		<section id="H7729ACD4FAC74BF0A2CFE6FFF4864538" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Crop Insurance Accountability Act of
			 2013</short-title></quote>.</text>
		</section><section id="H53A5E8774C4048B8BA0B24EFA2C66BC3"><enum>2.</enum><header>Highly erodible
			 land and wetland conservation for crop insurance</header>
			<subsection id="H336C26C2358E4ECEAB32C8C1ECBC9266"><enum>(a)</enum><header>Highly erodible
			 land program ineligibility</header>
				<paragraph id="H278F656A9C504C5883A6965719335DD8"><enum>(1)</enum><header>In
			 general</header><text>Section 1211(a)(1) of the Food Security Act of 1985 (16
			 U.S.C. 3811(a)(1)) is amended—</text>
					<subparagraph id="H2E4B8EBF6DBA41BD947028C4AFCE23DA"><enum>(A)</enum><text>in subparagraph
			 (C), by striking <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="HF4A22F98635F4705BB589BDE788D1175"><enum>(B)</enum><text>in subparagraph
			 (D), by adding <quote>or</quote> at the end; and</text>
					</subparagraph><subparagraph id="HD47EF4745C1343D9AB3525D8E51A4701"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H9F78AE06367049D993D4F2E3E9AF9B9A" style="OLC">
							<subparagraph id="HD8CB8C9834EE42B5BBCA1F3960361610"><enum>(E)</enum><text>any portion of the
				premium paid by the Federal Crop Insurance Corporation for a policy or plan of
				insurance under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>), on the
				condition that if a person is determined to have committed a violation under
				this subsection during a crop year, ineligibility under this subparagraph
				shall—</text>
								<clause id="HCC5C13D1F5CA483C9E00C521D00C1D33"><enum>(i)</enum><text>only apply to
				reinsurance years subsequent to the date of final determination of a violation,
				including all administrative appeals; and</text>
								</clause><clause id="H3413191182C846D6A5783D3DF62212B8"><enum>(ii)</enum><text>not apply to the
				existing reinsurance year or any reinsurance year prior to the date of final
				determination.</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H6F498B1489734AFBB1463940850AD16E"><enum>(2)</enum><header>Exemptions</header><text>Section
			 1212(a)(2) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3812">16 U.S.C. 3812(a)(2)</external-xref>) is
			 amended—</text>
					<subparagraph id="H36C40B3EE49648DB84EF7013269CEBA1"><enum>(A)</enum><text>in the first
			 sentence, by striking <quote>(2) If,</quote> and inserting the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="H0F6423101A404DF8B63B06C089424C21" style="OLC">
							<paragraph id="H58B518239CC5484186F23954530EE6CF"><enum>(2)</enum><header>Eligibility
				based on compliance with conservation plan</header>
								<subparagraph id="H14896DC677E5449AAA032B74C31C53FF"><enum>(A)</enum><header>In
				general</header><text>If,</text>
								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H2DB954DDF35C4D22858A0FA054601877"><enum>(B)</enum><text>in the second
			 sentence, by striking <quote>In carrying</quote> and inserting the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="H3E85B4434E47449BB2A3F7C8C306F545" style="OLC">
							<subparagraph id="H18AA3292165B406A92E2766EDB23E3BC"><enum>(B)</enum><header>Minimization of
				documentation</header><text>In carrying</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H42A96C4D962B452C86DED7094B5AF0EE"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H3F8F75E2A3F446DD9F3AD02903B97CC8" style="OLC">
							<subparagraph id="HB44A4D09164C46C181ADC4C121BA582A"><enum>(C)</enum><header>Crop
				insurance</header>
								<clause id="H5D4B0B5BCC904776A6654895539A227A"><enum>(i)</enum><header>In
				general</header><text>Notwithstanding section 1211(a)—</text>
									<subclause id="H73CBFAEDD6AD4ACE80FC5CFEBED36135"><enum>(I)</enum><text>in the case of a
				person that is subject to section 1211 for the first time after May 1, 2013,
				due to the amendment made by section 2(a) of the
				<short-title>Crop Insurance Accountability Act of
				2013</short-title>, any person who produces an agricultural commodity on the
				land that is the basis of the payments described in section 1211(a)(1)(E) shall
				have 5 reinsurance years after the date on which such payments become subject
				to section 1211 to develop and comply with an approved conservation plan so as
				to maintain eligibility for such payments; and</text>
									</subclause><subclause id="H1A127F847BF84432979C1716351E1582"><enum>(II)</enum><text>in the case of a
				person that the Secretary determines would have been in violation of section
				1211(a) if the person had continued participation in the programs requiring
