-time</quote>, when
			 used with respect to an internship, shall be defined by the Secretary in
			 regulations.</text>
				</paragraph><paragraph commented="no" id="H31400D6A1C81442EB1B258F4DA392C05"><enum>(5)</enum><header>Period of
			 nonattendence</header><text display-inline="yes-display-inline">The term
