		<section id="HB0C018259F3046EAA38D67342393DDFD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Foreign Counterfeit Merchandise
			 Prevention Act</short-title></quote>.</text>
		</section><section id="H9F298E2CE2444F549B353A475C095BBD"><enum>2.</enum><header>Exchange of
			 information related to trade enforcement</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1905">Section 1905</external-xref> of title 18, United States
			 Code, is amended—</text>
			<paragraph id="H83757C9D474840858DD234EFB3022DF8"><enum>(1)</enum><text>by striking
			 <quote>Whoever</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">In
			 general.—</header-in-text>Whoever</quote>; and</text>
			</paragraph><paragraph id="H7D9F5F9A255144008A58287FE9E9CDB1"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="HC9E7383E5C9A49D2803F0611746F4044" style="OLC">
					<subsection id="H037415AE683041CE95D3C85BAC9C7ED1"><enum>(b)</enum><header>Provision of
				information relating to merchandise presented to Customs</header><text>It shall
				not be a violation of this section for an officer or employee of U.S. Customs
				and Border Protection, upon detention and thereafter, to provide to the owner
				of a copyright or a registered mark, or to any person who may be injured by a
				violation of <external-xref legal-doc="usc" parsable-cite="usc/17/1201">section 1201</external-xref> of title 17—</text>
						<paragraph id="HA2F318F3AA874B54B327873464CC7E3E"><enum>(1)</enum><text>any information
				appearing on the merchandise, including its retail packaging,</text>
						</paragraph><paragraph id="H412D60EF6E23435387A9CE40D9F5FA6C"><enum>(2)</enum><text>a sample of the
				merchandise and its retail packaging, or</text>
						</paragraph><paragraph id="H8E349AEE3E324617954310BAB56E9BBB"><enum>(3)</enum><text>digital images of
				the merchandise and its retail packaging,</text>
						</paragraph><continuation-text continuation-text-level="subsection">as it was
				presented to U.S. Customs and Border Protection, without redaction, whether
				imported into or exported from the United States, or attempted to be exported
				from the United States, for purposes of determining whether the merchandise or
				its retail packaging infringes the copyright, bears or consists of a
				counterfeit mark of the registered mark, or is in violation of section 1201 of
				title 17, as the case may be.</continuation-text></subsection><subsection id="H3CE59592017E41CF9444859009EDC657"><enum>(c)</enum><header>Provision of
				information relating to seized merchandise</header><text>It shall not be a
				violation of this section for an officer or employee of U.S. Customs and Border
				Protection, after seizing merchandise pursuant to a determination that the
				merchandise is in violation of <external-xref legal-doc="usc" parsable-cite="usc/17/1201">section 1201</external-xref> of title 17, to provide, to persons
				injured by the violation, information with respect to the merchandise,
				including, but not limited to, the following:</text>
						<paragraph id="H6678DB4BF1C84A6FAA3FC7CD6C9A9A7F"><enum>(1)</enum><text>The date of
				importation.</text>
						</paragraph><paragraph id="H578D5849205D4403BC4A9DEA6EFF7171"><enum>(2)</enum><text>The port of
				entry.</text>
						</paragraph><paragraph id="H52FC1C6E039945E5937DFCD3A20C6AB1"><enum>(3)</enum><text>The description of
				the merchandise from the entry.</text>
						</paragraph><paragraph id="HC98EB3B952A6484A96EE886F59BB7D39"><enum>(4)</enum><text>The quantity
				involved.</text>
						</paragraph><paragraph id="H99184106EA714324973D0D7AE24E53C8"><enum>(5)</enum><text>The country of
				origin of the merchandise.</text>
						</paragraph><paragraph id="H68A7B0D04EE840BB894F81D6331792FC"><enum>(6)</enum><text>The name and
				address of the foreign manufacturer.</text>
						</paragraph><paragraph id="H8F8718C6A04F4C6D92F29C09CBED5201"><enum>(7)</enum><text>The name and
