		<section id="H19369D506B8E4B4DB46572334986DD35" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Building upon Unique Indian Learning
			 and Development Act</short-title></quote>.</text>
		</section><section id="H280C935A74E4402C8902FCE7293724DE"><enum>2.</enum><header>In-school
			 facility innovation program contest</header>
			<subsection id="H1F9E331BC9AC4407A25DC497756DCF21"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of the
			 Interior shall—</text>
				<paragraph id="HB891F019D6F84948969957C71C917271"><enum>(1)</enum><text display-inline="yes-display-inline">establish an in-school facility innovation
			 program contest in which institutions of higher education, including Tribal
			 Colleges and Universities (as defined in section 316 of the Higher Education
			 Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c</external-xref>)), are encouraged to consider solving the problem
			 of how to improve school facilities for tribal schools and schools served by
			 the Bureau of Indian Education for problem-based learning in their coursework
			 and through extracurricular opportunities; and</text>
				</paragraph><paragraph id="HC03330B2F4DD4377BDBFF6573B047E88"><enum>(2)</enum><text>establish an
			 advisory group for the contest described in paragraph (1) that shall include
			 students enrolled at a Tribal College or University, a representative from the
			 Bureau of Indian Education, and engineering and fiscal advisors.</text>
				</paragraph></subsection><subsection id="HF5BB38C64EDE4394A5FCD1353C4AF367"><enum>(b)</enum><header>Submission of
			 finalists to the Indian Affairs Committee</header><text display-inline="yes-display-inline">The Secretary of the Interior shall submit
			 the finalists to the Committee on Indian Affairs of the Senate.</text>
			</subsection><subsection id="H44428D844EED41BCB2AEC347F29F20F2"><enum>(c)</enum><header>Winners</header><text display-inline="yes-display-inline">The Secretary of the Interior shall—</text>
				<paragraph id="H7FF82D0BE61A433489852B6EE7705B3E"><enum>(1)</enum><text display-inline="yes-display-inline">determine the winners of the program
			 contest conducted under this section; and</text>
				</paragraph><paragraph id="H9E7D34D1ACCA4B8BA8665DA1D5E96187"><enum>(2)</enum><text>award the winners
			 appropriate recognition and reward.</text>
				</paragraph></subsection></section><section id="H963E17C809A9402ABF4FAB925071871B"><enum>3.</enum><header>Department of the
			 Interior and Department of Education Joint Oversight Board</header>
			<subsection id="HEA0DC80FD7A14045AF400C3E7717DE8A"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Education and the Secretary of the
			 Interior shall jointly establish a Department of the Interior and Department of
			 Education Joint Oversight Board, that shall—</text>
				<paragraph id="H9BB3B452C0B149E6A7E799D8C52E8275"><enum>(1)</enum><text>be co-chaired by
			 both Departments; and</text>
				</paragraph><paragraph id="H4BF8ABE3B046473F9D67A8D78D4AB3E3"><enum>(2)</enum><text>coordinate
			 technical assistance, resource distribution, and capacity building between the
			 2 departments on the education of and for Native American students.</text>
				</paragraph></subsection><subsection id="H1F7336F9360647338975FA21B4BF1ECE"><enum>(b)</enum><header>Information To
			 be shared</header><text>The Joint Oversight Board shall facilitate the
			 communication, collaboration, and coordination between the 2 departments of
			 education policies, access to and eligibility for Federal resources, and budget
			 and school leadership development, and other issues, as appropriate.</text>
			</subsection></section><section id="H85EA8C7D9D7B430EA30DA8E3D881415C"><enum>4.</enum><header>Improve support
			 for teachers and administrators of native american students</header><text display-inline="no-display-inline">Subpart 2 of part A of title VII of the
			 Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7441">20 U.S.C. 7441 et seq.</external-xref>) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H04F962E634DA4EA6A05435C499954B15" style="OLC">
				<section id="HBBD5AE997DCE48A9934484B60F41B673"><enum>7123.</enum><header>Teacher and
				administrator pipeline for teachers and administrators of native american
				students</header>
					<subsection id="HA386440EE6E045AF8BBE88507A3B2A26"><enum>(a)</enum><header>Grants
				authorized</header><text display-inline="yes-display-inline">The Secretary
				shall award grants to eligible entities to enable such entities to create or
				expand a teacher or administrator, or both, pipeline for teachers and
				administrators of Native American students.</text>
					</subsection><subsection id="H7EFA88FD9D21466DB6774B9A79967E55"><enum>(b)</enum><header>Eligible
				entity</header><text display-inline="yes-display-inline">In this section, the
				term <term>eligible entity</term> means—</text>
						<paragraph id="HCD6CC000CC83447392CEAF2DCB3B91F3"><enum>(1)</enum><text display-inline="yes-display-inline">a local educational agency;</text>
						</paragraph><paragraph id="H112EF4E5B4914F83A129BA748912BAE8"><enum>(2)</enum><text display-inline="yes-display-inline">an institution of higher education;</text>
						</paragraph><paragraph id="H8F74349818C5450CB0E7C49EC699F1FB"><enum>(3)</enum><text display-inline="yes-display-inline">a Tribal College or University (as defined
				in section 316 of the Higher Education Act of 1965); or</text>
						</paragraph><paragraph id="H7D86A4A0E03048FBB7AC3244263CD74B"><enum>(4)</enum><text>a nonprofit
				organization.</text>
						</paragraph></subsection><subsection id="H2DDFBE13D8394D9D97E1B48DCF66AE80"><enum>(c)</enum><header>Priority</header><text>In
				awarding grants under this section, the Secretary shall give priority to Tribal
