			 period to be subsequently determined by the Speaker, in each case for
			 consideration of such provisions as fall within the jurisdiction of the

		<official-title>To prohibit the Secretaries of the Interior and
		  Agriculture from taking action on Federal lands that impede border security on
		  such lands, and for other purposes.</official-title>

	<legis-body id="H45C0627EAC4C4C24BA8E0D71740CB774" style="OLC">
		<section id="H3490243E741845AAAC784D536ABF2C53" section-type="section-one"><enum>1.</enum><header>Prohibition on actions that
			 impede border security on certain Federal land</header>
			<subsection id="H9D358921560449B29F4C7846B9B00C2E"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This section may be
			 cited as the <term>National Security and Federal Lands Protection Act</term>.</text>
			</subsection><subsection id="H01C1E662430840BD8C032BAD2D23613B"><enum>(b)</enum><header>Prohibition on
			 Secretaries of the Interior and Agriculture</header><text display-inline="yes-display-inline">The Secretary of the Interior or the
			 Secretary of Agriculture shall not impede, prohibit, or restrict activities of
			 U.S. Customs and Border Protection on Federal land located within 100 miles of
			 an international land border that is under the jurisdiction of the Secretary of
			 the Interior or the Secretary of Agriculture, to execute search and rescue
			 operations and to prevent all unlawful entries into the United States,
			 including entries by terrorists, other unlawful aliens, instruments of
			 terrorism, narcotics, and other contraband through the international land
			 borders of the United States.</text>
			</subsection><subsection id="H37D40F9FA6C946548083F186B5BD17D9"><enum>(c)</enum><header>Authorized
			 activities of U.S. Customs and Border Protection</header><text display-inline="yes-display-inline">U.S. Customs and Border Protection shall
			 have immediate access to Federal land within 100 miles of the international
			 land border under the jurisdiction of the Secretary of the Interior or the
			 Secretary of Agriculture for purposes of conducting the following activities on
			 such land that prevent all unlawful entries into the United States, including
			 entries by terrorists, other unlawful aliens, instruments of terrorism,
			 narcotics, and other contraband through the international land borders of the
			 United States:</text>
				<paragraph id="H70DE38761668420BB15DC2ED5D9136A3"><enum>(1)</enum><text>Construction and
			 maintenance of roads.</text>
				</paragraph><paragraph id="HF3308ECA3E3F419E81CDBC481753CD3E"><enum>(2)</enum><text>Construction and
			 maintenance of barriers.</text>
				</paragraph><paragraph id="HD76CB07083574E33932DF3BA82073192"><enum>(3)</enum><text>Use of vehicles to
			 patrol, apprehend, or rescue.</text>
				</paragraph><paragraph id="H0514E7C8EA404EEBA872430D3FBF1841"><enum>(4)</enum><text>Installation,
			 maintenance, and operation of communications and surveillance equipment and
			 sensors.</text>
				</paragraph><paragraph id="HD9E9294CF57F4227B33B617D191F7792"><enum>(5)</enum><text>Deployment of
			 temporary tactical infrastructure.</text>
				</paragraph></subsection><subsection id="H224A8AABDF714065AC8DE21E41DCE3A4"><enum>(d)</enum><header>Clarification
			 relating to waiver authority</header>
				<paragraph id="HEB39E57D08874FCEB8049D7C55573A20"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law (including any
			 termination date relating to the waiver referred to in this subsection), the
			 waiver by the Secretary of Homeland Security on April 1, 2008, under section
			 102(c)(1) of the Illegal Immigration Reform and Immigrant Responsibility Act of
			 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1103">8 U.S.C. 1103</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>) of the laws described in
			 paragraph (2) with respect to certain sections of the international border
			 between the United States and Mexico and between the United States and Canada
			 shall be considered to apply to all Federal land under the jurisdiction of the
			 Secretary of the Interior or the Secretary of Agriculture within 100 miles of
			 the international land borders of the United States for the activities of U.S.
			 Customs and Border Protection described in subsection (c).</text>
				</paragraph><paragraph id="H90177F3325964D9B853C27675EED5BCB"><enum>(2)</enum><header>Description of
			 laws waived</header><text>The laws referred to in paragraph (1) are limited to
			 the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the National Environmental Policy
			 Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), the Endangered Species Act of 1973 (16
			 U.S.C. 1531 et seq.), the National Historic Preservation Act (16 U.S.C. 470 et
			 seq.), <external-xref legal-doc="public-law" parsable-cite="pl/86/523">Public Law 86–523</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/469">16 U.S.C. 469 et seq.</external-xref>), the Act of June 8, 1906
			 (commonly known as the <term>Antiquities Act of 1906</term>; 16 U.S.C. 431 et
			 seq.), the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1271">16 U.S.C. 1271 et seq.</external-xref>), the Federal
			 Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>), the National
			 Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd et seq.</external-xref>),
			 the Fish and Wildlife Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/16/742a">16 U.S.C. 742a et seq.</external-xref>), the Fish and
			 Wildlife Coordination Act (<external-xref legal-doc="usc" parsable-cite="usc/16/661">16 U.S.C. 661 et seq.</external-xref>), subchapter II of chapter 5,
			 and chapter 7, of title 5, United States Code (commonly known as the
			 <term>Administrative Procedure Act</term>), the National Park Service Organic
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1">16 U.S.C. 1 et seq.</external-xref>), the General Authorities Act of 1970 (Public Law
			 91–383) (<external-xref legal-doc="usc" parsable-cite="usc/16/1a-1">16 U.S.C. 1a–1 et seq.</external-xref>), sections 401(7), 403, and 404 of the National
			 Parks and Recreation Act of 1978 (<external-xref legal-doc="public-law" parsable-cite="pl/95/625">Public Law 95–625</external-xref>, 92 Stat. 3467), and the
			 Arizona Desert Wilderness Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; Public Law
			 101–628).</text>
				</paragraph></subsection><subsection id="H52313A06F7B44485BEE33F82D93FE9EE"><enum>(e)</enum><header>Protection of
			 legal uses</header><text>This section shall not be construed to provide—</text>
				<paragraph id="H288D9CA83C4542578BDE86B2743FC96D"><enum>(1)</enum><text>authority to
			 restrict legal uses, such as grazing, hunting, mining, or public-use
			 recreational and backcountry airstrips on land under the jurisdiction of the
			 Secretary of the Interior or the Secretary of Agriculture; or</text>
				</paragraph><paragraph id="HBD85D64C892E41509AED109DFACE2C0D"><enum>(2)</enum><text>any additional
			 authority to restrict legal access to such land.</text>
				</paragraph></subsection><subsection id="H0FCF6FCB3737422B98887F96C3C41E8B"><enum>(f)</enum><header>Effect on State
			 and private land</header><text>This Act shall—</text>
				<paragraph id="HCF6D8E0EFFD641239196CFE8638AF9A1"><enum>(1)</enum><text>have no force or
			 effect on State or private lands; and</text>
				</paragraph><paragraph id="H290C28650D534AA6A6CA9CD61FE51A9F"><enum>(2)</enum><text>not provide
			 authority on or access to State or private lands.</text>
				</paragraph></subsection><subsection id="HD85C4294599D4EF784CC1C655A9F12D7"><enum>(g)</enum><header>Tribal
			 sovereignty</header><text>Nothing in this section supersedes, replaces,
			 negates, or diminishes treaties or other agreements between the United States
			 and Indian tribes.</text>
