		<official-title>To amend title 38, United States Code, to amend the
		  definition of the term <quote>spouse</quote> to recognize new State definitions
		  of such term for the purpose of the laws administered by the Secretary of
		  Veterans Affairs.</official-title>

		<section id="H7D5C73CB3588431B94C4934A2707BC96" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Veteran Spouses Equal Treatment
			 Act</short-title></quote>.</text>
		</section><section id="H0B04628CCAEC40428030CE4484F3D02F"><enum>2.</enum><header>Definition of
			 spouse for purposes of veteran benefits to reflect new state definitions of
			 spouse</header><text display-inline="no-display-inline">Section 101 of title
			 38, United States Code, is amended—</text>
			<paragraph id="H6F526EE54DD0451CAD5C49CABC2F0272"><enum>(1)</enum><text>in paragraph (3),
			 by striking <quote>of the opposite sex</quote>; and</text>
			</paragraph><paragraph id="HB0D015F167CA4A8BADB36F6087835C89"><enum>(2)</enum><text>by striking
			 paragraph (31) and inserting the following new paragraph:</text>

					<paragraph id="H4D77F4C09EA949098DC24DE569CD2601"><enum>(31)</enum><text>Notwithstanding
				<external-xref legal-doc="usc" parsable-cite="usc/1/7">section 7</external-xref> of title 1, an individual shall be considered a <term>spouse</term>
				if the marriage of the individual is valid in the State in which the marriage
				was entered into or, in the case of a marriage entered into outside any State,
				if the marriage is valid in the place in which the marriage was entered into
				and the marriage could have been entered into in a State. In this paragraph,
				the term <term>State</term> has the meaning given that term in paragraph (20),
				except that the term also includes the Commonwealth of the Northern Mariana
				Islands.</text>
