		<official-title>To amend the Internal Revenue Code of 1986 to provide tax
		  relief for damages relating to Hurricane Sandy, and for other
		  purposes.</official-title>

		<section id="HF9A25608063E4EBA839AF40A44CBDF90" section-type="section-one"><enum>1.</enum><header>Short title, etc</header>
			<subsection id="H97AFC09A633B41BBA2F4BBE42D12DC34"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote><short-title>Hurricane Sandy Tax Relief Act
			 of 2013</short-title></quote>.</text>
			</subsection><subsection id="H4194959B96854BE8AB11B85EFA4EB756"><enum>(b)</enum><header>Amendment of
			 1986 Code</header><text>Except as otherwise expressly provided, whenever in
			 this Act an amendment or repeal is expressed in terms of an amendment to, or
			 repeal of, a section or other provision, the reference shall be considered to
			 be made to a section or other provision of the Internal Revenue Code of
			 1986.</text>
			</subsection><subsection id="HAFEA8FB30B19400CA287D4FF4613F714"><enum>(c)</enum><header>Table of
			 contents</header><text>The table of contents for this Act is as follows:</text>

			</subsection></section><section id="HE5D8F634D57D4826A86E0E05F886E6C9"><enum>2.</enum><header>Waiver of
			 adjusted gross income limitation for losses and increase in standard deduction
			 by disaster casualty losses attributable to Hurricane Sandy</header>
			<subsection id="H009844539C164858AD6535B8AF8BC70B"><enum>(a)</enum><header>In
			 general</header><text>Subclause (I) of section 165(h)(3)(B)(i) is amended by
			 striking <quote>January 1, 2010</quote> and inserting <quote>January 1, 2010,
			 or the Hurricane Sandy federally declared disaster</quote>.</text>
			</subsection><subsection id="H81CB9FA4484A4E9CA162A4FF8B7FE72C"><enum>(b)</enum><header>Hurricane Sandy
			 federally declared disaster</header><text>Paragraph (3) of section 165(h) is
			 amended by adding at the end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="HA3281FE9F336442EA4D70D6F1EB6B983" style="OLC">
					<subparagraph id="H8D611C5F37F345E68A5CBFCE108A823B"><enum>(D)</enum><header>Application to
				Hurricane Sandy</header>
						<clause id="HFAA031CFCDF541E89B5A8718486398AA"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">Personal casualty
				losses shall be treated as described in subparagraph (B)(i) if such
				losses—</text>
							<subclause id="H01140237F9ED400DA866AFB486F8CAF5"><enum>(I)</enum><text>are attributable
				to the Hurricane Sandy federally declared disaster, and</text>
							</subclause><subclause id="H797F0907AB294C8D827AD33B1D33D75C"><enum>(II)</enum><text>occur in the
				Hurricane Sandy disaster area.</text>
							</subclause></clause><clause id="HE173CC7345C6458DBBA44E65A1EFF79A"><enum>(ii)</enum><header>Hurricane Sandy
				federally declared disaster</header><text display-inline="yes-display-inline">For purposes of clause (i), the term
				<term>Hurricane Sandy federally declared disaster</term> means the disaster
				occurring by reason of Hurricane Sandy and determined by the President before
				November 4, 2012, to warrant individual or individual and public assistance
				from the Federal Government under the Robert T. Stafford Disaster Relief and
				Emergency Assistance Act.</text>
						</clause><clause id="H46207DCE8DEF423BA6A9BE6DF60EC505"><enum>(iii)</enum><header>Hurricane
				Sandy disaster area</header><text>The term <term>Hurricane Sandy disaster
				area</term> means the area so determined to warrant such
				assistance.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H57BEF6EA36894462B5044D4E3175484F"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this subsection shall apply to taxable years ending after October 28,
			 2012.</text>
			</subsection></section><section id="H7B0E8649B6454B859143E591F9FB9D7D"><enum>3.</enum><header>Expensing of
			 qualified disaster expenses</header>
			<subsection id="H16B546DD54B94C07B5DA3B2FF803BC0B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Paragraph (2) of
			 198A(b) is amended—</text>
				<paragraph id="H819123B58E1A49558955C5E65A674F4E"><enum>(1)</enum><text>in subparagraph
			 (A) by striking <quote>January 1, 2010</quote> and inserting <quote>January 1,
			 2010, or released in the Hurricane Sandy disaster area on account of the
			 Hurricane Sandy federally declared disaster, as defined by section
			 165(h)(3)(D)</quote>,</text>
				</paragraph><paragraph id="HC4FFD0E6C93A445589D248FC9EA8935C"><enum>(2)</enum><text>in subparagraph
			 (B) by striking <quote>such date</quote> and inserting <quote>such date or
			 which is business-related property in the Hurricane Sandy disaster area that is
			 damaged or destroyed as a result of the Hurricane Sandy federally declared
			 disaster (as so defined)</quote>, and</text>
				</paragraph><paragraph id="HB2493E7FBEC24F9BA13BAC44405972E1"><enum>(3)</enum><text display-inline="yes-display-inline">in subparagraph (C) by striking <quote>such
			 date</quote> and inserting <quote>such date or which is business-related
			 property in the Hurricane Sandy disaster area that is damaged as a result of
			 the Hurricane Sandy federally declared disaster (as so defined)</quote>.</text>
				</paragraph></subsection><subsection id="HD8FF6628BD0948A886E504E3C627812A"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to amounts paid or incurred after October 28,
			 2012.</text>
			</subsection></section><section id="HD30848DCAB11459181AC3841F629BBC7"><enum>4.</enum><header>Net operating
			 losses attributable to federally declared disasters</header>
			<subsection id="HB534E8D4DEA54A6EA4892C20E7D03507"><enum>(a)</enum><header>In
			 general</header><text>Subsection (j) of section 172 is amended by adding at the
			 end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H94300EE313C144D6B920814F7BD8D807" style="OLC">
					<paragraph id="H4B29EB32F7F6441193CA179BE4EBBA4A"><enum>(5)</enum><header>Application to
				Hurricane Sandy</header>
						<subparagraph id="H8185E0C588FA42B38762204577E6CD4E"><enum>(A)</enum><header>In
				general</header><text>Losses shall be treated as described in paragraph
				(1)(A)(i) if such losses are attributable to the Hurricane Sandy federally
				declared disaster (as defined in section 165(h)(3)(D)) and occur in the
				Hurricane Sandy disaster area (as so defined).</text>
						</subparagraph><subparagraph id="HFE19B735110E486B93393FBD60548078"><enum>(B)</enum><header>Special
				rule</header><text>For purposes of subparagraph (A), paragraph (4) shall not
				apply.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF4C1B7B034A247F4ABEC3DC25CC8305C"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this section shall apply to taxable years ending after October 28, 2012.</text>
			</subsection></section><section id="H232454EAB7C149CEA6D40912365E1817"><enum>5.</enum><header>Waiver of certain
			 mortgage revenue bond requirements following federally declared
			 disasters</header>
			<subsection id="H34762EACF2534599AEF9B700E28C3728"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subparagraphs (A)(i)
			 and (B)(i) of section 143(k)(12), as added by the Tax Extenders and Alternative
			 Minimum Tax Relief Act of 2008, are each amended by striking <quote>January 1,
			 2010</quote> and inserting <quote>January 1, 2010, or in the case of a
			 residence located in the Hurricane Sandy disaster area on October 29, 2012, by
			 reason of the Hurricane Sandy federally declared disaster, as defined by
			 section 165(h)(3)(D)</quote>.</text>
			</subsection><subsection display-inline="no-display-inline" id="HF23888A8B96D4CB6BDA7EABB6BD3F37C"><enum>(b)</enum><header>Conforming
			 amendments</header><text display-inline="yes-display-inline">Subparagraph
			 (A)(ii) of such section is amended by striking <quote>such date</quote> and
			 inserting <quote>such date or by reason of the Hurricane Sandy federally
			 declared disaster (as so defined)</quote>.</text>
			</subsection><subsection id="HE0A89F1417FE4D5896466267F00A951C"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to disasters occurring after October 28, 2012.</text>
			</subsection></section><section id="H6A17FD78F25B4B9CAAA058CFEE7402ED"><enum>6.</enum><header>Increased
			 expensing for Hurricane Sandy qualified disaster assistance property</header>
			<subsection id="HFF9037E510F2441AA55160A3B33AF01A"><enum>(a)</enum><header>In
			 general</header><text>Subsection (e) of section 179 is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="HCB616A6A83FC4A06935268B3C40C6F89" style="OLC">
					<subsection id="H7C691D2858184A7CB3A53E1E83646AC4"><enum>(e)</enum><header>Special rules
				for Hurricane Sandy</header>
						<paragraph id="HBE916A4215094001A20252C1D9BD0985"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">If a taxpayer elects
				the application of this subsection for a taxable year and places in service
				during the taxable year any Hurricane Sandy qualified disaster assistance
				property—</text>
							<subparagraph id="HE19993260C354176B504B17713DE3F77"><enum>(A)</enum><text>the dollar amount
