purpose</header><subsection commented="no" display-inline="no-display-inline" id="H83AD40B36B9D49438FE6A2F358DA04C9"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds that—</text><paragraph commented="no" display-inline="no-display-inline" id="H296C6CAAF1A94AA68D8BDF5E031697CE"><enum>(1)</enum><text display-inline="yes-display-inline">the use of firearms and archery equipment for target practice and marksmanship training activities on Federal land is allowed, except to the extent specific portions of that land have been closed to those activities;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H485E96BF858D40AB952DA0BB47BA2A3A"><enum>(2)</enum><text display-inline="yes-display-inline">in recent years preceding the date of enactment of this Act, portions of Federal land have been closed to target practice and marksmanship training for many reasons;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H780D920A46CD4FAEBC1114DCDE0B9E75"><enum>(3)</enum><text display-inline="yes-display-inline">the availability of public target ranges on non-Federal land has been declining for a variety of reasons, including continued population growth and development near former ranges;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA53B20DF82A64BA0B33403FB870B6DA4"><enum>(4)</enum><text display-inline="yes-display-inline">providing opportunities for target practice and marksmanship training at public target ranges on Federal and non-Federal land can help—</text><subparagraph commented="no" display-inline="no-display-inline" id="H82C37F3901AF4BE98BC156BD7213DB20"><enum>(A)</enum><text display-inline="yes-display-inline">to promote enjoyment of shooting, recreational, and hunting activities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H87DA957B0C2043348F5FD19792D732FE"><enum>(B)</enum><text display-inline="yes-display-inline">to ensure safe and convenient locations for those activities;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H511C1C7AC1D74EE8B88EDD2A944A403A"><enum>(5)</enum><text display-inline="yes-display-inline">Federal law in effect on the date of enactment of this Act, including the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669">16 U.S.C. 669 et seq.</external-xref>), provides Federal support for construction and expansion of public target ranges by making available to States amounts that may be used for construction, operation, and maintenance of public target ranges; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H366AFFE6B8994A82831E111456292B2B"><enum>(6)</enum><text display-inline="yes-display-inline">it is in the public interest to provide increased Federal support to facilitate the construction or expansion of public target ranges.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7F84E7E24A4343A2969420816E8F1F7E"><enum>(b)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to facilitate the construction and expansion of public target ranges, including ranges on Federal land managed by the Forest Service and the Bureau of Land Management.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="H3F3D9159FAAA41DA8037DBB5CA2AD027" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definition of public target range</header><text display-inline="no-display-inline">In this Act, the term <term>public target range</term> means a specific location that—</text><paragraph commented="no" display-inline="no-display-inline" id="H20894FEEFBEC4496966A0A352359AB0C"><enum>(1)</enum><text display-inline="yes-display-inline">is identified by a governmental agency for recreational shooting;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCE8CBA39713A4C1084927A321B20EA54"><enum>(2)</enum><text display-inline="yes-display-inline">is open to the public;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1FFFBF9B97C9409897560F3FE4BBD8BF"><enum>(3)</enum><text display-inline="yes-display-inline">may be supervised; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFDDAFC74AB00463E8C8D51BBFC8FE52C"><enum>(4)</enum><text display-inline="yes-display-inline">may accommodate archery or rifle, pistol, or shotgun shooting.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="HF7BFF9E434BC44DE9F77E29CB34DECBE" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Amendments to Pittman-Robertson Wildlife Restoration Act</header><subsection commented="no" display-inline="no-display-inline" id="HD7A7D1639C86420797C3B5C10ADC2445"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">Section 2 of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669a">16 U.S.C. 669a</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H55081818332141EB9E9B8E5F6CBDAE12"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (2) through (8) as paragraphs (3) through (9), respectively; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H34889FB2D65F4C9288638FEC52552729"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the following:</text><quoted-block display-inline="no-display-inline" id="HF64259A11AD74D4B94FE94266CA497F4" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="H86607BA0D25E47E2A03894E50389F898"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>public target range</term> means a specific location that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H8E3DF8FFDDCA419E9241EFA2E39BAA64"><enum>(A)</enum><text display-inline="yes-display-inline">is identified by a governmental agency for recreational shooting;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9D4C078FA98B407B96F4C536EFFF4749"><enum>(B)</enum><text display-inline="yes-display-inline">is open to the public;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9943E46AB0FC4171BC361C1BE2F579DD"><enum>(C)</enum><text display-inline="yes-display-inline">may be supervised; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H18D1357BCF32419B899C6557F1D49282"><enum>(D)</enum><text display-inline="yes-display-inline">may accommodate archery or rifle, pistol, or shotgun shooting;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H65DA7C1153BA4A508D83441461ED8434"><enum>(b)</enum><header display-inline="yes-display-inline">Expenditures for management of wildlife areas and resources</header><text display-inline="yes-display-inline">Section 8(b) of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669g">16 U.S.C. 669g(b)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H9117EF4B5B9442A894CCCF38B9D54B97"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote><short-title>(b) Each State</short-title></quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HF5FC6BBA9DB7400C930D1AD7F6DFB204" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="HD5E77C0629584FACB4B4C27623054C34"><enum>(b)</enum><header display-inline="yes-display-inline">Expenditures for management of wildlife areas and resources</header><paragraph commented="no" display-inline="no-display-inline" id="H2C7C64A69845439CB9B3E8980BFF90D0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), each State</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9174A0FDB50D41FA91F0F266984AB7FC"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (1) (as so designated), by striking <quote><short-title>construction, operation,</short-title></quote> and inserting <quote><short-title>operation</short-title></quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H25F822F26D5A40788E797C9BA9684073"><enum>(3)</enum><text display-inline="yes-display-inline">in the second sentence, by striking <quote><short-title>The non-Federal share</short-title></quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HC970AAEB8A0E4CD38853674CE76C6735" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="HB1B81A26224A428E95BF57DCF26B3F11"><enum>(3)</enum><header