		<section id="H3A117E7ECB9F4C468309143E252308C5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Home Owner Managing Energy Savings Act
			 of 2013</short-title></quote> or the <quote><short-title>HOMES Act</short-title></quote>.</text>
		</section><section id="H6E2D3A5FF10E40109E1212DDF08CEA63"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H1F6461A1168E49DEA79A805E1B8C6543"><enum>(1)</enum><header>BPI</header><text>The
			 term <term>BPI</term> means the Building Performance Institute.</text>
			</paragraph><paragraph id="H30E3D94928A24C58941ABF4EF669255A"><enum>(2)</enum><header>Electric
			 utility</header><text>The term <term>electric utility</term> means any company,
			 person, cooperative, State, or Indian tribe agency that delivers or sells
			 electric energy at retail, including nonregulated utilities, utilities that are
			 subject to State or Indian tribe rate regulation, and Federal power marketing
			 administrations.</text>
			</paragraph><paragraph id="H8CA451B6D5334299997DDD7819E72303"><enum>(3)</enum><header>Federal rebate
			 processing system</header><text>The term <term>Federal Rebate Processing
			 System</term> means the Federal Rebate Processing System established under
			 section 3(b).</text>
			</paragraph><paragraph id="H51308DB82E7C4120BC42F376992DFCD6"><enum>(4)</enum><header>Home</header><text>The
			 term <term>home</term> means a residential dwelling unit in a building with no
			 more than 4 dwelling units that—</text>
				<subparagraph id="H30ED7C48C55342C0A2C4AE4342F16895"><enum>(A)</enum><text>is located in the
			 United States;</text>
				</subparagraph><subparagraph id="H96CF7E31EEAE47BFA603181877BCE85A"><enum>(B)</enum><text>was constructed
			 before the date of enactment of this Act; and</text>
				</subparagraph><subparagraph id="HBC7AC9A4155646D5A38E1E4AA97FF0DF"><enum>(C)</enum><text>is occupied at
			 least 6 months out of each of the 2 years immediately preceding the application
			 for a rebate under this Act.</text>
				</subparagraph></paragraph><paragraph id="HAE8FA25246D344C0BC37F898BCB1E181"><enum>(5)</enum><header>Home energy
			 savings retrofit rebate program</header><text>The term <term>Home Energy
			 Savings Retrofit Rebate Program</term> means the Home Energy Savings Retrofit
			 Rebate Program established under section 3(a).</text>
			</paragraph><paragraph id="H34F6071B0B6B4DAB94D28D04C7B660FB"><enum>(6)</enum><header>Homeowner</header><text>The
			 term <term>homeowner</term> means the owner of an owner-occupied home or a
			 tenant-occupied home.</text>
			</paragraph><paragraph id="H9FF1A77B98A24AF1B037B3DD627C6405"><enum>(7)</enum><header>Indian
			 tribe</header><text>The term <term>Indian tribe</term> has the meaning given
			 the term in section 4 of the Indian Self-Determination and Education Assistance
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text>
			</paragraph><paragraph id="H76D094C3E1CF48C29B1281D2C7582CD6"><enum>(8)</enum><header>Natural gas
			 utility</header><text>The term <term>natural gas utility</term> means any
			 company, person, cooperative, State or local governmental agency or
			 instrumentality, or Indian tribe that transports, distributes, or sells natural
			 gas at retail.</text>
			</paragraph><paragraph id="H980CBA7A2DA8463B8BBA72EF8891515C"><enum>(9)</enum><header>Qualified
			 contractor</header><text>The term <term>qualified contractor</term> means a
			 residential energy efficiency contractor that meets minimum applicable
			 requirements established under section 4.</text>
			</paragraph><paragraph id="H719A88A8BC944E4294D459CD2FB4556F"><enum>(10)</enum><header>Qualified home
			 energy efficiency retrofit</header><text>The term <term>qualified home energy
			 efficiency retrofit</term> means a retrofit described in section 8(d).</text>
			</paragraph><paragraph id="H07EB45DEA48940A0ABF8D05E47852626"><enum>(11)</enum><header>Quality
			 assurance program</header><text>The term <term>quality assurance program</term>
			 means a program established under this Act, or recognized by the Secretary
			 under this Act, to oversee the delivery of home efficiency retrofit programs to
			 ensure that work is performed in accordance with standards and criteria
			 established under this Act. Delivery of retrofit programs includes delivery of
			 quality assurance reviews of rebate applications and field inspections.</text>
			</paragraph><paragraph id="HB8A570FFCC78472EAACE3DBDA25C8E58"><enum>(12)</enum><header>Quality
			 assurance provider</header><text>The term <term>quality assurance
			 provider</term> means any entity that meets the minimum applicable requirements
			 established under section 6(b).</text>
			</paragraph><paragraph id="H91F332720C7E44C1960AB3EABA704BBF"><enum>(13)</enum><header>Rebate
			 aggregator</header><text>The term <term>rebate aggregator</term> means an
			 entity that meets the requirements of section 5.</text>
			</paragraph><paragraph id="HA91EB6E64BA7418B9B2E03A4782FFFE5"><enum>(14)</enum><header>Resnet</header><text>The
			 term <term>RESNET</term> means the Residential Energy Services Network, which
			 is a nonprofit certification and standard setting organization for home energy
			 raters that evaluate the energy performance of a home and Energy Smart
			 Contractors that make energy improvements to the home.</text>
			</paragraph><paragraph id="H3AA7AFCA984E448D93C931B4CA0867D1"><enum>(15)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy.</text>
			</paragraph><paragraph id="HA4D842CC5C6E4650A85A218D9594F1FD"><enum>(16)</enum><header>State</header><text>The
			 term <term>State</term> means—</text>
				<subparagraph id="H56BD39E4819D4C879B685FB09FD7D8AE"><enum>(A)</enum><text>a State;</text>
				</subparagraph><subparagraph id="H40289D80F1B741FF9BDBA606787027DB"><enum>(B)</enum><text>the District of
			 Columbia;</text>
				</subparagraph><subparagraph id="H6AB11D16B5A44A0A9F5F7CAE74ED1435"><enum>(C)</enum><text>the Commonwealth
			 of Puerto Rico;</text>
				</subparagraph><subparagraph id="H39A96073A9B846CC9D0153AB116A2A58"><enum>(D)</enum><text>Guam;</text>
				</subparagraph><subparagraph id="H73EFBE9D592B4547B6A3B0C1C0B96D7D"><enum>(E)</enum><text>American
			 Samoa;</text>
				</subparagraph><subparagraph id="H24817DA2139E4D258310B856BB3B71CD"><enum>(F)</enum><text>the Commonwealth
			 of the Northern Mariana Islands;</text>
				</subparagraph><subparagraph id="H569860E3160E45AEA388ED3DA57BD358"><enum>(G)</enum><text>the United States
			 Virgin Islands; and</text>
				</subparagraph><subparagraph id="H797C33DC8D82461FB535B83C4FBE1BC5"><enum>(H)</enum><text>any other