				compliance at any time after the date of enactment of the Food, Conservation,
				and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/8701">7 U.S.C. 8701 et seq.</external-xref>) and is currently in violation of
				section 1211(a), the person shall have 2 reinsurance years after the date on
				which the payments described in section 1211(a)(1)(E) become subject to section
				1211 to develop and comply with an approved conservation plan, as determined by
				the Secretary, so as to maintain eligibility for such payments.</text>
									</subclause></clause><clause display-inline="no-display-inline" id="HB88FB4B10584420EAE860E1B6E9E4CC7"><enum>(ii)</enum><header>Certification</header>
									<subclause id="HBC20462CCF394C7693FCB94534D329E5"><enum>(I)</enum><header>In
				general</header><text>Beginning with the first full reinsurance year
				immediately following the date of enactment of this subparagraph, all persons
				seeking eligibility for the payment of a portion of the premium paid by the
				Federal Crop Insurance Corporation for a policy or plan of insurance under the
				Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>) shall provide certification
				of compliance with section 1211(a), as determined by the Secretary.</text>
									</subclause><subclause id="H429869B69B0B467CB48C8675C1180BF5"><enum>(II)</enum><header>Timely
				evaluation</header><text>The Secretary shall evaluate the certification in a
				timely manner and—</text>
										<item id="HEF8E925E348B49BBB66671D4F6D2E214"><enum>(aa)</enum><text>a
				person who has properly complied with certification shall be held harmless with
				regard to eligibility during the period of evaluation; and</text>
										</item><item id="H2E8898C2DF194449ADE2234DE0BF260A"><enum>(bb)</enum><text>if
				the Secretary fails to evaluate the certification in a timely manner and the
				person is subsequently found to be in violation of section 1211(a),
				ineligibility shall not apply to the person for that violation.</text>
										</item></subclause><subclause id="H7766A80DD30949D2832A5127806EB6DB"><enum>(III)</enum><header>Equitable
				contribution</header>
										<item id="H784A4EC148C7489D8869D18364AA7242"><enum>(aa)</enum><header>In
				general</header><text>If a person fails to provide certification of compliance
				to the Secretary as required and is subsequently found in violation of section
				1211(a), the Secretary shall determine the amount of an equitable contribution
				to conservation in accordance with section 1241(e) by the person for the
				violation.</text>
										</item><item id="HE48605705080416691A312781C4B3422"><enum>(bb)</enum><header>Limitation</header><text>The
				contribution shall not exceed the total of the portion of the premium paid by
				the Federal Crop Insurance Corporation for a policy or plan of insurance for
				all years the person is determined to have been in violation subsequent to the
				date on which certification was first required under this
				clause.</text>
										</item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H24DF2C0755A14087AADFBAEDD05A45FC"><enum>(b)</enum><header>Wetland
			 conservation program ineligibility</header><text>Section 1221 of the Food
			 Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3821">16 U.S.C. 3821</external-xref>) is amended—</text>
				<paragraph id="HD47EEA50CC7B443FA38521B5E91295FF"><enum>(1)</enum><text>in subsection (b),
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H079F02F5B1284B80B7709E6F1762ACFB" style="OLC">
						<paragraph id="HD9ABEC87A1E74C0891C3F91438B1E929"><enum>(4)</enum><header>Crop
				insurance</header>
							<subparagraph id="HF3A27FD1CA624FDEB27ECE02040512C7"><enum>(A)</enum><header>In
				general</header><text>Except as provided in this paragraph, a person subject to
				a final determination, including all administrative appeals, of a violation of
				subsection (c) shall have 1 reinsurance year to initiate a conservation plan to
				remedy the violation, as determined by the Secretary, before becoming
				ineligible under that subsection in the following reinsurance year to receive
				any payment of any portion of the premium paid by the Federal Crop Insurance
				Corporation for a policy or plan of insurance under the Federal Crop Insurance
				Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>).</text>
							</subparagraph><subparagraph id="H4EAB288068984D78BE6FF2C891C55476"><enum>(B)</enum><header>Applicability</header><text>In
				the case of a person that is subject to this subsection or subsection (d) for
				the first time due to the amendment made by section 2(b) of the
				<short-title>Crop Insurance Accountability Act of