				Colleges and Universities (as defined in section 316 of the Higher Education
				Act of 1965).</text>
					</subsection><subsection id="H9A868C2FB9A54FD3965DD2874819FDDF"><enum>(d)</enum><header>Activities</header><text display-inline="yes-display-inline">An eligible entity that receives a grant
				under this section shall create a program that shall prepare, recruit, and
				provide continuing education for teachers and administrators of Native American
				students, in particular for teachers of—</text>
						<paragraph id="H12BD6997D2D2452A84C8DBFBA6D243E6"><enum>(1)</enum><text display-inline="yes-display-inline">science, technology, engineering, and
				mathematics;</text>
						</paragraph><paragraph id="HDFA06E7C88084D9382A96E3247C13F67"><enum>(2)</enum><text display-inline="yes-display-inline">subjects that lead to health professions;
				and</text>
						</paragraph><paragraph id="HDC195C61178F47FCA8D27DFDC16178A9"><enum>(3)</enum><text display-inline="yes-display-inline">green skills and <quote>middle
				skills</quote>, including electrical, welding, technology, plumbing, and green
				jobs.</text>
						</paragraph></subsection><subsection id="HD048A3F2DB7A472DB73E00C76C1F7B4D"><enum>(e)</enum><header>Incentives for
				teachers and administrators</header><text display-inline="yes-display-inline">An eligible entity that receives a grant
				under this section may provide incentives to teachers and principals who make a
				commitment to serve high-need, high-poverty, tribal schools, including in the
				form of scholarships, loan forgiveness, incentive pay, or housing
				allowances.</text>
					</subsection><subsection id="H57E03D0F78A74435BFFA5119581854AF"><enum>(f)</enum><header>School and
				community orientation</header><text display-inline="yes-display-inline">An
				eligible entity that receives a grant under this section shall develop an
				evidence-based, culturally based school and community orientation for new
				teachers and administrators of Native American
				students.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H4BCCDBD94D3840BD9EB08F7E07C37046"><enum>5.</enum><header>Native American
			 student support</header>
			<subsection id="H7A92BA415B41447993DEF519B8F3D1DA"><enum>(a)</enum><header>Standards-Based
			 assessments</header><text>Section 1111(b)(3) of the Elementary and Secondary
			 Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(3)</external-xref>) is amended by adding at the end
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF593ED864C94425DBF202EB57F3A41D2" style="OLC">
					<subparagraph id="H46B7CE5FA0554A9BBCFFA6243588C144"><enum>(E)</enum><header>Standards-based
				education assessments</header><text>Notwithstanding any other provision of this
				Act, a State shall develop standards-based education assessments and classroom
				lessons to accommodate diverse learning styles, which assessments may be used
				by the State in place of the general assessments described in subparagraph
				(A).</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC8B4E9DEB9984BA58C5CDC728896FD34"><enum>(b)</enum><header>Support</header><text>The
			 Secretary of Education shall expand programs for Native American school
			 children—</text>
				<paragraph id="H08DDAAF5EB7A477292837BD33DFFCE91"><enum>(1)</enum><text>to provide support
			 for learning in the children's Native language and culture; and</text>
				</paragraph><paragraph id="HEDF51BC050A14F73B4692AB97DDF2DD9"><enum>(2)</enum><text>to provide English
			 language instruction.</text>
				</paragraph></subsection><subsection id="H9B0C2D4B40004D1C9B717B8553E8CFC2"><enum>(c)</enum><header>Research</header><text>The
			 Comptroller General of the United States shall conduct research on culture- and
			 language-based education to identify the factors that improve education and
			 health outcomes.</text>
			</subsection><subsection id="H3E6C5A7BFC904DDDB060F5BC19968C28"><enum>(d)</enum><header>Native language
			 teaching</header><text>Section 1119 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/20/6319">20 U.S.C. 6319</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC8CF6DE70943489DBE5ED43AFDA13933" style="OLC">
					<subsection id="HBE31EF8E01B04E919797E84E776A6469"><enum>(m)</enum><header>Qualifications
				for Native language teachers</header>
						<paragraph id="H3AE064D84ED64177A88755BF376E7A77"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, the
				requirements of subsection (a) for local educational agencies and States with
				respect to highly qualified teachers, shall not apply to a teacher of a Native
				language.</text>
						</paragraph><paragraph id="HDD168D4EAF6946159F052CCC8B511738"><enum>(2)</enum><header>Alternative
				licensure or certification</header><text>Each State educational agency
				receiving assistance under this part shall develop an alternative licensure or
				certification for teachers of a Native
				language.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H07C17457BBBD41728E94EB83B90436AE"><enum>(e)</enum><header display-inline="yes-display-inline">Grant program To ensure the survival and
			 continuing vitality of native american languages</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H23F88046840C4764B5FC61333133BFCC"><enum>(1)</enum><header>Definitions</header><text>In
			 this subsection:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HEE08A3C8954840FB8D47B78E7B320FD8"><enum>(A)</enum><header>Commissioner</header><text>The
			 term <term>Commissioner</term> means the Commissioner of the Administration for
			 Native Americans in the Department of Health and Human Services (established
			 under section 803B of the Native American Programs Act of 1974 (42 U.S.C.