				in effect under subsection (b)(1) for the taxable year shall be increased by
				the qualified disaster limitation amount, and</text>
							</subparagraph><subparagraph id="HBDE19A7D827040CD8D9096C18A78FBD6"><enum>(B)</enum><text>the dollar amount
				in effect under subsection (b)(2) for the taxable year shall be increased by
				the qualified disaster limitation reduction amount.</text>
							</subparagraph></paragraph><paragraph id="H87B0454BEC6940CAA034CF306B118DB5"><enum>(2)</enum><header>Qualified
				disaster limitation amount</header><text>For purposes of paragraph (1), the
				term <term>qualified disaster limitation amount</term> means the lesser
				of—</text>
							<subparagraph id="H117AFAE1CC344604B99F071A7F4DE46E"><enum>(A)</enum><text>$500,000,
				or</text>
							</subparagraph><subparagraph id="HE09C44A5C472489B81F90693E80D8C92"><enum>(B)</enum><text>the cost of
				Hurricane Sandy qualified disaster assistance property placed in service during
				the taxable year.</text>
							</subparagraph></paragraph><paragraph id="H22BD5C18C68344DEA7ACCC327BBB2271"><enum>(3)</enum><header>Qualified
				disaster limitation reduction amount</header><text>For purposes of paragraph
				(1), the term <term>qualified disaster limitation amount</term> means the
				lesser of—</text>
							<subparagraph id="H74DA167E4F234459A844A6C8B25C7119"><enum>(A)</enum><text>$2,000,000,
				or</text>
							</subparagraph><subparagraph id="H27DAE9BB3EAD4A3AB27BC6A0883465D7"><enum>(B)</enum><text display-inline="yes-display-inline">the cost of Hurricane Sandy qualified
				disaster assistance property placed in service during the taxable year.</text>
							</subparagraph></paragraph><paragraph commented="no" id="H029744D3908E492585E9EE17C4659754"><enum>(4)</enum><header>Hurricane Sandy
				qualified disaster assistance property</header><text>For purposes of this
				subsection—</text>
							<subparagraph id="HE131F78EA7BC417EB98E4244A87CB9AF"><enum>(A)</enum><header>In
				general</header><text>The term <term>Hurricane Sandy qualified disaster
				assistance property</term> means section 179 property (as defined in subsection
				(d)) and qualified property—</text>
								<clause commented="no" id="H1E2E7B7FA6B44CA89D21F70D8C30C0BA"><enum>(i)</enum><text>the original use
				of which in the Hurricane Sandy disaster area commences with the taxpayer on or
				after October 29, 2012,</text>
								</clause><clause commented="no" id="H9FC80D4EF9CE46A4957FCBFD35F9052B"><enum>(ii)</enum><text display-inline="yes-display-inline">substantially all of the use of which is in
				the Hurricane Sandy disaster area, and</text>
								</clause><clause commented="no" id="HC4AEAB4594C74AED8F4B67FD9063BDEA"><enum>(iii)</enum><text>which—</text>
									<subclause commented="no" id="H7528F179F6BD450D98962CF24B021C06"><enum>(I)</enum><text>rehabilitates
				property damaged, or replaces property destroyed or condemned, as a result of
				the Hurricane Sandy federally declared disaster, except that, for purposes of
				this clause, property shall be treated as replacing property destroyed or
				condemned if, as part of an integrated plan, such property replaces property
				which is included in a continuous area which includes real property destroyed
				or condemned, and</text>
									</subclause><subclause commented="no" id="H8D109F99484E48F6A544DE214811573F"><enum>(II)</enum><text>is located in the
				same county as the property being rehabilitated or replaced,</text>
									</subclause></clause><clause commented="no" id="HDFA8D3ED67934C4FB8F0A1C8A9D58594"><enum>(iv)</enum><text>which is placed
				in service or acquired by the taxpayer by purchase (as defined in subsection
				(d)) on or after October 29, 2012, but only if no written binding contract for
				the acquisition was in effect before such date, and</text>
								</clause><clause commented="no" id="H94358E6176164D29BFF8AC8CC139E7A5"><enum>(v)</enum><text>which is placed in
				service by the taxpayer on or after October 29, 2012, and before December 31,
				2015 (December 31, 2016, in the case of nonresidential real property and
				residential rental property).</text>
								</clause></subparagraph><subparagraph id="HD3B4CAE0789048E1ACDF7C1891952803"><enum>(B)</enum><header>Qualified
				property</header><text>The term <term>qualified property</term> means property
				which is—</text>
								<clause commented="no" display-inline="no-display-inline" id="H3B80E70E4C3248B5863714F2FD324A6B"><enum>(i)</enum><text>tangible property
				to which section 168 applies and which has a recovery period of 39 years or
				less, or</text>
								</clause><clause commented="no" id="H3D6BD1A3A7D44347A8B959F2AF6FCFDD"><enum>(ii)</enum><text>computer software
				(as defined in section 167(f)(1)(B)) for which a deduction is allowable under
				section 167(a).</text>
								</clause></subparagraph><subparagraph id="HC3655CEF4E7D4561A4657603D8863DA8"><enum>(C)</enum><header>Exceptions</header>
								<clause id="H2158DDE80D9F4CDE9EFF5F3B41677C76"><enum>(i)</enum><header>Alternative
				depreciation property</header><text>Such term shall not include any property to
				which the alternative depreciation system under section 168(g) applies,
				determined without regard to paragraph (7) thereof (relating to election to
				have system apply).</text>
								</clause><clause id="H90E7AF651DCF412283B12A7A386853C4"><enum>(ii)</enum><header>Tax-exempt bond
				financed property</header><text>Such term shall not include any property any
				portion of which is financed with the proceeds of any obligation the interest
				on which is exempt from tax under section 103.</text>
								</clause></subparagraph><subparagraph id="H896BEDF66DD246BF8C76B33DE5A4A63E"><enum>(D)</enum><header>Election</header><text display-inline="yes-display-inline">An election under this subsection for any
				taxable year shall—</text>
								<clause id="H26E55D1BF8DD4B8AA9D2900E2A82B9B6"><enum>(i)</enum><text display-inline="yes-display-inline">specify the items of Hurricane Sandy
				qualified disaster assistance property to which the election applies and the
				portion of the cost of each of such items which is to be taken into account
				under paragraph (1), and</text>
								</clause><clause id="HD48E5861462D4BD096C294639D7B7937"><enum>(ii)</enum><text>be made on the
				taxpayer’s return of the tax imposed by this chapter for the taxable
				year.</text>
								</clause></subparagraph><subparagraph id="H7C8136A3E7B94BFCBF5CC8610F4106BE"><enum>(E)</enum><header>Special
				rules</header><text>For purposes of this subsection, rules similar to the rules
				of subparagraph (E) of section 168(k)(2) shall apply, except that such
				subparagraph shall be applied—</text>
								<clause id="HBCC6A1FB73BC4FD8ABCBDF621F56FEB0"><enum>(i)</enum><text>by
				substituting <quote>the date of the Hurricane Sandy federally declared
				disaster</quote> for <quote>December 31, 2007</quote> each place it appears
				therein,</text>
								</clause><clause id="H7F1B37828DFA4765924BFF54AC6CDA86"><enum>(ii)</enum><text>by substituting
				<quote>January 1, 2016</quote> for <quote>January 1, 2014</quote> in clause (i)
				thereof, and</text>
								</clause><clause id="H67556585E327436DB04DBC6D2BBE4157"><enum>(iii)</enum><text>by substituting
				<quote>Hurricane Sandy qualified section 179 disaster assistance
				property</quote> for <quote>qualified property</quote> in clause (iv)
				thereof.</text>
								</clause></subparagraph></paragraph><paragraph id="HEE7D7178676647448A3FFA97B02EF113"><enum>(5)</enum><header>Terms relating

				disaster</term> and <term>Hurricane Sandy disaster area</term> have the
				meanings given such terms by section 165(h)(3)(D).</text>
						</paragraph><paragraph id="H53C28299518E438AB14C850EB7A13F52"><enum>(6)</enum><header>Recapture</header><text>For
				purposes of this subsection, rules similar to the rules under subsection
				(d)(10) shall apply with respect to any qualified section 179 disaster
				assistance property which ceases to be qualified section 179 disaster
				assistance
				property.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6489A318417C42119892E95116E3AC27"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years ending after October 28, 2012.</text>
			</subsection></section><section commented="no" id="HB22C720F2CAD4D5D9842F1453D2CC613"><enum>7.</enum><header>Increased
			 limitation on charitable contributions for disaster relief</header>
			<subsection commented="no" id="H973B5C158A2F4CFB9A67682185228007"><enum>(a)</enum><header>Individuals</header><text>Paragraph
			 (1) of section 170(b) is amended by redesignating subparagraphs (F) and (G) as
			 subparagraphs (G) and (H), respectively, and by inserting after subparagraph
			 (E) the following new subparagraph:</text>
				<quoted-block id="H703D1E47F70A472CB135948752705EDD" style="OLC">
					<subparagraph commented="no" id="H2AA5D592DD6449DDB4894DD71C79C12B"><enum>(F)</enum><header>Qualified
				Hurricane Sandy disaster contributions</header>
