		  Monument, and for other purposes.</official-title>

		<section id="H2C135EBF21594919B5C7CE44CD6B155D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Oregon Caves Revitalization Act of
			 2013</short-title></quote>.</text>
		</section><section id="H02C2477A708449DFB29B2F46A4919EA3"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to add
			 surrounding land to the Monument—</text>
			<paragraph id="H16084BDA815C40B493DD2E8D26A5D58C"><enum>(1)</enum><text>to enhance the
			 protection of the resources associated with the Monument; and</text>
			</paragraph><paragraph id="HF660A4A10D3B4AC3B41B22464EFA76D0"><enum>(2)</enum><text>to increase public
			 recreation opportunities.</text>
			</paragraph></section><section id="H6950A71B8BD34F59AFCFC1863A78F4AB"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H1A8F7DB88F46438B87B28837F2EB3617"><enum>(1)</enum><header>Map</header><text>The
			 term <term>map</term> means the map titled <quote>Oregon Caves National
			 Monument and Preserve</quote> numbered 150/80,023, and dated May 2010.</text>
			</paragraph><paragraph id="HA372CB2BAEDF4D6B86E7DC1618709736"><enum>(2)</enum><header>Monument</header><text>The
			 term <term>Monument</term> means the Oregon Caves National Monument established
			 by Presidential Proclamation Number 876 (36 Stat. 2497), dated July 12,
			 1909.</text>
			</paragraph><paragraph id="HF7CD827B77A546AD9734732FC414C279"><enum>(3)</enum><header>National
			 Preserve</header><text>The term <term>National Preserve</term> means the
			 National Preserve designated by section 4(a).</text>
			</paragraph><paragraph id="H717A69ADC1854172A9F85CB8559841B4"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="HECCC2B92FD5A4F7DAD7ECEBF88DB2E36"><enum>(5)</enum><header>Secretary
			 concerned</header><text>The term <term>Secretary concerned</term> means—</text>
				<subparagraph id="H8574F192E8C640A5897305D5CFDDA3E0"><enum>(A)</enum><text>the Secretary of
			 Agriculture (acting through the Chief of the Forest Service), with respect to
			 National Forest System land; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4AEB914BC9584EA28932ACB1D09599A7"><enum>(B)</enum><text>the Secretary of
			 the Interior, with respect to land managed by the Bureau of Land
			 Management.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD8813E95722C4DEF82304911CB0C515E"><enum>(6)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Oregon.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H863AF6142D774E508E509F403A515CAB"><enum>4.</enum><header>Designation; land
			 transfer; boundary adjustment</header>
			<subsection commented="no" display-inline="no-display-inline" id="H1B15C78BED484A96BD6FA628D0316AAC"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Monument shall be
			 known and designated as the <quote>Oregon Caves National Monument and
			 Preserve</quote>. The land identified on the map as <quote>Proposed Addition
			 Lands</quote> shall be designated as a National Preserve.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H6B2E9E9145F74DE795722CCA7DEBF7CA"><enum>(b)</enum><header>Land
			 transfer</header><text>The Secretary of Agriculture shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H633CC4C0D14149718DF7C705D91F5AB4"><enum>(1)</enum><text display-inline="yes-display-inline">transfer approximately 4,070 acres of land
			 identified on the map as the <quote>Proposed Addition Lands</quote> to the
			 Secretary to be administered as part of the Oregon Caves National Monument and
			 Preserve; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H768672D1959642578BCAD6FEEF9B3208"><enum>(2)</enum><text>adjust the
			 boundary of the Rogue River-Siskiyou National Forest to exclude the land
			 transferred under paragraph (1).</text>
				</paragraph></subsection><subsection id="H6DF948A341C941B5B2F4FA59946F85DF"><enum>(c)</enum><header>Boundary
			 adjustment</header><text>The boundary of the National Monument is modified to
			 exclude approximately 4 acres of land—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H4E82D85FE3284169B443A1D41AC4740E"><enum>(1)</enum><text>located in the
			 City of Cave Junction; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0EEA22D293354E30BE34464DAFEE55D3"><enum>(2)</enum><text>identified on the
			 map as the <quote>Cave Junction Unit</quote>, as depicted on the map.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HBA6B48578F9D4FD686D714E60A8CA1D8"><enum>(d)</enum><header>Availability of
			 map</header><text>The map shall be on file and available for public inspection
			 in the appropriate offices of the National Park Service.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HE461AD3080FC4B80A40727C682F9ABC5"><enum>(e)</enum><header>References</header><text>Any
			 reference in a law, map, regulation, document, paper, or other record of the
			 United States to the Monument shall be considered to be a reference to the
			 <quote>Oregon Caves National Monument and Preserve</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HAFA63CC9984648AAA6057E929A0477DA"><enum>5.</enum><header>Administration</header>
			<subsection commented="no" display-inline="no-display-inline" id="H41797A7A17E14B03907F9C301D7C4746"><enum>(a)</enum><header>In