			 2991b–2)).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H91F5B9EECD454632B59D817D971AC2EF"><enum>(B)</enum><header>Eligible
			 entity</header><text>The term <term>eligible entity</term> means any agency or
			 organization that is eligible for financial assistance under section 803(a) of
			 the Native American Programs Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/2991b">42 U.S.C. 2991b(a)</external-xref>).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBA124F8FA112489DB9E090DE7713450E"><enum>(2)</enum><header>Establishment of
			 grant program</header><text>The Commissioner shall establish a program to
			 provide eligible entities with grants for the purpose of assisting Native
			 Americans to ensure the survival and continuing vitality of Native American
			 languages.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8BA957452D9E4F97AAB4F3E4C199B87A"><enum>(3)</enum><header>Use of
			 amounts</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="HBAA4474F665B461B8CFFFFB55D89E6E1"><enum>(A)</enum><header>In
			 general</header><text>An eligible entity may use amounts received under this
			 subsection to carry out activities that ensure the survival and continuing
			 vitality of Native American languages, including—</text>
						<clause id="H3074D77C6501442D9A408F6D761E98AD"><enum>(i)</enum><text>the
			 establishment and support of community Native American language projects
			 designed to bring older and younger Native Americans together to facilitate and
			 encourage the transfer of Native American language skills from one generation
			 to another;</text>
						</clause><clause id="HB1596D28257D4D509254EE289CFEAA24"><enum>(ii)</enum><text>the
			 establishment of projects that train Native Americans to—</text>
							<subclause id="H8536E5A7731143AEAE4F2F7632027C6C"><enum>(I)</enum><text>teach a Native
			 American language to others; or</text>
							</subclause><subclause id="H914611CF7B0040BBA84FC9C144F9FB45"><enum>(II)</enum><text>serve as
			 interpreters or translators of a Native American language;</text>
							</subclause></clause><clause id="H1909142ED0E04622B59A2E5C17E880FE"><enum>(iii)</enum><text>the development,
			 printing, and dissemination of materials to be used for the teaching and
			 enhancement of a Native American language;</text>
						</clause><clause id="H1081919C308747BA8CFD258BDA18D72B"><enum>(iv)</enum><text>the
			 establishment or support of a project to train Native Americans to produce or
			 participate in television or radio programs to be broadcast in a Native
			 American language;</text>
						</clause><clause id="H407F823A1FE24662941FB918EEE048B0"><enum>(v)</enum><text>the
			 compilation, transcription, and analysis of oral testimony to record and
			 preserve a Native American language;</text>
						</clause><clause id="H6A1DED6A390240979EFDDADF48A34B24"><enum>(vi)</enum><text>the
			 purchase of equipment, including audio and video recording equipment,
			 computers, and software, required to carry out a Native American language
			 project; and</text>
						</clause><clause id="H34E26D017CFB4390942F287EA1739238"><enum>(vii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HF0BE8392CEDC4EBCA6B82A6F4A389F0C"><enum>(I)</enum><text>the establishment of
			 Native American language nests, which are site-based educational programs
			 that—</text>
								<item id="H550053430F7D40AD9B090CC38019344A" indent="up1"><enum>(aa)</enum><text>provide instruction and child care
			 through the use of a Native American language for at least 10 children under
			 the age of 7 for an average of at least 500 hours per year per student;</text>
								</item><item id="HF44BDDB7713B4643B7DF39BF58E5A3E9" indent="up1"><enum>(bb)</enum><text>provide classes in a Native American
			 language for parents (or legal guardians) of students enrolled in a Native
			 American language nest (including Native American language-speaking parents);
			 and</text>
								</item><item id="H3FDFE1D375F748DFAF48723432D88517" indent="up1"><enum>(cc)</enum><text>ensure that a Native American
			 language is the dominant medium of instruction in the Native American language
			 nest;</text>
								</item></subclause><subclause id="H92322A2AD20E4578B2D11D64D929832E" indent="up1"><enum>(II)</enum><text>the establishment of Native American
			 language survival schools, which are site-based educational programs for
			 school-age students that—</text>
								<item id="H7E70D150C77A42A486D9C08977CD7A69"><enum>(aa)</enum><text>provide an average of at least 500
			 hours of instruction through the use of 1 or more Native American languages for
			 at least 15 students for whom a Native American language survival school is the
			 principal place of instruction;</text>
								</item><item id="H3F490FD1B7CA4E1F8063A8D5BA1CDC65"><enum>(bb)</enum><text>develop instructional courses and
			 materials for learning Native American languages and for instruction through
			 the use of Native American languages;</text>
								</item><item id="HEA14243C2CCE4673BA587589DD395BA6"><enum>(cc)</enum><text>provide for teacher training;</text>
								</item><item id="H0498520824154C3091C016D6938BFDBE"><enum>(dd)</enum><text>work toward a goal of all students
			 achieving—</text>
									<subitem id="H5832ABDF54C44ECFAE4758CAD15AB745"><enum>(AA)</enum><text>fluency in a Native American language;
			 and</text>
									</subitem><subitem id="HB2E28001893A48E9BA613B3F24CCAB3A"><enum>(BB)</enum><text>academic proficiency in mathematics,
			 reading (or language arts), and science; and</text>
									</subitem></item><item id="H4C9D2257D17244A7B1CA9630456B5FFC"><enum>(ee)</enum><text>are located in areas that have high
			 numbers or percentages of Native American students; and</text>
								</item></subclause><subclause id="HFB62EE02811E4F9A872F2BA8437B9D67" indent="up1"><enum>(III)</enum><text>the establishment of Native American
