		<official-title>To amend title XVIII of the Social Security Act to
		  provide comprehensive audiology services to Medicare beneficiaries, and for
		  other purposes.</official-title>

		<section id="H8970557A09064B4A92B1ECFB6ACD00FA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medicare Audiology Services
			 Enhancement Act of 2013</short-title></quote>.</text>
		</section><section id="H8B38E235D0D644A4A49436FC0BA610B5"><enum>2.</enum><header>Comprehensive
			 audiology services for Medicare beneficiaries</header>
			<subsection id="HCDF0B04C9FC0401D8C820160310D1670"><enum>(a)</enum><header>In
			 general</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>)
			 is amended—</text>
				<paragraph id="H174A6A273D6F4F2286367996BB56AC7F"><enum>(1)</enum><text>in subsection
			 (s)(2)—</text>
					<subparagraph id="HA575B04905D94E0ABD47DFEFFD20A52C"><enum>(A)</enum><text>in subparagraph
			 (EE), by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="HEB318ED9FD3C4062B0CA558CBE496BC9"><enum>(B)</enum><text>in subparagraph
			 (FF), by adding <quote>and</quote> at the end; and</text>
					</subparagraph><subparagraph id="HAC1335D49B60431DAFF193065C7FC12F"><enum>(C)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="HC294864661BC42EE960820D618943E7E" style="traditional">
							<subparagraph id="H2A316C3F585D4859B3A78503A069CE28"><enum>(GG)</enum><text>audiology
				services (as defined in subsection
				(ll)(3));</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H91606954E57F422FAA4B451077BD3CE8"><enum>(2)</enum><text>by amending
			 paragraph (3) of subsection (ll) to read as follows:</text>
					<quoted-block id="H15078C46BF564B4597609172EE59AE0B" style="OLC">
						<paragraph id="H4B67EF56287D48FA8F4B907F9BD47086" indent="up1"><enum>(3)</enum><text>The term <term>audiology
				services</term> means only the following services furnished by a qualified
				audiologist as the audiologist is legally authorized to perform under State law
				(or the State regulatory mechanism provided by State law), pursuant to an order
				or referral by a physician, as would otherwise be covered if furnished by a
				physician:</text>
							<subparagraph id="H61683C2F36D243BF8087672AA20656BC"><enum>(A)</enum><text>Hearing and balance assessment
				services.</text>
							</subparagraph><subparagraph id="H6FA695071CBF477DAE10E647BDD82E48"><enum>(B)</enum><text>Auditory treatment services, including
				auditory processing and auditory rehabilitation treatment.</text>
							</subparagraph><subparagraph id="H45D86D1F1C224CE396040D4E9D0B6EB8"><enum>(C)</enum><text>Vestibular treatment services.</text>
							</subparagraph><subparagraph id="H16B30D2544204DB98E60B9BB54D4D8D7"><enum>(D)</enum><text>Intraoperative neurophysiologic
				monitoring
				services.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H9AA36E7E9F5447E09E5ACFCBE5A21ED8"><enum>(b)</enum><header>Payment under
			 part B under physician fee schedule for comprehensive audiology
			 services</header><text>Section 1848(j)(3) of the Social Security Act (42 U.S.C.
			 1395w–4(j)(3)) is amended by inserting <quote>(2)(GG),</quote> before
			 <quote>(3),</quote>.</text>
			</subsection><subsection id="HBEA9425ED999404EBADD52C7C1F733A9"><enum>(c)</enum><header>Audiology
			 services performed in hospitals excluded from inpatient hospital
			 services</header><text>Section 1861(b)(4) of the Social Security Act (42 U.S.C.
			 1395x(b)(4)) is amended by striking <quote>and services of a certified
			 registered nurse anesthetist</quote> and inserting <quote>services of a
			 certified registered nurse anesthetist, and inter-operative neurophysiological
			 monitoring provided by a physician or qualified audiologist (as defined in
			 subsection (ll)(4)(B))</quote>.</text>
			</subsection><subsection id="HE9BD73EAC43F4BA39DF2074E0CE047F2"><enum>(d)</enum><header>Requirements of
			 service</header><text>Section 1835(a)(2) of the Social Security Act (42 U.S.C.
			 1395n(a)(2)) is amended—</text>
				<paragraph id="H3786F65BF78E457182211211020090F7"><enum>(1)</enum><text>in subparagraph
			 (B), by striking <quote>and (D)</quote> and inserting <quote>(D), and
			 (GG)</quote>;</text>
				</paragraph><paragraph id="HD33D18EAA3DA46D495C2811649EE99DE"><enum>(2)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (E);</text>
				</paragraph><paragraph id="H20F69D2B31484EB5B98DB0F8A252751D"><enum>(3)</enum><text>by striking the
			 period at the end of subparagraph (F) and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="H13777DBD5CA84307A6A371E3126DF6E8"><enum>(4)</enum><text>by inserting after
			 subparagraph (F) the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HC62F680D169746949307FC29F0C4F7DD" style="OLC">
						<subparagraph id="HC1E65A30D5004C1B92E504CCB1EB7511"><enum>(G)</enum><text display-inline="yes-display-inline">in the case of outpatient audiology
				services, (i) such services are or were required because the individual needed
				the specialized services of a physician or qualified audiologist to furnish
				such audiology services, (ii) a plan of care for furnishing such services has
				been established by the physician or qualified audiologist and is submitted to
				and periodically reviewed by the referring or ordering physician, and (iii)
				such services are or were furnished while the individual is or was under the
				care of a
				physician.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H7AF2DFAD0912408F9CA8EC3E8FA43394"><enum>(e)</enum><header>Audiology
			 services included as designated health services for purposes of limitation on
			 certain physician referrals</header><text>Section 1877(h)(6) of the Social
			 Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395nn">42 U.S.C. 1395nn(h)(6)</external-xref>) is amended by adding at the end the
			 following new subparagraph:</text>
				<quoted-block id="H7D5A1B8A604342D48316FB1FC1647BEB" style="OLC">
					<subparagraph id="H91C8BC705E1748AD886E7CC3D01F56B5"><enum>(M)</enum><text>Audiology services
				(as defined in section
				1861(ll)(3)).</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H35ABFEF2E47A4A69BCAE6574D7335A8D"><enum>(f)</enum><header>Participation in
			 Medicare</header><text>Nothing in this section shall be construed to require a
			 qualified audiologist (as defined in section 1861(ll)(4)(B) of the Social
			 Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ll)(4)(B)</external-xref>)) to participate in the Medicare
			 program under title XVIII of the Social Security Act (42 U.S.C. 1395 et
			 seq.).</text>
			</subsection><subsection id="HC6008F72EA794085B44A098CCEB3F43C"><enum>(g)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to services
			 furnished on or after January 1, 2014.</text>
