committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc><action-instruction>For text of introduced bill, see copy of bill as introduced on June 11, 2013</action-instruction></action><action display="yes"><action-desc display="yes"><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 with respect to the applicability of the Act to Federal facilities, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body changed="added" committee-id="HIF00" display-enacting-clause="yes-display-enacting-clause" id="H37393003E934481681565BE6538DB467" reported-display-style="italic" style="OLC"><section id="HAB5D1EC185CB4D1EAEAB23AEBD705C5E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Facility Accountability Act of 2013</short-title></quote>.</text></section><section id="H7E0327E20081466EA324886F4FC63105"><enum>2.</enum><header>Federal facilities</header><subsection id="HCAB1B9C5EED342EC8FC194790336249B"><enum>(a)</enum><header>Application to Federal Government</header><text display-inline="yes-display-inline">Section 120(a) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9620">42 U.S.C. 9620(a)</external-xref>) is amended in the heading by striking <header-in-text level="subsection" style="OLC"><quote><short-title>of Act</short-title></quote></header-in-text>.</text></subsection><subsection id="H4F99F96B155249C38C4AA6A6D0F7EC51"><enum>(b)</enum><header>Application of requirements to Federal facilities</header><text display-inline="yes-display-inline">Section 120(a)(2) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9620">42 U.S.C. 9620(a)(2)</external-xref>) is amended—</text><paragraph id="H9C7511BA263D4C599CD608A74DEDA5CC"><enum>(1)</enum><text>by striking <quote>preliminary assessments</quote> and inserting <quote>response actions</quote>;</text></paragraph><paragraph id="H2018AC06651B45129FFCDF9B30625232"><enum>(2)</enum><text>by inserting <quote>or</quote> after <quote>National Contingency Plan,</quote>;</text></paragraph><paragraph id="H1903866827B14BDDB118427A19AF05EE"><enum>(3)</enum><text>by striking <quote>, or applicable to remedial actions at such facilities</quote>; and</text></paragraph><paragraph id="H9693833F8FA54CCDA57127CB8E863927"><enum>(4)</enum><text>by inserting <quote>or have been</quote> before <quote>owned or operated</quote>.</text></paragraph></subsection><subsection id="HEE1E829812D74FC69AED0FF0872E4193"><enum>(c)</enum><header>Applicability of laws</header><text display-inline="yes-display-inline">Section 120(a)(4) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9620">42 U.S.C. 9620(a)(4)</external-xref>) is amended to read as follows:</text><quoted-block changed="added" committee-id="HIF00" display-inline="no-display-inline" id="HF69DBBB084AD4AC7B61A047620DDCF1B" reported-display-style="italic" style="OLC"><paragraph id="H9BC7CCC3E5334918B8F090826C7D87C0"><enum>(4)</enum><header>Applicability of laws</header><subparagraph id="H994EF695F21A49BAB082460ACEED13DF"><enum>(A)</enum><header>In general</header><text>Each department, agency, and instrumentality of the United States shall be subject to, and comply with, at facilities that are or have been owned or operated by any such department, agency, or instrumentality, State substantive and procedural requirements regarding response relating to hazardous substances or pollutants or contaminants, including State hazardous waste requirements, in the same manner and to the same extent as any nongovernmental entity.</text></subparagraph><subparagraph id="H3F65A5D57B6147BA8B112B4520DE3EE6"><enum>(B)</enum><header>Compliance</header><clause id="H57482704CFB84934A0156F40D4345889"><enum>(i)</enum><header>In general</header><text>The United States hereby expressly waives any immunity otherwise applicable to the United States with respect to any State substantive or procedural requirement referred to in subparagraph (A).</text></clause><clause id="H52D9236103EE4EF5865026E13D4D3278"><enum>(ii)</enum><header>Injunctive relief</header><text>Neither the United States, nor any agent, employee, nor officer thereof, shall be immune or exempt from any process or sanction of any State or Federal Court with respect to the enforcement of any injunctive relief under subparagraph (C)(ii).</text></clause><clause id="HEFAE60287086480CAE2E72118D3ED6D9"><enum>(iii)</enum><header>Civil penalties</header><text display-inline="yes-display-inline">No agent, employee, or officer of the United States shall be personally liable for any civil penalty under any State substantive or procedural requirement referred to in subparagraph (A), or this Act, with respect to any act or omission within the scope of the official duties of the agent, employee, or officer.</text></clause></subparagraph><subparagraph id="H25452EBD759047CDBD30A48305953D3F"><enum>(C)</enum><header>Substantive and procedural requirements</header><text display-inline="yes-display-inline">The State substantive and procedural requirements referred to in subparagraph (A) include—</text><clause id="H4850AC3B451F465F995E722CEB3A14D2"><enum>(i)</enum><text>administrative orders;</text></clause><clause id="H788CB181F8AB499B927533CABC1A6289"><enum>(ii)</enum><text>injunctive relief;</text></clause><clause id="H2C148484E0AE47268358E3189F60EE77"><enum>(iii)</enum><text>civil and administrative penalties and fines, regardless of whether such penalties or fines are punitive or coercive in nature or are imposed for isolated, intermittent, or continuing violations;</text></clause><clause id="H2DD60CBB02B34A62BBFAB2BFE756E7E8"><enum>(iv)</enum><text>reasonable service charges or oversight costs; and</text></clause><clause id="HF2379793C55E447C893650B4BD46EB0A"><enum>(v)</enum><text display-inline="yes-display-inline">laws or regulations requiring the imposition and maintenance of engineering or land use controls.</text></clause></subparagraph><subparagraph id="HD61CCFEFAC064985954A8713F98D2BB3"><enum>(D)</enum><header>Reasonable service charges or oversight costs</header><text display-inline="yes-display-inline">The reasonable service charges or oversight costs referred to in subparagraph (C) include fees or charges assessed in connection with—</text><clause id="H143025F5DF744F529FBE6E6F847FFC6E"><enum>(i)</enum><text>the processing, issuance, renewal, or modification of permits;</text></clause><clause id="H99DAEC5C13B3472995259C4DD00F9E9B"><enum>(ii)</enum><text>the review of plans, reports, studies, and other documents;</text></clause><clause id="HD8D4E09B3A674B838AB418B2F32411E8"><enum>(iii)</enum><text>attorney’s fees;</text></clause><clause id="H593F5D5D9B8240929709FF5E461A0ED9"><enum>(iv)</enum><text>inspection and monitoring of facilities or vessels; and</text></clause><clause id="H1B43276954E44155B9A0F8AD9A39DAD8"><enum>(v)</enum><text display-inline="yes-display-inline">any other nondiscriminatory charges that are assessed in connection with a State requirement regarding response relating to hazardous substances or pollutants or contaminants.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H95EF0337A28A4DC984328C330BFB7AB7"><enum>3.</enum><header>Authority to delegate, issue regulations</header><text display-inline="no-display-inline">Section 115 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9615">42 U.S.C. 9615</external-xref>) is amended by adding at the end the following new sentence: <quote>If the President delegates or assigns any duties or powers under this section to a department, agency, or instrumentality of the United States other than the Administrator, the Administrator may review, as the Administrator determines necessary or upon request of any State, actions taken, or regulations promulgated, pursuant to such delegation or assignment, for purposes of ensuring consistency with the guidelines, rules, regulations, or criteria established by the Administrator under this title.</quote>.</text></section></legis-body><endorsement display="yes"><action-date date="20131101">November 1, 2013</action-date><action-desc>The <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name> discharged;