			 language restoration programs, which are educational programs that—</text>
								<item id="H0736A52A6E7A476598F795B563C0251C"><enum>(aa)</enum><text>operate at least 1 Native American
			 language program for the community that the educational program serves;</text>
								</item><item id="H54BA3AF18A8644E89F14FEA682BCB823"><enum>(bb)</enum><text>provide training programs for
			 teachers of Native American languages;</text>
								</item><item id="HF96D8BCC4DF54400B3BE2A9A7593A71D"><enum>(cc)</enum><text>develop instructional materials for
			 the Native American language restoration programs;</text>
								</item><item id="HFCA503CE687C4833993A422BB69009FD"><enum>(dd)</enum><text>work toward a goal of increasing
			 proficiency and fluency in at least 1 Native American language; and</text>
								</item><item id="H6C26DCE3E6164F8698FD19AAF4A50B7E"><enum>(ee)</enum><text>provide instruction in at least 1
			 Native American language.</text>
								</item></subclause></clause></subparagraph><subparagraph id="H504DA4DAB2774188B9E2F8B02B6F1535"><enum>(B)</enum><header>Native American
			 language restoration programs</header><text>An eligible entity carrying out a
			 program described in subparagraph (A)(vii)(III) may use amounts made available
			 under this section to carry out—</text>
						<clause id="H8F39BB7C5E2E42728BBED6FE9751E669"><enum>(i)</enum><text>Native American
			 language programs, including—</text>
							<subclause id="H501F631D27924D3EAFCAFAF869F18443"><enum>(I)</enum><text>Native American
			 language immersion programs;</text>
							</subclause><subclause id="HDA5A8E5EE1BA450CABD17AB3EBE3B0E2"><enum>(II)</enum><text>Native American
			 language and culture camps;</text>
							</subclause><subclause id="H7A46D17ED2D446CBBC318F6B0605A313"><enum>(III)</enum><text>Native American
			 language programs provided in coordination and cooperation with educational
			 entities;</text>
							</subclause><subclause id="H5B183AA778EA405C953CA6847684FEBB"><enum>(IV)</enum><text>Native American
			 language programs provided in coordination and cooperation with institutions of
			 higher education with expertise in the relevant Native language, particularly
			 Tribal Colleges and Universities (as defined in section 316 of the Higher
			 Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c</external-xref>));</text>
							</subclause><subclause id="H69D32F49ABF84630826A4469E6DC3C15"><enum>(V)</enum><text>Native American
			 language programs that use a master-apprentice model of learning languages;
			 and</text>
							</subclause><subclause id="H924BDDED01F1476B8F9C015863D57BB1"><enum>(VI)</enum><text>Native American
			 language programs provided through a regional program to better serve
			 geographically dispersed students;</text>
							</subclause></clause><clause id="HCD4C6F6F1DBB4F02BE51807BCEC256F5"><enum>(ii)</enum><text>Native American
			 language teacher training programs, including—</text>
							<subclause id="H719DFCE130094214AF716107B5FBF665"><enum>(I)</enum><text>training programs
			 in Native American language translation for fluent speakers;</text>
							</subclause><subclause id="HE8E9317851CE4D66BDBCC4A4F19C9AD3"><enum>(II)</enum><text>training programs
			 for Native American language teachers; and</text>
							</subclause><subclause id="HC1527D70E21B46849467ADBB98EC8CC6"><enum>(III)</enum><text>training
			 programs for teachers in the use of Native American language materials, tools,
			 and interactive media to teach Native American language; and</text>
							</subclause></clause><clause id="H0AEEC0842C0740E58A06E1437115D3EA"><enum>(iii)</enum><text>the development
			 of Native American language materials, including books, audio and visual tools,
			 and interactive media programs.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB9E85010377842EA8499640FA842D163"><enum>(4)</enum><header>Applications</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="HAC44FAD0C3BD48F3A50119612608497F"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), in awarding a grant under
			 this subsection, the Commissioner shall select applicants from among eligible
			 entities on the basis of applications submitted to the Commissioner at such
			 time, in such form, and containing such information as the Commissioner
			 requires.</text>
					</subparagraph><subparagraph id="H2A6170B45ABC44F58D71D9E15588FC9D"><enum>(B)</enum><header>Requirements</header><text>An
			 application under subparagraph (A) shall include, at a minimum—</text>
						<clause id="HC45524327C4D4B13A963B36E76565A3F"><enum>(i)</enum><text>a
			 detailed description of the current status of the Native American language to
			 be addressed by the project for which a grant is requested, including a
			 description of existing programs and projects, if any, in support of that
			 language;</text>
						</clause><clause id="HA011E2E85129493A9839646ACBB208E1"><enum>(ii)</enum><text>a
			 detailed description of the project for which the grant is requested;</text>
						</clause><clause id="H2F500FF0A42F4515BD9EDAC370164E0E"><enum>(iii)</enum><text>a
			 statement that the objectives of the project are in accordance with the
			 purposes of this subsection;</text>
						</clause><clause id="HB6BC5E030C514FA395DD1B1616D70459"><enum>(iv)</enum><text>a
			 detailed description of the plan of the applicant to evaluate the
			 project;</text>
						</clause><clause id="H1863D7AB1B2346169964A1D2B716A64C"><enum>(v)</enum><text>if
			 appropriate, an identification of opportunities for the replication or
			 modification of the project for use by other Native Americans;</text>
						</clause><clause id="H5D1C452EB7A842AF8E7ED3E1906067D6"><enum>(vi)</enum><text>a
			 plan for the preservation of the products of the Native American language
			 project for the benefit of future generations of Native Americans and other
			 interested persons; and</text>
