		<section id="H835FB17B1F094A83BCBDC3A3E590AC6A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Assessment Accuracy and Improvement
			 Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H35AD738AB59A4A3EB8BA06104832BAA8" section-type="subsequent-section"><enum>2.</enum><header>Use of adaptive
			 assessments</header><text display-inline="no-display-inline">Section 1111 of
			 the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311</external-xref>) is amended
			 by adding at the end the following:</text>

				<subsection id="H71F4CEBF26934EEA8F54FEEA5717F5BE"><enum>(n)</enum><header>Use of adaptive
				assessments</header>
					<paragraph id="H7D6FD8B3C3E344419FA283208FB6378B"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of this Act, a State may provide that the assessments to be
				used to measure student achievement by that State, and by the schools and local
				educational agencies of that State, shall be adaptive assessments (rather than
				the assessments otherwise required by this Act) that accurately assess student
				achievement above and below grade level while also measuring grade-level
				performance.</text>
					</paragraph><paragraph id="H76597CF15B184EC4A67F69485FE57CE2"><enum>(2)</enum><header>Definition</header><text>For
				purposes of paragraph (1), an adaptive assessment is an assessment that changes
				its difficulty according to the performance of a student but reports the
				outcome of the assessment on a scale that is common to all students.</text>
					</paragraph><paragraph id="H7022D12664144A4488645D57CC3C46A4"><enum>(3)</enum><header>Evaluation</header><text>The
				Secretary shall ensure that the protocol for evaluating the adaptive
				assessments is included in peer review guidance
				documents.</text>