						<clause commented="no" id="H600DC26BE1524751B9A0FE65C4CE36DB"><enum>(i)</enum><header>In
				general</header><text>Any qualified Hurricane Sandy disaster contribution shall
				be allowed to the extent that the aggregate of such contributions does not
				exceed the excess of 80 percent of the taxpayer’s contribution base over the
				amount of all other charitable contributions allowable under this
				paragraph.</text>
						</clause><clause id="H558DEB50858842B2AE3924C434FF680C"><enum>(ii)</enum><header>Qualified
				Hurricane Sandy disaster contribution</header><text display-inline="yes-display-inline">For purposes of this subparagraph, the term
				<term>qualified Hurricane Sandy disaster contribution</term> means any
				charitable contribution if—</text>
							<subclause id="H099881206921497DB95B717A73608456"><enum>(I)</enum><text>such
				contribution—</text>
								<item id="H37CED1B0260C47CCB6CFB23BA0B63632"><enum>(aa)</enum><text>is
				paid during the period beginning on October 29, 2012, and ending on December
				31, 2013, in cash to an organization described in subparagraph (A), and</text>
								</item><item id="H4A6E55E6D2F74997A8F7EACB87B5CF69"><enum>(bb)</enum><text>is
				made for relief efforts in the Hurricane Sandy disaster area related to the
				Hurricane Sandy federally declared disaster,</text>
								</item></subclause><subclause id="H2F86A917C26242CDAFA9608E3DC71685"><enum>(II)</enum><text display-inline="yes-display-inline">the taxpayer obtains from such organization
				contemporaneous written acknowledgment (within the meaning of subsection
				(f)(8)) that such contribution was used (or is to be used) for relief efforts
				in the Hurricane Sandy disaster area related to the Hurricane Sandy federally
				declared disaster, and</text>
							</subclause><subclause id="H209490E7251941E9B813494B77108903"><enum>(III)</enum><text>the taxpayer has
				elected the application of this subparagraph with respect to such
				contribution.</text>
							</subclause></clause><clause id="H52E486B7F1AA45488321E0A9D666855F"><enum>(iii)</enum><header>Exception</header><text>A
				qualified Hurricane Sandy disaster contribution shall not include a
				contribution by a donor if the contribution is—</text>
							<subclause id="H83636B8A14EC46B78712D7050CC39DEE"><enum>(I)</enum><text>to an organization
				described in section 509(a)(3), or</text>
							</subclause><subclause id="H474EFE63ADBC46E5A357EE39E035133A"><enum>(II)</enum><text>for establishment
				of a new, or maintenance of an existing, donor advised fund (as defined in
				section 4966(d)(2)).</text>
							</subclause></clause><clause commented="no" id="HB39481D5C1EA475BBCAA8EE2EFD3A922"><enum>(iv)</enum><header>Carryover</header>
							<subclause id="HCE0275C3AD4E4A1C95390226A4E86175"><enum>(I)</enum><header>In
				general</header><text>If the aggregate amount of contributions described in
				clause (i) exceeds the limitation under clause (i), such excess shall be
				treated (in a manner consistent with the rules of subsection (d)(1)) as a
				charitable contribution to which clause (i) applies in each of the 5 succeeding
				years in order of time.</text>
							</subclause><subclause commented="no" id="HEBCD57E74BA842DFB7C69589DCA5679A"><enum>(II)</enum><header>Coordination
				with other subparagraphs</header><text>For purposes of applying this
				subparagraph and subsection (d)(1), contributions described in clause (i) shall
				not be treated as described in subparagraph (A) and such subparagraph shall be
				applied without regard to such contributions.</text>
							</subclause></clause><clause id="H6911985ED3694987A964DAA14D0D0FFA"><enum>(v)</enum><header>Application of
				election to partnerships and S corporations</header><text>In the case of a
				partnership or S corporation, the election under subparagraph (F)(ii)(III)
				shall be made separately by each partner or shareholder.</text>
						</clause><clause id="H13226F08AC9D49B58424FAF8C72EBD5E"><enum>(vi)</enum><header>Hurricane Sandy
				federally declared disaster and disaster area</header><text display-inline="yes-display-inline">For purposes of this subparagraph, the
				terms <term>Hurricane Sandy federally declared disaster</term> and
				<term>Hurricane Sandy disaster area</term> have the meanings given such terms
				by section
				165(h)(3)(D).</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="HBDDB58C15FE7401E82AF1DEF4B31BB62"><enum>(b)</enum><header>Corporations</header>
				<paragraph commented="no" id="H017642945148434082B5DFDEF8EDE2F0"><enum>(1)</enum><header>In
			 general</header><text>Paragraph (2) of section 170(b) is amended by
			 redesignating subparagraph (C) as subparagraph (D) and by inserting after
			 subparagraph (B) the following new subparagraph:</text>

				taxpayer’s taxable income over the amount of charitable contributions allowed
				under subparagraph (A).</text>
							</clause><clause commented="no" id="H5AABF7A0F9DA46458113611E698B23B8"><enum>(ii)</enum><header>Carryover</header><text>If
				the aggregate amount of contributions described in clause (i) exceeds the
				limitation under clause (i), such excess shall be treated (in a manner
				consistent with the rules of subsection (d)(1)) as a charitable contribution to
				which clause (i) applies in each of the 5 succeeding years in order of
				time.</text>
							</clause><clause commented="no" id="H96A8AAA3EAFB45BBB0745185AA8F1C99"><enum>(iii)</enum><header>Qualified
				disaster contribution</header><text>The term <term>qualified Hurricane Sandy

			 amendments</header>

			 markets tax credit for investments in community development entities serving
			 Hurricane Sandy disaster areas</header>
			<subsection id="H614F01D8541641E88A8507792D892417"><enum>(a)</enum><header>In
			 general</header><text>Paragraph (1) of section 45D(f) is amended by striking
			 the period at the end of subparagraph (G) and inserting <quote>, and</quote>
			 and by adding at the end the following:</text>

			 to Hurricane Sandy</header><text>Subsection (f) of section 45D is amended by
			 adding at the end the following new paragraph:</text>
				<quoted-block id="H1B3B0CE067DB4825A401A9735CDF3492" style="OLC">
					<paragraph id="H536EA7378795473A82F610FDC29CF65C"><enum>(4)</enum><header>Increased
				special allocation for community development entities serving Hurricane Sandy
				Federal disaster areas</header>
						<subparagraph id="H0F1ED6C289344D7987389F2B3DD63601"><enum>(A)</enum><header>In
				general</header><text>The limitation under paragraph (1)(H) shall be allocated
				among qualified community development entities to make qualified low-income
				community investments within the Hurricane Sandy disaster area (as defined in
				section 165(h)(3)(D)).</text>
						</subparagraph><subparagraph id="H3F8B7FB51BCF454D94EA07F69654CF12"><enum>(B)</enum><header>Allocation of
				increase</header><text>The limitation under subparagraph (A) shall be allocated
				by the Secretary under paragraph (2) to qualified community development
				entities and shall give priority to such entities with a record of having
				successfully provided capital or technical assistance to businesses or
				communities within the Hurricane Sandy disaster area.</text>
						</subparagraph><subparagraph id="HD41DD00D51C64755A9E225EAC7A11A61"><enum>(C)</enum><header>Separate
				carryover of unused limitation</header><text display-inline="yes-display-inline">Paragraph (3) shall be applied separately
				with respect to the limitation under paragraph
				(1)(H).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H01258B6811124C2BBDD8DD062492B01E"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to calendar
			 years beginning after 2011.</text>
			</subsection></section><section id="H58D5DE37BF1A40C0ABFA2F5B17C18204"><enum>9.</enum><header>Extension of
			 expensing for environmental remediation costs</header>
			<subsection id="H51B7E8981B33495185E682DCAAA3677B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 198 is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0840F3D7DDD8495085F2E40153818DEE" style="OLC">
					<subsection id="H48CAEF0E0B5540138F3D02B1F0D67C58"><enum>(i)</enum><header>Extension
				relating to Hurricane Sandy</header><text display-inline="yes-display-inline">Subsection (h) shall not apply in the case
				of any qualified environmental remediation expenditure paid or incurred after
				the date of the Hurricane Sandy federally declared disaster (as defined in
				section 165(h)(3)(D)) and before January 1, 2015, by reason of such disaster at
				a qualified contaminated site located in the Hurricane Sandy disaster area (as
				so
				defined).</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE58DE62A1CAE40B9845F9E29E67E6BCD"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall apply to expenditures paid or incurred after October 28,
			 2012.</text>
			</subsection></section><section id="HE3F582A330D742DBA5665C9B0C274654"><enum>10.</enum><header>Special rule for
			 public utility casualty losses</header>
