		<section id="H17CB11CFC6A946479077D778A2165680" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Commonsense Contractor Compensation
			 Act of 2013</short-title></quote>.</text>
		</section><section id="HB4FB66EE441143FD978D53DEF5137F37"><enum>2.</enum><header>Limitation on
			 allowable Government contractor compensation costs</header>
			<subsection id="H45653D78296444F5BC793D0698D37FC8"><enum>(a)</enum><header>Limitation</header>
				<paragraph id="H09DDFAF4410A461B977542BDCB9CA929"><enum>(1)</enum><header>Civilian
			 contracts</header><text><external-xref legal-doc="usc" parsable-cite="usc/41/4304">Section 4304(a)(16)</external-xref> of title 41, United States Code, is
			 amended to read as follows:</text>
					<quoted-block id="HBDDFF9CFF1794B53927A05884596B134" style="OLC">
						<paragraph id="HC7F0EB717D4542ECB7216AF2A8ACB264"><enum>(16)</enum><text display-inline="yes-display-inline">Costs of compensation of contractor and
				subcontractor employees for a fiscal year, regardless of the contract funding
				source, to the extent that such compensation exceeds the rate payable for the
				Vice President under <external-xref legal-doc="usc" parsable-cite="usc/3/104">section 104</external-xref> of title 3, United States Code, except that
				the head of an executive agency may establish one or more narrowly targeted
				exceptions for scientists, engineers, or other specialists upon a determination
				that such exceptions are needed to ensure that the executive agency has
				continued access to needed skills and
				capabilities.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H552EA62CBA6E46588FDBF233BC23154C"><enum>(2)</enum><header>Defense
			 contracts</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/2324">Section 2324(e)(1)(P)</external-xref> of title 10, United States Code,
			 is amended to read as follows:</text>

						<subparagraph id="H82C3D6D0D67C4F5697CA30660E905C10"><enum>(P)</enum><text display-inline="yes-display-inline">Costs of compensation of contractor and
				subcontractor employees for a fiscal year, regardless of the contract funding
				source, to the extent that such compensation exceeds the rate payable for the
				Vice President under <external-xref legal-doc="usc" parsable-cite="usc/3/104">section 104</external-xref> of title 3, United States Code, except that
				the head of an executive agency may establish one or more narrowly targeted

						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HFFA208E868ED49F2BB84B6894F32AEED"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="HF81D1AEB86D34214B75F3A19097E6A9F"><enum>(1)</enum><header>Repeal</header><text>Section
			 1127 of title 41, United States Code, is hereby repealed.</text>
				</paragraph><paragraph id="H10E0126E99304539BE5B15F89931914E"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 11 of
			 title 41, United States Code, is amended by striking the item relating to
			 section 1127.</text>
				</paragraph></subsection><subsection id="HA60C340618314DCC8C4BEB4D54BF2A8C"><enum>(c)</enum><header>Applicability</header><text>This
			 section and the amendments made by this section shall apply only with respect
			 to costs of compensation incurred under contracts entered into on or after the
			 date that is 180 days after the date of the enactment of this Act.</text>
			</subsection><subsection id="HEACEC064A5844C67BE3C6552FC43D9F1"><enum>(d)</enum><header>Reports</header>
				<paragraph id="H0FF0390F05344721AD5C462ACB619F87"><enum>(1)</enum><header>In
			 general</header><text>Not later than 60 days after the end of each fiscal year,
			 the Director of the Office of Management and Budget shall submit a report on
			 contractor compensation to—</text>
					<subparagraph id="H93432E0B95754E249C431B51E26B4516"><enum>(A)</enum><text>the Committee on
			 Armed Services of the Senate;</text>
					</subparagraph><subparagraph id="HB2747AE7D80F4B73B0B700C30B3C3E48"><enum>(B)</enum><text>the Committee on
			 Armed Services of the House of Representatives;</text>
					</subparagraph><subparagraph id="HEDD29364ADB1423AA08D29351A370FF7"><enum>(C)</enum><text>the Committee on
			 Homeland Security and Governmental Affairs of the Senate;</text>
					</subparagraph><subparagraph id="H6DE19F53E57447B5A36AC1544B7D4A32"><enum>(D)</enum><text>the Committee on
			 Homeland Security of the House of Representatives;</text>
					</subparagraph><subparagraph id="H37B6AC5C08204BDDBBC171A90EB6EF55"><enum>(E)</enum><text>the Committee on
			 Appropriations of the Senate; and</text>
					</subparagraph><subparagraph id="H67A5CC00202940F4B00531EFB93A7CD8"><enum>(F)</enum><text>the Committee on
			 Appropriations of the House of Representatives.</text>
					</subparagraph></paragraph><paragraph id="HFD2F92A3B1414B44A2F43B31B85876CF"><enum>(2)</enum><header>Elements</header><text>The
			 report required under paragraph (1) shall include—</text>
					<subparagraph id="HA4D4EEC1F61B4B84976693614D9D7901"><enum>(A)</enum><text>the total number
			 of contractor employees, by executive agency, in the narrowly targeted
			 exception positions described under subsection (a) during the preceding fiscal
			 year;</text>
					</subparagraph><subparagraph id="HFD9D8467567E41A2BE72DDA43DB8728C"><enum>(B)</enum><text>the
			 taxpayer-funded compensation amounts received by each contractor employee in a
			 narrowly targeted exception position during such fiscal year; and</text>
					</subparagraph><subparagraph id="HE43FD561BFB34176B4F4DC688B40EB41"><enum>(C)</enum><text>the duties and
			 services performed by contractor employees in the narrowly targeted exception
			 positions during such fiscal year.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