display-inline="yes-display-inline">Non-Federal share</header><text display-inline="yes-display-inline">The non-Federal share</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5E761DCA5B794316A46BBD85C27F4541"><enum>(4)</enum><text display-inline="yes-display-inline">in the third sentence, by striking <quote><short-title>The Secretary</short-title></quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H05592E9E66324C5B90E1135DF53FD3BB" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="H0D94DDF3F7D8424A8E82BE3AA59AD362"><enum>(4)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Secretary</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA944263B21764F239152609FE6B451EB"><enum>(5)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) (as designated by paragraph (1) of this subsection) the following:</text><quoted-block display-inline="no-display-inline" id="H5FBAEC7202FD4A53AC5509DFF9CE4A76" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="H9641D78E32C34444879198E0CA7517BE"><enum>(2)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">Notwithstanding the limitation described in paragraph (1), a State may pay up to 90 percent of the cost of acquiring land for, expanding, or constructing a public target range.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HBA718B3E85174A1683B48A569E62F405"><enum>(c)</enum><header display-inline="yes-display-inline">Firearm and bow hunter education and safety program grants</header><text display-inline="yes-display-inline">Section 10 of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669h-1">16 U.S.C. 669h–1</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H14685261D1DD404BA419EC28DD6C9EA7"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HFF9056051B0D4827AFA400B25390B185" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="HCBDE646681B441D882845F25A8421345"><enum>(3)</enum><header display-inline="yes-display-inline">Allocation of additional amounts</header><text display-inline="yes-display-inline">Of the amount apportioned to a State for any fiscal year under section 4(b), the State may elect to allocate not more than 10 percent, to be combined with the amount apportioned to the State under paragraph (1) for that fiscal year, for acquiring land for, expanding, or constructing a public target range.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDCA6B38882C54ADB920C6B2E468F27BE"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (b) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H6D2682A09B33410ABF9C1EF202407C7B" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H3CD272B1BEC54C9B9BF9203E31C91352"><enum>(b)</enum><header display-inline="yes-display-inline">Cost sharing</header><paragraph commented="no" display-inline="no-display-inline" id="H461734A83A494123B5BDC8AD469922BD"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the Federal share of the cost of any activity carried out using a grant under this section shall not exceed 75 percent of the total cost of the activity.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9E61F56C4EBF4513A401BE97C0DE5280"><enum>(2)</enum><header display-inline="yes-display-inline">Public target range construction or expansion</header><text display-inline="yes-display-inline">The Federal share of the cost of acquiring land for, expanding, or constructing a public target range in a State on Federal or non-Federal land pursuant to this section or section 8(b) shall not exceed 90 percent of the cost of the activity.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H364A0EBE5D4C413CBD4317EE3605165C"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (c)(1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="HEE1D01F3B5064C19A81DA9D5C5844998"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote><short-title>Amounts made</short-title></quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H1B8E0DEEE7C04415BB4AE7761C203EA2" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="HB77A93DA80DE42728B22DC7A6FBE06BB"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), amounts made</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H91774A8063DD481293D86E655C7071C3"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HCE1BF985DAFB44799C5B13F3C3381D69" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="H477BA7657AFD45DBB3AE2D7ACDD70B8B"><enum>(B)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">Amounts provided for acquiring land for, constructing, or expanding a public target range shall remain available for expenditure and obligation during the 5-fiscal-year period beginning on October 1 of the first fiscal year for which the amounts are made available.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HDB312F71B41F44349EBA603A02C17DD3" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Limits on liability</header><subsection commented="no" display-inline="no-display-inline" id="H31D159FD910D4355A6988178FFA4989A"><enum>(a)</enum><header display-inline="yes-display-inline">Discretionary function</header><text display-inline="yes-display-inline">For purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code (commonly referred to as the <quote><short-title>Federal Tort Claims Act</short-title></quote>), any action by an agent or employee of the United States to manage or allow the use of Federal land for purposes of target practice or marksmanship training by a member of the public shall be considered to be the exercise or performance of a discretionary function.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H841FDF24FA61499F90FEED67F84C69CD"><enum>(b)</enum><header display-inline="yes-display-inline">Civil action or claims</header><text display-inline="yes-display-inline">Except to the extent provided in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code, the United States shall not be subject to any civil action or claim for money damages for any injury to or loss of property, personal injury, or death caused by an activity occurring at a public target range that is—</text><paragraph commented="no" display-inline="no-display-inline" id="HC02191A1A8FD45F9BB95E08282C5ED8B"><enum>(1)</enum><text display-inline="yes-display-inline">funded in whole or in part by the Federal Government pursuant to the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669">16 U.S.C. 669 et seq.</external-xref>); or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H262D0F52211549A196B1AC36CB061B5E"><enum>(2)</enum><text display-inline="yes-display-inline">located on Federal land.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HEEA9035BBC304543B8F071FBA7561A6B" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Sense of Congress regarding cooperation</header><text display-inline="no-display-inline">It is the sense of Congress that, consistent with applicable laws and regulations, the Chief of the Forest Service and the Director of the Bureau of Land Management should cooperate with State and local authorities and other entities to carry out waste removal and other activities on any Federal land used as a public target range to encourage continued use of that land for target practice or marksmanship training.</text></section></legis-body><endorsement display="yes"><action-date date="20131022">October 22, 2013</action-date><action-desc>Reported from the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc><action-date date="20131022">October 22, 2013</action-date><action-desc>The <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name> discharged;
