		<section id="HB349A78C71CE414B89C34B59920A308C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Visa Overstay Enforcement Act of
			 2013</short-title></quote>.</text>
		</section><section id="HE62E76240B454C3C9C085748CB07873B"><enum>2.</enum><header>Unlawful presence
			 criminalized</header><text display-inline="no-display-inline">The Immigration
			 and Nationality Act is amended by inserting after section 274D the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H36C14FC6B99343A48E228FB549E19850" style="OLC">
				<section id="HF01600C82A40424885B2038827BF4810"><enum>274E.</enum><header>Unlawful
				presence</header>
					<subsection id="HA76E0C98C8064D99A675EB4EC2B1440D"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				subsection (b), any alien who is unlawfully present in the United States for a
				period of 30 consecutive days shall be punished—</text>
						<paragraph id="H01A474B1F0EE41A89882EEEDCB701305"><enum>(1)</enum><text>in the case of a
				first offense, as felony, by a fine of not more than $10,000 or by imprisonment
				for not more than 1 year, or both; and</text>
						</paragraph><paragraph id="H1FC7C4320A4E425F8FCCDE26D9FD5F8E"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of a subsequent offense, as a
				felony, by a fine of not more than $15,000 or by imprisonment for not more than
				5 years, or both.</text>
						</paragraph></subsection><subsection id="HB2D3B5B68BB84E27809FB2CA201E1808"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">If the Secretary of Homeland Security
				determines that because of illness or any other extenuating circumstance the
				alien has been unlawfully present, the alien shall not be subject to the
				penalties under subsection (a).</text>
					</subsection><subsection id="H832C88E7C6A7405D9577F727C8781CDA"><enum>(c)</enum><header>Limitation on
				reentry</header>
						<paragraph id="H59C723CD0AA04D38AA6F5A3A09F97A3E"><enum>(1)</enum><header>First
				offenders</header><text display-inline="yes-display-inline">Any alien convicted
				of a violation of subsection (a)(1)—</text>
							<subparagraph id="H95068D399C954F37A09BD190C3D20761"><enum>(A)</enum><text>may not be
				admitted to the United States for a period of 5 years, beginning on the date of
				the conviction; and</text>
							</subparagraph><subparagraph id="HFC849B56B6D64587B47F8820843C724F"><enum>(B)</enum><text display-inline="yes-display-inline">may not be granted a visa for a period of
				10 years, beginning on the date of the conviction.</text>
							</subparagraph></paragraph><paragraph id="H5F8A492AD73B4B30BBD4BBE92BD9DBFB"><enum>(2)</enum><header>Subsequent
				offenses</header><text>Any alien convicted of a violation of subsection
				(a)(2)—</text>
							<subparagraph id="HAA536B64CBAC442BB235220C3596333E"><enum>(A)</enum><text display-inline="yes-display-inline">may not be admitted to the United States;
				and</text>
							</subparagraph><subparagraph id="HB53F12757AF94393B583FE4DC3CDAC5F"><enum>(B)</enum><text display-inline="yes-display-inline">may not be granted a
				visa.</text>
							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H184CE6185A33499FAAF9270BDCB5B69E"><enum>3.</enum><header>Biometric Entry
			 and Exit system</header>
			<subsection id="H7B774039975F481EB0A8EABE327F182C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 90
			 days after the date of the enactment of this Act, the Secretary of Homeland
			 Security shall submit to the appropriate congressional committees a plan to
			 implement, immediately, a biometric exit capability using a person’s
			 fingerprints at all land, sea, and air ports of entry under the US–VISIT
			 program, in accordance with the Enhanced Security and Visa Entry Reform Act of
			 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/73">Public Law 107–73</external-xref>).</text>
			</subsection><subsection id="H7799E30516FD43ED9611860DF925867F"><enum>(b)</enum><header>Contents of
			 plan</header><text display-inline="yes-display-inline">The Secretary of
			 Homeland Security shall include the following requirements when developing the
			 biometric plan:</text>
				<paragraph id="H50809F51C058439CAB01A7F10F660F3D"><enum>(1)</enum><text display-inline="yes-display-inline">Leveraging of all biometric
			 technologies.</text>
				</paragraph><paragraph id="H23958D4A53F44A7591AC57D280C85836"><enum>(2)</enum><text>Utilization of
			 biometric technologies used by the United States Government in Iraq and
			 Afghanistan.</text>
				</paragraph><paragraph id="HCD8BB057924C40F4A201927DE0F5E430"><enum>(3)</enum><text>Establish
			 collaborative relationships with airports and the airlines.</text>
				</paragraph><paragraph id="HE46C1A1C7133454D8F3C3EA6B380EC61"><enum>(4)</enum><text>Allow for reliable
			 reporting of visa overstay rates.</text>
				</paragraph><paragraph id="H2C0218746F684B388DC97853C85C1FAD"><enum>(5)</enum><text>Coordination of
			 databases across the United States Government including all databases
			 maintained by the Department of Homeland Security, the Department of Justice,
			 and the Department of State.</text>
				</paragraph><paragraph id="HC45C5B2FF8EF42FFACD9780C61EAAE9B"><enum>(6)</enum><text>Assessment of
			 operational and funding requirements of Department of Homeland Security
			 components, specifically U.S. Border Patrol, U.S. Customs and Border Protection
			 and U.S. Immigration and Customs Enforcement.</text>
				</paragraph><paragraph id="H4A8F5DD732A140B49DEDD6260C7B1CB4"><enum>(7)</enum><text>Not later than 30
			 days after the date of enactment of this Act, the Secretary shall establish
			 plans for establishing a pilot biometric exit project at a minimum of two land
			 ports of entry at the U.S.-Canada border and a minimum of four land ports of
			 entry at the U.S.-Mexico border.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HAE86A9C8796244EDA3463031F6474530"><enum>(c)</enum><header>Biometric entry
			 and exit data system</header>
				<paragraph id="HF55AC13AEF3C441EA9369A43BBE3DB8F"><enum>(1)</enum><header>Airports</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Secretary of Homeland Security shall establish the
			 biometric entry and exit data system required by section 7208 of the
			 Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/8/1365b">8 U.S.C. 1365b</external-xref>) at
			 each airport that is a port of entry to the United States.</text>
				</paragraph><paragraph id="H27EB9EBE256A4785B64D1C7C88BF4707"><enum>(2)</enum><header>All ports of
			 entry</header><text>Not later than 2 years after the date of enactment of this
			 Act, the Secretary of Homeland Security shall establish the biometric entry and
			 exit data system required by section 7208 of the Intelligence Reform and
			 Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/8/1365b">8 U.S.C. 1365b</external-xref>) at all ports of entry to the
			 United States.</text>
				</paragraph></subsection></section></legis-body>