			<subsection id="HBBA24A7DB16D46B99D0E5DB484F0A177"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (f) of
			 section 172 is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H9CD7CC91387F428289C6CB542EA14FDD" style="OLC">
					<paragraph id="H735BBFDBF86542BBB5505D5FDEF97ABE"><enum>(7)</enum><header>Hurricane Sandy
				public utility casualty losses</header>
						<subparagraph id="HC001A2B913724EE2A45EA8407AAC6986"><enum>(A)</enum><header>In
				general</header><text>The amount described in paragraph (1)(A) for any taxable
				year shall be increased by the Hurricane Sandy public utility casualty loss for
				such taxable year.</text>
						</subparagraph><subparagraph id="HF12EF6AE948E40B8B79988A22078FE1D"><enum>(B)</enum><header>Hurricane Sandy
				public utility casualty loss</header><text>For purposes of this paragraph, the
				term <term>Hurricane Sandy public utility casualty loss</term> means any
				casualty loss of public utility property (as defined in section 168(i)(10))
				located in the Hurricane Sandy disaster area if—</text>
							<clause id="H8C98A0D677AB4A6E87B0D03E90EC67F4"><enum>(i)</enum><text>such loss is
				allowed as a deduction under section 165 for the taxable year,</text>
							</clause><clause id="H058CFD4A1C274B2DA257E47B3A856E60"><enum>(ii)</enum><text>such loss is by
				reason of Hurricane Sandy, and</text>
							</clause><clause id="H114FAD8AFD0540EDA96031057E76D2DD"><enum>(iii)</enum><text>the taxpayer
				elects the application of this paragraph with respect to such loss.</text>
							</clause></subparagraph><subparagraph display-inline="no-display-inline" id="HEB7459B40EED415490F4792587A3545A"><enum>(C)</enum><header>Reduction for
				gains from involuntary conversion</header><text>The amount of any Hurricane
				Sandy public utility casualty loss which would (but for this subparagraph) be
				taken into account under subparagraph (A) for any taxable year shall be reduced
				by the amount of any gain recognized by the taxpayer for such year from the
				involuntary conversion by reason of Hurricane Sandy of public utility property
				(as so defined) located in the Hurricane Sandy disaster area.</text>
						</subparagraph><subparagraph id="H066F0FA3B2974038A667452776672EFF"><enum>(D)</enum><header>Hurricane Sandy
				disaster area</header><text>For purposes of this paragraph, the term
				<term>Hurricane Sandy disaster area</term> has the meaning given such term by
				section 165(h)(3)(D).</text>
						</subparagraph><subparagraph id="H355646AEB6AD4D1CBFE46669E10A7D52"><enum>(E)</enum><header>Coordination
				with general disaster loss rules</header><text>Section 168(k) and section
				165(i) shall not apply to any Hurricane Sandy public utility casualty loss to
				the extent such loss is taken into account under subparagraph (A).</text>
						</subparagraph><subparagraph id="HCD27AB2705C646B398127766ED341E9C"><enum>(F)</enum><header>Election</header><text>Any
				election under subparagraph (B)(iii) shall be made in such manner as may be
				prescribed by the Secretary and shall be made by the due date (including
				extensions of time) for filing the taxpayer’s return for the taxable year of
				the loss. Such election, once made for any taxable year, shall be irrevocable
				for such taxable
				year.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5ADD64A6E8524EF495E9099180C12AB1"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to losses
			 arising in taxable years ending after October 28, 2012.</text>
			</subsection></section><section id="H894D0E770A84460ABE20026E5C9B7BB1"><enum>11.</enum><header>Determination of
			 earned income for purposes of earned income credit and child tax
			 credit</header>
			<subsection id="HE9AD115855A049CEA9EB2BA861C6C2E1"><enum>(a)</enum><header>Earned income
			 credit</header><text display-inline="yes-display-inline">Section 32 is amended
			 by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H8A6E3E7B4810464B9EFA7B122E88F319" style="OLC">
					<subsection id="HA34E572D2BCF40F7AA8E23EC08E41900"><enum>(n)</enum><header>Special rule
				relating to Hurricane Sandy</header><text display-inline="yes-display-inline">For purposes of this section and section
				24(d)—</text>
						<paragraph id="HEE86BBC332A94EA7BDAD8057749757EE"><enum>(1)</enum><header>In
				general</header><text>In the case of a qualified individual, if the earned
				income of the taxpayer for the taxable year which includes the applicable date
				is less than the earned income of the taxpayer for the preceding taxable year,
				the credit allowed under subsection (a) may, at the election of the taxpayer,
				be determined by substituting—</text>
							<subparagraph id="H1549CDB87EAF4FDB97711989D13D8FA2"><enum>(A)</enum><text>such earned income
				for the preceding taxable year, for</text>
							</subparagraph><subparagraph id="HBF94B19DACFF44C080117777334B912B"><enum>(B)</enum><text>such earned income
				for the taxable year which includes the applicable date.</text>
							</subparagraph></paragraph><paragraph id="H4DC15E8017C542FCA0396DC9DDE08872"><enum>(2)</enum><header>Qualified
				individual</header><text display-inline="yes-display-inline">For purposes of
				this subsection, the term <term>qualified individual</term> means any
				individual—</text>
							<subparagraph id="H14D842BCABC243DAAAED06295811AC97"><enum>(A)</enum><text>whose principal
				place of abode on the applicable date was located in the Hurricane Sandy
				disaster area and such individual was displaced from such principal place of
				abode by reason of the Hurricane Sandy federally declared disaster, or</text>
							</subparagraph><subparagraph id="HE4D7AC9999654A4489F6C7B75EF379BC"><enum>(B)</enum><text>who performed
				substantially all employment services in the disaster area and was so employed
				on the applicable date.</text>
							</subparagraph></paragraph><paragraph id="HC7D6B377ADA74435B6D6F84408A1368C"><enum>(3)</enum><header>Other
				definitions</header><text>For purposes of this subsection—</text>
							<subparagraph id="H3E56268EC01446E690F9DFA4F77A4604"><enum>(A)</enum><header>Applicable
				date</header><text display-inline="yes-display-inline">The term
				<term>applicable date</term> means any day on or after October 29, 2012, and on
				or before November 3, 2012.</text>
							</subparagraph><subparagraph id="H30BBECAD977444F79442F2AD738983DE"><enum>(B)</enum><header>Hurricane Sandy
				federally declared disaster and disaster area</header><text display-inline="yes-display-inline">The terms <term>Hurricane Sandy federally
				declared disaster</term> and <term>Hurricane Sandy disaster area</term> have
				the meanings given such terms by section 165(h)(3)(D).</text>
							</subparagraph></paragraph><paragraph id="H1B7ED1E125284603A75B21242A7B2BE2"><enum>(4)</enum><header>Special
				rules</header>
							<subparagraph id="HCBAAB3B01080415782E90C233F3E536D"><enum>(A)</enum><header>Application to
				joint returns</header><text>For purposes of paragraph (1), in the case of a
				joint return for a taxable year which includes the applicable date—</text>
								<clause id="H248F1FA97BAC455683168F41B839A3F1"><enum>(i)</enum><text>such paragraph
				shall apply if either spouse is a qualified individual, and</text>
								</clause><clause id="HD77EDE7E4A4D45608C6BDE4D65DC9331"><enum>(ii)</enum><text>the earned income
				of the taxpayer for the preceding taxable year shall be the sum of the earned
				income of each spouse for such preceding taxable year.</text>
								</clause></subparagraph><subparagraph id="H96BE09E42A864355BB31E582548BD9CD"><enum>(B)</enum><header>Uniform
				application of election</header><text>Any election made under paragraph (1)
				shall apply with respect to both this section and section 24(d).</text>
							</subparagraph><subparagraph id="H21364485457C48D184C9DF1CD3ED2878"><enum>(C)</enum><header>Errors treated
				as mathematical error</header><text>For purposes of section 6213, an incorrect
				use on a return of earned income pursuant to paragraph (1) shall be treated as
				a mathematical or clerical error.</text>
							</subparagraph><subparagraph id="H9F701A47B6DA40A2B6AF11FF69EFA61E"><enum>(D)</enum><header>No effect on
				determination of gross income, etc</header><text>Except as otherwise provided
				in this subsection, this title shall be applied without regard to any
				substitution under paragraph
				(1).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H748E7688BEEC425DA4CB7C2560763B52"><enum>(b)</enum><header>Child tax
			 credit</header><text>Subsection (d) of section 24 is amended by adding at the
			 end the following new paragraph:</text>

						<subparagraph id="HD8DAC2FA07364F61827A401717A974AC"><enum>(A)</enum><header>In
				general</header><text>The term <term>Hurricane Sandy employee</term> means any
				individual—</text>
							<clause id="HB2DBED000B6A4DAD9FEEBD127FFB237D"><enum>(i)</enum><text>who, on or after
				October 29, 2012, and on or before November 3, 2012, had a principal place of
				abode in the Hurricane Sandy disaster area,</text>