						</clause><clause id="H6DB0279CBD3542C2AC33930680391C39"><enum>(vii)</enum><text>in
			 the case of an application for a grant to carry out any purpose specified in
			 paragraph (3)(A)(vii)(III), a certification by the applicant that the applicant
			 has not less than 3 years of experience in operating and administering a Native
			 American language survival school, a Native American language nest, or any
			 other educational program in which instruction is conducted in a Native
			 American language.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7DC863DBE0A6459081F56AF02C821B8A"><enum>(C)</enum><header display-inline="yes-display-inline">Participating organizations</header><text display-inline="yes-display-inline">If an applicant determines that the
			 objectives of a proposed Native American language project would be accomplished
			 more effectively through a partnership with an educational entity, the
			 applicant shall identify the educational entity as a participating organization
			 in the application.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2F4BF85826F24A6E936A91CBE5090B12"><enum>(5)</enum><header>Limitations on
			 funding</header>
					<subparagraph id="H3527C1F5EA0C419291BB7724C301EA01"><enum>(A)</enum><header>Federal
			 share</header><text>The Federal share of the total cost of a program under this
			 subsection shall not exceed 80 percent.</text>
					</subparagraph><subparagraph id="H87F80B11E1514198A11ECFC8575D1FBE"><enum>(B)</enum><header>Non-Federal
			 share</header>
						<clause id="H379AFF45F85D4FCDBA466E9868BF6362"><enum>(i)</enum><header>In
			 general</header><text>The non-Federal share of the cost of a program under this
			 subsection may be provided in cash or fairly evaluated in-kind contributions,
			 including facilities, equipment, or services.</text>
						</clause><clause id="HCF7747394FE247B9A33DAAAF3B65AA8C"><enum>(ii)</enum><header>Source of
			 non-Federal share</header><text>The non-Federal share—</text>
							<subclause id="H5CB3217E1C574A79AD99310B18DDF868"><enum>(I)</enum><text>may be provided
			 from any private or non-Federal source; and</text>
							</subclause><subclause id="H2727E21B79AD45B58627CDF273F7D7E3"><enum>(II)</enum><text>may include
			 amounts (including interest) distributed to an Indian tribe—</text>
								<item id="HCE8E3D2A30344235BE95F4BC0E65BE70"><enum>(aa)</enum><text>by
			 the Federal Government pursuant to the satisfaction of a claim made under
			 Federal law;</text>
								</item><item id="H7A4336CF4E7E4E46A0026F1011EB6F12"><enum>(bb)</enum><text>from
			 amounts collected and administered by the Federal Government on behalf of an
			 Indian tribe or the members of an Indian tribe; or</text>
								</item><item id="H660AFEA87A474CF083716C303B95AAE9"><enum>(cc)</enum><text>by
			 the Federal Government for general tribal administration or tribal development
			 under a formula or subject to a tribal budgeting priority system,
			 including—</text>
									<subitem id="H431CA9D887FC4B91B61776C5540848B4"><enum>(AA)</enum><text>amounts involved
			 in the settlement of land or other judgment claims;</text>
									</subitem><subitem id="HB6F2EE5CDF0541F798947CE7A5910D36"><enum>(BB)</enum><text>severance or
			 other royalty payments; or</text>
									</subitem><subitem id="HA0340F62EC1C46EEA8F48A12B96680C4"><enum>(CC)</enum><text>payments under
			 the Indian Self-Determination Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450f">25 U.S.C. 450f et seq.</external-xref>) or a tribal budget
			 priority system.</text>
									</subitem></item></subclause></clause></subparagraph><subparagraph id="HB85DB9A79E6B4BF39D54B5660F901336"><enum>(C)</enum><header>Duration</header>
						<clause id="HFC9FBBC0793946089D6505F23BF1D0D8"><enum>(i)</enum><header>In
			 general</header><text>Subject to clause (ii), the Commissioner may make grants
			 made under this subsection on a 1-year, 2-year, or 3-year basis.</text>
						</clause><clause id="H8385FD27E3E04D86B932A8F67F661E3F"><enum>(ii)</enum><header>Native American
			 language restoration program</header><text>The Commissioner shall only make a
			 grant available under paragraph (3)(A)(vii)(III) on a 3-year basis.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1AA4C9C18675402791C5FA89440C08DE"><enum>(6)</enum><header>Administration</header>
					<subparagraph id="H6634BC75DC82400D94AF71EC4D7C2729"><enum>(A)</enum><header>Expert
			 panel</header>
						<clause id="HDE587DA9116F4903800EA66210EC4000"><enum>(i)</enum><header>In
			 general</header><text>Not later than 180 days after date of enactment of this
			 subsection, the Commissioner shall appoint a panel of experts for the purpose
			 of assisting the Commissioner to review—</text>
							<subclause id="HE9DB4D596CE44C919BD60515704805FD"><enum>(I)</enum><text>applications
			 submitted under paragraph (4);</text>
							</subclause><subclause id="HD39B71D9559846B6B0F305CEB3E63573"><enum>(II)</enum><text>evaluations
			 carried out to comply with paragraph (4)(B)(iv); and</text>
							</subclause><subclause id="H35DFA8D7C4654F85A93385DFE2E4B247"><enum>(III)</enum><text>the preservation
			 of products required by paragraph (4)(B)(vi).</text>
							</subclause></clause><clause id="H125223B4EE3A4D208EB4354C2C889774"><enum>(ii)</enum><header>Composition</header>
							<subclause id="H337C00954F804D7CBE30BAED4EF3A287"><enum>(I)</enum><header>In
			 general</header><text>The panel shall include—</text>
								<item id="HF0BCC62AA46041E191898F1F2B282084"><enum>(aa)</enum><text>a
			 designee of the Institute of American Indian and Alaska Native Culture and Arts
			 Development;</text>
								</item><item id="H04DE98B4EEC048F1BD207DB52B9B97F5"><enum>(bb)</enum><text>representatives
			 of national, tribal, and regional organizations that focus on Native American
			 language or Native American cultural research, development, or training;
			 and</text>
