<official-title>To amend title XVIII of the Social Security Act to strengthen and protect Medicare hospice programs.</official-title>

<section id="HC520BFE5EEC6440296EB3DCEEC22305B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hospice Evaluation and Legitimate Payment Act of 2013</short-title></quote>.</text></section> 
<section id="HB4BD3BF53F0649948AB548C6E48F58CD"><enum>2.</enum><header>Ensuring timely access to hospice care</header> 
<subsection id="HACA769C0D14B4662BF0E82EA78AAF845"><enum>(a)</enum><header>In general</header><text>Section 1814(a)(7)(D)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f(a)(7)(D)(i)</external-xref>) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H16804A3762C34C65AD952F3A1D2B7B77" style="OLC"> 
<clause id="HF89EE6D35CF340EAA130C3DBDBEDD30B"><enum>(i)</enum><text>a hospice physician, nurse practitioner, clinical nurse specialist, or physician assistant (as those terms are defined in section 1861(aa)(5)), or other health professional (as designated by the Secretary), has a face-to-face encounter with the individual to determine continued eligibility of the individual for hospice care prior to the first 60-day period and each subsequent recertification under subparagraph (A)(ii) (or, in the case where a hospice program newly admits an individual who would be entering their first 60-day period or a subsequent hospice benefit period or where exceptional circumstances, as defined by the Secretary, may prevent a face-to-face encounter prior to the beginning of the hospice benefit period, not later than 7 calendar days after the individual’s election under section 1812(d)(1) with respect to the hospice program) and attests that such visit took place (in accordance with procedures established by the Secretary); and</text></clause><after-quoted-block>. </after-quoted-block></quoted-block></subsection> 
<subsection id="HD30574F0AD2044E7928F074E7F6C1655"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) takes effect on January 1, 2014, and applies to hospice care furnished on or after such date.</text></subsection></section> 
<section id="HF68BFFED0D9E4B95AD948EC09B303A7A"><enum>3.</enum><header>Restoring and protecting the Medicare hospice benefit</header> 
<subsection id="HB68365FE1BDB47D7A6D63ACB667BA072"><enum>(a)</enum><header>In general</header><text>Section 1814(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f(i)</external-xref>) is amended—</text> 
<paragraph id="H49774B3C56BB4AFCBBB4061191899D86"><enum>(1)</enum><text>in paragraph (6)—</text> 
<subparagraph id="H460C1A724F544600B0A8C3F370A84608"><enum>(A)</enum><text>in subparagraph (D)—</text> 
<clause id="H4713AFF37510418EAD94F4CBBC87B616"><enum>(i)</enum><text>in clause (i)—</text> 
<subclause id="H7A43A6037B4C4FF9B185E6A08281B12C"><enum>(I)</enum><text>in the first sentence, by striking <quote>not earlier than October 1, 2013, the Secretary shall, by regulation,</quote> and inserting <quote>subject to clause (iii), not earlier than the later of 2 years after the demonstration program under subparagraph (F) is completed or October 1, 2017, the Secretary shall, by regulation, preceded by a notice of the proposed regulation in the Federal Register and a period for public comment in accordance with section 1871(b)(1),</quote>; and</text></subclause> 
<subclause id="H19D33AE2B5C4480A9983F9D5283B6BD4"><enum>(II)</enum><text>in the second sentence, by inserting <quote> and shall take into account the results of the evaluation conducted under subparagraph (F)(ii)</quote> before the period; and</text></subclause></clause> 
<clause id="HBF00649348814F5A84104B9F6A8302EB"><enum>(ii)</enum><text>by adding at the end the following new clause:</text> 
<quoted-block display-inline="no-display-inline" id="H5CFC97F92CE64B6F8183E200D49A5C9E" style="OLC"> 
<clause id="H1D29C2C599C444B5B3B261948BEFA395" indent="up1"><enum>(iii)</enum><text>The Secretary shall implement the revisions in payment pursuant to clause (i) unless the Secretary determines that the demonstration program under subparagraph (F) demonstrated that such revisions would adversely affect access to quality hospice care by beneficiaries under this title.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="HE5A08E9E2B41409593C0664FA8BB2B43"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="HA94DBA8FAE744B9A8B1DD34AC921899E" indent="up1"><enum>(F)</enum><header>Hospice payment reform demonstration program</header> 