							</clause><clause id="HF258EBBDCC1F49AEA512DC4F4632BD23"><enum>(ii)</enum><text>who did not apply
				for or receive unemployment compensation under State or Federal law in 2012
				before October 29, 2012, but first applied for or received such compensation
				after such date and before February 15, 2013,</text>
							</clause><clause id="HE1BD66F7C8754C06BB137EB76A36CAD4"><enum>(iii)</enum><text>who receives
				such compensation without a break until the earlier of exhausting such
				compensation under Federal or State law or the hiring date, and</text>
							</clause><clause id="H1EDB7B5629B7445A8008D7D4AD03D04C"><enum>(iv)</enum><text>whose hiring date
				for a position the principal place of employment of which is located in the
				Hurricane Sandy disaster area (as defined in section 165(h)(3)(D)) is before
				January 1, 2014.</text>
							</clause></subparagraph><subparagraph id="HEF3D619FA8EA4E3CBD4E5CC2BAEEB34D"><enum>(B)</enum><header>Reasonable
				identification acceptable</header><text>In lieu of the certification
				requirement under subparagraph (A) of paragraph (13), an individual may provide
				to the employer reasonable evidence that the individual is a Hurricane Sandy
				employee, and subparagraph (B) of such paragraph shall be applied as if such
				evidence were a certification described in such subparagraph.</text>
						</subparagraph><subparagraph id="HE08D6F9BC5D1407692E56A81D6B5286D"><enum>(C)</enum><header>Special
				rules</header><text>For purposes of this paragraph—</text>
							<clause id="H517D41F1518140199DAFB8C4AE0FD4F0"><enum>(i)</enum><text>subsection (c)(4)
				shall not apply, and</text>
							</clause><clause id="H5D1C759397324880A7CA3CDF3ED82F96"><enum>(ii)</enum><text display-inline="yes-display-inline">subsection (i)(2) shall not apply with
				respect to the first hire of such employee as a Hurricane Sandy employee,
				unless such employee was an employee of the employer on October 28,
				2012.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H30C828383C004D1CABF50917A74B04E1"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to taxable years ending after October 28, 2012.</text>
			</subsection></section><section id="H2740C9772FF243D79A6916D0A49A9F5A"><enum>13.</enum><header>Hurricane Sandy
			 Bonds</header>
			<subsection id="H71B5E9892B254A9F8EF8914EC393C9B6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subpart A of part IV
			 of subchapter B of chapter 1 is amended by inserting after section 146 the
			 following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HC017316CD1BE401DA2D9A67AD4A2E774" style="OLC">
					<section id="H99533F28AD4647E79B6CBA950604C5FB"><enum>146A.</enum><header>Hurricane
				Sandy Bonds</header>
						<subsection id="HCB3B944B6F934533B0E32176F0C0948A"><enum>(a)</enum><header>In
				general</header><text>For purposes of this title, any qualified Hurricane Sandy
				Bond shall—</text>
							<paragraph id="HAE87D6673AF54CDF8A6CC227033D0F3A"><enum>(1)</enum><text>be treated as an
				exempt facility bond, and</text>
							</paragraph><paragraph id="H1D0176F6DA7042A298AA9F30F25034A4"><enum>(2)</enum><text>not be subject to
				section 146.</text>
							</paragraph></subsection><subsection id="H9FED58E766E44C6C9C5A623FE0C1CA48"><enum>(b)</enum><header>Qualified
				Hurricane Sandy Bond</header><text>For purposes of this section, the term
				<term>qualified Hurricane Sandy bond</term> means any bond issued as part of an
				issue if—</text>
							<paragraph id="H739E5429A6574909BF1C3516B4F50FC2"><enum>(1)</enum><text>95 percent or more
				of the net proceeds of such issue are to be used for qualified project
				costs,</text>
							</paragraph><paragraph id="H0553F42938364201BFA0EBCD476929A4"><enum>(2)</enum><text>such bond is
				issued by a State or any political subdivision thereof any part of which is in
				the Hurricane Sandy disaster area,</text>
							</paragraph><paragraph id="HEFD5EAFCADA6472891D2BC78799BBEEF"><enum>(3)</enum><text>the Governor of
				the issuing State designates such bond for purposes of this section, and</text>
							</paragraph><paragraph id="H1A8A3E39C52141FFB9616FD39F90ED67"><enum>(4)</enum><text>such bond is
				issued after the date of the enactment of this section and before January 1,
				2016.</text>
							</paragraph></subsection><subsection commented="no" id="HD40E3D3D3D324267BB9E1D71513A1EE3"><enum>(c)</enum><header>Limitation on
				amount of bonds</header>
							<paragraph commented="no" id="HD88E62E2741F46DCB4A1525F6167B741"><enum>(1)</enum><header>In
				general</header><text>The maximum aggregate face amount of bonds which may be
				designated under this section shall not exceed—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H34C351C407FB47BABDD92C3AAF96BA57"><enum>(A)</enum><text>$3,200,000,000 in
				the case of Connecticut,</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1156EF80637947818807D14280F6E581"><enum>(B)</enum><text display-inline="yes-display-inline">$9,200,000,000 in the case of New Jersey,
				and</text>
								</subparagraph><subparagraph commented="no" id="H8203B02D1CEB40A0A266C3C7705B5A96"><enum>(C)</enum><text>$9,200,000,000 in
				the case of New York.</text>
								</subparagraph></paragraph><paragraph id="H24BE40DC34B2478787334D1BEA922DF9"><enum>(2)</enum><header>Reduction for
				failure to issue bonds</header>
								<subparagraph id="H862A005D67424E528577A65D79B80345"><enum>(A)</enum><header>2013</header><text>If
				after the date of enactment of this section and before January 1, 2014, less
				than 10 percent of the face amount of the bond limitation for a State has been
				issued, the authorized limitation for such State under paragraph (1) shall be
				reduced by the amount by which 10 percent of the face amount of the bond
				limitation for such State exceeds the face amount of issued bonds.</text>
								</subparagraph><subparagraph id="HC71954395E1147AB94BB2E8DD6655981"><enum>(B)</enum><header>2014</header><text>If
				after the date of enactment of this section and before January 1, 2015, less
				than 30 percent of the face amount of the bond limitation for a State has been
				issued, the authorized limitation for such State shall be reduced by the amount
				by which 10 percent of the face amount of the bond limitation for such State
				exceeds the face amount of issued bonds.</text>
								</subparagraph></paragraph><paragraph commented="no" id="H56AF5864B2F443289F52CD2EEBBB6385"><enum>(3)</enum><header>Movable
				property</header><text display-inline="yes-display-inline">No bonds shall be
				issued which are to be used for movable fixtures and equipment.</text>
							</paragraph><paragraph commented="no" id="H083094E1E51B4EECAB6785EC70130B87"><enum>(4)</enum><header>Treatment of
				current refunding bonds</header><text>Paragraph (1) shall not apply to any bond
				(or series of bonds) issued to refund a qualified Hurricane Sandy bond,
				if—</text>
								<subparagraph commented="no" id="HE07C7556385444B0A49C176C548624E7"><enum>(A)</enum><text>the average
				maturity date of the issue of which the refunding bond is a part is not later
				than the average maturity date of the bonds to be refunded by such
				issue,</text>
								</subparagraph><subparagraph commented="no" id="HBFC4577A7FFC4824AA790DE24F069ACE"><enum>(B)</enum><text>the amount of the
				refunding bond does not exceed the outstanding amount of the refunded bond,
				and</text>
								</subparagraph><subparagraph commented="no" id="H0AF28536AB154023B414AA8F3B0669DC"><enum>(C)</enum><text>the net proceeds
				of the refunding bond are used to redeem the refunded bond not later than 90
				days after the date of the issuance of the refunding bond.</text>
								</subparagraph><continuation-text commented="no" continuation-text-level="paragraph">For purposes of subparagraph (A),
				average maturity shall be determined in accordance with section
				147(b)(2)(A).</continuation-text></paragraph></subsection><subsection id="H27291F8C64C841339A8351522CB34CEE"><enum>(d)</enum><header>Qualified
				project costs</header><text>For purposes of this section, the term
				<term>qualified project costs</term> means the cost of acquisition,
				construction, reconstruction, and renovation of—</text>
							<paragraph id="H61E075D88B7A492A87FBE7F814A4E90E"><enum>(1)</enum><text display-inline="yes-display-inline">residential rental property (as defined in
				section 142(d)),</text>
							</paragraph><paragraph id="HB152843F2CAE49949A55AADB53E92E37"><enum>(2)</enum><text display-inline="yes-display-inline">nonresidential real property (including
				fixed improvements associated with such property),</text>
							</paragraph><paragraph id="HD9C4DF0151504F35A8C093E9AF1C0852"><enum>(3)</enum><text>a facility
				described in paragraph (2) or (3) of section 142(a), or</text>
							</paragraph><paragraph id="HF599110D42BF43C587F908BE5110DC04"><enum>(4)</enum><text display-inline="yes-display-inline">public utility property (as defined in
				section 168(i)(10)),</text>