				2013</short-title>, the person shall have 2 reinsurance years after the date of
				final determination, including all administrative appeals, to take such steps
				as the Secretary determines appropriate to remedy or mitigate the violation in
				accordance with subsection (c).</text>
							</subparagraph><subparagraph id="HAB63D1DB314A44DFB3B59BFB81209414"><enum>(C)</enum><header>Good
				faith</header><text>If the Secretary determines that a person subject to a
				final determination, including all administrative appeals, of a violation of
				subsection (c) acted in good faith and without intent to violate this section
				as described in section 1222(h), the Secretary shall give the person 1
				reinsurance year to begin mitigation, restoration, or such other steps as are
				determined necessary by the Secretary.</text>
							</subparagraph><subparagraph id="H07322F005214407A94401560AAE1FF13"><enum>(D)</enum><header>Tenant
				relief</header>
								<clause id="HD46B0B1680304C14971EEEFBAC3BC964"><enum>(i)</enum><header>In
				general</header><text>If a tenant is determined to be ineligible for payments
				and other benefits under this section, the Secretary may limit the
				ineligibility only to the farm that is the basis for the ineligibility
				determination if the tenant has established, to the satisfaction of the
				Secretary that—</text>
									<subclause id="H5639752616C345CEA63E17447119DC71"><enum>(I)</enum><text>the tenant has
				made a good faith effort to meet the requirements of this section, including
				enlisting the assistance of the Secretary to obtain a reasonable conservation
				plan for restoration or mitigation for the farm;</text>
									</subclause><subclause id="H0E0C21EFA535464AB3F1A6358A0A782B"><enum>(II)</enum><text>the landlord on
				the farm refuses to comply with the plan on the farm; and</text>
									</subclause><subclause id="HF1236A22C8E84EFCB46882F31E8756CF"><enum>(III)</enum><text>the Secretary
				determines that the lack of compliance is not a part of a scheme or device to
				avoid the compliance.</text>
									</subclause></clause><clause id="H7712AA00A121435C8AE418E7C83B7BD9"><enum>(ii)</enum><header>Report</header><text>The
				Secretary shall provide an annual report to the Committee on Agriculture of the
				House of Representatives and the Committee on Agriculture, Nutrition, and
				Forestry of the Senate concerning the ineligibility determinations limited
				during the previous 12-month period under this subparagraph.</text>
								</clause></subparagraph><subparagraph id="HF456B6C8298544CD8EA0D1EDFF037B29"><enum>(E)</enum><header>Certification</header>
								<clause id="H738AA519207946B8AF39AB87FA036E4F"><enum>(i)</enum><header>In
				general</header><text>Beginning with the first full reinsurance year
				immediately following the date of enactment of this paragraph, all persons
				seeking eligibility for the payment of a portion of the premium paid by the
				Federal Crop Insurance Corporation for a policy or plan of insurance under the
				Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>) shall provide certification
				of compliance with this section as determined by the Secretary.</text>
								</clause><clause id="H54115E151EBB41BC92B1A539CE2CCECF"><enum>(ii)</enum><header>Timely
				evaluation</header><text>The Secretary shall evaluate the certification in a
				timely manner and—</text>
									<subclause id="H25D5A2F4B16346B483391B678AB1E9BB"><enum>(I)</enum><text>a person who has
				properly complied with certification shall be held harmless with regard to
				eligibility during the period of evaluation; and</text>
									</subclause><subclause id="HCA111F3F8E0540E28AE8A7E638F2DBEB"><enum>(II)</enum><text>if the Secretary
				fails to evaluate the certification in a timely manner and the person is
				subsequently found to be in violation of subsection (c), ineligibility shall
				not apply to the person for that violation.</text>
									</subclause></clause><clause id="HA0E393FAE5E945679DF88335B724AF92"><enum>(iii)</enum><header>Equitable
				contribution</header>
									<subclause id="H3E23194E92934D678918D792498EBFCF"><enum>(I)</enum><header>In
				general</header><text>If a person fails to provide certification of compliance
				to the Secretary as required and is subsequently found in violation of
				subsection (c), the Secretary shall determine the amount of an equitable
				contribution to conservation in accordance with section 1241(e) by the person
				for the violation.</text>
									</subclause><subclause id="H28EC84D8C4BB422D9AB23302B28EBA42"><enum>(II)</enum><header>Limitation</header><text>The