			 territory or possession of the United States.</text>
				</subparagraph></paragraph></section><section id="H6781BD88C7F942D493DD5229C9275080"><enum>3.</enum><header>Home Energy
			 Savings Retrofit Rebate Program</header>
			<subsection id="H22EC4EE7EFF5489CBCFC89D777DAA0FD"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall establish the Home Energy Savings
			 Retrofit Rebate Program.</text>
			</subsection><subsection id="H3DB0FB99D15742048C4817A888B227A0"><enum>(b)</enum><header>Federal rebate
			 processing system</header>
				<paragraph id="H4AEB5B4F7EE54C7D9B8A84B4D555B663"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Secretary, in consultation with the Secretary of the Treasury,
			 shall—</text>
					<subparagraph id="HC5FAF1F7960B4A7BAA9DE564F8ED9420"><enum>(A)</enum><text>establish a
			 Federal Rebate Processing System which shall serve as a database and
			 information technology system that will allow rebate aggregators to submit
			 claims for reimbursement using standard data protocols;</text>
					</subparagraph><subparagraph id="HC89A124B31784F9D8A98B151EFE26461"><enum>(B)</enum><text>establish a
			 national retrofit Web site that provides information on the Home Energy Savings
			 Retrofit Rebate Program, including—</text>
						<clause id="H01690F9125C84009895DA8A5A1B68A20"><enum>(i)</enum><text>how
			 to determine whether particular efficiency measures are eligible for rebates;
			 and</text>
						</clause><clause id="H16261639E3884E8598ACD91850483D15"><enum>(ii)</enum><text>how
			 to participate in the program; and</text>
						</clause></subparagraph><subparagraph id="H9E164AF9E6934588B45286723F9922DB"><enum>(C)</enum><text>make available
			 model forms for demonstrating compliance with all applicable requirements of
			 this Act, which shall be required to be submitted by—</text>
						<clause id="H7E902080174A43DB8E49CC8EB57344FA"><enum>(i)</enum><text>each
			 qualified contractor on completion of an eligible home energy retrofit;
			 and</text>
						</clause><clause id="HF4B8FC53638947FCB9F5CBFEFB9E1FAB"><enum>(ii)</enum><text>each quality
			 assurance provider on completion of field verification.</text>
						</clause></subparagraph></paragraph><paragraph id="H7D9610D88F6F4993AA9068754F5288A6"><enum>(2)</enum><header>Model
			 forms</header><text>In carrying out paragraph (1)(C), the Secretary shall
			 consider the model forms developed by the National Home Performance Council,
			 Inc. If the Secretary does not adopt these forms, the Secretary shall convene a
			 group of stakeholders that are directly and materially affected by the Program
			 to develop the final forms.</text>
				</paragraph></subsection></section><section id="HB45F5F18F937411FB1C44EF441A57CF7"><enum>4.</enum><header>Contractors</header>
			<subsection id="H9618BD3DDE1445CAA0B7F59966DDE323"><enum>(a)</enum><header>Contractor
			 qualifications</header><text>A contractor may perform retrofit work under the
			 Home Energy Savings Retrofit Rebate Program in a State if the
			 contractor—</text>
				<paragraph id="HAC1E5572BF7B4236A564A0B8D62AD1AC"><enum>(1)</enum><text>meets all
			 applicable contractor licensing requirements established by the State;</text>
				</paragraph><paragraph id="H35541C9A7D364BFCA0A7DEEBEE6DAFBF"><enum>(2)</enum><text>is—</text>
					<subparagraph id="H1D42A60CCBFE49F2A93530F2555D0DF0"><enum>(A)</enum><text>accredited
			 by—</text>
						<clause id="H7BFD99BFEA00445A806ABCE251DE3F91"><enum>(i)</enum><text>BPI
			 as an Accredited Contractor;</text>
						</clause><clause id="H6A24E7BF14424109AC466AF926A82685"><enum>(ii)</enum><text>RESNET as an
			 Energy Smart Home Performance Team;</text>
						</clause><clause id="H7BC0E70C3BF4432881360DFE4E21631B"><enum>(iii)</enum><text>the Air
			 Conditioning Contractors of America as a QA Home Performance Contractor;</text>
						</clause><clause id="H3A3986093BEF48A7AF317DB47A8C7693"><enum>(iv)</enum><text>a
			 State-based certification program established to carry out State energy, clean
			 air, or environmental programs; or</text>
						</clause><clause id="HFFA723ADCD5541FF8AD9D5EC65B95BEF"><enum>(v)</enum><text>an
			 equivalent certification program approved by the Secretary for this purpose;
			 or</text>
						</clause></subparagraph><subparagraph id="HC9EE87E394F34C458714BD2B60B476FE"><enum>(B)</enum><text>the general
			 contractor, that—</text>
						<clause id="H810AE4C160E44B2FAF354D3D951C7CB8"><enum>(i)</enum><text>subjects the
			 energy efficiency retrofit to a review and quality assurance inspection by a
			 third party approved by the Department of Energy for performing quality
			 assurance inspections; and</text>
						</clause><clause id="H62320BBF8F9447F4AA1BE5285FFED63B"><enum>(ii)</enum><text>employs, or
			 otherwise utilizes subcontractors who employ, individuals to complete
			 individual or comprehensive scopes of work related to the energy efficiency
			 retrofit who are certified by—</text>
							<subclause id="HE429DAAB6E5444FEA542D6A11D1130EB"><enum>(I)</enum><text display-inline="yes-display-inline">BPI;</text>
							</subclause><subclause id="H065072BE04E54FDB8A2AE1740D8B74C4"><enum>(II)</enum><text>RESNET;</text>
							</subclause><subclause id="H5DB0F8A209AF4B6E95A4B6E873E0F191"><enum>(III)</enum><text>North American
			 Technical Excellence;</text>
							</subclause><subclause id="HEFF9469CA9D5480FA42BD605ED766E3A"><enum>(IV)</enum><text display-inline="yes-display-inline">the Air Conditioning Contractors of
			 America;</text>
							</subclause><subclause id="H3F291B15B78E4EA591721530F173A871"><enum>(V)</enum><text>the Laborers
			 International Union of North America;</text>
							</subclause><subclause id="HCC787CD4F6C6474F813B06D0A8B575D0"><enum>(VI)</enum><text display-inline="yes-display-inline">a regional or State Department of Energy
			 Weatherization Training Center; or</text>
							</subclause><subclause id="HCC31430EDD104BBE89C518E560A6C683"><enum>(VII)</enum><text>other contractor
			 or worker certification programs approved by the Secretary;</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="H8DAD79E0F26946AAAEC1D191255221DD"><enum>(3)</enum><text>holds insurance
			 coverage of at least $1,000,000 for general liability, and for such other
			 purposes and in such other amounts as required by the State; and</text>
				</paragraph><paragraph id="HBDC8C013D60C44D4B28F82E3552AA7C5"><enum>(4)</enum><text>provides
			 warranties to the homeowner that completed work will—</text>