<clause id="H5D2929A54F644303A4D07FFA790715C1"><enum>(i)</enum><header>Establishment of demonstration program</header> 
<subclause id="H2F2FF1C94A634EDD99669B735FC6D234"><enum>(I)</enum><header>In general</header><text>Before implementing any revisions to the methodology for determining the payment rates for routine home care and other services included in hospice care under subparagraph (D), the Secretary shall establish a Medicare Hospice Payment Reform demonstration program (in this subparagraph referred to as the <quote>demonstration program</quote>) to test such proposed revisions.</text></subclause> 
<subclause id="H13E9BEB9652C42D2945564A62740867E"><enum>(II)</enum><header>Duration</header><text>The demonstration program shall be conducted for a 2-year period beginning on or after October 1, 2013.</text></subclause> 
<subclause id="H8F89B4C02F31415683139B8827B4AB16"><enum>(III)</enum><header>Scope</header><text>Any certified hospice program may apply to participate in the demonstration program and the Secretary shall select not more than 15 such hospice programs to participate in the demonstration program.</text></subclause> 
<subclause id="H2DF0434E56F44B44BA058860A5C3CAC4"><enum>(IV)</enum><header>Representative participation</header><text>Hospice programs selected under subclause (III) to participate in the demonstration program shall include a representative cross-section of hospice programs throughout the United States, including programs located in urban and rural areas.</text></subclause> </clause> 
<clause id="H517A6466F2024C26AA740DA45EC1A309"><enum>(ii)</enum><header>Evaluation and report</header> 
<subclause id="HB14A9730123C4ACDB8AB8901C165FE2A"><enum>(I)</enum><header>Evaluation</header><text>The Secretary shall conduct an evaluation of the demonstration program. Such evaluation shall include an analysis of whether the use of the revised payment methodology under the demonstration program has improved the quality of patient care and access to hospice care for beneficiaries under this title and the impact of such payment revisions on hospice care providers, including the impact, if any, on the ability of hospice programs to furnish quality care to beneficiaries under this title.</text></subclause> 
<subclause id="H14DDD7A98C084A79B5017798D5D1DB8A"><enum>(II)</enum><header>Report</header><text>Not later than 2 years after the completion of the demonstration program, the Secretary shall submit to Congress a report containing the results of the evaluation conducted under subclause (I), together with recommendations for such legislation and administrative action as the Secretary determines appropriate.</text></subclause></clause> 
<clause id="H4F03EF6DC7DF4487B000C51D5CF5CF27"><enum>(iii)</enum><header>Budget neutrality</header><text display-inline="yes-display-inline">With respect to the 2-year period of the demonstration program, the Secretary shall ensure that revisions in payment implemented as part of the demonstration program shall result in the same estimated amount of aggregate payments under this title for hospice care for the programs participating in the demonstration as would have been made if the hospice programs had not participated in the demonstration program. </text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> </paragraph></subsection></section> 
<section id="H436A3F8E6C1D4795A1B42D902A464D92"><enum>4.</enum><header>Hospice survey requirement</header> <text display-inline="no-display-inline">Section 1861(dd)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(dd)(4)</external-xref>) is amended by adding at the end the following new subparagraph:</text> 
<quoted-block display-inline="no-display-inline" id="H86E661FFF5A24BF19C257CBA82DA984F" style="OLC"> 
<subparagraph id="H53A1569BFE114D74B5AA97E66E43F013" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">Any entity that is certified as a hospice program shall be subject to a standard survey by an appropriate State or local survey agency, or an approved accreditation agency, as determined by the Secretary, not less frequently than once every 36 months beginning 6 months after the date of the enactment of this subparagraph.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
