The primary function of the Veterans Economic Opportunity Administration is the administration of the programs of the Department which provide assistance related to economic opportunity to veterans and their dependents and survivors.</text></subsection><subsection id="H20EB8A1A724D4349B4109C1CF3996768"><enum>(b)</enum><header>Under Secretary for Economic Opportunity</header><text display-inline="yes-display-inline">The Veterans Economic Opportunity Administration is under the Under Secretary for Veterans Economic Opportunity, who is directly responsible to the Secretary for the operations of the Administration.</text></subsection></section><section id="HB8B528DE7A5B465C8F408670238DC2D9"><enum>8002.</enum><header>Functions of Administration</header><subsection id="HB1F45FE745CC4C25A83F57E988281E4D"><enum></enum><text>The Veterans Economic Opportunity Administration is responsible for the administration of the following programs of the Department:</text><paragraph id="H41998F530B024E519CA110DE052CCE63"><enum>(1)</enum><text>Vocational rehabilitation and employment programs.</text></paragraph><paragraph id="H86D8991370434FA9B4D6272008C5F0D0"><enum>(2)</enum><text>Educational assistance programs.</text></paragraph><paragraph id="HDA5009E854FB4E62AFC4B19D2CDC8F82"><enum>(3)</enum><text>Veterans’ housing loan and related programs.</text></paragraph><paragraph id="H204C4F7610BE4625ABD556BDA50F5176"><enum>(4)</enum><text>The veterans small business program under section 8127 of this title.</text></paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H17E74A622D704C98B716EC628F5313CF"><enum>(2)</enum><header>Clerical amendments</header><text>The tables of chapters at the beginning of title 38, United States Code, and of part V of title 38, United States Code, are each amended by inserting after the item relating to chapter 79 the following new item:</text><quoted-block display-inline="no-display-inline" id="H29A3045A032742D197FC09EE5F473AF1" style="USC"><toc><multi-column-toc-entry bold="on" level="section"><toc-enum>80. </toc-enum><level-header level="section">Veterans Economic Opportunity Administration</level-header><target>8001</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H198E7F39417C4366A6FB7FA23C536830"><enum>(b)</enum><header>Effective date</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/80">Chapter 80</external-xref> of title 38, United States Code, as added by subsection (a) shall take effect on October 1, 2014.</text></subsection></section><section id="H1422B411690E40D181B900990D850BA5"><enum>5.</enum><header>Under Secretary for Veterans Economic Opportunity</header><subsection id="H4052FF04486E4D5782B2E85536E2D48F"><enum>(a)</enum><header>Under Secretary</header><paragraph id="H95D0D3FCED954EE491EF7A8AD824518A"><enum>(1)</enum><header>In general</header><text>Chapter 3 is amended by inserting after section 306 the following new section:</text><quoted-block display-inline="no-display-inline" id="H1A50275404C44A18927CA99544B89DD6" style="USC"><section id="H02EFFCEA7AE7499CB01FB206B39C75DA"><enum>306A.</enum><header>Under Secretary for Veterans Economic Opportunity</header><subsection id="H2537B96841504AF19011CCD12C1649C0"><enum>(a)</enum><header>Under Secretary</header><text display-inline="yes-display-inline">There is in the Department an Under Secretary for Veterans Economic Opportunity, who is appointed by the President, by and with the advice and consent of the Senate. The Under Secretary for Veterans Economic Opportunity shall be appointed without regard to political affiliation or activity and solely on the basis of demonstrated ability in—</text><paragraph id="HE37660A1B68E4C90BACF280E17AA5E72"><enum>(1)</enum><text>information technology; and</text></paragraph><paragraph id="H8A9D122953F543A896D260A6E3F005E5"><enum>(2)</enum><text>the administration of programs within the Veterans Economic Opportunity Administration or programs of similar content and scope.</text></paragraph></subsection><subsection id="HB434E594C9AD4424BA6EA88B3099FAC4"><enum>(b)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The Under Secretary for Veterans Economic Opportunity is the head of, and is directly responsible to the Secretary for the operations of, the Veterans Economic Opportunity Administration.</text></subsection><subsection id="HDDB4335609E34C7EA93EC9891190C199"><enum>(c)</enum><header>Vacancies</header><paragraph commented="no" display-inline="yes-display-inline" id="H0074361B49214BECA394B79BD50CCB11"><enum>(1)</enum><text>Whenever a vacancy in the position of Under Secretary for Veterans Economic Opportunity occurs or is anticipated, the Secretary shall establish a commission to recommend individuals to the President for appointment to the position.</text></paragraph><paragraph id="H7A047EB4E201478BBF3DDD4AD09CA1F1" indent="up1"><enum>(2)</enum><text>A commission established under this subsection shall be composed of the following members appointed by the Secretary:</text><subparagraph id="H5FFD16C6D6644D23930495111BB9DCDB"><enum>(A)</enum><text display-inline="yes-display-inline">Three persons representing education and training, vocational rehabilitation, employment, real estate, mortgage finance and related industries, and survivor benefits activities affected by the Veterans Economic Opportunity Administration.</text></subparagraph><subparagraph id="H417B0E51025A403B84CC11EBE79EEA8B"><enum>(B)</enum><text>Two persons representing veterans served by the Veterans Economic Opportunity Administration.</text></subparagraph><subparagraph id="HAAFC6CFCFBF3464EB4B8D7A6A2A72C88"><enum>(C)</enum><text>Two persons who have experience in the management of private sector benefits programs of similar content and scope to the economic opportunity programs of the Department.</text></subparagraph><subparagraph id="HB85737D87AE04601BBA9D6A3A079AC15"><enum>(D)</enum><text>The Deputy Secretary of Veterans Affairs.</text></subparagraph><subparagraph commented="no" id="HDE0557731D3444FAAFEAFC6963040B67"><enum>(E)</enum><text>The chairman of the Veterans’ Advisory Committee on Education formed under section 3692 of this title.</text></subparagraph><subparagraph id="HC29D5F519F734C6AA4DFD43C2CE9C2B1"><enum>(F)</enum><text display-inline="yes-display-inline">One person who has held the position of Under Secretary for Veterans Economic Opportunity, if the Secretary determines that it is desirable for such person to be a member of the commission.</text></subparagraph></paragraph><paragraph id="H6C240938321D44DDA84CCC5FB65E145E" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">A commission established under this subsection shall recommend at least three individuals for appointment to the position of Under Secretary for Veterans Economic Opportunity. The commission shall submit all recommendations to the Secretary. The Secretary shall forward the recommendations to the President and the Committees on Veterans’ Affairs of the Senate and House of Representatives with any comments the Secretary considers appropriate. Thereafter, the President may request the commission to recommend additional individuals for appointment.