					<subparagraph id="H23650CA433E646AAA8B181336967D744"><enum>(A)</enum><text>be free of
			 significant defects;</text>
					</subparagraph><subparagraph id="HADBD37843D6246DBB3663BE2E4F332D8"><enum>(B)</enum><text>be installed in
			 accordance with the specifications of the manufacturer, and all applicable
			 State and local codes; and</text>
					</subparagraph><subparagraph id="H790D940DE3DD4355BD74F274CDA1E5A8"><enum>(C)</enum><text>perform properly
			 for a period of at least 1 year after the date of completion of the
			 work.</text>
					</subparagraph></paragraph></subsection><subsection id="H5C500DAA5D054DD88D59C6BB6FD7CF05"><enum>(b)</enum><header>Agreement
			 between contractor and homeowner</header><text>A contractor who performs
			 retrofit work under the Home Energy Savings Retrofit Rebate Program must sign a
			 written or electronic contract with the homeowner that includes—</text>
				<paragraph id="HA165A974600F408BAA9821CA02E9E460"><enum>(1)</enum><text>an agreement to
			 not increase the cost of the home improvement as a result of the rebates
			 received under this Act with respect to physical improvements made to the
			 home;</text>
				</paragraph><paragraph id="H1C46415D28974EF99A09639A0C75CBBF"><enum>(2)</enum><text>if the contractor
			 and homeowner choose the transferable rebate option authorized under section 7,
			 an agreement to provide the homeowner, before a contract is executed between
			 the contractor and the homeowner covering the eligible work, a notice of the
			 rebate amount the contractor intends to apply for with respect to eligible work
			 under this Act; and</text>
				</paragraph><paragraph id="H9F0574B77A46487A92F1C069FCA5DA5B"><enum>(3)</enum><text>an acknowledgement
			 that the homeowner—</text>
					<subparagraph id="HEABCAC8FD69C4BB597B64F92299481D5"><enum>(A)</enum><text>has reviewed the
			 national retrofit Web site for the program;</text>
					</subparagraph><subparagraph id="H3BC804E78614468DBD30784625E73EA2"><enum>(B)</enum><text>understands the
			 scope of work intended to be completed and that such work may be eligible for a
			 rebate under the program; and</text>
					</subparagraph><subparagraph id="HD78644E79E98442C9324BD1EB3237542"><enum>(C)</enum><text>understands that
			 the rebate funds are fully subject to availability from the Department or
			 Rebate Aggregator and not within the control of the contractor.</text>
					</subparagraph></paragraph></subsection></section><section id="HB862754BEDC948FC9EFB0099615A86A0"><enum>5.</enum><header>Rebate
			 aggregators</header>
			<subsection id="HFA9EC545CD874EEAB6497781965FC1C1"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall develop a network of rebate
			 aggregators or a national rebate aggregator that can facilitate the delivery of
			 rebates to participating homeowners or contractors by—</text>
				<paragraph id="HB08C9DBECD604FB4A091AA934CDB98B2"><enum>(1)</enum><text>reviewing the
			 proposed rebate application for completeness and accuracy;</text>
				</paragraph><paragraph id="H355A8C434C334E709FCF020C756D36ED"><enum>(2)</enum><text>reviewing measures
			 for eligibility in accordance with this Act;</text>
				</paragraph><paragraph id="HE5E84F11361C4A5D8DA4045EF2E93A4F"><enum>(3)</enum><text>providing data to
			 the Federal Rebate Processing System consistent with data protocols established
			 by the Secretary; and</text>
				</paragraph><paragraph id="H3815BC93C7794CD5B7682E0CFA3D840F"><enum>(4)</enum><text>as soon as
			 practicable but not later than 30 days after the date of receipt, distributing
			 funds received from the Department of Energy to homeowners or
			 contractors.</text>
				</paragraph></subsection><subsection id="H4B946E60B66C4FD485CA6CAE52E765BB"><enum>(b)</enum><header>Eligibility</header><text>To
			 be eligible to apply to the Secretary for approval as a rebate aggregator, an
			 entity shall be—</text>
				<paragraph id="HFEE008F014FF4E919B35811E3A4B9661"><enum>(1)</enum><text>a
			 Home Performance with Energy Star program sponsor;</text>
				</paragraph><paragraph id="HBC0A635BF21A41DC9415571E2E8FF38E"><enum>(2)</enum><text>an entity
			 administering a residential or building energy efficiency retrofit program,
			 solar program, or other such program impacting energy efficiency in homes
			 established or approved by a State or local government;</text>
				</paragraph><paragraph id="HEF277FFDA19A4CB1BC25E0BF0DBD572D"><enum>(3)</enum><text>a
			 Federal power marketing administration, an electric utility, or a natural gas
			 utility that has—</text>
					<subparagraph id="H9759705028DD4914B0D444E974FF3B2B"><enum>(A)</enum><text>a residential
			 energy efficiency retrofit program; and</text>
					</subparagraph><subparagraph id="HE624D80E8B954A879D62D273EACA0169"><enum>(B)</enum><text>a quality
			 assurance provider or provider network; or</text>
					</subparagraph></paragraph><paragraph id="H56293D00EB3D4678A48B60B7900D06A6"><enum>(4)</enum><text>an entity that
			 demonstrates to the Secretary that the entity can perform the functions of a
			 rebate aggregator, without disrupting existing residential retrofits in the
			 States that are incorporating the Home Energy Savings Retrofit Rebate Program,
			 including demonstration of—</text>
					<subparagraph id="H7D533FAB9B764B0BA6E9A11E1D894B20"><enum>(A)</enum><text>the capability to
			 provide electronic data to the Federal Rebate Processing System;</text>
					</subparagraph><subparagraph id="H1BF50604ADE24AA486AB8EE42B75F62A"><enum>(B)</enum><text>a financial system
			 that is capable of tracking the distribution of rebates to participating
			 contractors; and</text>
					</subparagraph><subparagraph id="HE59D19554A5543A1951F574E70DD10B9"><enum>(C)</enum><text>coordination and
			 cooperation by the entity with the appropriate State energy office regarding
			 participation in the existing energy efficiency programs that will be
			 delivering the Home Energy Savings Retrofit Rebate Program.</text>
					</subparagraph></paragraph></subsection><subsection id="HF3DC76DF2B154B868D75499B783B4892"><enum>(c)</enum><header>Public utility
			 commission efficiency targets</header><text>The Secretary shall—</text>
				<paragraph id="H76E8A1ECC1884717B5D20AEB028D1802"><enum>(1)</enum><text>develop guidelines
			 for States and local governments to use to allow utilities participating as
			 rebate aggregators to count the energy savings from the participation of the
			 utilities toward State and local level energy savings targets; and</text>
				</paragraph><paragraph id="H589FB3F34B004677BC9FCE5E8D00CCD3"><enum>(2)</enum><text>work with States
