Such removal action should</quote>.</text></subsection><subsection id="H973414AFD74A403F977E9C5114EBC635"><enum>(b)</enum><header>Remedial action</header><text display-inline="yes-display-inline">Section 104(c)(2) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(c)(2)</external-xref>) is amended by striking <quote>before determining any appropriate remedial action</quote> and inserting <quote>during the process of selecting, and in selecting, any appropriate remedial action</quote>.</text></subsection><subsection id="H683F82B543324E37B5A9EE9C565512BC"><enum>(c)</enum><header>Selection of remedial action</header><text>Section 104(c)(4) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(c)(4)</external-xref>) is amended by striking <quote>shall select remedial actions</quote> and inserting <quote>shall, in consultation with the affected State or States, select remedial actions</quote>.</text></subsection><subsection id="H1BEC9A42F89F49E29BBD09EA002B8BCB"><enum>(d)</enum><header>Consultation with State and local officials</header><text>Section 120(f) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9620">42 U.S.C. 9620(f)</external-xref>) is amended—</text><paragraph id="H1F14C6548E4F4D17B75D329C04BA5582"><enum>(1)</enum><text>by striking <quote>shall afford to</quote> and inserting <quote>shall consult with</quote>;</text></paragraph><paragraph id="H88DE1FDD8FF54BDA88A3DB28C34ECE71"><enum>(2)</enum><text>by inserting <quote>and shall provide such State and local officials</quote> before <quote>the opportunity to participate in</quote>; and</text></paragraph><paragraph commented="no" id="H4256B11CF4D2469383EA13B2B8113E81"><enum>(3)</enum><text>by adding at the end the following: <quote>If State or local officials make a determination not to participate in the planning and selection of the remedial action, such determination shall be documented in the administrative record regarding the selection of the response action.</quote>.</text></paragraph></subsection></section><section id="HF9A1D0C4B9DF4B2C95B4CA86C05A622E"><enum>3.</enum><header>State credit for other contributions</header><text display-inline="no-display-inline">Section 104(c)(5) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(c)(5)</external-xref>) is amended—</text><paragraph id="HA6BA9C9EBA544935BF00C09EF7F52FCE"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="HB12A28A164C54F77817E5D972BC399AF"><enum>(A)</enum><text>by inserting <quote>removal at such facility, or for</quote> before <quote>remedial action</quote>; and</text></subparagraph><subparagraph id="H75A188EBFD49446AA6CF1E2D75A5A43A"><enum>(B)</enum><text>by striking <quote>non-Federal funds.</quote> and inserting <quote>non-Federal funds, including oversight costs and in-kind expenditures. For purposes of this paragraph, in-kind expenditures shall include expenditures for, or contributions of, real property, equipment, goods, and services, valued at a fair market value, that are provided for the removal or remedial action at the facility, and amounts derived from materials recycled, recovered, or reclaimed from the facility, valued at a fair market value, that are used to fund or offset all or a portion of the cost of the removal or remedial action.</quote>; and</text></subparagraph></paragraph><paragraph id="H41E0C7CD89CE433FAD52503AB3CCFF55"><enum>(2)</enum><text>in subparagraph (B), by inserting <quote>removal or</quote> after <quote>under this paragraph shall include expenses for</quote>.</text></paragraph></section><section id="HDAF08AD3DFD04C1EB1FC533485FB4330"><enum>4.</enum><header>State concurrence with listing on the national priorities list</header><subsection id="H3091E1F72FEE42DEAA58A22B995D6403"><enum>(a)</enum><header>Basis for recommendation</header><text display-inline="yes-display-inline">Section 105(a)(8)(B) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9605">42 U.S.C. 9605(a)(8)(B)</external-xref>) is amended—</text><paragraph commented="no" id="H2989DAC744F94EC9A676B8DD8CEB4B72"><enum>(1)</enum><text>by inserting <quote>Not later than 90 days after any revision of the national list, with respect to a priority not included on the revised national list, upon request of the State that submitted the priority for consideration under this subparagraph, the President shall provide to such State, in writing, the basis for not including such priority on such revised national list. The President may not add a facility to the national list over the written objection of the State, unless (i) the State, as an owner or operator or a significant contributor of hazardous substances to the facility, is a potentially responsible party, (ii) the President determines that the contamination has migrated across a State boundary, resulting in the need for response actions in multiple States, or (iii) the criteria under the national contingency plan for issuance of a health advisory have been met.</quote> after <quote>the President shall consider any priorities established by the States.</quote>; and</text></paragraph><paragraph id="H5A479A7C1DF14D2982F7A199498395BE"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>To the extent practicable, the highest priority facilities shall be designated individually and shall be referred to as</quote> and all that follows through the semicolon at the end, and inserting <quote>Not more frequently than once every 5 years, a State may designate a facility that meets the criteria set forth in subparagraph (A) of this paragraph, which shall be included on the national list;</quote>.</text></paragraph></subsection><subsection id="HAED96C07CD544CA3ADFCBB7EBA9A4C57"><enum>(b)</enum><header>State involvement</header><text display-inline="yes-display-inline">Section 121(f)(1)(C) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9621">42 U.S.C. 9621(f)(1)(C)</external-xref>) is amended by striking <quote>deleting sites from</quote> and inserting <quote>adding sites to, and deleting sites from,</quote>.</text></subsection></section><section id="H7C4FB1A9C7BD4F98A659335161B5774D"><enum>5.</enum><header>State environmental covenant law</header><text display-inline="no-display-inline">Section 121(d)(2)(A)(ii) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9621">42 U.S.C. 9621(d)(2)(A)(ii)</external-xref>) is amended by striking <quote>State environmental or facility siting law</quote> and inserting <quote>State environmental, facility siting, or environmental covenant law, or under a State law or regulation requiring the use of engineering controls or land use controls,</quote>.</text></section></legis-body><endorsement display="yes"><action-date date="20131101">November 1, 2013</action-date><action-desc>The <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name> discharged; committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