</text></paragraph><paragraph id="H76A89F56E452405FBD86E5341E81E1CB" indent="up1"><enum>(4)</enum><text>The Assistant Secretary or Deputy Assistant Secretary of Veterans Affairs who performs personnel management and labor relations functions shall serve as the executive secretary of a commission established under this subsection.</text></paragraph></subsection><subsection id="HD8FCCD89E0D54D03842BADAEABB66374"><enum>(d)</enum><header>Qualifications of recommended individuals</header><text>Each individual recommended to the President by the commission for appointment to the position of Under Secretary for Veterans Economic Opportunity shall be an individual who has held a senior level position in the private sector with responsibilities relating to at least one of the following:</text><paragraph id="HD306FC0484D24BC89CEC90244BE7CAD7"><enum>(1)</enum><text>Education policy.</text></paragraph><paragraph id="HD77BFDF6385746DC8B1E10F4F8672832"><enum>(2)</enum><text>Vocational rehabilitation.</text></paragraph><paragraph id="HAEB52001FB58423BA0A96C34579051CE"><enum>(3)</enum><text>Employment.</text></paragraph><paragraph id="HAEE26796A7B04667A9C2584C70B618FB"><enum>(4)</enum><text>Home loan finance.</text></paragraph><paragraph id="HEFEE7ABFA85F42F2BE0DF8F31B1F86D6"><enum>(5)</enum><text>Small business development.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H6DE8E1565D7F4922A158862D6DA80482"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 306 the following new item:</text><quoted-block display-inline="no-display-inline" id="H06CE1E9E19DD483BB1AD65613C87D8B2" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">306A. id="H9E90C9FE16A54626B485F33D8D859961"><enum>(b)</enum><header>Conforming amendments</header><text>Title 38, United States Code, is further amended—</text><paragraph id="H724D3062761A45969641383038248BD8"><enum>(1)</enum><text>in section 306(c)(2), by striking subparagraphs (A) and (E) and redesignating subparagraphs (B), (C), (D), and (F), as subparagraphs (A) through (D), respectively;</text></paragraph><paragraph id="HA33122BEC66A4E26B8606513C77A77B1"><enum>(2)</enum><text>in section 317(d), by inserting after <quote>Under Secretary for Benefits,</quote> the following: <quote>the Under Secretary for Veterans Economic Opportunity,</quote>;</text></paragraph><paragraph id="HBB37C6D11BD34F75B942B6BFA33C5317"><enum>(3)</enum><text display-inline="yes-display-inline">in section 318(d)(2), by inserting after <quote>Under Secretary for Benefits,</quote> the following: <quote>the Under Secretary for Veterans Economic Opportunity,</quote>;</text></paragraph><paragraph id="HBFCE004ACBCA4BD4B71109F494597866"><enum>(4)</enum><text>in section 516(e)(2)(C), by striking <quote>Health and the Under Secretary for Benefits</quote> and inserting <quote>Health, the Under Secretary for Benefits, and the Under Secretary for Veterans Economic Opportunity</quote>;</text></paragraph><paragraph id="HECAD1CADF6A74E0EBB53786F82544F39"><enum>(5)</enum><text display-inline="yes-display-inline">in section 541(a)(2)(B), by striking <quote>Health and the Under Secretary for Benefits</quote> and inserting <quote>Health, the Under Secretary for Benefits, and the Under Secretary for Veterans Economic Opportunity</quote>;</text></paragraph><paragraph id="HB7EE6EE2D49F4671B5EB08A736785963"><enum>(6)</enum><text display-inline="yes-display-inline">in section 542(a)(2)(B)(iii), by striking <quote>Health and the Under Secretary for Benefits</quote> <quote>assistance</quote> the following: <quote>, other than assistance related to economic opportunity,</quote>; and</text></paragraph><paragraph id="H1922F7A1CEA54B428706AF173B0E9F68"><enum>(10)</enum><text>in section 7703, by striking paragraphs (2) and (3) and redesignating paragraphs (4) and (5) as paragraphs (2) and (3), respectively.</text></paragraph></subsection><subsection id="HA32654D05C7F42A8813DD74BC3B3D781"><enum>(c)</enum><header>Full-Time employees</header><text display-inline="yes-display-inline">For fiscal years 2014 and 2015, the aggregate number of full-time equivalent employees authorized for the Veterans Benefit Administration and the Veterans Economic Opportunity Administration, as established under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/80">chapter 80</external-xref> of title 38, United States Code, as added by section 2, may not exceed 20,851.</text></subsection><subsection id="HC6CA4159C581453CBB192790A8904072"><enum>(d)</enum><header>Effective date</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/306A">Section 306A</external-xref> of title 38, United States Code, as added by subsection (a), and the amendments made by this section, shall take effect on October 1, 2014.</text></subsection></section><section id="HCA2490993BB847E5BE1B871EDC04D228" section-type="subsequent-section"><enum>6.</enum><header>Five-year extension of homeless veterans reintegration programs</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/2021">Section 2021(e)(F)</external-xref> of title 38, United States Code, is amended by striking <quote>2013</quote> and inserting <quote>2018</quote>.</text></section><section id="H0E5AEBC315B44F11A174B25FF9FCE6D7"><enum>7.</enum><header>Entitlement of children of certain deceased veterans to educational assistance under the Post-9/11 Educational Assistance Program of the Department of Veterans Affairs</header><subsection id="HCDACDBB8E5ED4292A2E6315527F7248F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3311(b)(9) is amended—</text><paragraph id="H66D6EBE2FC8B4A57B46463E306219BDE"><enum>(1)</enum><text>by striking <quote>2001, dies in line of duty while serving on active duty as a member of the Armed Forces.</quote> and inserting <quote>2001—</quote>; and</text></paragraph><paragraph id="HB35A1E56D6FB4774BBB35551CF30B01F"><enum>(2)</enum><text>by adding at the end the following new subparagraphs:</text><quoted-block display-inline="no-display-inline" id="HF7DF8A1CF9F0450AAE41CA310CD897A8" style="USC"><subparagraph id="H086AF8CA65A74309A5BA28797F6B1B51"><enum>(A)</enum><text display-inline="yes-display-inline">dies in line of duty while serving on active duty as a member of the Armed Forces; or</text></subparagraph><subparagraph id="HD103DEAAD695479898915A2A500AA771"><enum>(B)</enum><text>is awarded the Purple Heart for an injury and dies as a result of that injury during the 31-day period beginning on the date of the person’s discharge or release from active duty service in the Armed Forces.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA84DB61C5D8543748E895A1A52BE212E"><enum>(b)</enum><header>Applicability</header><text>The amendments made by subsection (a) shall apply with respect to a person who dies on or after September 11, 2001.