			 and local governments to assist in the adoption of those guidelines for the
			 purposes and duration of the Home Energy Savings Retrofit Rebate
			 Program.</text>
				</paragraph></subsection></section><section id="H80D54812190949DE8720386977F1CE9C"><enum>6.</enum><header>Quality assurance
			 providers</header>
			<subsection id="H1E88BBBBE7E748D7AACA6F5231EFBC88"><enum>(a)</enum><header>Qualifications</header><text>An
			 entity shall be considered a quality assurance provider under this Act only if
			 the entity is qualified through—</text>
				<paragraph id="H41943ABC9B994621B069927DDC54F92E"><enum>(1)</enum><text>the BPI;</text>
				</paragraph><paragraph id="H8C2ECDB3C0B84808AE6333788854553D"><enum>(2)</enum><text>RESNET; or</text>
				</paragraph><paragraph id="HEABA3FA549BB486A80790E67F6A72AB7"><enum>(3)</enum><text display-inline="yes-display-inline">any other entity designated by the
			 Secretary such as a State or local government or a residential energy
			 efficiency retrofit program approved by a State or local government.</text>
				</paragraph></subsection><subsection id="HB535136D9B524100B056929472965188"><enum>(b)</enum><header>Functions</header><text>A
			 quality assurance provider shall—</text>
				<paragraph id="HBFBFB84C8FA543DA8281D175632D97F6"><enum>(1)</enum><text>be independent of
			 the contractor;</text>
				</paragraph><paragraph id="HC0742DD0966C473C9E5BAA4A73C76B8C"><enum>(2)</enum><text>confirm that
			 contractors or installers of home energy efficiency retrofits meet the
			 qualification requirements of this Act; and</text>
				</paragraph><paragraph id="H02AD34219BE347058F00F6BB41F36703"><enum>(3)</enum><text>perform field
			 inspections to confirm the compliance of the retrofit work and the simulated
			 energy savings under the Home Energy Savings Retrofit Rebate Program.</text>
				</paragraph></subsection></section><section id="HFEBEB6AE7B9E4ECA9720327A388CDD6B"><enum>7.</enum><header>Transferability
			 of home energy savings rebate</header><text display-inline="no-display-inline">A homeowner may transfer the rebate provided
			 under the Home Energy Savings Retrofit Rebate Program to the contractor
			 performing the retrofit work if the contractor completes a form that
			 accompanies the rebate form developed under section 3(b). This form, to be made
			 publically available by the Secretary 90 days after the date of enactment of
			 this Act, must be approved by paper signature or electronically by the
			 homeowner and include—</text>
			<paragraph id="H00D5593C714E482EA95BA87DAAF48FC1"><enum>(1)</enum><text>the amount of the
			 rebate the contractor will submit for disbursement to the contractor;</text>
			</paragraph><paragraph id="H14538B3A5CCA475CAADAEDB65D5AC7E9"><enum>(2)</enum><text>the level of
			 energy use reduction of the home retrofit certified under section 8(e)(4), and
			 assurance that the contractor will provide the certificate to the homeowner
			 within 30 days of receipt from the Department of Energy;</text>
			</paragraph><paragraph id="HC5D51B2A39FE4669B65286E970EAE9CD"><enum>(3)</enum><text>a
			 documentation report of the retrofit performed and paid by the homeowner;
			 and</text>
			</paragraph><paragraph id="H3523642A74BD43D48AC38B2B33E3ECF4"><enum>(4)</enum><text>confirmation from
			 the homeowner that they understand they have the right to submit directly for
			 the rebate and have chosen to transfer the credit in full to the
			 contractor.</text>
			</paragraph></section><section id="H7BC845B3CF8748D4851C5F469D207D16"><enum>8.</enum><header>Home Energy
			 Savings Retrofit Rebate Program</header>
			<subsection id="H8B9AC17A08644705B76CCC9F83DE0A93"><enum>(a)</enum><header>In
			 general</header><text>If a qualified home energy efficiency retrofit of a home
			 is carried out after January 1, 2014, by a qualified contractor in accordance
			 with this section, rebates shall be awarded for retrofits that achieve home
			 energy savings in accordance with this Act.</text>
			</subsection><subsection id="HF9D7EF8C5B6F489F898B2287DD624970"><enum>(b)</enum><header>Amount of
			 rebates</header>
				<paragraph id="H752B291E5C034C9C880BBC35B6CCA7F4"><enum>(1)</enum><header>In
			 general</header><text>Subject to subsection (e), the amount of a rebate
			 provided to the owner of a home or a designee of the owner under this section
			 shall be—</text>
					<subparagraph id="H971FD09273EF4367B88AD4E4871A76A0"><enum>(A)</enum><text>$2,000 for a 20–24
			 percent reduction in home energy use;</text>
					</subparagraph><subparagraph id="HD05A0ECAF91E46BD88B7F4CCE0F8B856"><enum>(B)</enum><text>$3,000 for a 25–29
			 percent reduction in home energy use;</text>
					</subparagraph><subparagraph id="H0C74916B1BCA4AA89883EBAC2E3B1136"><enum>(C)</enum><text>$4,000 for a 30–34
			 percent reduction in home energy use;</text>
					</subparagraph><subparagraph id="H7595E5E275BA477DAE10A0FD35A0FD49"><enum>(D)</enum><text>$5,000 for a 35–39
			 percent reduction in home energy use;</text>
					</subparagraph><subparagraph id="H19C9F1116631489F974D528E061066BC"><enum>(E)</enum><text>$6,000 for a 40–44
			 percent reduction in home energy use;</text>
					</subparagraph><subparagraph id="H4140AF99C5E84076B446888FF43B3242"><enum>(F)</enum><text>$7,000 for a 45–49
			 percent reduction in home energy use; and</text>
					</subparagraph><subparagraph id="H6D3CE4CB689A4EA3B05AFFA973A3D695"><enum>(G)</enum><text>$8,000 for a 50
			 percent or more reduction in home energy use.</text>
					</subparagraph></paragraph><paragraph id="H41877A5D313A4F73A428C4DB654D4078"><enum>(2)</enum><header>Rebate
			 payment</header>
					<subparagraph id="H6D8F88A34DD74ECA95F053BEBC7D0F5F"><enum>(A)</enum><header>In
			 general</header><text>The rebate shall be paid, based on energy savings as
			 calculated under subsection (e), within 60 days after—</text>
						<clause id="H9C388F4BF5BF408A910F7D2856051033"><enum>(i)</enum><text>submission of the
			 required rebate forms; and</text>
						</clause><clause id="H67A464FAEDF44520A286BF3BFA8232BA"><enum>(ii)</enum><text>the
			 completion of any quality assurance assessment required under subparagraph
			 (B).</text>
						</clause></subparagraph><subparagraph id="HFA52C20DC9804352B5B5D297DB4A4D25"><enum>(B)</enum><header>Quality
			 assurance assessments</header><text>The Secretary shall establish a schedule of
			 required quality assurance assessments. In the first year of the program, the
			 first 10 homes retrofit by each contractor and then 60 percent of all future