							</paragraph><continuation-text continuation-text-level="subsection">which is
				located in the Hurricane Sandy Disaster area and was damaged or destroyed by
				reason of the Hurricane Sandy federally declared disaster.</continuation-text></subsection><subsection id="H85A44407D688484BA86CD2A82F73D95C"><enum>(e)</enum><header>Special
				rules</header><text>In applying this title to any qualified Hurricane Sandy
				Bond, the following modifications shall apply:</text>
							<paragraph id="H9A6CAFFEBC024B5E91FF48D9C9665922"><enum>(1)</enum><text>Section 147(d)
				(relating to acquisition of existing property not permitted) shall be applied
				by substituting <quote>50 percent</quote> for <quote>15 percent</quote> each
				place it appears.</text>
							</paragraph><paragraph id="H3898F19F036546E2A81000CCAAB9A061"><enum>(2)</enum><text>Section
				148(f)(4)(C) (relating to exception from rebate for certain proceeds to be used
				to finance construction expenditures) shall apply to the available construction
				proceeds of bonds issued under this section. For purposes of the preceding
				sentence, the following spending requirements shall apply in lieu of the
				requirements in clause (ii) of such section:</text>
								<subparagraph id="H693C81286DCB427AB275CEFEE3005634"><enum>(A)</enum><text>40 percent of such
				available construction proceeds are spent for the governmental purposes of the
				issue within the 2-year period beginning on the date the bonds are
				issued,</text>
								</subparagraph><subparagraph id="HFAA05B8BC478439EA8AD797F15C2B795"><enum>(B)</enum><text display-inline="yes-display-inline">60 percent of such proceeds are spent for
				such purposes within the 3-year period beginning on such date,</text>
								</subparagraph><subparagraph id="HF51FC987D6034C00867C6915DFFEF233"><enum>(C)</enum><text display-inline="yes-display-inline">80 percent of such proceeds are spent for
				such purposes within the 4-year period beginning on such date, and</text>
								</subparagraph><subparagraph id="H93B9BC956A144643853DD773AA2B83D7"><enum>(D)</enum><text display-inline="yes-display-inline">100 percent of such proceeds are spent for
				such purposes within the 5-year period beginning on such date.</text>
								</subparagraph></paragraph><paragraph id="H4A8CB0B8828E48589A1FE03CDDA6F693"><enum>(3)</enum><text>Repayments of
				principal on financing provided by the issue—</text>
								<subparagraph id="H87A19AF7F2C144A393ADC15F679FE6D4"><enum>(A)</enum><text>may not be used to
				provide financing, and</text>
								</subparagraph><subparagraph id="H6909BD54D5AD4D36A75F24B82EE4E015"><enum>(B)</enum><text>must be used not
				later than the close of the 1st semiannual period beginning after the date of
				the repayment to redeem bonds which are part of such issue.</text>
								</subparagraph><continuation-text continuation-text-level="paragraph">The
				requirement of subparagraph (B) shall be treated as met with respect to amounts
				received within 5 years after the date of issuance of the issue (or, in the
				case of a refunding bond, the date of issuance of the original bond) if such
				amounts are used by the close of such 5 years to redeem bonds which are part of
				such issue.</continuation-text></paragraph><paragraph id="H1626CD9F46C84AAA89E17D492AA01CF8"><enum>(4)</enum><text>Section 57(a)(5)
				shall not apply.</text>
							</paragraph></subsection><subsection id="H86FF0F05207B4E739D3E3DEBC8953258"><enum>(f)</enum><header>Separate issue
				treatment of portions of an issue</header><text>This section shall not apply to
				the portion of an issue which (if issued as a separate issue) would be treated
				as a qualified bond or as a bond that is not a private activity bond
				(determined without regard to paragraph (1)), if the issuer elects to so treat
				such portion.</text>
						</subsection><subsection id="H6732F5DF9A814E73B2AB050F5AEDD297"><enum>(g)</enum><header>Hurricane Sandy
				federally declared disaster and disaster area</header><text display-inline="yes-display-inline">The terms <term>Hurricane Sandy federally
				declared disaster</term> and <term>Hurricane Sandy disaster area</term> have
				the meanings given such terms by section
				165(h)(3)(D).</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1B44EBD948F846158171B89AD1234B0A"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for subpart A of part IV of
			 subchapter B of chapter 1 is amended by inserting after the item relating to
			 section 146 the following new item:</text>

			</subsection><subsection id="H9BAD190FD54F4119BE0272B835160EFC"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to
			 obligations issued after the date of the enactment of this Act.</text>
			</subsection></section><section id="HFC4263B4389D4318A979EE9EE7F9EF19"><enum>14.</enum><header>Additional
			 low-income housing credit may be allocated in States damaged by Hurricane
			 Sandy</header>
			<subsection id="H38D49F48D0904408AF65393B65B7BCC0"><enum>(a)</enum><header>In
			 general</header><text>Paragraph (3) of section 42(h) (relating to limitation on
			 aggregate credit allowable with respect to projects located in a State) is
			 amended by adding at the end the following new subparagraph:</text>
				<quoted-block id="H880A9144234F43DC98941DD9076A6EB6" style="OLC">
					<subparagraph id="HEAE850057C0047E7B06D0BB4E1180658"><enum>(J)</enum><header>Increase in
				State housing credit for States damaged by Hurricane Sandy</header>
						<clause id="H22095E675BF947FCBE4298597AD6C9AE"><enum>(i)</enum><header>In
				general</header><text>In the case of calendar year 2013, the State housing
				credit ceiling of each State any portion of which includes any portion of the
				Hurricane Sandy disaster area shall be increased by so much of the aggregate
				housing credit dollar amount as does not exceed the applicable limitation
				allocated by the State housing credit agency of such State for such calendar
				year to buildings located in such disaster area.</text>
						</clause><clause id="H6494A357FCF44BD4BD616E75E3394683"><enum>(ii)</enum><header>Applicable
				limitation</header><text>For purposes of clause (i), the applicable limitation
				is the greater of—</text>
							<subclause id="H514CC6DA761C47C2AD32DBFFD70F7C3E"><enum>(I)</enum><text>$8 multiplied by
				the population of the area described in clause (vii)(I), or</text>
							</subclause><subclause id="HFCEC891F72864567A4F44D43BDC033E9"><enum>(II)</enum><text>50 percent of the
				State housing credit ceiling (determined without regard to this subparagraph)
				for 2013.</text>
							</subclause></clause><clause id="HF71B0805882F4683A4A9D0B88C9875C3"><enum>(iii)</enum><header>Applicable
				percentage</header><text>For purposes of this section, the applicable
				percentage with respect to any building to which amounts allocated under clause
				(i) shall be determined under subsection (b)(2), except that subparagraph (A)
				thereof shall be applied by substituting <quote>December 31, 2015</quote> for
				<quote>December 31, 2013</quote>.</text>
						</clause><clause id="HE7802DDF38A8444F9B3F58C04BA53CF7"><enum>(iv)</enum><header>Allocations
				treated as made first from additional allocation amount for purposes of
				determining carryover</header><text>For purposes of determining the unused
				State housing credit ceiling under subparagraph (C) for any calendar year, any
				increase in the State housing credit ceiling under clause (i) shall be treated
				as an amount described in clause (ii) of such subparagraph.</text>
						</clause><clause id="H61EC57C11EE341CDB47C61420C7890BB"><enum>(v)</enum><header>Difficult
				development area</header>
							<subclause id="H8FC4ED4DD8AF40EAA8BB19550B4E173A"><enum>(I)</enum><header>In
				general</header><text>In the case of property placed in service during 2013,
				2014, or 2015, the Hurricane Sandy disaster area shall be treated as a
				difficult development area designated under subclause (I) of subsection
				(d)(5)(B)(iii), and shall not be taken into account for purposes of applying
				the limitation under subclause (II) of such subsection.</text>
							</subclause><subclause id="HF68ECD8C4F72452F913A16FA8662CEB2"><enum>(II)</enum><header>Application of
				clause</header><text>Subclause (I) shall apply only to—</text>
								<item id="HE6F3DDAEFE76471C812B4501701088D9"><enum>(aa)</enum><text>housing credit
				dollar amounts allocated during 2013, and</text>
								</item><item id="H96A9C4405876463B995302B5ED877B73"><enum>(bb)</enum><text>to
				the extent that paragraph (1) does not apply to any building by reason of
				paragraph (4), only with respect to bonds issued after December 31,
				2012.</text>
								</item></subclause></clause><clause id="H4EBBAE1863554A39B5EA784B871E1F54"><enum>(vi)</enum><header>Hurricane Sandy
				disaster area and Hurricane Sandy federally declared disaster</header><text>For
				purposes of this subparagraph—</text>
							<subclause id="HB7572A586896413E9D4C8F5A58102A84"><enum>(I)</enum><header>Disaster