</text></subsection><subsection id="HB71AE57C91AD4203AA1C5497606DACDD"><enum>(c)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on October 1, 2014, and apply to payments of educational assistance for programs of education pursued after that date.</text></subsection></section><section id="H9EE37B0D21E24B62AECA5D157A259145" section-type="subsequent-section"><enum>8.</enum><header>Recodification and improvement of election process for Post-9/11 Educational Assistance Program</header><subsection id="HA0296CC5909142889FFE040442BA68F0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter III of chapter 33 is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="H55199879B10248EAA72A388E2D8E672E" style="USC"><section id="H27DD518EEDCD4F0881C1F793DC8ABE3E"><enum>3326.</enum><header>Election to receive educational assistance</header><subsection id="H0B7638888B6A48F985975FC72DE526D7"><enum>(a)</enum><header>Individuals eligible To elect participation in post-9/11 educational assistance</header><text>An individual may elect to receive educational assistance under this chapter if such individual—</text><paragraph id="H08086A6823EF49578FD0D782C884328B"><enum>(1)</enum><text>as of August 1, 2009—</text><subparagraph id="H3EA89C4631714D95B202BFB2644A5CFF"><enum>(A)</enum><text>is entitled to basic educational assistance under chapter 30 of the title and has used, but retains unused, entitlement under that chapter;</text></subparagraph><subparagraph id="HD32CF826FC7D49118389ECAE1928BE17"><enum>(B)</enum><text>is entitled to educational assistance under chapter 107, 1606, or 1607 of title 10 and has used, but retains unused, entitlement under the applicable chapter;</text></subparagraph><subparagraph id="H46C517AF9D484274832BE65ED679D0E9"><enum>(C)</enum><text>is entitled to basic educational assistance under chapter 30 of this title but has not used any entitlement under that chapter;</text></subparagraph><subparagraph id="H3110D07BF5D448F8BF2A3DD4FB39CC4D"><enum>(D)</enum><text>is entitled to educational assistance under chapter 107, 1606, or 1607 of title 10 but has not used any entitlement under such chapter;</text></subparagraph><subparagraph id="H14AA4D14F69047548C192F1C29F2278C"><enum>(E)</enum><text>is a member of the Armed Forces who is eligible for receipt of basic educational assistance under chapter 30 this title and is making contributions toward such assistance under section 3011(b) or 3012(c) of this title; or</text></subparagraph><subparagraph id="HFE7A2401EB0C48CE8B62CF9C753F37BC"><enum>(F)</enum><text>is a member of the Armed Forces who is not entitled to basic educational assistance under chapter 30 of this title by reason of an election under section 3011(c)(1) or 3012(d)(1) of this title; and</text></subparagraph></paragraph><paragraph id="HA6D2176270064EA998161F4DAE8D023A"><enum>(2)</enum><text>as of the date of the individual’s election under this paragraph, meets the requirements for entitlement to educational assistance under this chapter.</text></paragraph></subsection><subsection id="HD931653DDD8E480181752AD781970D07"><enum>(b)</enum><header>Cessation of contributions toward GI bill</header><text>Effective as of the first month beginning on or after the date of an election under subsection (a) of an individual described by paragraph (1)(E) of that subsection, the obligation of the individual to make contributions under section 3011(b) or 3012(c) of this title, as applicable, shall cease, and the requirements of such section shall be deemed to be no longer applicable to the individual.</text></subsection><subsection id="HE9287979A35E4D6D8F3D7EB96AC599E4"><enum>(c)</enum><header>Revocation of remaining transferred entitlement</header><paragraph id="H3908281AB0074C508D97A84927643AEF"><enum>(1)</enum><header>Election to revoke</header><text>If, on the date an individual described in paragraph (1)(A) or (1)(C) of subsection (a) makes an election under that subsection, a transfer of the entitlement of the individual to basic educational assistance under section 3020 of this title is in effect and a number of months of the entitlement so transferred remain unutilized, the individual may elect to revoke all or a portion of the entitlement so transferred that remains unutilized.</text></paragraph><paragraph id="H596C946E48094334B4316730BE112F62"><enum>(2)</enum><header>Availability of revoked entitlement</header><text>Any entitlement revoked by an individual under this paragraph shall no longer be available to the dependent to whom transferred, but shall be available to the individual instead for educational assistance under chapter 33 of this title in accordance with the provisions of this section.</text></paragraph><paragraph id="H513AA32B85FA4ABCB6ECD7FA29A07076"><enum>(3)</enum><header>Availability of unrevoked entitlement</header><text>Any entitlement described in paragraph (1) that is not revoked by an individual in accordance with that paragraph shall remain available to the dependent or dependents concerned in accordance with the current transfer of such entitlement under section 3020 of this title.</text></paragraph></subsection><subsection id="HA769AAA3C5FB453A8BC69BD8B7EDD34B"><enum>(d)</enum><header>Post-9/11 educational assistance</header><paragraph id="H81A73299D19A4B91AA5D29337D11B32B"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2) and except as provided in subsection (e), an individual making an election under subsection (a) shall be entitled to educational assistance under this chapter in accordance with the provisions of this chapter, instead of basic educational assistance under chapter 30 this title, or educational assistance under chapter 107, 1606, or 1607 of title 10, as applicable.</text></paragraph><paragraph id="H1D0EF3D61D8B40AA99078D9EC7696801"><enum>(2)</enum><header>Limitation on entitlement for certain individuals</header><text>In the case of an individual making an election under subsection (a) who is described by paragraph (1)(A) of that subsection, the number of months of entitlement of the individual to educational assistance under this chapter 33 shall be the number of months equal to—</text><subparagraph id="H841CBFD7B4B54711ADC86795CF5CBEE4"><enum>(A)</enum><text>the number of months of unused entitlement of the individual under chapter 30 of this title, as of the date of the election, plus</text></subparagraph><subparagraph id="HA4D79CC92CC2472890A60675D4A36361"><enum>(B)</enum><text>the number of months, if any, of entitlement revoked by the individual under subsection (c)(1).</text></subparagraph></paragraph></subsection><subsection id="HE96295E9593E45A89A26513E9DF5BB96"><enum>(e)</enum><header>Continuing entitlement to educational assistance not available under 9/11 assistance program</header><paragraph id="HA8B5322587F3449880A07AE7EC654F92"><enum>(1)</enum><header>In general</header><text>In the event educational assistance to which an individual making an election under subsection (a) would be entitled under chapter 30 of this title, or chapter 107, 1606, or 1607 of title 10, as applicable, is not authorized to be available to the individual under the provisions of this chapter the individual shall remain entitled to such educational assistance in accordance with the provisions of the applicable chapter.