		<official-title>To amend title 18, United States Code, to provide for
		  clarification as to the meaning of access without authorization, and for other
		  purposes.</official-title>

		<section id="H7D6D494FF185449E825799CF5C540DB4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Aaron’s Law Act of
			 2013</short-title></quote>.</text>
		</section><section id="H1870DA7BCEAD4FB1AD002544A24141BA"><enum>2.</enum><header>Clarifying that
			 <quote>access without authorization</quote> under 18 U.S.C. 1030 means
			 circumvention of technological barriers in order to gain unauthorized
			 access</header>
			<subsection id="HB7D26C329E64451FAFFAC45E3E05B914"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1030(e)(6) of
			 title 18, United States Code, is amended by—</text>
				<paragraph id="HF28B093F510C4E64B9864CB9F90EF0CA"><enum>(1)</enum><text>striking
			 <quote>exceeds authorized access</quote> and all that follows; and</text>
				</paragraph><paragraph id="H6A2022700CB045839A445622CA8A58E0"><enum>(2)</enum><text>inserting the
			 following:</text>
					<quoted-block display-inline="yes-display-inline" id="H1C9CE377CAE641B4BEC90E0D01273DA9" style="OLC">
						<text><quote>access without
			 authorization</quote> means—</text><subparagraph id="HD9410C8779F04BC0B12CA9DDABA59550"><enum>(A)</enum><text>to obtain
				information on a protected computer;</text>
						</subparagraph><subparagraph id="H635CA00C7E064131863F669B40E442DC"><enum>(B)</enum><text>that the accesser
				lacks authorization to obtain; and</text>
						</subparagraph><subparagraph id="H3B122CE3C5D94F959953C3F3240C7C75"><enum>(C)</enum><text>by knowingly
				circumventing one or more technological or physical measures that are designed
				to exclude or prevent unauthorized individuals from obtaining that
				information;</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H4AD6E470AF9E4D58AE6411A9F8615125"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section 1030 of
			 title 18, United States Code, is amended—</text>
				<paragraph id="H1D2E022FA694478B9E393888907A21AC"><enum>(1)</enum><text>in subsection
			 (d)(10) by striking <quote>unauthorized access, or exceeding authorized access,
			 to a</quote> and inserting <quote>access without authorization of a
			 protected</quote>; and</text>
				</paragraph><paragraph id="H93D3787C3B8E4380B8728E673C825394"><enum>(2)</enum><text>by striking
			 <quote>exceeds authorized access</quote> each place it appears.</text>
				</paragraph></subsection></section><section id="H4807EF9451B44CB4866381ABD9D9758A"><enum>3.</enum><header>Eliminating
			 redundancy</header><text display-inline="no-display-inline">Section 1030(a)(4)
			 of title 18, United States Code, is repealed.</text>
		</section><section id="HEF4530A754BA4FC19CFAD1272FE2478E"><enum>4.</enum><header>Making penalties
			 proportional to crimes</header><text display-inline="no-display-inline">Section
			 1030(c)(2) of title 18, United States Code is amended—</text>
			<paragraph id="H477C0C6FCD4F469A89773CAD119EA392"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
				<subparagraph id="H17E8C0880F274014982F018C17951F39"><enum>(A)</enum><text>by striking
			 <quote>conviction for another</quote> and inserting <quote>subsequent</quote>;
			 and</text>
				</subparagraph><subparagraph id="H1FE6B6B9E03E4F69AD1FD66704BD596A"><enum>(B)</enum><text>by inserting
			 <quote>such</quote> after <quote>attempt to commit</quote>;</text>
				</subparagraph></paragraph><paragraph id="H473781838E9A4362AF203CEC0DC023E7"><enum>(2)</enum><text>in subparagraph
			 (B)(i), by inserting after <quote>financial gain</quote> the following:
			 <quote>and the fair market value of the information obtained exceeds
			 $5,000</quote>;</text>
			</paragraph><paragraph id="HFE666D3985FE4F519C252DB7AD163970"><enum>(3)</enum><text>in subparagraph
			 (B)(ii), by striking <quote>the offense was committed</quote> and all that
			 follows through the semicolon, and inserting the following: <quote>the offense
			 was committed in furtherance of any criminal act in violation of the
			 Constitution or laws of the United States or of any State punishable by a term
			 of imprisonment greater than one year, unless such criminal acts are prohibited
			 by this section or such State violation would be based solely on accessing
			 information without authorization;</quote>;</text>
			</paragraph><paragraph id="H662FBA18684143558FF6722CFF2E7117"><enum>(4)</enum><text>in subparagraph
			 (B)(iii), by inserting <quote>fair market</quote> before <quote>value</quote>;
			 and</text>
			</paragraph><paragraph id="H6645D291A1654B9B908F3A1C36AFAA0E"><enum>(5)</enum><text>in subparagraph
			 (C)—</text>
				<subparagraph id="H7395CA09D47046789F03DE3A3586F3DD"><enum>(A)</enum><text>by striking
			 <quote>conviction for another</quote> and inserting <quote>subsequent</quote>;
			 and</text>
				</subparagraph><subparagraph id="HE21FDC0A9FBB432A8E6CF7735D6DD385"><enum>(B)</enum><text>by inserting
			 <quote>such</quote> after <quote>attempt to commit</quote>.</text>