			 homes shall be required to have a quality assurance assessment. The Secretary
			 shall establish a cost effective schedule of required quality assurance
			 assessments for subsequent years based on performance under the program.</text>
					</subparagraph></paragraph><paragraph id="H6E30821866B34F4398E721E1C5A1A603"><enum>(3)</enum><header>Limitation</header><text>In
			 no event shall the amount of rebates under this subsection exceed—</text>
					<subparagraph id="H71D3131D1B614CAE8F16A9EDF9060C23"><enum>(A)</enum><text>$10,000 with
			 respect to any individual; or</text>
					</subparagraph><subparagraph id="H992EEB5FC3AE4A74A234650881164EDB"><enum>(B)</enum><text>50 percent of the
			 qualified home energy efficiency expenditures paid or incurred by the homeowner
			 under subsection (c).</text>
					</subparagraph></paragraph></subsection><subsection id="H87953FF917E54920A24C0D39A7BA3378"><enum>(c)</enum><header>Qualified home
			 energy efficiency expenditures</header><text>For purposes of this section, the
			 term <term>qualified home energy efficiency expenditures</term>—</text>
				<paragraph id="H33EC99344F5B46EDB84CF2DDC3024468"><enum>(1)</enum><text>means any amount
			 paid or incurred by a homeowner for a qualified home energy efficiency
			 retrofit, including the cost of diagnostic procedures, labor, reporting, and
			 modeling; and</text>
				</paragraph><paragraph id="HE8AB0DDE32D644AFAA3108D0390329EE"><enum>(2)</enum><text>does not
			 include—</text>
					<subparagraph id="H139E504771284D768989AF4FEBEB0A27"><enum>(A)</enum><text>improvements to
			 swimming pools or hot tubs; or</text>
					</subparagraph><subparagraph id="H0047FB7174FF40B69FCCD848EDE9EB7D"><enum>(B)</enum><text>any amount paid or
			 incurred to purchase or install a biomass, wood, or wood pellet furnace,
			 boiler, or stove, unless the system—</text>
						<clause id="HEFBAA2003444470FA47F165FF388C1E0"><enum>(i)</enum><text>is
			 designed to meet at least 70 percent of the heating demands of the home;</text>
						</clause><clause id="H2BC54F68A63C452581BC97512EA6D399"><enum>(ii)</enum><text>in
			 the case of woodstoves, is certified by the Environmental Protection
			 Agency;</text>
						</clause><clause id="HEB0AC181332E4F6AAD3590FA22C9DDD8"><enum>(iii)</enum><text>in
			 the case of a wood stove replacement, replaces an existing wood stove with a
			 stove that is certified by the Environmental Protection Agency, if a voucher is
			 provided by the installer or other responsible party certifying that the old
			 stove has been removed and made inoperable;</text>
						</clause><clause id="H97F712D5C93B4D738BD5A6563EE8CC55"><enum>(iv)</enum><text>in
			 the case of a furnace or boiler, is in a home with a distribution system (such
			 as piping, ducts, vents, blowers, or affixed fans) that allows heat from the
			 furnace or boiler to reach all or most parts of the home; and</text>
						</clause><clause id="H01A8D1D365174951AD2AB10DBC033EFD"><enum>(v)</enum><text>is
			 certified by an independent test laboratory approved by the Secretary as
			 having—</text>
							<subclause id="H3979FDFBE504427FA7401392B7DD3A64"><enum>(I)</enum><text>thermal efficiency
			 (with a high heating value) of at least 75 percent for stoves and 80 percent
			 for furnaces and boilers;</text>
							</subclause><subclause id="H9C1BCEAE394141E38C2BA74413292E06"><enum>(II)</enum><text>particulate
			 emissions of less than 3.0 grams per hour for wood stoves or pellet stoves;
			 and</text>
							</subclause><subclause id="H2008BC69DB29483E942A2D9D7705C881"><enum>(III)</enum><text>less than 0.07
			 lbs per million BTU for outdoor boilers and furnaces.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection id="HDE29445EACE447C5BB7098EC8C1E60B6"><enum>(d)</enum><header>Qualified home
			 energy efficiency retrofit</header>
				<paragraph id="HC511B69FBB3E485381FE043ED62F009F"><enum>(1)</enum><header>In
			 general</header><text>A qualified home energy efficiency retrofit is a retrofit
			 that implements measures, during a rebate-eligible year in the existing
			 principal residence of the homeowner which is located in the United States,
			 intended to reduce the energy use of such residence. A qualified home energy
			 efficiency retrofit shall—</text>
					<subparagraph id="H11DEB636E6D64877A361B89F31FCE5E5"><enum>(A)</enum><text>be implemented and
			 installed by a qualified contractor;</text>
					</subparagraph><subparagraph id="H5BA4BB4A538C49C7B0438003A12AB3B9"><enum>(B)</enum><text>install a set of
			 measures modeled to achieve a reduction in home energy use of 20 percent or
			 more from the baseline established under subparagraph (C), using computer
			 modeling software approved under paragraph (2);</text>
					</subparagraph><subparagraph id="H4E97ABE5580842C2A6F53C5F8D1DE109"><enum>(C)</enum><text>establish the
			 baseline energy use as provided in subsection (e)(1)(C);</text>
					</subparagraph><subparagraph id="HE2F0755BC07541DDA7A5E128C634DC2D"><enum>(D)</enum><text>implement a
			 test-out procedure, following guidelines of the applicable accrediting program
			 described in section 4(a)(2) (A), (B), or (C), or equivalent guidelines
			 approved by the Secretary for this purpose, to ensure—</text>
						<clause id="H22672AAD51FF447CB780CAAACE602091"><enum>(i)</enum><text>the
			 safe operation of all systems post retrofit; and</text>
						</clause><clause id="HE826EF4A4E5D4526B957C1A572027018"><enum>(ii)</enum><text>that all
			 improvements are included in, and have been installed according to—</text>
							<subclause id="H320B3AB07DF141F79E37C428414D1F4E"><enum>(I)</enum><text>standards of the
			 applicable accrediting program described in section 4(a)(2) (A), (B), or
			 (C);</text>
							</subclause><subclause id="HBB8CB07996064FF9A89B270ECB77EEBE"><enum>(II)</enum><text>manufacturers
			 installation specifications; and</text>
							</subclause><subclause id="H165664481C094C0BAF8AE54549ED1080"><enum>(III)</enum><text>all applicable
			 State and local codes or equivalent standards approved by the Secretary for
			 this purpose;</text>
							</subclause></clause></subparagraph><subparagraph id="HED66B71988964CD8AA97AFBF9B24FE8E"><enum>(E)</enum><text>include only
			 measures that have an average estimated life of 5 years or more as determined
			 by the Secretary;</text>
					</subparagraph><subparagraph id="HC1FF09DEFC9D47F8851BE5DAE40FE0AB"><enum>(F)</enum><text>not include any
			 amount which is paid or incurred in connection with any expansion of the square