</text></paragraph><paragraph id="H4029619E006D45A6B8F6E8EC76E184FE"><enum>(2)</enum><header>Charge for use of entitlement</header><text>The utilization by an individual of entitlement under paragraph (1) shall be chargeable against the entitlement of the individual to educational assistance under this chapter at the rate of one month of entitlement under this chapter for each month of entitlement utilized by the individual under paragraph (1) (as determined as if such entitlement were utilized under the provisions of chapter 30 of this title, or chapter 107, 1606, or 1607 of title 10, as applicable).</text></paragraph></subsection><subsection id="H4EDA1BBB1C93471F91550F26B7F5E8C4"><enum>(f)</enum><header>Additional post-9/11 assistance for members having made contributions toward GI bill</header><paragraph id="HCDAB86BE9B414F01B03C0245694FAAAE"><enum>(1)</enum><header>Additional assistance</header><text>In the case of an individual making an election under subsection (a) who is described by subparagraph (A), (C), or (E) of paragraph (1) of that subsection, the amount of educational assistance payable to the individual under this chapter 33 as a monthly stipend payable under paragraph (1)(B) of section 3313(c) of this title, or under paragraphs (2) through (7) of that section (as applicable), shall be the amount otherwise payable as a monthly stipend under the applicable paragraph increased by the amount equal to—</text><subparagraph id="HB210E3BBA43245AF9E74A2084ADE6773"><enum>(A)</enum><text>the total amount of contributions toward basic educational assistance made by the individual under section 3011(b) or 3012(c) of this title, as of the date of the election, multiplied by</text></subparagraph><subparagraph id="H0FA9656DA131476A990350F980BD9A89"><enum>(B)</enum><text>the fraction—</text><clause id="H650F8EC30F754AA4AE62134006453CFE"><enum>(i)</enum><text>the numerator of which is—</text><subclause id="H4F0CB7E398154B11BC8152B4D01DA4EE"><enum>(I)</enum><text display-inline="yes-display-inline">the number of months of entitlement to basic educational assistance under chapter 30 of this title remaining to the individual at the time of the election; plus</text></subclause><subclause id="HBDC66784F38740F8BE1567FEA4B7382F"><enum>(II)</enum><text>the number of months, if any, of entitlement under such chapter 30 revoked by the individual under subsection (c)(1); and</text></subclause></clause><clause id="HF5CF27DC89954E4C8F2BA6442182C0E8"><enum>(ii)</enum><text>the denominator of which is 36 months.</text></clause></subparagraph></paragraph><paragraph id="HEFC99A88C34D4320863369F07857959E"><enum>(2)</enum><header>Months of remaining entitlement for certain individuals</header><text display-inline="yes-display-inline">In the case of an individual covered by paragraph (1) who is described by subsection (a)(1)(E), the number of months of entitlement to basic educational assistance remaining to the individual for purposes of paragraph (1)(B)(i)(II) shall be 36 months.</text></paragraph><paragraph id="H367D12FEA10443F792081879679DB965"><enum>(3)</enum><header>Timing of payment</header><text>The amount payable with respect to an individual under paragraph (1) shall be paid to the individual together with the last payment of the monthly stipend payable to the individual under paragraph (1)(B) of section 3313(c) of this title, or under subsections (b) through (g) of that section (as applicable), before the exhaustion of the individual’s entitlement to educational assistance under this chapter.</text></paragraph></subsection><subsection id="HAEB2A2093226409CB68657C1068EF1B8"><enum>(g)</enum><header>Continuing entitlement to additional assistance for critical skills or speciality and additional service</header><text>An individual making an election under subsection (a)(1) who, at the time of the election, is entitled to increased educational assistance under section 3015(d) of this title, or <external-xref legal-doc="usc" parsable-cite="usc/10/16131">section 16131(i)</external-xref> of title 10, or supplemental educational assistance under subchapter III of chapter 30 of this title, shall remain entitled to such increased educational assistance or supplemental educational assistance in the utilization of entitlement to educational assistance under this chapter, in an amount equal to the quarter, semester, or term, as applicable, equivalent of the monthly amount of such increased educational assistance or supplemental educational assistance payable with respect to the individual at the time of the election.</text></subsection><subsection id="H7DF442AF6856460E861046135F73B063"><enum>(h)</enum><header>Alternative election by Secretary</header><paragraph id="H61EAC0C0C6EE40D4AB0442126CF835F0"><enum>(1)</enum><header>In general</header><text>In the case of an individual who, on or after October 1, 2014, submits to the Secretary an election under this section that the Secretary determines is clearly against the interests of the individual, the Secretary may make an alternative election on behalf of the individual that the Secretary determines is in the best interests of the individual.</text></paragraph><paragraph id="HFC336B010C55496BAE8BAE4AC324D334"><enum>(2)</enum><header>Notice</header><text display-inline="yes-display-inline">If the Secretary makes an election on behalf of an individual under this subsection, the Secretary shall notify the individual by not later than seven days after making such election and shall provide the individual with a 30-day period, beginning on the date of the individual’s receipt of such notice, during which the individual may modify or revoke the election made by the Secretary on the individual’s behalf. The Secretary shall include, as part of such notice, a clear statement of why the alternative election made by the Secretary is in the best interests of the individual as compared to the election submitted by the individual. The Secretary shall provide the notice required under this paragraph by electronic means whenever possible.</text></paragraph></subsection><subsection id="H646F8DCA726D414DB5E30227243E131F"><enum>(i)</enum><header>Irrevocability of elections</header><text>An election under subsection (a) or (c)(1) is irrevocable.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3C560A4DDFEC427ABC83A4FA5735C990"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text><quoted-block display-inline="no-display-inline" id="HCCCDE55FA4EB4CDB8E5803776E6DBD1A" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">3326. Election to receive educational assistance.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H21A2F127A5394F9C8A56C3BB47C213AA"><enum>(c)</enum><header>Conforming repeal</header><text display-inline="yes-display-inline">Subsection (c) of section 5003 of the Post-9/11 Veterans Educational Assistance Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/252">Public Law 110–252</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/3301">38 U.S.C. 3301</external-xref> note) is hereby repealed.