		<official-title>To amend the Individuals with Disabilities Education Act
		  in order to limit the penalties to a State that does not meet its maintenance
		  of effort level of funding to a one-time penalty.</official-title>

		<section id="H022307F38693453C93ED78266EE891AF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>IDEA MOE Adjustment
			 Act</short-title></quote>.</text>
		</section><section id="H9C872BDDB8404A4BBE5778989B933651"><enum>2.</enum><header>Penalty
			 limitation</header><text display-inline="no-display-inline">Section 612(a)(18)
			 of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1412">20 U.S.C. 1412(a)(18)</external-xref>) is
			 amended—</text>
			<paragraph id="H9E48048A17F141428826697C4CCE907F"><enum>(1)</enum><text>in subparagraph
			 (B)—</text>
				<subparagraph id="H31EA86DC552F463F9A40E6506E556F24"><enum>(A)</enum><text>by striking
			 <quote>The Secretary shall reduce the allocation of funds under section 611 for
			 any fiscal year</quote> and inserting the following:</text>
					<quoted-block id="H3519A019E5E448489D43DD9C25BB829C" style="OLC">
						<subsection id="H9B80531CCA224F69BC53C2858FA27C63"><enum>(i)</enum><header>Reduction</header><text>The
				Secretary shall reduce the allocation of funds under section 611 for 1 fiscal
				year.</text>
						</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H856CB4F907FD48CEB5E09441BD815BED"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="H7CB761CFB2C04B369C8703DB14E62EEB" style="OLC">
					<clause id="H09C7903EB8EB4D57A856D88A909D9ADB"><enum>(ii)</enum><header>Distribution of
				funds</header><text>In any case where a State’s allocation under clause (i) is
				reduced, the Secretary shall distribute to all other States (as that term is
				defined in section 611(g)(2)) that were not subject to a reduction in
				allocation under such clause, the amount by which any State’s allocation under
				section 611(d) was reduced under such clause, in accordance with subclauses
				(II) and (III) of section 611(d)(3)(A)(i) and without regard to paragraphs
				(A)(i)(I) and (B) of section 611(d)(3).</text>
					</clause><clause id="H7D5B5A9E26DF4CC3921CB9B0E5E1E6EB"><enum>(iii)</enum><header>Use of funds
				by states</header><text>Each State that receives additional funds under clause
				(ii) shall allocate such funds to local educational agencies in accordance with
				section 611(f).</text>
					</clause><clause id="HF77FACCA4E114C298F2487DC7E8B59A3"><enum>(iv)</enum><header>No
				consideration for future years allocation</header><text>Notwithstanding section
				611(d), in calculating the amounts for allocations under such section for
				fiscal year 2013 and all subsequent years, the Secretary, when determining the
				amount a State received under such section for a preceding fiscal year, shall
				not consider—</text>
						<subclause id="H0BFC025D83A646CDAA80F9AE79987E18"><enum>(I)</enum><text>any amount by
				which a State’s allocation under such section for fiscal year 2012 or any
				subsequent year is reduced under clause (i); and</text>
						</subclause><subclause id="HAB268FAC1B74455DBC4F3F1840296731"><enum>(II)</enum><text>any amount by
				which a State’s allocation increased, pursuant to clause (ii), as a result of a
				State’s reduction in allocation for fiscal year 2012 or any subsequent
				year.</text>
