<official-title>To amend the Solid Waste Disposal Act relating to review of regulations under such Act and to amend the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 relating to financial responsibility for classes of facilities.</official-title>

<section id="HED97BA82470845A49F6F263B0E52F4EC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reducing Excessive Deadline Obligations Act of 2013</short-title></quote>.</text></section> 
<section id="H9360B1F6CF1A4009B80F8E9F12C5313D"><enum>2.</enum><header>Review of regulations under the Solid Waste Disposal Act</header><text display-inline="no-display-inline">Section 2002(b) of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6912">42 U.S.C. 6912(b)</external-xref>) is amended to read as follows: </text> 
<quoted-block style="OLC" id="H64A60F5B03B844A0BA65CC49142D7ADA" display-inline="no-display-inline"> 
<subsection id="H6332CFE815AE4773A029964E7269B9F6"><enum>(b)</enum><header>Review of regulations</header><text display-inline="yes-display-inline">The Administrator shall review, and revise, as the Administrator determines appropriate, regulations promulgated under this Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H926EA93E40594B7C907F4EF158C007A7"><enum>3.</enum><header>Financial responsibility for classes of facilities under CERCLA</header><text display-inline="no-display-inline">Section 108(b) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9608">42 U.S.C. 9608(b)</external-xref>) is amended—</text> 
<paragraph id="H87D2A4E47CBB4299806F87B27722D1C2"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="HF44E2FD2719D4602B3F002AC1F0AC55B"><enum>(A)</enum><text>by striking <quote>Not later than three years after the date of enactment of the Act, the President shall</quote> and inserting <quote>The President shall, as appropriate,</quote>; and</text></subparagraph> 
<subparagraph id="H607636EA04FE4E9398C43DE6C1CCD8F0"><enum>(B)</enum><text>by striking <quote>first</quote> after <quote>for which requirements will be</quote>; and</text></subparagraph> </paragraph> 
<paragraph id="H196CD21F47B8467D9F63CD329C27F60F" commented="no"><enum>(2)</enum><text>in paragraph (2)—</text> 
<subparagraph id="H1E34B5B4F428404E86D0A14B94A587A9" commented="no"><enum>(A)</enum><text>by striking <quote>any one, or any combination, of the following:</quote> and inserting <quote>forms of security, including</quote>; and</text></subparagraph> 
<subparagraph id="H3C753051C0FA458892A35FE9E902EA8A" commented="no"><enum>(B)</enum><text>by striking <quote>or qualification</quote> and inserting <quote>and qualification</quote>.</text></subparagraph></paragraph></section> 
<section id="H9B0BB5E3A32544638323DED30B77E533"><enum>4.</enum><header>Report to Congress regarding financial responsibility requirements</header><text display-inline="no-display-inline">Section 108(b) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9608">42 U.S.C. 9608(b)</external-xref>) is further amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H1E285F0ACBB84167BE39EE5F8E9CFB02" display-inline="no-display-inline"> 
<paragraph id="HD681B52A2BB349B1BFCF96EB96776916" indent="up1"><enum>(6)</enum><text>The President may not promulgate any financial responsibility requirement under this subsection without first submitting to Congress a report—</text> 
<subparagraph id="H4D14B4D3F2AF41DDBF9CB4E4D6824707"><enum>(A)</enum><text>describing each facility or class of facilities to be covered by such requirement;</text></subparagraph> 
<subparagraph id="H11779E1E637D420794850CC9980EE628"><enum>(B)</enum><text>describing the development of such requirement, why the facility or class of facilities proposed to be covered by such requirement present the highest level of risk of injury, and why the facility or class of facilities is not already covered by adequate financial responsibility requirements;</text></subparagraph> 
<subparagraph id="HBFC00FE50CC74020A7E48EAAA4F0A80D"><enum>(C)</enum><text>describing the financial responsibility requirements promulgated by States or other Federal agencies for the facility or class of facilities to be covered by the financial responsibility requirement proposed under this subsection and explaining why the requirement proposed under this subsection is necessary; </text></subparagraph> 
<subparagraph id="H531293DB57B0488E807FB0D808DC76A5"><enum>(D)</enum><text>describing the exposure to the Fund for response costs resulting from the facility or class of facilities proposed to be covered; and </text></subparagraph> 
<subparagraph id="H3086A35F6ACC4BE4B52361B3628F9893"><enum>(E)</enum><text>describing the capacity of the financial and credit markets to provide instruments of financial responsibility necessary to meet such requirement.</text></subparagraph><continuation-text continuation-text-level="paragraph">The President shall update any report submitted under this paragraph to reflect any revision of the facilities or classes of facilities to be covered by a financial responsibility requirement that is the subject of such report.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H4347749936E84E4DAB37A80B15E5163B"><enum>5.</enum><header>Preemption of financial responsibility requirements</header><text display-inline="no-display-inline">Section 114(d) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9614">42 U.S.C. 9614(d)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="HF07075E5163F4377A4F50BFE04D2A47E" display-inline="no-display-inline"> 
<subsection id="HF670900BA3614332AF63A3EE0AC0AD43"><enum>(d)</enum><text display-inline="yes-display-inline">No owner or operator of a vessel or facility who establishes and maintains evidence of financial responsibility associated with the production, transportation, treatment, storage, or disposal of hazardous substances pursuant to financial responsibility requirements under any State law or regulation, or any other Federal law or regulation, shall be required to establish or maintain evidence of financial responsibility under this title, unless the President determines, after notice and opportunity for public comment, that in the event of a release, such other Federal or State financial responsibility requirements are insufficient to cover likely response costs under section 104. Except as provided in this subsection, evidence of compliance with such other Federal or State financial responsibility requirements shall be accepted by the President in lieu of compliance with any requirement for financial responsibility promulgated under this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
