		<official-title>To amend the Fair Debt Collection Practices Act to
		  provide for a timetable for verification of medical debt and to increase the
		  efficiency of credit markets with more perfect information.</official-title>

		<section id="HF4AD988A6D6042E0B2CD34F4B084CFCD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Accuracy in Reporting Medical Debt Act of
			 2013</short-title></quote>.</text>
		</section><section id="H3104A654E8B24A87A3223D02BB7B8C7B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="H098ADF5A44E348029F7219CDED41C2CA"><enum>(1)</enum><text display-inline="yes-display-inline">A reduction in a consumer’s credit score
			 can impede consumers’ economic activity and consumer borrowing capacity.</text>
			</paragraph><paragraph id="HC5BA7D4037B040798D9CD9F0249CB359"><enum>(2)</enum><text>A
			 2012 Federal Trade Commission report found that as many as 40 million Americans
			 have mistakes on their credit report.</text>
			</paragraph><paragraph id="HF035FE9E372E44EAAF7C52C02BCC8A36"><enum>(3)</enum><text>According to
			 credit evaluators, medical debt collections are inconsistently reported, and of
			 questionable value in predicting future payment performance.</text>
			</paragraph><paragraph id="HECCC6737A5954C26B82C502A152F60B7"><enum>(4)</enum><text>Medical debt that
			 has been completely paid off or settled will remain on a consumer’s credit
			 report and can significantly damage a consumer’s credit score for 7
			 years.</text>
			</paragraph><paragraph id="H418B0132A0C1437B9602CD965B08A641"><enum>(5)</enum><text>Creditworthy
			 consumers may be denied credit, pay higher interest rates, or pay higher fees
			 when buying or refinancing a home loan or obtaining credit for credit-related
			 products due to disputed medical debt on their credit reports.</text>
			</paragraph></section><section id="H08CBDEF065294F2FB90AC484EF8D2E02"><enum>3.</enum><header>Validation of
			 medical debt</header>
			<subsection id="H5E64D75E91C64628A46FD76D3FCC4FC6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 809 of the
			 Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692g">15 U.S.C. 1692g</external-xref>) is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H7878B025257246E18DF99E689CFB4E00" style="OLC">
					<subsection id="HAC76D544DF6D43EFBB046D1F4E07D13E"><enum>(f)</enum><header>Validation of
				medical debt</header><text display-inline="yes-display-inline">For purposes of
				medical debt, the following shall apply:</text>
						<paragraph id="H7099EC02315442A280D772F206CB73F0"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subsection:</text>
							<subparagraph id="HCF19EE3BCDFC4BE79B931EC10C4B718C"><enum>(A)</enum><header>Consumer
				reporting agency</header><text>The term <term>consumer reporting agency</term>
				has the meaning given such term under section 603(f) of the Fair Credit
				Reporting Act.</text>
							</subparagraph><subparagraph id="H79F491CF205E40579978FD6D7A6CF671"><enum>(B)</enum><header>Disputes the
				validity</header><text>With respect to a medical debt, a consumer disputes the
				validity of such debt if the consumer states, in writing, that either—</text>
								<clause id="H5D24F2322FC349A0B743DFF6BE947F30"><enum>(i)</enum><text>the consumer is
				continuing to communicate with an insurance company to determine coverage for
				the debt;</text>
								</clause><clause id="HBF7F7827E5F0484FB475AD78FF7BA606"><enum>(ii)</enum><text>the consumer
				disputes the amount or existence of the debt; or</text>
								</clause><clause id="HB8F49E8A1B8D4FD1B46B209F670580D3"><enum>(iii)</enum><text display-inline="yes-display-inline">the consumer has applied for financial
				assistance, provides evidence of such application, and is awaiting a
				determination.</text>
								</clause></subparagraph><subparagraph id="H9C06D3DA6F044A9290786ECB76B7D6C5"><enum>(C)</enum><header>Medical
				debt</header><text display-inline="yes-display-inline">The term <term>medical
				debt</term> means a debt arising from the receipt of medical services,
				products, or devices.</text>
							</subparagraph></paragraph><paragraph id="H0428983D9C6A44A091F65DEB0390618A"><enum>(2)</enum><header>Notice of
				specific deadline</header><text display-inline="yes-display-inline">When
				sending a statement described under subsection (a)(3), the debt collector shall
				include the following information:</text>
							<subparagraph id="H72EE4893456E4209BB5163C7253A4056"><enum>(A)</enum><text display-inline="yes-display-inline">That the debt collector could report to a
				consumer reporting agency regarding the debt, if the consumer does not respond
				to the notice within 30 days from the date on which the consumer received the
				statement.</text>
							</subparagraph><subparagraph id="HEB6EAEEE1AAF48BCAC1348BE6A2C5C07"><enum>(B)</enum><text>That, if the
				consumer does respond, the debt collector could report to a consumer reporting
				agency regarding the debt at the end of the 120-day period beginning on the
				date that the debt collector sends the statement.</text>
							</subparagraph><subparagraph id="H6EDC9AA096C242019BE604640A90679A"><enum>(C)</enum><text display-inline="yes-display-inline">The specific date that is the end of the
				120-day period beginning on the date that the debt collector sends the
				statement.</text>
							</subparagraph></paragraph><paragraph id="HC776932A7F4646FDB154ED3E7FC4185F"><enum>(3)</enum><header>Effect of
				consumer notice</header><text display-inline="yes-display-inline">If the
				consumer notifies the debt collector, in writing, within the 30-day period
				described under subsection (a), that the consumer disputes the validity of the
				debt, the debt collector may not, during the 120-day period beginning on the
				date that the debt collector sends the written notice described under
				subsection (a), communicate with, or report any information to, any consumer
				reporting agency regarding such debt. This paragraph shall have no effect on
				when a debt collector may or may not engage in activities to collect or attempt
				to collect any debt owed or due or asserted to be owed.</text>
						</paragraph><paragraph id="H287440C9184F41598E48A253E9EC06E5"><enum>(4)</enum><header>Reporting after
				the 120-day period</header><text display-inline="yes-display-inline">Nothing in
				this subsection shall prohibit the debt collector from communicating with, or
				reporting any information to, any consumer reporting agency regarding such debt
				after the end of such 120-day
				period.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H791318F377F14396B9D089D0F81C0ED5"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall take effect after
			 the end of the 6-month period beginning on the date of the enactment of this
			 Act.</text>