				address of the exporter.</text>
						</paragraph><paragraph id="HABAC430960EA446DB0ACDD07FE3686F9"><enum>(8)</enum><text>The name and
				address of the importer.</text>
						</paragraph><paragraph id="H2634A02D78984FC7BEC3FF33144DC0E6"><enum>(9)</enum><text>Photographic or
				digital images of the merchandise.</text>
						</paragraph></subsection><subsection id="H97A9FE14BC584B65A633880AC71F9DE9"><enum>(d)</enum><header>Definitions</header><text>As
				used in this section—</text>
						<paragraph id="H2C6372DA81794FDBB11208DE965B1203"><enum>(1)</enum><text>the term
				<term>registered mark</term> has the meaning given that term in section 45 of
				the Lanham Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1127">15 U.S.C. 1127</external-xref>);</text>
						</paragraph><paragraph id="H2661C70E0F6440E5B4FDAFD04FA46A18"><enum>(2)</enum><text>the term
				<term>Lanham Act</term> has the meaning given that term in section 2320(f) of
				this title;</text>
						</paragraph><paragraph id="HA98F84AF934C44F68EFDB75C56DFC0C8"><enum>(3)</enum><text>the term
				<term>counterfeit mark</term> has the meaning given that term in section
				2320(f) of this title; and</text>
						</paragraph><paragraph id="H3F2B24048CDE49EE8548A9B98B1FE9CE"><enum>(4)</enum><text>the term
				<term>without redaction</term> means, with respect to merchandise, without
				removing, revising, or otherwise obscuring any information, codes, marks,
				numbers, or any other markings that appear on the merchandise or its retail
				packaging.</text>
						</paragraph></subsection><subsection id="H2F0B4696614D4E7BAD17DC2BEF2E6344"><enum>(e)</enum><header>Rule of
				construction</header><text>Subsections (b), (c), and (d) apply only with
				respect to tangible goods presented to U.S. Customs and Border Protection for
				importation into, or exportation from, the United
				States.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HD999A7D9740B4083A010F65B5F0EDF9D"><enum>3.</enum><header>Prevention of
			 importation of manufactured goods bearing infringing marks</header>
			<subsection id="H6092A4E94E8D47208453D088D122C56B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 42 of the
			 Lanham Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1124">15 U.S.C. 1124</external-xref>), is amended—</text>
				<paragraph id="H3D945A7E2FD14607AA58FF463D2B7513"><enum>(1)</enum><text>in the first
			 sentence, by striking <quote>Except as</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">In
			 general.—</header-in-text>Except as</quote>;</text>
				</paragraph><paragraph id="HEA792BAE9A76465A8B4B15E86360BD71"><enum>(2)</enum><text>by striking
			 <quote>of the Treasury</quote> each place it appears and inserting <quote>of
			 Homeland Security</quote>; and</text>
				</paragraph><paragraph id="HFD7979BC98DE47A697B521732C5EE28A"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H77E4B8446B1740E7BE2711779B5015B5" style="OLC">
						<subsection id="H52826608C78345309003DE5CC387BCB6"><enum>(b)</enum><header>Detention of
				critical merchandise</header><text display-inline="yes-display-inline">With
				respect to critical merchandise that bears a registered trademark recorded
				under subsection (a), if U.S. Customs and Border Protection detains the
				merchandise because the merchandise is suspected of bearing a counterfeit mark,
				then, upon such detention, the Secretary—</text>
							<paragraph id="H9D6F381B98AA44DE999F465D1A4FAB7C"><enum>(1)</enum><text>shall provide to
				the owner of the registered trademark any information on the critical
				merchandise and its packaging and labels, including, without redaction,
				photographs or digital images of the critical merchandise, packaging, and
				labels; and</text>
							</paragraph><paragraph id="H3CD28AAA061D45BB8834C05E75D9016F"><enum>(2)</enum><text>may, at any time,
				subject to any applicable bonding and return requirements, provide to the owner
