		<official-title>To amend title 39, United States Code, to cap rural post
		  office closures at no more than 5 percent of total closures in any given year,
		  and for other purposes.</official-title>

		<section id="HB6EFE2B1B08A42A7B49A98A5B2EAA267" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Securing Access to Rural Postal
			 Services Act of 2013</short-title></quote>.</text>
		</section><section id="H0E64C6388E8543B89E83C717FE66FF73" section-type="subsequent-section"><enum>2.</enum><header>Treatment of closures
			 and consolidations</header>
			<subsection id="H963CEA29A3BC46A6B51E89CCA5529CB1"><enum>(a)</enum><header>Rural post
			 office annual closure limitation</header>
				<paragraph id="HCE8AC0ECEF994EEEAFBBE683F43554D7"><enum>(1)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/39/404a">Section 404a(a)</external-xref> of title 39, United States Code, is
			 amended—</text>
					<subparagraph id="H9243E09B4A8748308E927E7F1B7E6008"><enum>(A)</enum><text>in paragraph (2),
			 by striking <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="H28AAFB827A1D42F6BAE6F2BE02309021"><enum>(B)</enum><text>in paragraph (3),
			 by striking the period and inserting <quote>; or</quote>; and</text>
					</subparagraph><subparagraph id="HA06A9034287C4F3F99608F130384042C"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H1716A33724E64B1EB04EE62C1A4CD1FC" style="USC">
							<paragraph id="H35056FBAE4D748A4B23BD3B3B25F1CCE"><enum>(4)</enum><text display-inline="yes-display-inline">in any calendar year, close, consolidate,
				or suspend the operations of more than 5 percent of the postal facilities
				that—</text>
								<subparagraph id="HC35DC24661E84707869C25C3B64265C6"><enum>(A)</enum><text>were operating as
				of the first day of such calendar year; and</text>
								</subparagraph><subparagraph id="HF8F3EE7BDB1740288441A42A3B8928A6"><enum>(B)</enum><text>were within the K
				or L cost ascertainment grouping as of June 23,
				2011.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HBEA71F4E2DD74EC2AB992D03FDF68969"><enum>(2)</enum><header>Definition</header><text>Section
			 404a of title 39, United States Code, is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H4E9D2DF4C0264294B32AB1D434F58150" style="USC">
						<subsection id="H9D03D39005AC43F888FF1B1C487ABC8A"><enum>(d)</enum><text display-inline="yes-display-inline">For purposes of subsection (a)(4), the term
				<term>postal facility</term> means a post office, post office branch, post
				office classified station, or other facility which is operated by the Postal
				Service, and the primary function of which is to provide retail postal
				services.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HACDA97E0143B41A69076E847EC5DF5BE"><enum>(b)</enum><header>Alternative
			 postal access choice</header><text><external-xref legal-doc="usc" parsable-cite="usc/39/404">Section 404(d)</external-xref> of title 39, United States
			 Code, is amended by striking all that precedes paragraph (2) and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H743DE843918D40B0B0C3BF61FA88FD43" style="USC">
					<subsection id="H8D406FBA288743DFBE827946DD397694"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HD7D5537C43D847DB9C73D29E9949AB05"><enum>(1)</enum><text display-inline="yes-display-inline">The Postal Service, prior to making a
				determination under subsection (a)(3) as to the necessity for the closing or
				consolidation or any post office, shall—</text>
							<subparagraph id="H9BBA600200F54142A08D84FFAF0028F6" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">provide adequate notice of its intention to
				close or consolidate such post office at least 60 days prior to the proposed
				date of such closing or consolidation to postal customers served by such post
				office;</text>
							</subparagraph><subparagraph id="H0325239EF00B4EB983E1EE75388B71B2" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">conduct a nonbinding survey on the proposed
				closing or consolidation to allow postal customers served by such post office
				an opportunity to indicate their preference between or among—</text>
								<clause id="H4F57D37EF3C24FB984BE2EDD345ACA34"><enum>(i)</enum><text>the closing or consolidation;
				and</text>
								</clause><clause id="H6AE81F8CC3D54024A98511F07A12442E"><enum>(ii)</enum><text>1 or more alternative options;
				and</text>
								</clause></subparagraph><subparagraph id="HA18399D596C7426C881A20B2935B2B4E" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">ensure that—</text>
								<clause id="HE6E86E6836BA4532AAA9CE03D8CB1D9D"><enum>(i)</enum><text>should the closure or consolidation
				of a post office be deemed necessary, it shall be the policy of the Postal
				Service to provide alternative access to postal services to those served by the
				post office by—</text>
									<subclause id="HC6070C982D6B47519465490BFE58F322"><enum>(I)</enum><text>the alternative option under subparagraph
				(B)(ii); or</text>
									</subclause><subclause id="HC5A0815FF3634916A0356CA5C938AEAF"><enum>(II)</enum><text>if more than one, the option under
				subparagraph (B)(ii) preferred by the greatest number of survey respondents;
				and</text>
									</subclause></clause><clause id="HFE34D782E62E4D3AB6D49ACE77DDED96"><enum>(ii)</enum><text>if the Postal Service is unable to
				provide alternative access through the option described in clause (i) or if
				such option would be cost prohibitive, the Postal Service—</text>
									<subclause id="H4F62C5D997E240B2ACDDEE543A870BD2"><enum>(I)</enum><text>may provide alternative access through a
				different means; and</text>
									</subclause><subclause id="H74134A1D6CFA43749C54AA1CC29D5E96"><enum>(II)</enum><text>shall provide written notice to postal
				customers served by the post office identifying and explaining why the option
				identified by clause (i) was not possible or cost prohibitive, as the case may
				be.</text>
									</subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