			 general</header><text>The Secretary, acting through the Director of the
			 National Park Service, shall administer the National Monument and Preserve in
			 accordance with—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H058062604E294601AE5F9538DA9C6EE7"><enum>(1)</enum><text>this Act;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF48FEFD9CBCD4645838770E22D46AB27"><enum>(2)</enum><text>Presidential
			 Proclamation Number 876 (36 Stat. 2497), dated July 12, 1909; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8E9CAB0E65A74F7A82FF227C0B8B29E2"><enum>(3)</enum><text>any law (including
			 regulations) generally applicable to units of the National Park System,
			 including the National Park Service Organic Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1">16 U.S.C. 1 et seq.</external-xref>).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3D8FC160D8B84A519C17F599804DD0FA"><enum>(b)</enum><header>Fire
			 management</header><text display-inline="yes-display-inline">As soon as
			 practicable after the date of enactment of this Act, in accordance with
			 subsection (a), the Secretary shall revise the fire management plan for the
			 Monument to include the National Preserve and, in accordance with the revised
			 plan, carry out hazardous fuel management activities within the boundaries of
			 the National Monument and Preserve.</text>
			</subsection><subsection id="H7B77014BF3384D55A342C6E2B44C23AF"><enum>(c)</enum><header>Existing forest
			 service contracts</header><text display-inline="yes-display-inline">The
			 Secretary shall allow for the completion of existing Forest Service stewardship
			 and service contracts executed as of the date of enactment of this Act and
			 shall recognize the authority of the Secretary of Agriculture for the purpose
			 of administering the existing Forest Service contracts through their
			 completion. All terms and conditions of existing Forest Service contracts shall
			 remain in place for the duration of those contracts. Any such liability
			 existing at the time of enactment of this Act shall be that of the Forest
			 Service.</text>
			</subsection><subsection id="H2E84E60B7C3F4E5EB3107F152503D9C1"><enum>(d)</enum><header>Grazing</header><text display-inline="yes-display-inline">The Secretary may allow the grazing of
			 livestock within the preserve to continue where authorized under permits or
			 leases in existence as of the date of enactment of this Act. Grazing shall be
			 at no more than the current level, as measured in Animal Unit Months, and
			 subject to applicable laws and National Park Service regulations.</text>
			</subsection></section><section id="H7E90AF0DC06E419EB265B1C5BB965825"><enum>6.</enum><header>Voluntary grazing
			 lease or permit donation program</header>
			<subsection id="H870B88371E3F46F0B99656121738F877"><enum>(a)</enum><header>Donation of
			 lease or permit</header>
				<paragraph id="H32F11CC9C7B94A849AAD6DB958E6B3E5"><enum>(1)</enum><header>Acceptance by
			 Secretary concerned</header><text display-inline="yes-display-inline">The
			 Secretary concerned shall accept the donation of a grazing lease or permit from
			 a lessee or permittee for—</text>
					<subparagraph id="H79B1DA48625F4BEB8FA4FA06CE884270"><enum>(A)</enum><text display-inline="yes-display-inline">the Big Grayback Grazing Allotment located
			 in the Rogue River-Siskiyou National Forest; and</text>
					</subparagraph><subparagraph id="H2BF0901EB9B74090A621E7A18A83AC75"><enum>(B)</enum><text>the Billy Mountain
			 Grazing Allotment located on a parcel of land that is managed by the Secretary
			 (acting through the Director of the Bureau of Land Management).</text>
					</subparagraph></paragraph><paragraph id="HA34F569018F14D629DF4AA562E2A00D2"><enum>(2)</enum><header>Termination</header><text display-inline="yes-display-inline">With respect to each permit or lease
			 donated under subparagraph (a), the Secretary shall—</text>
					<subparagraph id="HB90534C068DB4E98A1F832858FB46953"><enum>(A)</enum><text display-inline="yes-display-inline">terminate the grazing permit or lease;
			 and</text>
					</subparagraph><subparagraph id="H0E74F4AA796E4BCF923DA950D0B12CB9"><enum>(B)</enum><text>ensure a permanent
			 end to grazing on the land covered by the permit or lease.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDC4AE51ECB0544FE8DAA8E309D3D37BD"><enum>(b)</enum><header>Effect of
			 donation</header><text>A lessee or permittee that donates a grazing lease or
			 grazing permit (or a portion of a grazing lease or grazing permit) under this
			 section shall be considered to have waived any claim to any range improvement
			 on the associated grazing allotment or portion of the associated grazing
			 allotment, as applicable.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HE554B8B9FBC54592A7A5B423A622EACD"><enum>7.</enum><header>Hunting, fishing,
			 and trapping</header>
			<subsection commented="no" display-inline="no-display-inline" id="H7BD40A67D7884A0EBFE0D95AE7457FFD"><enum>(a)</enum><header>In
			 general</header><text>Except as provided in subsection (b), the Secretary shall