				area</header><text>The term <term>Hurricane Sandy disaster area</term> means
				each county included in the geographical area covered by the Hurricane Sandy
				federally declared disaster.</text>
							</subclause><subclause id="H3666E5917B314B06884109855926299A"><enum>(II)</enum><header>Hurricane Sandy
				federally declared disaster and disaster area</header><text display-inline="yes-display-inline">The term <term>Hurricane Sandy federally
				declared disaster</term> has the meaning given such term by section
				165(h)(3)(D).</text>
							</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H091BDD4CD3914C7D9CFF8A76C8D9231B"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall take effect on the
			 date of the enactment of this Act.</text>
			</subsection></section><section id="H6EC34B659F9947338EC1C7BFA27E4C9E"><enum>15.</enum><header>Special rules
			 for use of retirement funds</header>
			<subsection id="HB48922A25707455188552C249932EE49"><enum>(a)</enum><header>Early withdrawal
			 from retirement plans</header><text>Paragraph (2) of section 72(t) is amended
			 by adding at the end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="HE0F080975E124136928EB95C5A2C30FF" style="OLC">
					<subparagraph id="H984B9C6FF72C4711B4EE5AA47E2B75C0"><enum>(H)</enum><header>Hurricane Sandy
				distributions</header><text display-inline="yes-display-inline">Distributions
				to an individual which are Hurricane Sandy distributions (as defined in
				paragraph
				(11)).</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HCE7B3EABE38040CF93CE8D9BC5C26702"><enum>(b)</enum><header>Special
			 rules</header><text>Subsection (t) of section 72 is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB7C17C2128EB41C9AFF6443E166E3B41" style="OLC">
					<paragraph id="H77055CDDFF294A008234517E3D97317C"><enum>(11)</enum><header>Special rules
				relating to use of retirement funds relating to Hurricane Sandy</header>
						<subparagraph id="H9F8EA343CB244B72B509B601F303B272"><enum>(A)</enum><header>Distributions</header><text display-inline="yes-display-inline">For purposes of this paragraph—</text>
							<clause id="H368268F6C2334CE09EF4E1E74B066A99"><enum>(i)</enum><header>In
				general</header><text>The term <term>Hurricane Sandy distribution</term> means
				any distribution from an eligible retirement plan (as defined by section
				402(c)(8)(B)) made on or after October 29, 2012, and before January 1, 2014, to
				an individual whose principal place of abode on October 29, 2012, is located in
				the Hurricane Sandy disaster area (as defined in section 165(h)(3)(D)) and who
				has sustained an economic loss by reason of Hurricane Sandy.</text>
							</clause><clause id="H3DE0792709EE4E1CB4A911A16C5AD75F"><enum>(ii)</enum><header>Aggregate
				dollar limitation</header>
								<subclause id="HA6A8954ABC8F4D348311EB6756AE73F0"><enum>(I)</enum><header>In
				general</header><text>For purposes of this paragraph, the aggregate amount of
				distributions received by an individual which may be treated as Hurricane Sandy
				distributions for any taxable year shall not exceed the excess (if any)
				of—</text>
									<item id="HB84422E0760D461F82A7F5A151154088"><enum>(aa)</enum><text>$100,000,
				over</text>
									</item><item id="HBA8A4457132841D5A70B796F250FE0E8"><enum>(bb)</enum><text>the
				aggregate amounts treated as Hurricane Sandy distributions received by such
				individual for all prior taxable years.</text>
									</item></subclause><subclause id="H2F34F29823BC42F69C63ED435152171E"><enum>(II)</enum><header>Treatment of
				plan distributions</header><text>If a distribution to an individual would
				(without regard to subclause (I)) be a Hurricane Sandy distribution, a plan
				shall not be treated as violating any requirement of this title merely because
				the plan treats such distribution as a Hurricane Sandy distribution, unless the
				aggregate amount of such distributions from all plans maintained by the
				employer (and any member of any controlled group which includes the employer)
				to such individual exceeds $100,000.</text>
								</subclause><subclause id="H899B878340AE49449FDD622ABFC3E95D"><enum>(III)</enum><header>Controlled
				group</header><text>For purposes of subclause (II), the term <term>controlled
				group</term> means any group treated as a single employer under subsection (b),
				(c), (m), or (o) of section 414.</text>
								</subclause></clause><clause id="H08DCC1F944954768AB26D395B82F2E40"><enum>(iii)</enum><header>Amount
				distributed may be repaid</header>
								<subclause id="HBA84BEABBCFE4C4287C37B03ED2021BA"><enum>(I)</enum><header>In
				general</header><text>Any individual who receives a Hurricane Sandy
				distribution may, at any time during the 3-year period beginning on the day
				after the date on which such distribution was received, make one or more
				contributions in an aggregate amount not to exceed the amount of such
				distribution to an eligible retirement plan of which such individual is a
				beneficiary and to which a rollover contribution of such distribution could be
				made under section 402(c), 403(a)(4), 403(b)(8), 408(d)(3), or 457(e)(16), as
				the case may be.</text>
								</subclause><subclause id="H402AD6B72DBD4A0B940DD1368E9E38A8"><enum>(II)</enum><header>Treatment of
				repayments of distributions from eligible retirement plans other than
				IRAs</header><text>For purposes of this title, if a contribution is made
				pursuant to subclause (I) with respect to a Hurricane Sandy distribution from
				an eligible retirement plan other than an individual retirement plan, then the
				taxpayer shall, to the extent of the amount of the contribution, be treated as
				having received the Hurricane Sandy distribution in an eligible rollover
				distribution (as defined in section 402(c)(4)) and as having transferred the
				amount to the eligible retirement plan in a direct trustee to trustee transfer
				within 60 days of the distribution.</text>
								</subclause><subclause id="H97241EF5E3104B5696A2B7B8E91C750E"><enum>(III)</enum><header>Treatment of
				repayments for distributions from IRAs</header><text>For purposes of this
				title, if a contribution is made pursuant to subclause (I) with respect to a
				Hurricane Sandy distribution from an individual retirement plan (as defined by
				section 7701(a)(37)), then, to the extent of the amount of the contribution,
				the Hurricane Sandy distribution shall be treated as a distribution described
				in section 408(d)(3) and as having been transferred to the eligible retirement
				plan in a direct trustee to trustee transfer within 60 days of the
				distribution.</text>
								</subclause></clause><clause id="HC0ECB1B46B6D48A28C225E938C37EEA7"><enum>(iv)</enum><header>Income
				inclusion spread over 3-year period</header>
								<subclause id="H3331463750764ACEB752716D82EF344A"><enum>(I)</enum><header>In
				general</header><text>In the case of any Hurricane Sandy distribution, unless
				the taxpayer elects not to have this clause apply for any taxable year, any
				amount required to be included in gross income for such taxable year shall be
				so included ratably over the 3-taxable year period beginning with such taxable
				year.</text>
								</subclause><subclause id="H2E6C7A7FDFB8440F89FDEC34B1329FFE"><enum>(II)</enum><header>Special
				rule</header><text>For purposes of subclause (I), rules similar to the rules of
				subparagraph (E) of section 408A(d)(3) shall apply.</text>
								</subclause></clause><clause id="H513185456F1641B599F1B5A5337DD078"><enum>(v)</enum><header>Special
				rules</header>
								<subclause id="H502799E430D741DCA20080098783159C"><enum>(I)</enum><header>Exemption of
				distributions from trustee to trustee transfer and withholding
				rules</header><text>For purposes of sections 401(a)(31), 402(f), and 3405,
				Hurricane Sandy distributions shall not be treated as eligible rollover
				distributions.</text>
								</subclause><subclause id="H51E2B385992A4F6E83B60F3A52059EDC"><enum>(II)</enum><header>Hurricane Sandy
				distributions treated as meeting plan distribution
				requirements</header><text>For purposes this title, a Hurricane Sandy
				distribution shall be treated as meeting the requirements of sections
				401(k)(2)(B)(i), 403(b)(7)(A)(ii), 403(b)(11), and 457(d)(1)(A).</text>
								</subclause></clause></subparagraph><subparagraph id="H8F79A1C02B0E4909AA65569DE99C9407"><enum>(B)</enum><header>Recontributions
				of withdrawals for home purchases</header>
							<clause id="H2D7E0F175CE547D58984C903DB9E42D0"><enum>(i)</enum><header>In
				general</header><text>Any individual who received a distribution described in
				clause (ii) may, during the applicable period, make one or more contributions
				in an aggregate amount not to exceed the amount of such distribution to an
				eligible retirement plan (as defined in section 402(c)(8)(B)) of which such
				individual is a beneficiary and to which a rollover contribution of such