				contribution shall not exceed the total of the portion of the premium paid by
				the Federal Crop Insurance Corporation for a policy or plan of insurance for
				all years the person is determined to have been in violation subsequent to the
				date on which certification was first required under this
				subparagraph.</text>
									</subclause></clause></subparagraph></paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HC5714B92484A404780CFCBD5B76A6CD3"><enum>(2)</enum><text>by redesignating
			 subsections (c), (d), and (e) as subsections (d), (e), and (f), respectively;
			 and</text>
				</paragraph><paragraph id="H99E98AE4E30E4330AEE4924FE70186C9"><enum>(3)</enum><text>by inserting after
			 subsection (b) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HE226E47FF813483D9AFBB18513582ACC" style="OLC">
						<subsection id="H174060ACC13540C8873FE8A99696AD45"><enum>(c)</enum><header>Ineligibility
				for crop insurance premium assistance</header>
							<paragraph id="H90F96462B9614A2D8807A70902D42833"><enum>(1)</enum><header>In
				general</header><text>If a person is determined to have committed a violation
				under subsection (a) or (d) during a crop year, the person shall be ineligible
				to receive any payment of any portion of the premium paid by the Federal Crop
				Insurance Corporation for a policy or plan of insurance under the Federal Crop
				Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>).</text>
							</paragraph><paragraph id="HEE27E51D0EAF496AACD983A8847A01BE"><enum>(2)</enum><header>Applicability</header><text>Ineligibility
				under this subsection shall—</text>
								<subparagraph id="H300E7C818C7D40DCBE76FD5BCC3B4947"><enum>(A)</enum><text>only apply to
				reinsurance years subsequent to the date of final determination of a violation,
				including all administrative appeals; and</text>
								</subparagraph><subparagraph id="H95073D33208C4B148443DAAFA6AAFDC0"><enum>(B)</enum><text>not apply
				to—</text>
									<clause id="H8610B993B82B4730957319A1CF16CCD9"><enum>(i)</enum><text>the existing
				reinsurance year; or</text>
									</clause><clause id="H5B643D20C7B3446D9A5A5C553C505A07"><enum>(ii)</enum><text>any reinsurance
				year prior to the date of final determination.</text>
									</clause></subparagraph></paragraph><paragraph id="H4E7FD93310754C85A71CFCD4386F0683"><enum>(3)</enum><header>Date of
				conversion</header><text>Notwithstanding subsection (d), ineligibility for crop
				insurance premium assistance shall apply as follows:</text>
								<subparagraph id="HA08709D82CAB4D4AA2F8D4BA457928DF"><enum>(A)</enum><text>In the case of
				wetland that the Secretary determines was converted after the date of enactment
				of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/8701">7 U.S.C. 8701 et seq.</external-xref>) but
				on or before May 1, 2013, and continues to be in violation, the person shall
				have 2 reinsurance years after the date on which this subsection applies, to
				begin the mitigation process, as determined by the Secretary.</text>
								</subparagraph><subparagraph id="H1946A0981A124A3F9D3B8B1212B17673"><enum>(B)</enum><text>In the case of
				wetland that the Secretary determines was converted after May 1, 2013—</text>
									<clause commented="no" id="HF81037E7ACBA49D19ED6BE2429DE482F"><enum>(i)</enum><text>subject to clause
				(ii), the person shall be ineligible to receive crop insurance premium
				subsidies in subsequent reinsurance years unless section 1222(b) applies;
				and</text>
									</clause><clause id="H450A68A8D56A4690A04E4D94741375F2"><enum>(ii)</enum><text>for any violation
				that the Secretary determines impacts less than 5 acres of the entire farm, the
				person may pay a contribution in accordance with section 1241(e) in an amount
				equal to 150 percent of the cost of mitigation, as determined by the Secretary,
				for wetland restoration in lieu of ineligibility to receive crop insurance
				premium assistance.</text>
									</clause></subparagraph><subparagraph id="HFABA447A3FEA4B17AAC62DCB0FBE554F"><enum>(C)</enum><text>In the case of a
				wetland that the Secretary determines was converted prior to the date of
				enactment of the Food, Conservation, and Energy Act of 2008 (7 U.S.C. 8701 et
				seq.), ineligibility under this subsection shall not apply.</text>
								</subparagraph><subparagraph id="H620FFE9830F044858FF5F2D6EE649D0A"><enum>(D)</enum><text>In the case of an
				agricultural commodity for which an individual policy or plan of insurance is
				available for the first time to the person after the date of enactment of the
				<short-title>Crop Insurance Accountability Act of
				2013</short-title>—</text>