			 permit hunting, fishing, and trapping on land and water within the National
			 Preserve in accordance with each applicable law (including regulations) of the
			 Federal Government and the State.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HA60B64676AC94B3381A7081D22D3FD45"><enum>(b)</enum><header>Administrative
			 exceptions</header><text>In accordance with subsection (c), the Secretary may
			 designate areas in which, and establish limited periods during which, no
			 hunting, fishing, or trapping may be permitted within the National Preserve due
			 to concerns relating to—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H283E52218E9F4C129419B4014C1F345E"><enum>(1)</enum><text>public
			 safety;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA182CE1FF9BA4479835835845FFEF784"><enum>(2)</enum><text>the administration
			 of the National Preserve; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3891E714959A4C38810F3D79C9C3E5D1"><enum>(3)</enum><text>the compliance by
			 the Secretary with any applicable law (including regulations).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1F17366AB55F4CEFB61C55A1F34E6938"><enum>(c)</enum><header>Consultation
			 with appropriate State agency</header><text>Except to respond to a situation
			 that the Secretary determines to be an emergency, the Secretary shall consult
			 with the appropriate agency of the State before taking any act to close any
			 area within the National Preserve to hunting, fishing, or trapping.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HD37788C1B5464A108D353018BDFD7C00"><enum>8.</enum><header>Effect</header><text display-inline="no-display-inline">Nothing in this Act affects the authority or
			 responsibility of the State to carry out any law or duty of the State relating
			 to fish and wildlife on areas located within the National Preserve.</text>
		</section><section id="HADB135B614B2434F9647E1F21E431035"><enum>9.</enum><header>Wild and scenic
			 river designation, River Styx, Oregon</header><text display-inline="no-display-inline">Section 3(a) of the Wild and Scenic Rivers
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>) is amended by inserting the following paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="H54A0F0406CE044EAB279E72A03651AD5" style="OLC">
				<paragraph id="H79681B8F09A543ECBFB9EBCD5D16AE22"><enum>(__)</enum><header>River Styx,
				Oregon</header><text display-inline="yes-display-inline">The subterranean
				segment of Cave Creek, known as the River Styx, to be administered by the
				Secretary of the Interior as a scenic
				river.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H7DA7A31515EE4992A75FD11D28EDDF92"><enum>10.</enum><header>Wild and scenic
			 river designation for study</header><text display-inline="no-display-inline">Section 5(a) of the Wild and Scenic Rivers
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1276">16 U.S.C. 1276(a)</external-xref>) is amended by adding at the end the following:</text>

				<paragraph id="HEB9160E2D3E449A589EEDB406184A16A"><enum>(__)</enum><header>Oregon Caves
				National Monument and Preserve, Oregon</header>
					<subparagraph id="H385DCECE569E4CBFBDD8FED2586A088B"><enum>(A)</enum><header>Cave Creek,
				Oregon</header><text>The 2.6-mile segment of Cave Creek from the headwaters at
				the River Styx to the boundary of the Rogue River Siskiyou National
				Forest.</text>
					</subparagraph><subparagraph id="H0D1C0944AE3A417BA4C07F7C22187F76"><enum>(B)</enum><header>Lake Creek,
				Oregon</header><text>The 3.6-mile segment of Lake Creek from the headwaters at
				Bigelow Lakes to the confluence with Cave Creek.</text>
					</subparagraph><subparagraph id="HB2A4E80FFA304A0A8BE6FB2F891F39CB"><enum>(C)</enum><header>No Name Creek,
				Oregon</header><text>The 0.6-mile segment of No Name Creek from the headwaters
				to the confluence with Cave Creek.</text>
					</subparagraph><subparagraph id="H90DC96CBE9674A22B95F34833FF26C59"><enum>(D)</enum><header>Panther
				Creek</header><text>The 0.8-mile segment of Panther Creek from the headwaters
				to the confluence with Lake Creek.</text>
					</subparagraph><subparagraph id="H973137BA765B4A3C8F68D52E837B414B"><enum>(E)</enum><header>Upper Cave
				Creek</header><text>The segment of Upper Cave Creek from the headwaters to the
				confluence with River
				Styx.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HAC2E55D06DE543AAAF9E1D5B1C268DE0"><enum>11.</enum><header>Study and
			 report</header><text display-inline="no-display-inline">Section 5(b) of the
			 Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1276">16 U.S.C. 1276(b)</external-xref>) is amended by adding at the end
			 the following:</text>

				<paragraph id="H9B226C0307024D8BB9D6CA77E30A5444"><enum>(__)</enum><header>Oregon Caves
				National Monument and Preserve, Oregon</header><text display-inline="yes-display-inline">Not later than 3 years after funds are made
				available to carry out this paragraph, the Secretary shall complete the study
				of the Oregon Caves National Monument and Preserve segments designated for
				study in subsection (a), and shall submit to Congress a report containing the
				results of the
				study.</text>
