		<official-title>To direct the Secretary of the Interior and Secretary of
		  Agriculture to expedite access to certain Federal lands under the
		  administrative jurisdiction of each Secretary for good Samaritan
		  search-and-recovery missions, and for other purposes.</official-title>

	<legis-body id="HD5A61F4BB2AB43DF967BE806A8E8C98F" style="OLC">
		<section id="HB8EA7C0C6CAF435D999C31BF1CD0C86E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Good Samaritan Search and Recovery Act of
			 2013</short-title></quote>.</text>
		</section><section id="H4CD703EE9933498CA1E16962F549A133"><enum>2.</enum><header>Expedited access
			 to certain Federal lands</header>
			<subsection id="H37956A59A34447BFAF937388D96687F7"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 develop and implement a process to expedite access to Federal lands under the
			 administrative jurisdiction of the Secretary for eligible organizations and
			 eligible individuals to request access to Federal lands to conduct good
			 Samaritan search-and-recovery missions. The process developed and implemented
			 pursuant to this subsection shall include provisions that clarify that—</text>
				<paragraph id="HAA1AAD1B0F0B4A12AF17022919939E06"><enum>(1)</enum><text>an eligible
			 organization or eligible individual granted access under this section shall be
			 acting for private purposes and shall not be considered a Federal
			 volunteer;</text>
				</paragraph><paragraph id="H9D0E4682F6194C8EA7FD0DA09E2DCEB8"><enum>(2)</enum><text display-inline="yes-display-inline">an eligible organization or eligible
			 individual conducting a good Samaritan search-and-recovery mission under this
			 section shall not be considered a volunteer under section 3 of the Volunteers
			 in the Parks Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/16/18i">16 U.S.C. 18i</external-xref>);</text>
				</paragraph><paragraph id="H34C19726BF5843EBBA767D70275ABE94"><enum>(3)</enum><text display-inline="yes-display-inline">the Federal Torts Claim Act shall not apply
			 to an eligible organization or eligible individual carrying out a privately
			 requested good Samaritan search-and-recovery mission under this section;
			 and</text>
				</paragraph><paragraph id="H37E7D5C6B9054E609A87C99895920DF1"><enum>(4)</enum><text display-inline="yes-display-inline">the Federal Employee Compensation Act shall
			 not apply to an eligible organization or eligible individual conducting good
			 Samaritan search-and-recovery mission under this section and such activities
			 shall not constitute civilian employment.</text>
				</paragraph></subsection><subsection id="H1B1D880FFD564302B0B1A0690E2304F5"><enum>(b)</enum><header>Release of the
			 federal government from liability</header><text>The Secretary shall not require
			 an eligible organization or an eligible individual to have liability insurance
			 as a condition of accessing Federal lands under this section if the eligible
			 organization or eligible individual—</text>
				<paragraph id="H96B7589B325E41ADBE3F8C3697D6F42A"><enum>(1)</enum><text>acknowledges and
			 consents, in writing, to the provisions listed in paragraphs (1) through (4) of
			 subsection (a); and</text>
				</paragraph><paragraph id="H277AA6319A17482AAEA0B4AFC53B7565"><enum>(2)</enum><text>signs a waiver
			 releasing the Federal Government from all liability related to the access
			 granted under this section.</text>
				</paragraph></subsection><subsection id="H1A4BB46E879C41259C2BD85AC2A69A87"><enum>(c)</enum><header>Approval and
			 denial of requests</header>
				<paragraph id="H7CCC299381F24837897876F8DB71971D"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall notify an eligible organization and
			 eligible individual of the approval or denial of a request by that eligible
			 organization and eligible individual to carry out a good Samaritan
			 search-and-recovery mission under this section not more than 48 hours after the
			 request is made.</text>