</text></subsection></section><section id="H906554AF3A9B48C0A95D0BC0719FBC77" section-type="subsequent-section"><enum>9.</enum><header>Centralized reporting of veteran enrollment by certain groups, districts, and consortiums of educational institutions</header><subsection id="HB40014D1BF6A400AACDAFEA7BA46C2F7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3684(a) is amended—</text><paragraph id="H0D143190DD85425B9F3EFA0EC30E4CBE"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>32, 33,</quote> after <quote>31,</quote>; and</text></paragraph><paragraph id="H1999C5332CDE4D8AA644E326778B7E75"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HE2BED08A388844C893BAF1F2FB8AF3EB" style="USC"><paragraph display-inline="no-display-inline" id="H9567623006C04A369B17A1DA3D385254" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>educational institution</term> may include a group, district, or consortium of separately accredited educational institutions located in the same State that are organized in a manner that facilitates the centralized reporting of the enrollments in such group, district, or consortium of institutions.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H0C3E0BF73C164EF9B04FFCD588F695E3"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply with respect to reports submitted on or after the date of the enactment of this Act.</text></subsection></section><section id="HCB96BEA23C384CD2A7A8ABA61738E74A"><enum>10.</enum><header>Extension of loan guaranty fee for certain subsequent loans</header><subsection id="HE48BDE65047247F1AC4ED6E2DEADA6C5"><enum>(a)</enum><header>Extension</header><text>Section 3729(b)(2)(B) is amended—</text><paragraph id="H4B97872A5D6546BBBE3C4610279375C1"><enum>(1)</enum><text>in clause (i), by striking <quote>October 1, 2017</quote> and inserting <quote>October 1, 2018</quote>; and</text></paragraph><paragraph id="H9588E5181B3840F7A10FC1D1A8B03209"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>October 1, 2017</quote> and inserting <quote>October 1, 2018</quote>.</text></paragraph></subsection></section><section id="H7B73471A870B4D80900428987D7CB492" section-type="subsequent-section"><enum>11.</enum><header>Mortgage protection for members of the Armed Forces, surviving spouses, and certain veterans</header><subsection id="H0A4198D023994D45BCB8796257970DD4"><enum>(a)</enum><header>Members of the Armed Forces, surviving spouses, and certain disabled veterans</header><paragraph id="HC225AD6467A8434883F95F642D16E8BD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Title III of the Servicemembers Civil Relief Act (50 U.S.C. App. 501 et seq.) is amended by inserting after section 303 the following new section:</text><quoted-block display-inline="no-display-inline" id="H038F2B81E1BE4D0CAFCCDBAD5C6E1BE2" style="OLC"><section id="H8A563C244F904CBCA3236814F1FA5812"><enum>303A.</enum><header>Mortgages and trust deeds of certain servicemembers, surviving spouses, and disabled veterans</header><subsection id="HFC9477E939B743BEBFAC8DD2BB31ED14"><enum>(a)</enum><header>Mortgage as Security</header><text>This section applies only to an obligation on real or personal property owned by a covered individual that—</text><paragraph id="H7572857BE5474CFCB5A431FF6388C8D1"><enum>(1)</enum><text display-inline="yes-display-inline">originated at any time and for which the covered individual is still obligated; and</text></paragraph><paragraph id="H00F7F47020A64A7E8F657B1FA74662AE"><enum>(2)</enum><text>is secured by a mortgage, trust deed, or other security in the nature of a mortgage.</text></paragraph></subsection><subsection id="H7E977DDB40814E51BE50DC3EA8C63E35"><enum>(b)</enum><header>Stay of Proceedings</header><paragraph id="H6E82C9C786CC4E3DBFF883CDA68906EE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In accordance with subsection (d)(1), in a judicial action pending or in a nonjudicial action commenced during a covered time period to enforce an obligation described in subsection (a), a court—</text><subparagraph id="H12CA357F7C5949A88C9A1627A8385633"><enum>(A)</enum><text>may, after a hearing and on its own motion, stay the proceedings until the end of the covered time period; and</text></subparagraph><subparagraph id="H7F7FC651CE3B49C78157C6989B39865E"><enum>(B)</enum><text display-inline="yes-display-inline">shall, upon application by a covered individual, stay the proceedings until the end of the covered time period.</text></subparagraph></paragraph><paragraph id="H0C4FDD4EC9CE4F42AA1354513050D587"><enum>(2)</enum><header>Obligation to stop proceedings</header><text display-inline="yes-display-inline">Upon receipt of notice provided under subsection (d)(1), a mortgagee, trustee, or other creditor seeking to foreclose on real property secured by an obligation covered by this section using any judicial or nonjudicial proceedings shall immediately stop any such proceeding until the end of the covered time period.</text></paragraph></subsection><subsection id="H86097744D5CC42A392E25EA4F548E1BA"><enum>(c)</enum><header>Sale or Foreclosure</header><text display-inline="yes-display-inline">A sale, judicial or nonjudicial foreclosure, or seizure of property for a breach of an obligation described in subsection (a) that is not stayed under subsection (b) shall not be valid during a covered time period except—</text><paragraph id="H8F754820B0A3429BBDF40811C41A008B"><enum>(1)</enum><text>upon a court order granted before such sale, judicial or nonjudicial foreclosure, or seizure with a return made and approved by the court; or</text></paragraph><paragraph id="H6F44CDBB21B5494EA0910270B61628E3"><enum>(2)</enum><text>if made pursuant to an agreement as provided in section 107.</text></paragraph></subsection><subsection commented="no" id="HC74A29ED73E047708963C863176CEC65"><enum>(d)</enum><header>Notice required</header><paragraph commented="no" id="H1AC681EEC09C40AC9F7386A3739A2B42"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To be covered under this section, a covered individual shall provide to the mortgagee, trustee, or other creditor written notice that such individual is so covered.</text></paragraph><paragraph commented="no" id="H4FF91C0EF22E4C36B414D734E39C518A"><enum>(2)</enum><header>Manner</header><text display-inline="yes-display-inline">Written notice under paragraph (1) may be provided electronically.</text></paragraph><paragraph id="H518447E7F38D471EB98812A0B42DF44A"><enum>(3)</enum><header>Time</header><text>Notice provided under paragraph (1) shall be provided during the covered time period.