								</item><item id="H2FB0F0D0C3324F0CA6D044D480608639"><enum>(cc)</enum><text>other
			 individuals who are recognized as experts in the area of Native American
			 language.</text>
								</item></subclause><subclause id="H0C091777F8FE4240B28D40A2C911C859"><enum>(II)</enum><header>Recommendations</header><text>The
			 Commissioner shall solicit recommendations for appointments to the panel from
			 Indian tribes and tribal organizations.</text>
							</subclause></clause><clause id="HC01BACA355544CAB8026A893FD232E8B"><enum>(iii)</enum><header>Duties</header><text>The
			 duties of the panel shall include—</text>
							<subclause id="H7ECE5E264FE3425082BE32E81B1BEEF0"><enum>(I)</enum><text>making
			 recommendations regarding the development and implementation of regulations,
			 policies, procedures, and rules of general applicability with respect to the
			 administration of this subsection;</text>
							</subclause><subclause id="H6603B273D04046829449092DEEDC4CA1"><enum>(II)</enum><text>reviewing
			 applications received under paragraph (4);</text>
							</subclause><subclause id="H2096A3AB308D43658948839ECB637EF0"><enum>(III)</enum><text>providing to the
			 Commissioner a list of recommendations for the approval of applications in
			 accordance with—</text>
								<item id="H6D7266A26D884849B389FD8E6C02FECD"><enum>(aa)</enum><text>regulations
			 issued by the Secretary of Health and Human Services; and</text>
								</item><item id="HEFF186D5948F44A396F560CE801A6D18"><enum>(bb)</enum><text>the
			 relative need for the project; and</text>
								</item></subclause><subclause id="H37CE047303704072B144211F11FD69E1"><enum>(IV)</enum><text>reviewing
			 evaluations submitted to comply with paragraph (4)(B)(iv).</text>
							</subclause></clause></subparagraph><subparagraph id="HB80D9C7711F949B199256DBCC42C60DD"><enum>(B)</enum><header>Products
			 generated by projects</header>
						<clause id="H0F627514624546F09F67F7528026F118"><enum>(i)</enum><header>In
			 general</header><text>Subject to clause (ii), for preservation and use in
			 accordance with the responsibilities of the respective organization under
			 Federal law, a copy of any product of a Native American language project for
			 which a grant is made under this subsection—</text>
							<subclause id="H1CC1377E649F42FA8416EEF142ACBEF2"><enum>(I)</enum><text>shall be
			 transmitted—</text>
								<item id="HE38F5E17B2BE441C92FC26542B986BC8"><enum>(aa)</enum><text>to
			 the Institute of American Indian and Alaska Native Culture and Arts
			 Development; and</text>
								</item><item id="H42054D33D3724C28953B7F96A3049BD9"><enum>(bb)</enum><text>to
			 the Tribal Colleges or Universities where the language addressed in the grant
			 program is inherent; and</text>
								</item></subclause><subclause id="HE9BE23618952407FA989C9B4BF9790EF"><enum>(II)</enum><text>may be
			 transmitted, at the discretion of the grantee, to national and regional
			 repositories of similar material.</text>
							</subclause></clause><clause id="HB957A8A475AA4B4A82498391A3D9539B"><enum>(ii)</enum><header>Exemption</header>
							<subclause id="H60CB78F858844756A38BC859220EC422"><enum>(I)</enum><header>In
			 general</header><text>In accordance with the Federal recognition of the
			 sovereign authority of each Indian tribe over all aspects of the culture and
			 language of that Indian tribe and subject to subclause (II), an Indian tribe
			 may make a determination—</text>
								<item id="HFA3A20517B4C41719196832CFA90CCF8"><enum>(aa)</enum><text>not
			 to transmit a copy of a product under clause (i);</text>
								</item><item id="H07616B65FA124F06A2BEEFC8335179E7"><enum>(bb)</enum><text>not
			 to permit the redistribution of a copy of a product transmitted under clause
			 (i); or</text>
								</item><item id="H87D29EDF5D344E14BA542B442A194458"><enum>(cc)</enum><text>to
			 restrict in any manner the use or redistribution of a copy of a product
			 transmitted under clause (i).</text>
								</item></subclause><subclause id="H6CB1E16CA2D14F1CB756BCE09EE7D90D"><enum>(II)</enum><header>Restrictions</header><text>Subclause
			 (I) does not authorize an Indian tribe—</text>
								<item id="H35AB02E2A1ED4C3EB98D3B27B4F22E7D"><enum>(aa)</enum><text>to
			 limit the access of the Commissioner to a product described in clause (i) for
			 purposes of administering this subsection or evaluating the product; or</text>
								</item><item id="HC71EC9DE4C6F4FB8B052DECA8AEF309E"><enum>(bb)</enum><text>to
			 sell a product described in clause (i), or a copy of that product, for profit
			 to the entities referred to in clause (i).</text>
								</item></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4252B852FE0E4E1993289F7B84458A49"><enum>(7)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to carry out this subsection such sums as are
			 necessary for each of fiscal years 2014 through 2019.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H72535B7EF55C4D809C1CE990339C1A88"><enum>(f)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H257B0D4D907C49D3A2BE6058BB84BBBE"><enum>(1)</enum><header>In
			 general</header><text>Section 803C of the Native American Programs Act of 1974
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/2991b-3">42 U.S.C. 2991b–3</external-xref>) is repealed.</text>
				</paragraph><paragraph id="H00D4530585284B70BA9ED95E2EAC6590"><enum>(2)</enum><header>Authorization of
			 appropriations</header><text>Section 816 of the Native American Programs Act of
			 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/2992d">42 U.S.C. 2992d</external-xref>) is amended—</text>
					<subparagraph id="HD00D85AD5D264C4C8D67012D6C55CBA5"><enum>(A)</enum><text>in subsection (a),
			 by striking <quote>sections 803(d), 803A, 803C, 804, subsection (e) of this
			 section</quote> and inserting <quote>sections 803(d), 803A, and 804, subsection

