<official-title>To amend the Food and Nutrition Act of 2008 to permit providers of eligible food purchasing and delivery services to be approved as retail food stores that accept and redeem supplemental nutrition assistance benefits.</official-title>

<section id="HC4BF42E57D6F4BA1B0CA3EF67D61597E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhancing Nutrition Services to the Elderly and Disabled Act of 2013</short-title></quote>.</text></section> 
<section id="HF645D44479D247A381761CFB4B64C141"><enum>2.</enum><header>Enhancing services to elderly and disabled supplemental nutrition assistance program recipients</header><text display-inline="no-display-inline">Section 3(p) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(p)</external-xref>) is amended—</text> 
<paragraph id="H0A1BB7270CA14CFEBCC8B11DD20D1B3B"><enum>(1)</enum><text>in paragraph (3) by striking <quote>and</quote> at the end,</text></paragraph> 
<paragraph id="H8C4B05D886DC4BE6B78ADAC8779D09FC"><enum>(2)</enum><text>in paragraph (4) by striking the period at the end and inserting <quote>; and</quote>, and</text></paragraph> 
<paragraph id="H613C54D30ECC4457B116A2C8700CA19B"><enum>(3)</enum><text>by inserting after paragraph (4) the following:</text>

<paragraph id="H2FF56539DEEE4CC38DD39883D493BB73"><enum>(5)</enum><text>a public or private nonprofit food purchasing and delivery service that—</text> 
<subparagraph id="HEF68A53B867B4EB18965A6D298B55474"><enum>(A)</enum><text>purchases food for, and delivers such food to, individuals who are—</text> 
<clause id="HA0FE5C70138B4A7089D224B73172333D"><enum>(i)</enum><text>unable to shop for food; and</text></clause> 
<clause id="H2C3936A9CCB64890A7E522CF894DE0AB"><enum>(ii)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="H29DD1E084CE14CA999A0D009D0665FB2"><enum>(I)</enum><text>not less than 60 years of age; or</text></subclause> 
<subclause id="HC7B664513835437999A715E1C8FD570D" indent="up1"><enum>(II)</enum><text>physically or mentally handicapped or otherwise disabled;</text></subclause></clause></subparagraph> 
<subparagraph id="H412DD293BAC645DEB9F3C7080720479C"><enum>(B)</enum><text>clearly notifies the participating household at the time such household places a food order—</text> 
<clause id="H4BEE14140D5B4E0AB5C55AF31969BF27"><enum>(i)</enum><text>of any delivery fee associated with the food purchase and delivery provided to such household by such service; and</text></clause> 
<clause id="H85A5765551F642CB9E175C8E34A8FD13"><enum>(ii)</enum><text>that a delivery fee cannot be paid with benefits provided under the supplemental nutrition assistance program; and</text></clause></subparagraph> 
<subparagraph id="H63F5B5C121BA4107B972D5C62865A61A"><enum>(C)</enum><text>sells food purchased for such household at the price paid by such service for such food and without any additional cost markup.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HFAA8F38F69B441BF87C965F4A13C4E5F"><enum>3.</enum><header>Implementation</header> 
<subsection id="H49D5BE67358E42EEB404CB4D0E2D336E"><enum>(a)</enum><header>Issuance of regulations</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Agriculture shall issue regulations that—</text> 
<paragraph id="H8EB83168D1994A88BF44AD4FBFC14C18"><enum>(1)</enum><text>establish criteria to identify a food purchasing and delivery service referred to in section 3(p)(5) of the Food and Nutrition Act of 2008, and</text></paragraph> 
<paragraph id="H6E0B447C0FDF42AA8378E89E09370E52"><enum>(2)</enum><text>establish procedures to ensure that such service—</text> 
<subparagraph id="HCC50961B953E441F8E4ED3FE2F9E76C3"><enum>(A)</enum><text>does not charge more for a food item than the price paid by such service for such food item,</text></subparagraph> 
<subparagraph id="HF121E2AC91D54011BED46F31D348ABED"><enum>(B)</enum><text>offers food delivery service at no or low cost to households under such Act,</text></subparagraph> 
<subparagraph id="HB0D4E446BBCA480BBDDBF3A5F9867954"><enum>(C)</enum><text>ensures that benefits provided under the supplemental nutrition assistance program are used only to purchase food, as defined in section 3 of such Act,</text></subparagraph> 
<subparagraph id="HE9E9980F8E04469DB54345606944755F"><enum>(D)</enum><text>limits the purchase of food, and the delivery of such food, to households eligible to receive services described in section 3(p)(5) of this Act,</text></subparagraph> 
<subparagraph id="HFC9D64CA43ED47999F599CFE577ECAB2"><enum>(E)</enum><text>has established adequate safeguards against fraudulent activities, including unauthorized use of electronic benefit cards issued under such Act, and</text></subparagraph> 
<subparagraph id="H6638598086054375A1C2062902FF5365"><enum>(F)</enum><text>such other requirements as the Secretary deems to be appropriate.</text></subparagraph></paragraph></subsection> 
<subsection id="H779F4F4D40EC422CA1F3719B3B79C4BC"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">Before the issuance of regulations under subsection (a), the Secretary of Agriculture may not approve more than 20 food purchasing and delivery services referred to in section 3(p)(5) of the Food and Nutrition Act of 2008 to participate as retail food stores under the supplemental nutrition assistance program.</text></subsection></section> 
<section id="HE504E6E2FD04460BBD0D3DDE81C5B280"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect 30 days after the date of the enactment of this Act.</text></section>