</text></paragraph><paragraph id="H06AECDE35D3940FC9C668BB35B5B1C9F"><enum>(4)</enum><header>Contents</header><text display-inline="yes-display-inline">With respect to a servicemember described in subsection (g)(1)(A), notice shall include—</text><subparagraph id="HACC035F1827C4462A20B4AC049BB8DD3"><enum>(A)</enum><text display-inline="yes-display-inline">a copy of the servicemember’s official military orders, or any notification, certification, or verification from a servicemember's commanding officer that provides evidence of servicemember's eligibility for special pay as described in subsection (g)(1)(A); or</text></subparagraph><subparagraph id="H50EAB70CF7AB42F5A056D32412B88A87"><enum>(B)</enum><text display-inline="yes-display-inline">an official notice using a form designed under paragraph (5).</text></subparagraph></paragraph><paragraph id="H018F966006F04C3E8AE7DAB017B53CFD"><enum>(5)</enum><header>Official forms</header><subparagraph id="HD62A8C952F1E46EF8E2CCF4000EC3214"><enum>(A)</enum><header>In general</header><text>The Secretary of Defense shall design and distribute an official Department of Defense form that can be used by an individual to give notice under paragraph (1).</text></subparagraph><subparagraph id="HAA7ADD776E1648E09CFB48FCD9FE29CF"><enum>(B)</enum><header>Use of official form not required</header><text>Failure by any individual to use a form designed or distributed under subparagraph (A) to provide notice shall not make such provision of notice invalid.</text></subparagraph></paragraph></subsection><subsection id="HFF6058CB8580499A939DEAE48DE1C6A4"><enum>(e)</enum><header>Aggregate duration</header><text display-inline="yes-display-inline">The aggregate duration for which a covered individual (except a servicemember described in subsection (g)(1)(A)) may be covered under this section is one year.</text></subsection><subsection display-inline="no-display-inline" id="HD9E21BDFCDFC43879AFB96C6E0E7959A"><enum>(f)</enum><header>Misdemeanor</header><text>A person who knowingly makes or causes to be made a sale, foreclosure, or seizure of property that is prohibited by subsection (c), or who knowingly attempts to do so, shall be fined as provided in title 18, United States Code, or imprisoned for not more than one year, or both.</text></subsection><subsection id="H433946E8185C454F81AEA07B411A0516"><enum>(g)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HB4DA460AEDD640F9B559348B989E2F5C"><enum>(1)</enum><header>Covered individual</header><text>The term <term>covered individual</term> means the following individuals:</text><subparagraph id="HFF3CA965D0AF451BB326A4447666C426"><enum>(A)</enum><text>A servicemember who is or was eligible for hostile fire or imminent danger special pay under <external-xref legal-doc="usc" parsable-cite="usc/37/310">section 310</external-xref> of title 37, United States Code, during a period of military service.</text></subparagraph><subparagraph id="H1343019133F6409988B900A27087B5CE"><enum>(B)</enum><text display-inline="yes-display-inline">A servicemember placed on convalescent status, including a servicemember transferred to the temporary disability retired list under section <external-xref legal-doc="usc" parsable-cite="usc/10/1202">1202</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/10/1205">1205</external-xref> of title 10, United States Code.</text></subparagraph><subparagraph id="H262CF85AEC2644C39DBD4DD4DABD329E"><enum>(C)</enum><text display-inline="yes-display-inline">A veteran who was medically discharged and retired under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/61">chapter 61</external-xref> of title 10, United States Code, except for a veteran described in section 1207 of such title.</text></subparagraph><subparagraph id="H74330A4BF5834D4FA95BC94442CE27F3"><enum>(D)</enum><text display-inline="yes-display-inline">A surviving spouse (as defined in <external-xref legal-doc="usc" parsable-cite="usc/38/101">section 101(3)</external-xref> of title 38, United States Code, and in accordance with section 103 of such title) of a servicemember who died while in military service if such spouse is the successor in interest to property covered under subsection (a).</text></subparagraph></paragraph><paragraph id="H5EBF888456FF4E219C4673B0A35FE736"><enum>(2)</enum><header>Covered time period</header><text>The term <term>covered time period</term> means the following time periods:</text><subparagraph id="H016364840DD84ABC924B749357DEB797"><enum>(A)</enum><text>With respect to a servicemember who is or was eligible for hostile fire or imminent danger special pay under <external-xref legal-doc="usc" parsable-cite="usc/37/310">section 310</external-xref> of title 37, United States Code, during a period of military service, during the period beginning on the first day on which the servicemember is or was eligible for such special pay during such period of military service and ending on the date that is one year after the last day of such period of military service.</text></subparagraph><subparagraph id="HD6B7BC07FB1C4E04913E4712E96B6D22"><enum>(B)</enum><text display-inline="yes-display-inline">With respect to a servicemember described in paragraph (1)(B), during the one-year period beginning on the date on which the servicemember is placed on convalescent status or transferred to the temporary disability retired list under section <external-xref legal-doc="usc" parsable-cite="usc/10/1202">1202</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/10/1205">1205</external-xref> of title 10, United States Code.</text></subparagraph><subparagraph commented="no" id="HA27EB8618E904F2DBA19CBDDBFB3629E"><enum>(C)</enum><text display-inline="yes-display-inline">With respect to a veteran described in paragraph (1)(C), during the one-year period beginning on the date of the retirement of such veteran.</text></subparagraph><subparagraph commented="no" id="H15F9D63EBB5443049EB543C85AA755B0"><enum>(D)</enum><text display-inline="yes-display-inline">With respect to a surviving spouse of a servicemember as described in paragraph (1)(D), during the one-year period beginning on the date on which the spouse receives notice of the death of the servicemember.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H84EBC6147A1D4B55B9DDC39453613E10"><enum>(2)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of such Act is amended by inserting after the item relating to section 303 the following new item:</text><quoted-block display-inline="no-display-inline" id="H16B57B17AF614D8AB2D901EC95752078" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 303A. Mortgages and trust deeds of certain servicemembers, surviving spouses, and disabled veterans.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H4FD38D5F0DD9450F9432542F44085D98"><enum>(3)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 107 of the Servicemembers Civil Relief Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/517">50 U.S.C. App. 517</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H0E49358BBC414445914B60DB8E439240" style="OLC"><subsection id="HF0F9CB4DE24A4BBEBDA1BC59A1411EB1"><enum>(e)</enum><header>Other individuals</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>servicemember</term> includes any covered individual under section 303A.