									<clause id="H6EA3B4469AA44BD1B19FF6534AB05DA0"><enum>(i)</enum><text>ineligibility
				shall apply only to conversions that take place after the date on which the
				policy or plan of insurance first becomes available to the person; and</text>
									</clause><clause id="H65699FFDB39544F49E86ECDAC845E117"><enum>(ii)</enum><text>the person shall
				take such steps as the Secretary determines appropriate to mitigate any prior
				conversion in a timely manner but not to exceed 2 calendar years.</text>
									</clause></subparagraph></paragraph><paragraph id="H7E6082436C1A4D8289B1F610EF2DD417"><enum>(4)</enum><header>Certification</header>
								<subparagraph id="HB76EF3D5D5BE4186B66178E1E84D1326"><enum>(A)</enum><header>In
				general</header><text>In enforcing eligibility under this subsection, the
				Secretary shall use existing processes and procedures for certifying
				compliance.</text>
								</subparagraph><subparagraph id="HAB4E8866D7D741A18111E957E992EBC5"><enum>(B)</enum><header>Responsibility</header><text>The
				Secretary, acting through the agencies of the Department of Agriculture, shall
				be solely responsible for determining whether a producer is eligible to receive
				crop insurance premium subsidies in accordance with this subsection.</text>
								</subparagraph><subparagraph id="HB5D6152B21D54F6F94F13462B14449A2"><enum>(C)</enum><header>Limitation</header><text>The
				Secretary shall ensure that no agent, approved insurance provider, or employee
				or contractor of an agency or approved insurance provider, bears responsibility
				or liability for the eligibility of an insured producer under this subsection,
				other than in cases of misrepresentation, fraud, or a scheme or device to avoid
				compliance.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="HB12C6C2B0689444E9022923FDE0D0305"><enum>3.</enum><header>Technical
			 assistance</header><text display-inline="no-display-inline">Section 1241(b) of
			 the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3841">16 U.S.C. 3841(b)</external-xref>) is amended to read as
			 follows:</text>
			<quoted-block display-inline="no-display-inline" id="H7B42796C1B544B338D90C5A55F21CD5C" style="OLC">
				<subsection id="H23805C2829DD4021991333286BE690B6"><enum>(b)</enum><header>Technical
				assistance</header>
					<paragraph id="H11229118D37F4457B6A9DBD3A03BCB40"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Effective for fiscal
				year 2005 and each subsequent fiscal year, Commodity Credit Corporation funds
				made available for each of the programs specified in paragraphs (1) through (7)
				of subsection (a)—</text>
						<subparagraph id="HE0F98134CD964AF5B7C3918DA43E3AE7"><enum>(A)</enum><text>shall be available
				for the provision of technical assistance for the programs for which funds are
				made available, as necessary to implement the programs effectively; and</text>
						</subparagraph><subparagraph id="H94E5DB3A497C4DF990FCC92BF2FD24E5"><enum>(B)</enum><text>shall not be
				available for the provision of technical assistance for conservation programs
				specified in subsection (a) other than the program for which the funds were
				made available.</text>

						<subparagraph id="H62D326842191499DA02EE57FE5C3571B"><enum>(A)</enum><header>In
				general</header><text>In the delivery of technical assistance under the Soil
				Conservation and Domestic Allotment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/590a">16 U.S.C. 590a et seq.</external-xref>), the Secretary
				shall give priority to producers who request technical assistance from the
				Secretary in order to comply for the first time with the requirements of
				subtitle B and subtitle C of this title as a result of the amendments made by
				section 2 of the <short-title>Crop Insurance
				Accountability Act of 2013</short-title>.</text>
						</subparagraph><subparagraph id="H11290675A7384722A2C2EE72E00E6149"><enum>(B)</enum><header>Report</header><text>Not
				later than 270 days after the date of enactment of the
				<short-title>Crop Insurance Accountability Act of
				2013</short-title>, the Secretary shall submit to the Committee on Agriculture
				of the House of Representatives and the Committee on Agriculture, Nutrition,
				and Forestry of the Senate a report regarding the extent to which the
				conservation compliance requirements contained in the amendments made by
				section 2 of the <short-title>Crop Insurance
				Accountability Act of 2013</short-title> apply to and impact specialty crop
				growers, including national analysis and surveys to determine the extent of
				specialty crop acreage on highly erodible land and
				wetlands.</text>