					</subparagraph></paragraph></subsection></section><section id="HE9D479D5B80740609D53079D61E7E09E"><enum>6.</enum><header>Increased access
			 to resources for tribal schools, schools served by the Bureau of Indian
			 Education, and Native American students</header>
			<subsection id="HE689E0176A2041248A679966D888661E"><enum>(a)</enum><header>Reservation for
			 Bureau-Funded Schools and Programs and Schools Operated by a Tribe or Tribal
			 Organization</header>
				<paragraph id="H58C6013FBF6A4369B6C960B6047B1294"><enum>(1)</enum><header>In
			 General</header><text>The Secretary of Education shall ensure that any program
			 administered by the Department of Education that awards grants, contracts, or
			 other assistance to benefit elementary schools and secondary schools (as such
			 terms are defined in section 9101 of the Elementary and Secondary Education Act
			 of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)) or prekindergarten or early childhood programs,
			 provides a reservation, as described in this subsection, for 1 or more of the
			 following categories of entities, as determined appropriate by the Secretary of
			 Education for each such grant, contract, or assistance program:</text>
					<subparagraph id="HBDAA885B1B5844A9B2C1AEF8DCFE4262"><enum>(A)</enum><text>Bureau-funded
			 schools (as defined in section 1141 of the Education Amendments of 1978 (25
			 U.S.C. 2021)).</text>
					</subparagraph><subparagraph id="HCAC397D94D87422996E5AC3DDA0A12AB"><enum>(B)</enum><text>Prekindergarten
			 programs or early childhood programs or services operated by a tribe or Indian
			 organization (as defined in such section).</text>
					</subparagraph><subparagraph id="H966120D458B944B49CD6205D66258A08"><enum>(C)</enum><text>Elementary schools
			 or secondary schools operated by a tribe or Indian organization (as defined in
			 such section).</text>
					</subparagraph></paragraph><paragraph id="H697E7ACB5CAB4D90952046161491D0C0"><enum>(2)</enum><header>Amount of
			 Reservation</header>
					<subparagraph id="HC1B488DB62A94BE68017D72F8BB2F027"><enum>(A)</enum><header>Existing
			 Reservation of Funds</header><text>In the case of a grant, contract, or
			 assistance program provided by the Department of Education to benefit
			 elementary schools and secondary schools (as such terms are defined in section
			 9101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)) or
			 prekindergarten or early childhood programs for which funds are reserved for
			 entities described in paragraph (1), or for a group that may include such
			 entities—</text>
						<clause id="H238A4A1F06BA48DFBE21CDC649594EBE"><enum>(i)</enum><text>if
			 the existing reservation of funds is for an amount that is less than 0.5
			 percent, the amount of such reservation shall be increased to 0.5 percent;
			 and</text>
						</clause><clause id="H89D99955171E418ABE2AFAB238D539B0"><enum>(ii)</enum><text>if
			 the existing reservation of funds is for an amount that is equal to or greater
			 than 0.5 percent, the amount of such reservation shall be maintained.</text>
						</clause></subparagraph><subparagraph id="H5BA008418F7E4BF1A1E7433C30431E13"><enum>(B)</enum><header>No Existing
			 Reservation of Funds</header><text>In the case of a grant, contract, or
			 assistance program provided by the Department of Education to benefit
			 elementary schools and secondary schools (as such terms are defined in section
			 9101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)) or
			 prekindergarten or early childhood programs for which no funds are reserved for
			 the entities described in paragraph (1), the Secretary of Education shall
			 reserve 0.5 percent of such funds for such entities, as determined by the
			 Secretary of Education in accordance with paragraph (1).</text>
					</subparagraph></paragraph><paragraph id="H46515C5B8E4D45D6AF3391486D04F634"><enum>(3)</enum><header>Use of Reserved
			 Funds</header><text>Funds reserved under this section shall be used in
			 accordance with the uses of funds described for each particular grant,
			 contract, or assistance program. In addition to program support, such reserved
			 funds may be used, in an amount determined by the Secretary of Education, for
			 technical assistance or capacity building to ensure that the schools or
			 programs described in paragraph (1) are provided the assistance to compete for
			 such grants, contracts, or other assistance.</text>
				</paragraph><paragraph id="HD29BE2B3D9684AD198044AFDE379E53B"><enum>(4)</enum><header>Effect on Other
			 Laws</header><text>The Secretary of Education shall carry out this subsection
			 notwithstanding any other provision of law.</text>
				</paragraph></subsection><subsection id="HB0897BAD9DD649CBABC69E28E6C9FE64"><enum>(b)</enum><header>Safe and healthy
			 schools for Native American students</header><text>Subpart 2 of part A of title
			 IV of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7131 et
			 seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H93B1737BBA38486DA43BC4B4A15E6687" style="OLC">
					<section id="H1107CCDD4D3D4A9EA0A18AECA2C3CC86"><enum>4131.</enum><header>Safe and
				healthy schools for Native American students</header><text display-inline="no-display-inline">From funds made available to carry out this
				subpart, the Secretary shall—</text>
						<paragraph id="HC0DC5CBD2EB64732B8C44FEBF20C98E5"><enum>(1)</enum><text>establish a
				program to improve school environments and student skill development for
				healthy choices for Native American students, including—</text>
							<subparagraph id="H8B42AF55F9514C77B8B55E4A72BB2D0A"><enum>(A)</enum><text>prevention
				regarding—</text>
								<clause id="H309177B8CF1F4AA6BF74130BAA96C0BD"><enum>(i)</enum><text>alcohol and drug
				misuse;</text>
								</clause><clause id="HED9D63F9E3854E0FA23EA44DD6E3240B"><enum>(ii)</enum><text>suicide;</text>