			 footage of the residence; and</text>
					</subparagraph><subparagraph id="H1104EC94DB21489A9DF476056B616FA3"><enum>(G)</enum><text>not include
			 improvements to swimming pools or hot tubs or any other expenditure
			 specifically excluded by the Secretary.</text>
					</subparagraph></paragraph><paragraph id="HC049020E55664EE6A7D9013AFD60C6AB"><enum>(2)</enum><header>Approved
			 modeling software</header><text>The contractor shall use modeling software
			 certified by RESNET as following the software verification test suites in
			 section 4.2.1 of RESNET Publication No. 13–001, or under equivalent standards
			 approved by the Secretary for this purpose, and shall have the ability at a
			 minimum to assess the savings associated with all the measures for Home Energy
			 Savings Retrofit Rebate Program.</text>
				</paragraph><paragraph commented="no" id="H738745B26CCA440D827800A26F2802AC"><enum>(3)</enum><header>Exception</header><text>For
			 purposes of paragraph (1)(D)(ii), installation of gas-fired appliances shall
			 comply with requirements of the National Fuel Gas Code (ANSI Z223.1/NFPA 54)
			 and applicable installation requirements in lieu of performance of combustion
			 tests outside those required by the National Fuel Gas Code (2012 Edition) and
			 the International Fuel Gas Code (2012 Edition).</text>
				</paragraph></subsection><subsection id="HB221C79450A24C56A212290E84A9D577"><enum>(e)</enum><header>Energy use
			 reduction</header>
				<paragraph id="H5D797B1AB7244982A586C048588C6E97"><enum>(1)</enum><header>Determination of
			 energy use reduction</header>
					<subparagraph id="HBEA2BB97EE6A4CC9BCDCEAB3917F5515"><enum>(A)</enum><header>In
			 general</header><text>The reduction in energy use for any residence shall be
			 determined by modeling the annual predicted percentage reduction in total
			 energy consumption or costs for heating, cooling, hot water, and permanent
			 lighting. It shall be modeled using computer modeling software approved under
			 subsection (d)(2) and calibrated according to subparagraph (C) of this
			 paragraph.</text>
					</subparagraph><subparagraph id="HFC58B177B4FE4D3AA16BB7253AAF30C5"><enum>(B)</enum><header>Energy
			 costs</header><text>For the purposes of subparagraph (A), the energy cost per
			 unit of fuel for each fuel type shall be determined by dividing the total
			 actual energy bill (subtracting taxes and fees) for the residence for that fuel
			 type for the most recent available 12-month period by the total energy units of
			 that fuel type used over the same period.</text>
					</subparagraph><subparagraph id="H1A52D770FFFF4D23A57F3C38A198A6E2"><enum>(C)</enum><header>Baseline energy
			 use</header><text>For the purposes of subparagraph (A), the software model that
			 establishes the baseline energy use and predicted energy savings shall be
			 calibrated according to the procedures set forth in sections 3 and 4 of
			 ANSI/BPI Standard BPI–2400–S–2012: Standard Practice for Standardized
			 Qualification of Whole-House Energy Savings Predictions by Calibration to
			 Energy Use History, or an equivalent standard approved by the Secretary for
			 this purpose.</text>
					</subparagraph></paragraph><paragraph id="H17541DB817A844E3BD4F51B9599732CA"><enum>(2)</enum><header>Documentation</header><text>The
			 percent improvement in energy consumption calculated under this section shall
			 be documented through modeling software described in subsection (d)(2).</text>
				</paragraph><paragraph id="HB588B73E4E34442BBE98857EF60CE618"><enum>(3)</enum><header>Monitoring</header><text>The
			 Secretary—</text>
					<subparagraph id="H67B3264A23224D59A63328B6D6E41FFA"><enum>(A)</enum><text>shall periodically
			 evaluate the software packages used for determining rebates under this
			 section;</text>
					</subparagraph><subparagraph id="H2EC188F574874350AEFE007F164D478D"><enum>(B)</enum><text>shall monitor and
			 compare the predictions to the real energy data, and based on the results,
			 create performance criteria to allow or disallow the software; and</text>
					</subparagraph><subparagraph id="HA593794BE0CC4A7F8F09604838C1214B"><enum>(C)</enum><text>may disallow the
			 use of software programs that improperly assess energy savings.</text>
					</subparagraph></paragraph><paragraph id="H6426D12EA54449D8B1E99D13E65FC371"><enum>(4)</enum><header>Certificate of
			 retrofit performance</header><text>The Secretary shall establish a system for
			 distribution of a certificate of performance with the issuance of a rebate that
			 certifies the predicted level of energy use reduction achieved by the retrofit.
			 The certificate will be provided to the rebate recipient. If the recipient is
			 the contractor under the terms of section 7, the contractor shall remit the
			 certificate to the homeowner, to be delivered or postmarked not later than 30
			 days after the contractor’s receipt of the certificate.</text>
				</paragraph><paragraph id="HC4CDE44C09764E66AACC8C567CA5ACC7"><enum>(5)</enum><header>Exception</header><text>The
			 Secretary shall not utilize the authority provided under this Act to—</text>
					<subparagraph id="H7FA06AA412D5495C83691593697D5150"><enum>(A)</enum><text>develop, adopt, or
			 implement a public labeling system that rates and compares the energy
			 performance of one home with another; or</text>
					</subparagraph><subparagraph id="HB2411D33C23F4E1B96D88EFA5D974038"><enum>(B)</enum><text>require the public
			 disclosure of an energy performance evaluation or rating developed for any
			 specific home.</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">Nothing in
			 this paragraph shall preclude the computation, collection, or use, by the
			 Secretary, rebate aggregators, or quality assurance providers, or the States or
			 Indian tribes, for the purposes of gathering information on the rating and
			 comparison of the energy performance of homes with and without energy
			 efficiency retrofits.</continuation-text></paragraph></subsection><subsection id="HE5B8AA5B939E43808F7F22C220EDEFD0"><enum>(f)</enum><header>Qualification
			 for rebate</header><text>On submission of a claim for a retrofit rebate by a
			 rebate aggregator to the system established under section 5, the Secretary
			 shall provide reimbursement to the rebate aggregator, if—</text>
				<paragraph id="H3F2AE19004DA4135A61FFEB177CB6B11"><enum>(1)</enum><text>the retrofit is a
			 qualified home energy efficiency retrofit;</text>
				</paragraph><paragraph id="HBED2A637335F444794A83D1294235FBA"><enum>(2)</enum><text>the amount of the
