		<legis-type>A BILL</legis-type>
		<official-title>To achieve domestic energy independence by empowering
		  States to control the development and production of all forms of energy on all
		  available Federal land.</official-title>

	<legis-body id="H60F5D9A65A504A19828B40A9AF7D1122" style="OLC">
		<section id="H19AAA1E8391A468CA1618C1E4B1C0A39" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Land Freedom Act of
			 2013</short-title></quote>.</text>
		</section><section id="H984079721F6E4B59A7E7F8604260E620"><enum>2.</enum><header>State control of
			 energy development and production on all available federal land</header>
			<subsection id="H41054243F6D64EF487C945297FBAF354"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H54F30933F30847D48AB6A1205C2E200D"><enum>(1)</enum><header>Available
			 federal land</header><text>The term <term>available Federal land</term> means
			 any Federal land that, as of May 31, 2013—</text>
					<subparagraph id="H2DFA278B152D4B0A847ABAD301B2141D"><enum>(A)</enum><text>is located within
			 the boundaries of a State;</text>
					</subparagraph><subparagraph id="H1F96244C3A914F5494D80A02373ED15C"><enum>(B)</enum><text>is not held by the
			 United States in trust for the benefit of a federally recognized Indian
			 tribe;</text>
					</subparagraph><subparagraph id="H703164DCE3CB445FB8361AAEC9EB235E"><enum>(C)</enum><text>is not a unit of
			 the National Park System;</text>
					</subparagraph><subparagraph id="H7A62545B6C6E4C868ABF09E7FC0A581D"><enum>(D)</enum><text>is not a unit of
			 the National Wildlife Refuge System; and</text>
					</subparagraph><subparagraph id="H2549AB503D064AD3B7E37A627043F116"><enum>(E)</enum><text>is not a
			 Congressionally designated wilderness area.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H4E6BBD4E47FC4622A720A7EE2A5DDBF4"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
				</paragraph><paragraph commented="no" id="H9CDC3DE25D6A4C2EB60121AE73ED16D7"><enum>(3)</enum><header>State</header><text>The
			 term <term>State</term> means—</text>
					<subparagraph commented="no" id="H85BF6AC2ABA24E238FAF45466C3484BF"><enum>(A)</enum><text>a State;
			 and</text>
					</subparagraph><subparagraph commented="no" id="H79A617DA60E545839BAD4080CEECE5E8"><enum>(B)</enum><text>the District of
			 Columbia.</text>
					</subparagraph></paragraph></subsection><subsection id="HB2EE708C0523491A8A1CC3B712CC2D69"><enum>(b)</enum><header>State
			 programs</header>
				<paragraph id="H02215D785B46476A94E39C0BBF527FEB"><enum>(1)</enum><header>In
			 general</header><text>A State—</text>
					<subparagraph id="H0D066BE67C5B4501AE3F44E76F905555"><enum>(A)</enum><text>may establish a
			 program covering the leasing and permitting processes, regulatory requirements,
			 and any other provisions by which the State would exercise its rights to
			 develop all forms of energy resources on available Federal land in the State;
			 and</text>
					</subparagraph><subparagraph id="HA037C4633B7F4FE7B401D6D2A4405B72"><enum>(B)</enum><text>as a condition of
			 certification under subsection (c)(2) shall submit a declaration to the
			 Departments of the Interior, Agriculture, and Energy that a program under
			 subparagraph (A) has been established or amended.</text>
					</subparagraph></paragraph><paragraph id="H8B591F6E2BBC4C28A3B3BA77C87DE98E"><enum>(2)</enum><header>Amendment of
			 programs</header><text>A State may amend a program developed and certified
			 under this section at any time.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE52C8DFEC26E4091B042DFDEF6925F07"><enum>(3)</enum><header>Certification of
			 amended programs</header><text>Any program amended under paragraph (2) shall be
			 certified under subsection (c)(2).</text>
				</paragraph></subsection><subsection id="H36947C25357E4F908893AD4484E57056"><enum>(c)</enum><header>Leasing,
			 permitting, and regulatory programs</header>
				<paragraph id="HE3D297A3BDEE4A99A8771B06A49C6E44"><enum>(1)</enum><header>Satisfaction of
			 Federal requirements</header><text>Each program certified under this section
			 shall be considered to satisfy all applicable requirements of Federal law
			 (including regulations), including—</text>
					<subparagraph id="H18A7EA09D66A45759CAC3B2050BAB2F8"><enum>(A)</enum><text>the National
			 Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text>
					</subparagraph><subparagraph id="HE42EBB8866014DF49FEF6B6543937B16"><enum>(B)</enum><text>the Endangered
			 Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and</text>
					</subparagraph><subparagraph id="HF1B24BEE04C84860861EECFC18E4530A"><enum>(C)</enum><text>the National
			 Historic Preservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/470">16 U.S.C. 470 et seq.</external-xref>).</text>
					</subparagraph></paragraph><paragraph id="HC5DBCFDBDFDE45398755964FC41228F8"><enum>(2)</enum><header>Federal
			 certification and transfer of development rights</header><text>Upon submission
			 of a declaration by a State under subsection (b)(1)(B)—</text>
					<subparagraph id="HBD1B0027C28147D2878B52297D537DDF"><enum>(A)</enum><text>the program under
			 subsection (b)(1)(A) shall be certified; and</text>
					</subparagraph><subparagraph id="H1C4F3222C4E1434CBBF39F16D46DA5FA"><enum>(B)</enum><text>the State shall
			 receive all rights from the Federal Government to develop all forms of energy
			 resources covered by the program.</text>
					</subparagraph></paragraph><paragraph id="H04C2DEE277FD4271A433D638417B463A"><enum>(3)</enum><header>Issuance of
			 permits and leases</header><text>If a State elects to issue a permit or lease
			 for the development of any form of energy resource on any available Federal
			 land within the borders of the State in accordance with a program certified
			 under paragraph (2), the permit or lease shall be considered to meet all
			 applicable requirements of Federal law (including regulations).</text>
				</paragraph></subsection><subsection id="H7B928D6DF2A54FF9BF2E9E3274A2611C"><enum>(d)</enum><header>Judicial
			 review</header><text>Activities carried out in accordance with this Act shall
			 not be subject to judicial review.</text>
			</subsection><subsection id="H4DF01EB7E1284364AC393CEC014074F3"><enum>(e)</enum><header>Administrative
			 Procedure Act</header><text>Activities carried out in accordance with this Act
			 shall not be subject to subchapter II of chapter 5, and chapter 7, of title 5,
			 United States Code (commonly known as the ‘‘Administrative Procedure
			 Act’’).</text>