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H2684ABC63C024D0D8C272E32D9B4F8BD"><enum>(b)</enum><header>Increased civil penalties for mortgage violations</header><text display-inline="yes-display-inline">Paragraph (3) of section 801(b) of the Servicemembers Civil Relief Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/597">50 U.S.C. App. 597(b)(3)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H02A5805DC6AF4D959F9ECE70BDD0FDCF" style="OLC"><paragraph id="H16224D5235194229B6F396BE003333C9"><enum>(3)</enum><text>to vindicate the public interest, assess a civil penalty—</text><subparagraph id="HFBCD3DBEAA574FB2B96CFC35EFCCF469"><enum>(A)</enum><text>with respect to a violation of section 207, 303, or 303A regarding real property—</text><clause id="H0EB004D3F88344D5903424EC43E60959"><enum>(i)</enum><text>in an amount not exceeding $110,000 for a first violation; and</text></clause><clause id="H69267AF28CE349448E3D0B6C9250AE2F"><enum>(ii)</enum><text>in an amount not exceeding $220,000 for any subsequent violation; and</text></clause></subparagraph><subparagraph id="H45CB7300904B4998B7ECC53353F777B2"><enum>(B)</enum><text>with respect to any other violation of this Act—</text><clause id="H493E4E1FFDD84554955186F8DA634F8A"><enum>(i)</enum><text>in an amount not exceeding $55,000 for a first violation; and</text></clause><clause id="H5C7D35234CF547E39F5A0AEAD22768BE"><enum>(ii)</enum><text>in an amount not exceeding $110,000 for any subsequent violation.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H705769110475447A9886B23E5D91265F"><enum>(c)</enum><header>Credit discrimination</header><text display-inline="yes-display-inline">Section 108 of such Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/518">50 U.S.C. App. 518</external-xref>) is amended—</text><paragraph id="HD247DE74BA2044C0A2B17236DF59118C"><enum>(1)</enum><text>by striking <quote>Application by</quote> and inserting <quote>(a) <header-in-text level="subsection" style="OLC">Application or receipt</header-in-text>.—Application by</quote>; and</text></paragraph><paragraph id="H7972BAFB76E946CCA0ABFFE758E8FA22"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HC97668E663A24821839A471EBBCC917F" style="OLC"><subsection id="H3B8A104288914A848F93DFF877BE0427"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">In addition to the protections under subsection (a), an individual who is entitled to any right or protection provided under this Act may not be denied or refused credit or be subject to any other action described under paragraphs (1) through (6) of subsection (a) solely by reason of such entitlement.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF552BF46652F4CB1BA7B42AC344CEA30"><enum>(d)</enum><header>Effective date</header><text>Section 303A of the Servicemembers Civil Relief Act, as added by subsection (a), and the amendments made by this section, shall take effect on October 1, 2014.</text></subsection></section><section id="HC7E7176B7C034A8EAC0497FE137FA730"><enum>12.</enum><header>Treatment of relocation for active duty for purposes of mortgage refinancing</header><subsection id="HA2FE52BEA6F4495194EB502E5B2C21FE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title III of the Servicemembers Civil Relief Act (50 U.S.C. App. 531 et seq.) is amended by inserting after section 303A, as added by section 11(a)(1), the following new section:</text><quoted-block display-inline="no-display-inline" id="HE066E330289F4D9DB2BC66E5CFA83782" style="OLC"><section id="H0AB54715E7A646CAA171A31FED16D22A"><enum>303B.</enum><header>Treatment of relocation for active duty for purposes of mortgage refinancing</header><subsection id="H7CDEA6A1D99B4779B0263501B4EF571B"><enum>(a)</enum><header>Treatment of absence from residence due to active duty</header><paragraph id="HD8C72A0411164105A8A0C025391F9241"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), if, at any time that a servicemember who is the mortgagor under an existing mortgage does not reside in the residence that secures the existing mortgage because of relocation described in subsection (c)(1)(B), such servicemember inquires about or applies for a covered refinancing mortgage, such servicemember shall be, for all purposes relating to the covered refinancing mortgage, including such inquiry or application and eligibility for and compliance with any underwriting criteria and standards regarding such covered refinancing mortgage, considered to occupy the residence that secures the existing mortgage to be paid or prepaid by such covered refinancing mortgage as the principal residence of the servicemember during the period of any such relocation.</text></paragraph><paragraph id="H0A931832B81942F5927A4F9BA6D2EBB3"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply with respect to a servicemember at any time if, during the five-year period preceding such time, the servicemember entered into a covered refinancing mortgage pursuant to this section.</text></paragraph></subsection><subsection id="HE7F697FE1A744595B6C828F49B7A9175"><enum>(b)</enum><header>Mortgages originated before period military service</header><text display-inline="yes-display-inline">If a covered refinancing mortgage is entered into pursuant to this section with respect to an existing mortgage that originated before the period of the servicemember's military service, such covered refinancing mortgage shall be deemed to be an obligation that originated before the period of the servicemember's military service and for which the servicemember is still obligated for purposes of section 303(a)(1).</text></subsection><subsection id="HFA3EDFD8E52F4E09837C4140E3EB8B96"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H2FCA27035D3C491D982DEF8D4F3D4BBD"><enum>(1)</enum><header>Existing mortgage</header><text>The term <term>existing mortgage</term> means a mortgage that is secured by a 1- to 4-family residence, including a condominium or a share in a cooperative ownership housing association, that was the principal residence of a servicemember for a period that—</text><subparagraph id="HEDFC817AC5AE4C8F852581D8EB3DFD47"><enum>(A)</enum><text>had a duration of 13 consecutive months or longer; and</text></subparagraph><subparagraph id="H04098EFF11B148E6876D4A3DD081CDB7"><enum>(B)</enum><text display-inline="yes-display-inline">ended upon the relocation of the servicemember caused by the servicemember receiving military orders for a permanent change of station or to deploy with a military unit, or as an individual in support of a military operation, for a period of not less than 90 days that did not allow the servicemember to continue to occupy such residence as a principal residence.