				distribution could be made under section 402(c), 403(a)(4), 403(b)(8), or
				408(d)(3), as the case may be.</text>
							</clause><clause id="H0A3DE5C993F343DBAED4B271EA705022"><enum>(ii)</enum><header>Distribution
				described</header><text>For purposes of clause (i), a distribution is described
				in this clause if the distribution—</text>
								<subclause id="H68BF3C2585D44066BE53D904FCA788D0"><enum>(I)</enum><text>is described in
				paragraph (2)(F) or section 401(k)(2)(B)(i)(IV), 403(b)(7)(A)(ii) (but only to
				the extent such distribution relates to financial hardship), or
				403(b)(11)(B),</text>
								</subclause><subclause id="H8DC7BA2ABD88431D88248F6459AD3129"><enum>(II)</enum><text display-inline="yes-display-inline">is received after April 29, 2012, and
				before October 30, 2012, and</text>
								</subclause><subclause id="H222C547EA98D41739A187AED0A72C29F"><enum>(III)</enum><text display-inline="yes-display-inline">was to be used to purchase or construct a
				principal residence in the Hurricane Sandy disaster area (as defined in section
				165(h)(3)(D)), but which was not so purchased or constructed on account of
				Hurricane Sandy.</text>
								</subclause></clause><clause commented="no" id="H765F7BA7B82947B2BC7C566026CF45D0"><enum>(iii)</enum><header>Applicable
				period</header><text display-inline="yes-display-inline">For purposes of this
				subparagraph, the term <term>applicable period</term> means the period
				beginning on October 29, 2012, and ending five months after the date of
				enactment of the <short-title>Hurricane Sandy Tax Relief
				Act of 2013</short-title>.</text>
							</clause><clause id="HB5DB322E1E7A4482BD627EDF68926F1E"><enum>(iv)</enum><header>Treatment of
				repayments</header><text>Rules similar to the rules of subclauses (II) and
				(III) of subparagraph (A)(iii) shall apply for purposes of this
				subparagraph.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA11FBAE8CE7B41B9A619319DE1DECE4C"><enum>(c)</enum><header>Loans from
			 qualified plans</header><text display-inline="yes-display-inline">Subsection
			 (p) of section 72 is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H3AAFB39DF1444AA58ED045B78C8262C3" style="OLC">
					<paragraph id="HB695F16D5A0A499C9BB19A2B7533FE07"><enum>(6)</enum><header>Special rules
				relating to Hurricane Sandy</header>
						<subparagraph id="H1506BB75F72A4EE7BD7F8B0CE133B65F"><enum>(A)</enum><header>Increase in
				limit on loans not treated as distributions</header><text>In the case of any
				loan from a qualified employer plan to a qualified individual made during the
				applicable period—</text>
							<clause id="H786CF1D7815E4529BCF49BD9808365A6"><enum>(i)</enum><text>paragraph
				(2)(A)(i) shall be applied by substituting <quote>$100,000</quote> for
				<quote>$50,000</quote>, and</text>
							</clause><clause id="H3884706C4BAF4DE680D5087DA98D6D3E"><enum>(ii)</enum><text>paragraph
				(2)(A)(ii) shall be applied by substituting <quote>the present value of the
				nonforfeitable accrued benefit of the employee under the plan</quote> for
				<quote>one-half of the present value of the nonforfeitable accrued benefit of
				the employee under the plan</quote>.</text>
							</clause></subparagraph><subparagraph id="HC2806418693A4716B1CC7C64E65E86CF"><enum>(B)</enum><header>Delay of
				repayment</header><text>In the case of a qualified individual with an
				outstanding loan on or after the qualified beginning date from a qualified
				employer plan—</text>
							<clause id="HB364FFEBD2B241A790E16807C4A407CB"><enum>(i)</enum><text>if
				the due date pursuant to subparagraph (B) or (C) of paragraph (2) for any
				repayment with respect to such loan occurs during the period beginning on the
				qualified beginning date and ending on December 31, 2013, such due date shall
				be delayed for 1 year,</text>
							</clause><clause id="H701AA7E486F848279467665B05CB7477"><enum>(ii)</enum><text>any subsequent
				repayments with respect to any such loan shall be appropriately adjusted to
				reflect the delay in the due date under clause (i) and any interest accruing
				during such delay, and</text>
							</clause><clause id="HE5C34B592DB14369AE4AA3A81C8AB5F5"><enum>(iii)</enum><text>in determining
				the 5-year period and the term of a loan under subparagraph (B) or (C) of
				paragraph (2), the period described in clause (i) shall be disregarded.</text>
							</clause></subparagraph><subparagraph id="H2CCA3130223C4E5995109ECD94B68F80"><enum>(C)</enum><header>Qualified
				individual</header><text>For purposes of this paragraph—</text>
							<clause id="H8576C99D8B0C41ECB7156017B981C0AC"><enum>(i)</enum><header>In
				general</header><text>The term <term>qualified individual</term> means any
				qualified Hurricane Sandy individual.</text>
							</clause><clause id="HEB6FFB0113B647A8A273BE5A1F098BF1"><enum>(ii)</enum><header>Qualified
				Hurricane Sandy individual</header><text>The term <term>qualified Hurricane
				Sandy individual</term> means an individual whose principal place of abode on
				October 29, 2012, is located in the Hurricane Sandy disaster area (as defined
				in section 165(h)(3)(D)) and who has sustained an economic loss by reason of
				Hurricane Sandy.</text>
							</clause></subparagraph><subparagraph id="HF8BE71B06317454A91468E1A8EBAB0E9"><enum>(D)</enum><header>Other
				definitions</header><text>For purposes of this paragraph—</text>
							<clause id="H1687423EC62F483D862AE0547BD9F9B1"><enum>(i)</enum><header>Applicable
				period</header><text display-inline="yes-display-inline">The applicable period
				is the period beginning on the date of enactment of the
				<short-title>Hurricane Sandy Tax Relief Act of
				2013</short-title> and ending on December 31, 2013.</text>
							</clause><clause id="H0DEAC9C259984DD699B767CADEEF5DF8"><enum>(ii)</enum><header>Qualified
				beginning date</header><text>The qualified beginning date is October 29,
				2012.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3D65233EF91F46F6BF6D1E742EC54E07"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to years
			 ending after October 28, 2012.</text>
			</subsection><subsection id="H9D6AECBEBA6640B3B9A6E7319C79B82D"><enum>(e)</enum><header>Provisions
			 relating to plan amendments</header>
				<paragraph id="H3854FB71888E4693828120D18256EC0F"><enum>(1)</enum><header>In
			 general</header><text>If this subsection applies to any amendment to any plan
			 or annuity contract, such plan or contract shall be treated as being operated
			 in accordance with the terms of the plan during the period described in
			 paragraph (2)(B)(i).</text>
				</paragraph><paragraph id="H8B4B0F5F11E04195B3890FDD34AF8097"><enum>(2)</enum><header>Amendments to
			 which subsection applies</header>
					<subparagraph id="HC1BC3B39AF9E4EF8B7814774796F0010"><enum>(A)</enum><header>In
			 general</header><text>This subsection shall apply to any amendment to any plan
			 or annuity contract which is made—</text>
						<clause id="H2A672174550B4F6191F68B166475373B"><enum>(i)</enum><text>pursuant to any
			 provision of, or amendment made by. this section, or pursuant to any regulation
			 issued by the Secretary of the Treasury or the Secretary of Labor under any
			 provision of, or amendment made by, this section, and</text>
						</clause><clause id="H5C3D72249C754756A4423BCD095E7D4B"><enum>(ii)</enum><text>on
			 or before the last day of the first plan year beginning on or after January 1,
			 2014, or such later date as the Secretary of the Treasury may prescribe.</text>
						</clause><continuation-text continuation-text-level="subparagraph">In the
			 case of a governmental plan (as defined in section 414(d)), clause (ii) shall
			 be applied by substituting the date which is 2 years after the date otherwise
			 applied under clause (ii).</continuation-text></subparagraph><subparagraph id="H6120C58ED8494AE1A83FCFA609A150A9"><enum>(B)</enum><header>Conditions</header><text>This
			 subsection shall not apply to any amendment unless—</text>
						<clause id="H3B6499CF6FFE4DFCB4F46836B64062DC"><enum>(i)</enum><text>during the
			 period—</text>
							<subclause id="H4971BB7A88FC4C789469DC04677D33A2"><enum>(I)</enum><text>beginning on the
			 date that this section or the regulation described in subparagraph (A)(i) takes
			 effect (or in the case of a plan or contract amendment not required by this
			 section or such regulation, the effective date specified by the plan),
			 and</text>
							</subclause><subclause id="H05AC611DE40547639503696197D3C0F3"><enum>(II)</enum><text>ending on the
			 date described in subparagraph (A)(ii) (or, if earlier, the date the plan or
			 contract amendment is adopted), the plan or contract is operated as if such
			 plan or contract amendment were in effect; and</text>
							</subclause></clause><clause id="HE621892C5D384319A69A473B6AC97834"><enum>(ii)</enum><text>such plan or
			 contract amendment applies retroactively for such period.</text>
						</clause></subparagraph></paragraph></subsection></section></legis-body>