			 reimbursement is not more than the amount described in subsection (b);</text>
				</paragraph><paragraph id="H46E355D125E74B148C4219F84A3DD6E6"><enum>(3)</enum><text>documentation
			 required to verify the claim is transmitted with the claim; and</text>
				</paragraph><paragraph id="H6BA24F0A11D64608BF36914978105196"><enum>(4)</enum><text>any quality
			 assurance assessment required under subsection (b)(2)(B) has been
			 completed.</text>
				</paragraph></subsection><subsection id="HC73B6DB8FAA245E28BE9E68928D97CAF"><enum>(g)</enum><header>Homeowner
			 complaints</header>
				<paragraph id="H96798F57CE9046DE8E90A98FFD52CF11"><enum>(1)</enum><header>In
			 general</header><text>A homeowner may make a complaint under the quality
			 assurance program during the 1-year warranty period that compliance with the
			 quality assurance requirements of this section has not been achieved.</text>
				</paragraph><paragraph id="H93B0818C90AD4626B4D738FE85FB2EE4"><enum>(2)</enum><header>Verification</header>
					<subparagraph id="H2AB54199052A4E2F9D5E2559BB530513"><enum>(A)</enum><header>In
			 general</header><text>The quality assurance program shall provide that, on
			 receiving a complaint under paragraph (1), an independent quality assurance
			 provider shall conduct field verification on the retrofit work performed by the
			 contractor.</text>
					</subparagraph><subparagraph id="HAB9B018EE8EE430891FAAE55287D8C96"><enum>(B)</enum><header>Administration</header><text>A
			 verification under this paragraph shall be corrected in accordance with
			 subsection (f)(4).</text>
					</subparagraph></paragraph></subsection><subsection id="HEB4461DC8F364B17AC7E8919F35449A6"><enum>(h)</enum><header>Audits</header>
				<paragraph id="H78276831D35A4846A7DC8EE4C2D65C1E"><enum>(1)</enum><header>In
			 general</header><text>On making payment for a submission under this section,
			 the Secretary shall review rebate requests to determine whether program
			 requirements were met in all respects.</text>
				</paragraph><paragraph id="H69169C34DDBC45F09158FABB8EB664EB"><enum>(2)</enum><header>Incorrect
			 payment</header><text>On a determination of the Secretary under paragraph (1)
			 that a payment was made incorrectly to a party, the Secretary may—</text>
					<subparagraph id="H28C07C6BCC1449379A0F0493E3306682"><enum>(A)</enum><text>recoup the amount
			 of the incorrect payment; or</text>
					</subparagraph><subparagraph id="HA9B97B65F1454E4AA666949B6FDA1654"><enum>(B)</enum><text>withhold the
			 amount of the incorrect payment from the next payment made to the party
			 pursuant to a subsequent request.</text>
					</subparagraph></paragraph></subsection><subsection id="HBF3AE605FA2B4941BF6E7EDA4E580E38"><enum>(i)</enum><header>Incentives</header><text>The
			 amount of incentives that the Secretary may provide to quality assurance
			 providers and rebate aggregators under this Act shall be—</text>
				<paragraph id="H6CCF27BE109E40048B13D4B2A617F831"><enum>(1)</enum><text>$25 for each
			 rebate review and submission provided under the program;</text>
				</paragraph><paragraph id="H0506582A9E0647FB80E3B2D2C0F4ED8C"><enum>(2)</enum><text>$250 for each
			 field inspection conducted under the program; or</text>
				</paragraph><paragraph id="H372F16F1A766461DB62C946DDCC9F08F"><enum>(3)</enum><text>such other amounts
			 as the Secretary considers necessary to carry out the quality assurance
			 provisions of this Act.</text>
				</paragraph></subsection></section><section id="HAD9B8850425044238C72B4FB61134162"><enum>9.</enum><header>Grants to States
			 and Indian tribes</header>
			<subsection id="HB7C83981983E460DBD2D946E87ABF976"><enum>(a)</enum><header>In
			 general</header><text>A State or Indian tribe that receives a grant under
			 subsection (d) shall be permitted to use the grant for—</text>
				<paragraph id="HDC8701588E6C4D83AF76CCC87A1AB888"><enum>(1)</enum><text>administrative
			 costs;</text>
				</paragraph><paragraph id="HDB7EE623183B4753A5F6EEE29118ECAB"><enum>(2)</enum><text>oversight of
			 quality assurance plans;</text>
				</paragraph><paragraph id="H755CDA79A44F4F48B8E1EC9F3A546E07"><enum>(3)</enum><text>development of a
			 quality assurance program;</text>
				</paragraph><paragraph id="HE3C880C164884B6DA58F5B93E4F1BE6A"><enum>(4)</enum><text>establishment and
			 delivery of financing pilots in accordance with this Act;</text>
				</paragraph><paragraph id="HE6DDCFCC4AB7434491FBA8FFEC91EB7C"><enum>(5)</enum><text>coordination with
			 existing residential retrofit programs and infrastructure development to assist
			 deployment of the Home Energy Savings Retrofit Rebate Program; and</text>
				</paragraph><paragraph id="H4FB40A9F93DC43788BEE6BC9A60D5A0F"><enum>(6)</enum><text>the costs of
			 carrying out the responsibilities of the State or Indian tribe under the Home
			 Energy Savings Retrofit Rebate Program.</text>
				</paragraph></subsection><subsection id="H9657C9E1489249B4A3E49761E9DA3873"><enum>(b)</enum><header>Initial
			 grants</header><text>Not later than 60 days after receipt of a completed
			 application for a grant under this section, the Secretary shall either make the
			 grant or provide to the applicant an explanation for denying the grant.</text>
			</subsection><subsection id="H5E1307D24A86422E9165C6344D9E3EFE"><enum>(c)</enum><header>Indian
			 tribes</header><text>The Secretary shall reserve an appropriate amount of
			 funding to be made available to carry out this section for each fiscal year to
			 make grants available to Indian tribes under this section.</text>
			</subsection><subsection id="HAE090EF5D4B04572A1BAB8F329CD2E53"><enum>(d)</enum><header>State
			 allotments</header><text>From the amounts made available to carry out this
			 section for each fiscal year remaining after the reservation required under
			 subsection (c), the Secretary shall make grants available to States in
			 accordance with section 15.</text>
			</subsection><subsection id="H5A3279EF0EAB41A8A2D202F14D73A288"><enum>(e)</enum><header>Quality
			 assurance programs</header>
				<paragraph id="H40F4AAA414C34C6B84F50E599B701914"><enum>(1)</enum><header>In
			 general</header><text>A State or Indian tribe may use a grant made under this
			 section to carry out a quality assurance program that is—</text>
					<subparagraph id="H4B71AE4F8C7740BD87BB52FC99C1E832"><enum>(A)</enum><text>operated as part
			 of a State or local government approved energy conservation plan established
			 under part D of title III of the Energy Policy and Conservation Act (42 U.S.C.