</text></subparagraph></paragraph><paragraph id="H51B5B36EA31E46888E7AC354DD49F716"><enum>(2)</enum><header>Covered refinancing mortgage</header><text>The term <term>covered refinancing mortgage</term> means any mortgage—</text><subparagraph id="H1D9C1FDFA2A544569C61B3881F0C2A0E"><enum>(A)</enum><text display-inline="yes-display-inline">that is made for the purpose of paying or prepaying, and extinguishing, the outstanding obligations under an existing mortgage or mortgages; and</text></subparagraph><subparagraph id="H5EC0C61E6EF34E9C8B183AA7F0278F4A"><enum>(B)</enum><text display-inline="yes-display-inline">that is secured by the same residence that secured such existing mortgage or mortgages.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6CBED0D59BD248A4B9BDDF0F487AC20C"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents for such Act is amended by inserting after the item relating to section 303A the following new item:</text><quoted-block display-inline="no-display-inline" id="HF9E1BD41A08E4962B441DD227A45AD55" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 303B. Treatment of relocation for active duty for purposes of mortgage refinancing.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB195ADF3176D4738892B49F72FAE67F5"><enum>(c)</enum><header>Effective date</header><text>Section 303B of the Servicemembers Civil Relief Act, as added by subsection (a), and the amendments made by this section, shall take effect on October 1, 2014.</text></subsection></section><section id="H2DF6F8D192674F2AB14B1F35FB70B45C"><enum>13.</enum><header>Requirements for lending institutions that are creditors for obligations and liabilities covered by the Servicemembers Civil Relief Act</header><text display-inline="no-display-inline">Section 207 of the Servicemembers Civil Relief Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/527">50 U.S.C. App. 527</external-xref>) is amended—</text><paragraph id="H0A5B2D15DF184F379A6F1491F4AF1E87"><enum>(1)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f), respectively; and</text></paragraph><paragraph id="HC50F819113CE4D4EB0205312949285D9"><enum>(2)</enum><text>by inserting after subsection (c) the following new subsection (d):</text><quoted-block display-inline="no-display-inline" id="HC94226BD8B3B4C3097EE86C1736F98DC" style="OLC"><subsection id="HA1EAEB7A6E8441A99DED48C5FBAB2C36"><enum>(d)</enum><header>Lending institution requirements</header><paragraph display-inline="no-display-inline" id="H0CB0033B025544349E972C4988234C7C"><enum>(1)</enum><header>Compliance officers</header><text>Each lending institution subject to the requirements of this section shall designate an employee of the institution as a compliance officer who is responsible for ensuring the institution’s compliance with this section and for distributing information to servicemembers whose obligations and liabilities are covered by this section.</text></paragraph><paragraph id="H4BB59B8B4F6648949291BBEB1C1E4636"><enum>(2)</enum><header>Toll-free telephone number</header><text>During any fiscal year, a lending institution subject to the requirements of this section that had annual assets for the preceding fiscal year of $10,000,000,000 or more shall maintain a toll-free telephone number and shall make such telephone number available on the primary Internet website of the institution.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H67FA5730C8CF45D6A44A40DFF4763948" section-type="subsequent-section"><enum>14.</enum><header>Protection of child custody arrangements for parents who are members of the Armed Forces</header><subsection id="HCB366F85A1934970A5AC6062F414749E"><enum>(a)</enum><header>Child custody protection</header><text>Title II of the Servicemembers Civil Relief Act (50 U.S.C. App. 521 et seq.) is amended by adding at the end the following new section:</text><quoted-block id="H0161C278BAB7431999D530E7046B634D" style="OLC"><section id="H92BAC78A662A4E21AFC396ABCEB4E7C1"><enum>208.</enum><header>Child custody protection</header><subsection id="HE2A8AC78DA0D4541AB3E896ED0B5C44E"><enum>(a)</enum><header>Restriction on temporary custody order</header><text display-inline="yes-display-inline">If a court renders a temporary order for custodial responsibility for a child based solely on a deployment or anticipated deployment of a parent who is a servicemember, then the court shall require that, upon the return of the servicemember from deployment, the custody order that was in effect immediately preceding the temporary order shall be reinstated, unless the court finds that such a reinstatement is not in the best interest of the child, except that any such finding shall be subject to subsection (b).</text></subsection><subsection display-inline="no-display-inline" id="HF7389EB4A0E14100A9D16FDC6637B181"><enum>(b)</enum><header>Limitation on consideration of member’s deployment in determination of Child’s Best Interest</header><text display-inline="yes-display-inline">If a motion or a petition is filed seeking a permanent order to modify the custody of the child of a servicemember, no court may consider the absence of the servicemember by reason of deployment, or the possibility of deployment, as the sole factor in determining the best interest of the child.</text></subsection><subsection display-inline="no-display-inline" id="H4B6CB2B8A1C24485A1C9FF1E122A3859"><enum>(c)</enum><header>No Federal jurisdiction or right of action or removal</header><text display-inline="yes-display-inline">Nothing in this section shall create a Federal right of action or otherwise give rise to Federal jurisdiction or create a right of removal.</text></subsection><subsection id="HC8C7C8A3896F48AD98CFEA8264A5AC81"><enum>(d)</enum><header>Preemption</header><text>In any case where State law applicable to a child custody proceeding involving a temporary order as contemplated in this section provides a higher standard of protection to the rights of the parent who is a deploying servicemember than the rights provided under this section with respect to such temporary order, the appropriate court shall apply the higher State standard.</text></subsection><subsection id="H0488AED70E89489A834FE772C5243ED8"><enum>(e)</enum><header>Deployment Defined</header><text>In this section, the term <term>deployment</term> means the movement or mobilization of a servicemember to a location for a period of longer than 60 days and not longer than 540 days pursuant to temporary or permanent official orders—</text><paragraph id="H205A804778424444BB52E4366F020932"><enum>(1)</enum><text>that are designated as unaccompanied;</text></paragraph><paragraph id="H2050FDA944D245A4894010303C3C52C6"><enum>(2)</enum><text>for which dependent travel is not authorized; or</text></paragraph><paragraph id="H538078AA98974061B5AC17B3DCA45BED"><enum>(3)</enum><text>that otherwise do not permit the movement of family members to that location.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H74A8E239666F4425900E1F5908D71800"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of such Act is amended by adding at the end of the items relating to title II the following new item:</text><quoted-block id="HF8DE3A15998141549349232EFA2009FA" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">208.