				of the registered trademark samples of the critical merchandise, without
				redaction.</text>
							</paragraph></subsection><subsection id="H49FF8F2C0EF940CB9E6C1140839B0759"><enum>(c)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="HB69AB6E076E54293ADB82CDB7B9503EF"><enum>(1)</enum><header>Critical
				merchandise</header>
								<subparagraph id="H48DF4058E6694BD699CA6A4CC4584727"><enum>(A)</enum><header>In
				general</header><text>The term <term>critical merchandise</term>
				includes—</text>
									<clause id="H9774AB420CA44415B3C288EA071B4C13"><enum>(i)</enum><text>aircraft engines,
				appliances, propellers, and spare parts;</text>
									</clause><clause id="HFBB2F964921C4EE6B2692D65896111FB"><enum>(ii)</enum><text>motor vehicle
				equipment;</text>
									</clause><clause id="HC9FAA132B9164D0BA0895341F9A997F7"><enum>(iii)</enum><text>semiconductors;
				and</text>
									</clause><clause id="H4A7BB2EB26514051AF7475BBF4CF2435"><enum>(iv)</enum><text>any other article
				of manufacture that the Secretary determines could, if permitted entry into the
				United States in violation of the laws of the United States pose a danger to
				the health, safety, or welfare of consumers, or to the national security of the
				United States.</text>
									</clause></subparagraph><subparagraph id="H4126443C227F4499A761D7699820E6BC"><enum>(B)</enum><header>Other
				definitions</header><text display-inline="yes-display-inline">For purposes of
				subparagraph (A)—</text>
									<clause id="H5DFC45CC6EEB40A190467263C0599A18"><enum>(i)</enum><text>the terms
				<term>aircraft engine</term>, <term>appliance</term>, <term>propeller</term>,
				and <term>spare part</term> have the meanings given those terms in section
				40102(a) of title 49, United States Code;</text>
									</clause><clause id="H118A83958BB24F2BBA4B473C0B89A41B"><enum>(ii)</enum><text>the term
				<term>motor vehicle equipment</term> has the meaning given that term in section
				30102(a) of title 49, United States Code; and</text>
									</clause><clause id="H1C47209F749F428BB146E34F444FB466"><enum>(iii)</enum><text>the term
				<term>semiconductor</term> means <quote>semiconductor chip product</quote> as
				defined in <external-xref legal-doc="usc" parsable-cite="usc/17/901">section 901</external-xref> of title 17, United States Code.</text>
									</clause></subparagraph></paragraph><paragraph id="H9850D04DD609495A85E085529DA1218E"><enum>(2)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of Homeland Security.</text>
							</paragraph><paragraph id="HCAA1EE1705904F7FBC72E7D90B8CEA6B"><enum>(3)</enum><header>Without
				redaction</header><text display-inline="yes-display-inline">The term
				<term>without redaction</term> means, with respect to merchandise, without
				removing, revising, or otherwise obscuring any information, codes, marks,
				numbers, or any other markings that appear on the merchandise or its retail
				packaging.</text>
							</paragraph></subsection><subsection id="H687B0498ECEE40D59B945721CE97D5BD"><enum>(d)</enum><header>Rule of
				construction</header><text>This section applies only with respect to tangible
				goods presented to U.S. Customs and Border Protection for importation into the
				United
				States.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H2456C3DDDB9542F782B69006FD506A14"><enum>(b)</enum><header>Definition</header><text>In
			 this section, the term <term>Lanham Act</term> means the Act entitled <quote>An
			 Act to provide for the registration and protection of trademarks used in
			 commerce, to carry out the provisions of certain international conventions, and
			 for other purposes</quote>, approved July 5, 1946 (15 U.S.C. 1051 et
			 seq.).</text>
			</subsection><subsection id="H6907610641F145869C7AF8600C6D3154"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect upon
			 the expiration of the 60-day period beginning on the date of the enactment of
			 this Act.</text>