				</paragraph><paragraph id="H55FC4989C31048F8AE91FCF972F87C96"><enum>(2)</enum><header>Denials</header><text display-inline="yes-display-inline">If the Secretary denies a request from an
			 eligible organization or eligible individual to carry out a good Samaritan
			 search-and-recovery mission under this section, the Secretary shall notify the
			 eligible organization or eligible individual of—</text>
					<subparagraph id="HFEB2641464F64F7E87D7931E4678228B"><enum>(A)</enum><text>the reason for the
			 denial request; and</text>
					</subparagraph><subparagraph id="H1D25D6993F6446DD9FD940E2CA6DD82C"><enum>(B)</enum><text>any actions that
			 eligible organization or eligible individual can take to meet the requirements
			 for the request to be approved.</text>
					</subparagraph></paragraph></subsection><subsection id="HC71AAACB0D8244D9B36ABF2FA156881F"><enum>(d)</enum><header>Partnerships</header><text display-inline="yes-display-inline">The Secretary shall develop
			 search-and-recovery focused partnerships with search-and-recovery organizations
			 to—</text>
				<paragraph id="HD70EA720E6794C7398E13A43DFCB41DF"><enum>(1)</enum><text display-inline="yes-display-inline">coordinate good Samaritan
			 search-and-recovery missions on Federal lands under the administrative
			 jurisdiction of the Secretary; and</text>
				</paragraph><paragraph id="H54A4F65D4D9F4EB99D7039DF87704C28"><enum>(2)</enum><text display-inline="yes-display-inline">expedite and accelerate good Samaritan
			 search-and-recovery mission efforts for missing individuals on Federal lands
			 under the administrative jurisdiction of the Secretary.</text>
				</paragraph></subsection><subsection commented="no" id="H1D695C4B21B943029806101199BA8ADA"><enum>(e)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, the Secretary shall submit a joint report to
			 Congress describing—</text>
				<paragraph commented="no" id="H9377174EB12643BCBD922A1AA79B1A3A"><enum>(1)</enum><text>plans to develop
			 partnerships described in subsection (d)(1); and</text>
				</paragraph><paragraph commented="no" id="HD68F556CD2004430B98DF528533D62DB"><enum>(2)</enum><text display-inline="yes-display-inline">efforts being taken to expedite and
			 accelerate good Samaritan search-and-recovery mission efforts for missing
			 individuals on Federal lands under the administrative jurisdiction of the
			 Secretary pursuant to subsection (d)(2).</text>
				</paragraph></subsection><subsection id="H4F4475B89A1342EB9223C0B2E8F42196"><enum>(f)</enum><header>Definitions</header><text>For
			 the purposes of this section, the following definitions apply:</text>
				<paragraph id="H89E2618D1301488C93F485475ADC35B0"><enum>(1)</enum><header>Eligible
			 organization and eligible individual</header><text display-inline="yes-display-inline">The terms <term>eligible
			 organization</term> and <term>eligible individual</term> means an organization
			 or individual, respectively, that—</text>
					<subparagraph id="H84BA22F0F463411AA8D58B8EAE0A0C5F"><enum>(A)</enum><text>is acting in a
			 not-for-profit capacity; and</text>
					</subparagraph><subparagraph id="H7B5055D28EC54A8DA918410B36106FFC"><enum>(B)</enum><text display-inline="yes-display-inline">is certificated in training that meets or
			 exceeds standards established by the American Society for Testing and
			 Materials.</text>
					</subparagraph></paragraph><paragraph id="HC6A0E38A3B094C8CBA61971BB0CB628E"><enum>(2)</enum><header>Good Samaritan
			 search-and-recovery mission</header><text display-inline="yes-display-inline">The term <term>good Samaritan
			 search-and-recovery mission</term> means a search for one or more missing
			 individuals believed to be deceased at the time that the search is
			 initiated.</text>
				</paragraph><paragraph id="H01E42BC6681D4236A153E486961DC372"><enum>(3)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of the Interior or the Secretary of Agriculture, as
			 appropriate.</text>