								</clause><clause id="H2120C25A1D2A490A89DF00C22747C684"><enum>(iii)</enum><text>violence;</text>
								</clause><clause id="H78F5F2B240F547868DB9D1F0D66772AD"><enum>(iv)</enum><text>pregnancy;
				and</text>
								</clause><clause id="H1AAF2B449097470D8E5DBB5B190E0EFF"><enum>(v)</enum><text>obesity;</text>
								</clause></subparagraph><subparagraph id="H27E3E7C55A064615BF99E796501EFB5B"><enum>(B)</enum><text>nutritious eating
				programs; and</text>
							</subparagraph><subparagraph id="HDB60BCE33976464284A36787ACBC83C4"><enum>(C)</enum><text>anger and conflict
				management programs;</text>
							</subparagraph></paragraph><paragraph id="H109D6375802747758D17270A087A4814"><enum>(2)</enum><text>establish a
				program for school dropout prevention for Native American students; and</text>
						</paragraph><paragraph id="H350424DD9B17447A9907B9CBAACC1FC3"><enum>(3)</enum><text>collaborate with
				the Secretary of Agriculture to establish tribal-school specific school gardens
				and nutrition programs that are within the tribal cultural
				context.</text>
						</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H50299280BADD403790BD08C68B8B88A0"><enum>7.</enum><header>Funds for Impact
			 Aid</header><text display-inline="no-display-inline">In addition to amounts
			 otherwise appropriated to carry out title VIII of the Elementary and Secondary
			 Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7701">20 U.S.C. 7701 et seq.</external-xref>), there are authorized to be
			 appropriated, and there are appropriated, out of any money in the Treasury not
			 otherwise appropriated, to carry out such title VIII the following:</text>
			<paragraph id="H6C593D63CB784017BC3967A375C83CC5"><enum>(1)</enum><text>$750,000,000 for
			 fiscal year 2014.</text>
			</paragraph><paragraph id="H578999AAD9164BBD9694C429086A8231"><enum>(2)</enum><text>$750,000,000 for
			 fiscal year 2015.</text>
			</paragraph><paragraph id="H01CB8E89B3E04A7C8D2E3ACA1B0E11CC"><enum>(3)</enum><text>$750,000,000 for
			 fiscal year 2016.</text>
			</paragraph></section><section id="H2A83D6F44DCA495FA9D98DC19C569F1C"><enum>8.</enum><header>Forward Funding
			 for Tribal Colleges</header><text display-inline="no-display-inline">For
			 carrying out the following programs, there are authorized to be appropriated
			 $91,087,500 for fiscal year 2014 which shall become available on July 1, 2014,
			 and shall remain available through September 30, 2015:</text>
			<paragraph id="HDD1E60D510084C49BB6CE3233F84782D"><enum>(1)</enum><text>Programs under
			 title V of the Tribally Controlled Colleges and Universities Assistance Act of
			 1978 (<external-xref legal-doc="usc" parsable-cite="usc/25/1861">25 U.S.C. 1861 et seq.</external-xref>).</text>
			</paragraph><paragraph id="H609C2AF74F604447B64137E7A6AC6E21"><enum>(2)</enum><text>The Institute of
			 American Indian and Alaska Native Culture and Arts Development established
			 under the American Indian, Alaska Native, and Native Hawaiian Culture and Art
			 Development Act (<external-xref legal-doc="usc" parsable-cite="usc/20/4401">20 U.S.C. 4401 et seq.</external-xref>).</text>
			</paragraph><paragraph id="H2E334FBBA9904BEC9E7216A81347AB4A"><enum>(3)</enum><text>Institutional
			 operations grants for the Haskell Indian Nations University and Southwestern
			 Indian Polytechnic Institute under the authority of the Act of November 2, 1921
			 (<external-xref legal-doc="usc" parsable-cite="usc/25/13">25 U.S.C. 13</external-xref>), popularly known as the Snyder Act.</text>
			</paragraph><paragraph id="HFDFDA7FB89604272B30BEF49C0020240"><enum>(4)</enum><text>Scholarships and
			 adult education and special higher education scholarships under the authority
			 of the Act of November 2, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/25/13">25 U.S.C. 13</external-xref>), popularly known as the Snyder
			 Act.</text>
			</paragraph></section><section id="H7E55E3B1E30443318E82B0BA309F3E74"><enum>9.</enum><header>Definition of
			 Tribal School</header>
			<subsection id="H2CB4AF3C93BA43C3B82EE6A4762E4C1F"><enum>(a)</enum><header>ESEA
			 Definition</header><text>Section 9101 of the Elementary and Secondary Education
			 Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HB8429558114E4B6AA30AD03C39C754C9" style="OLC">
					<paragraph id="H2399D67E6B5340C38D3BB7402D2E7403"><enum>(44)</enum><header>Tribal
				School</header><text>The term <term>tribal school</term> means—</text>
						<subparagraph id="HA31D5F3A4D9146DCB1A41F85663FD3E3"><enum>(A)</enum><text>a school that is a
				Bureau-funded school, as defined in section 1141 of the Education Amendments of
				1978 (<external-xref legal-doc="usc" parsable-cite="usc/25/2021">25 U.S.C. 2021</external-xref>);</text>
						</subparagraph><subparagraph id="H93851EE41B2B4176BBEEEBD0E8C288B1"><enum>(B)</enum><text>a prekindergarten
				program, early childhood program or service, or elementary school or secondary
				school, operated by an Indian tribe or tribal organization (as defined in
				section 4 of the Indian Self-Determination and Education Assistance Act (25
				U.S.C. 450b));</text>
						</subparagraph><subparagraph id="H0F1859E2F9FE48D19C22A41732195CE9"><enum>(C)</enum><text>a school that is
				located on Indian lands (as defined in section 8013); or</text>
						</subparagraph><subparagraph id="HC2D810F5E4784944B84E4C1873404623"><enum>(D)</enum><text>a school in which
				a predominance of the students who attend the school are Native American or
				Alaska Native students, as determined by the
				Secretary.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H66A36328E7BF437485CAB39694650B74"><enum>(b)</enum><header>Definition for
			 this Act</header><text>In this Act, the term <term>tribal school</term> has the
			 meaning given the term in section 9101 of the Elementary and Secondary
			 Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>) (as amended by subsection (a)).</text>
