		<official-title>To provide for the removal of default information from a
		  borrower’s credit report with respect to certain rehabilitated education
		  loans.</official-title>

		<section id="H6B2E7A8DB95C490BB6738D386DC31E6A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Adjustment in Reporting Student Credit Act of
			 2013</short-title></quote> or the <quote><short-title>FAIR Student Credit Act
			 of 2013</short-title></quote>.</text>
		</section><section id="HC46A8404DE644EB8A263241FDE2644CC"><enum>2.</enum><header>Rehabilitation of
			 qualified education loans</header><text display-inline="no-display-inline">Section 623(a)(1) of the Fair Credit
			 Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681s-2">15 U.S.C. 1681s–2(a)(1)</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H6EAFE8FB3D614665891CD6EEC2FF887F" style="OLC">
				<subparagraph id="HEF804CC38F17477DA1ED20AC099E20D8"><enum>(E)</enum><header>Rehabilitation
				of qualified education loans</header>
					<clause id="HE8E1EB8D371448FC897BEA54A53F8041"><enum>(i)</enum><header>In
				general</header><text>Notwithstanding any other provision of this section, a
				person shall request to remove a previously reported default regarding a
				qualified education loan from a consumer report, and such request shall not be
				considered inaccurate, if the consumer of such loan successfully and
				voluntarily meets the requirements of a loan rehabilitation program, where the
				number of consecutive on-time monthly payments, in accordance with the terms
				and conditions of the loans, or any valid and legally binding modification
				thereto, are equal to the number of payments specified under section
				428F(a)(1)(A) of the Higher Education Act of 1965 (20 U.S.C.
				1078–6(a)(1)(A)).</text>
					</clause><clause id="H4B5F12711D9640F48ADDE19F73107546"><enum>(ii)</enum><header>Limitation</header><text>A
				consumer may obtain the benefits available under this subsection with respect
				to rehabilitating a loan only one time per loan.</text>
					</clause><clause id="H0F4BA3EF62634BD2A870C223E45818AC"><enum>(iii)</enum><header>Qualified
				education loan defined</header><text>For purposes of this subparagraph, the
				term <term>qualified education loan</term> has the meaning given such term
				under section 221(d) of the Internal Revenue Code of
				1986.</text>
					</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H8209F194B4554B7EB8705FEB8FFBAAF3"><enum>3.</enum><header>GAO
			 Study</header>
			<subsection id="HB68EA39ADE7C402494C75B4E1F836BF5"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United
			 States shall carry out a study on—</text>
				<paragraph id="H64EC79F097E644F68C11283896CB91E6"><enum>(1)</enum><text>the implementation
			 of section 623(a)(1)(E) of the Fair Credit Reporting Act, as added by section
			 2; and</text>
				</paragraph><paragraph id="H2B7113E5F9CC462A8481A6496B7BFDBE"><enum>(2)</enum><text>any hurdles
			 borrowers experience with the private loan rehabilitation program.</text>
				</paragraph></subsection><subsection id="H050462F4F95140FDAF7455A29FE2E2E8"><enum>(b)</enum><header>Report</header><text>Not
			 later than the end of the 18-month period beginning on the date of the
			 enactment of this Act, the Comptroller General shall issue a report to the
			 Congress containing all findings and determinations made in carrying out the
			 study required under subsection (a).</text>