			 6321 et seq.);</text>
					</subparagraph><subparagraph id="H512E7EE0B4F34F279E6341178CA681D9"><enum>(B)</enum><text>managed by the
			 office or the designee of the office that is—</text>
						<clause id="H4DA4F68A1E6448ADB884A5F125E8E548"><enum>(i)</enum><text>responsible for
			 the development of the plan under section 362 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6322">42 U.S.C. 6322</external-xref>);
			 and</text>
						</clause><clause id="HE2D376C75D884081AC845C33BEF1D674"><enum>(ii)</enum><text>to
			 the maximum extent practicable conducting an existing energy efficiency
			 program; and</text>
						</clause></subparagraph><subparagraph id="HF4E31C80406744FD82B64108D6709489"><enum>(C)</enum><text>in the case of a
			 grant made to an Indian tribe, managed by an entity designated by the Indian
			 tribe to carry out a quality assurance program or a national quality assurance
			 program manager.</text>
					</subparagraph></paragraph><paragraph id="H1A84007596F04634BF332EE748EE2408"><enum>(2)</enum><header>Noncompliance</header><text>If
			 the Secretary determines that a State or Indian tribe has not provided or
			 cannot provide adequate oversight over a quality assurance program to ensure
			 compliance with this Act, the Secretary may—</text>
					<subparagraph id="H732ACAFA27814F20ADD6BFD4D0F0C007"><enum>(A)</enum><text>withhold further
			 quality assurance funds from the State or Indian tribe; and</text>
					</subparagraph><subparagraph id="HE07F224FE6BA4AA48260BBC2DF8B5E52"><enum>(B)</enum><text>require that
			 quality assurance providers operating in the State or by the Indian tribe be
			 overseen by a national quality assurance program manager selected by the
			 Secretary.</text>
					</subparagraph></paragraph></subsection><subsection id="H09C0E4B76924436BA70069982A9A58AC"><enum>(f)</enum><header>Implementation</header><text>A
			 State or Indian tribe that receives a grant under this section may implement a
			 quality assurance program through the State, the Indian tribe, or a third party
			 designated by the State or Indian tribe, including—</text>
				<paragraph id="H544D4ACD96BF4DC0B0F7FE2B47E54E67"><enum>(1)</enum><text>an energy service
			 company;</text>
				</paragraph><paragraph id="H79AE6AF59BB5446EA251A1951067CC65"><enum>(2)</enum><text>an electric
			 utility;</text>
				</paragraph><paragraph id="H723AB7AE27734BBD8C786C511C59FFC1"><enum>(3)</enum><text>a
			 natural gas utility;</text>
				</paragraph><paragraph id="H135837D7BF05423EB89818CF7A7AEBD1"><enum>(4)</enum><text>a
			 third-party administrator designated by the State or Indian tribe; or</text>
				</paragraph><paragraph id="H756F802505904D93BEC49F48D59F1996"><enum>(5)</enum><text>a
			 unit of local government.</text>
				</paragraph></subsection><subsection id="HE4006AA323524C7C8E27651DF8363107"><enum>(g)</enum><header>Public-Private
			 partnerships</header><text>A State or Indian tribe that receives a grant under
			 this section is encouraged to form partnerships with utilities, energy service
			 companies, and other entities—</text>
				<paragraph id="HA2DF2F8AC5B84FCA9F81482C5B1B6EB9"><enum>(1)</enum><text>to assist in
			 marketing a program;</text>
				</paragraph><paragraph id="H8875D3D54C4D4AB4B93FA5392042C70D"><enum>(2)</enum><text>to facilitate
			 consumer financing;</text>
				</paragraph><paragraph id="HE72450EC73E7496EBDCA71140DCACDC0"><enum>(3)</enum><text>to assist in
			 implementation of the Home Energy Savings Retrofit Rebate Program, including
			 installation of qualified home energy efficiency retrofits; and</text>
				</paragraph><paragraph id="HCC041B7672954DB8A6045F33CCE25338"><enum>(4)</enum><text>to assist in
			 implementing quality assurance programs.</text>
				</paragraph></subsection><subsection id="H58832A7DC4B24D3380F34D31E8FC51A9"><enum>(h)</enum><header>Coordination of
			 rebate and existing State-Sponsored programs</header>
				<paragraph id="H90B7E4AFF01D4B80A98D61E778349709"><enum>(1)</enum><header>In
			 general</header><text>A State or Indian tribe shall, to the maximum extent
			 practicable, prevent duplication through coordination of a program authorized
			 under this Act with—</text>
					<subparagraph id="H682B399BA41F4E609063129260198CDB"><enum>(A)</enum><text>the Energy Star
			 appliance rebates program authorized under the American Recovery and
			 Reinvestment Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law 111–5</external-xref>; 123; Stat. 115); and</text>
					</subparagraph><subparagraph id="HA148C628258D47A19A363728D99F3DEE"><enum>(B)</enum><text>comparable
			 programs planned or operated by States, political subdivisions, electric and
			 natural gas utilities, Federal power marketing administrations, and Indian
			 tribes.</text>
					</subparagraph></paragraph><paragraph id="H41E015B9E1DE40E399F475C0C44126E0"><enum>(2)</enum><header>Existing
			 programs</header><text>In carrying out this subsection, a State or Indian tribe
			 shall—</text>
					<subparagraph id="HC8977D2DF86F4CD9A11D195BA3C3F59A"><enum>(A)</enum><text>give priority
			 to—</text>
						<clause id="H4A6647EB5C48497CB11F334EFDB2FACA"><enum>(i)</enum><text>comprehensive
			 retrofit programs in existence on the date of enactment of this Act, including
			 programs under the supervision of State utility regulators; and</text>
						</clause><clause id="H38A15F57E19142EBA3CD05304911EBEB"><enum>(ii)</enum><text>using funds made
			 available under this Act to enhance and extend existing programs; and</text>
						</clause></subparagraph><subparagraph id="H16F68044BB3E4678B2B3BE91BC88D2E8"><enum>(B)</enum><text>seek to enhance
			 and extend existing programs by coordinating with administrators of the
			 programs.</text>
					</subparagraph></paragraph></subsection></section><section id="H55F77BAA0BCC481088B3D0C0BE41B3E2"><enum>10.</enum><header>Quality
			 assurance program</header>
			<subsection id="H71EB2CF234DB47DDBD7C4269F576868F"><enum>(a)</enum><header>In
			 general</header><text>As part of a grant application described in section 9(b),
			 a State or Indian tribe shall submit to the Secretary a plan to implement a
			 quality assurance program that covers all federally assisted residential
			 efficiency retrofit work administered, supervised, or sponsored by the State or
			 Indian tribe.</text>
			</subsection><subsection id="HDC9A4341DC7640EA9B8F7C91BAFA63F1"><enum>(b)</enum><header>Implementation</header><text>The
			 State or Indian tribe shall—</text>
				<paragraph id="H0C8A942B1A384CF386AF10FEFCFEAE77"><enum>(1)</enum><text>develop a quality
			 assurance program in consultation with industry stakeholders, including
			 representatives of efficiency program managers, contractors, and environmental,
			 energy efficiency, and labor organizations; and</text>
				</paragraph><paragraph id="H666C6058074245D0BB1C1E131E8AB76C"><enum>(2)</enum><text>implement the
			 quality assurance program not later than 180 days after receipt of a grant
			 under section 9.</text>
				</paragraph></subsection><subsection id="HF6CE100CA1F5451094CA32771D6A0E76"><enum>(c)</enum><header>Components</header><text>The
			 quality assurance program established under this section shall include—</text>
				<paragraph id="HB47B424E6CBF4E74AB1D3B06BD194DED"><enum>(1)</enum><text>maintenance of a
			 list of qualified contractors authorized to perform such retrofit work as
			 described in section 4; and</text>
				</paragraph><paragraph id="H56374312696F4BAFA1C2FF27E831A2EC"><enum>(2)</enum><text>non-binding
			 targets and realistic plans for—</text>
					<subparagraph id="HB27483194CE44E799287B437598B565A"><enum>(A)</enum><text>the recruitment of
			 small minority-owned or women-owned business enterprises; and</text>
					</subparagraph><subparagraph id="HE00763848B0048139E9F051EA0E0CFB2"><enum>(B)</enum><text>the employment of
			 graduates of training programs that primarily serve low-income populations with
			 a median income that is below 200 percent of the poverty line (as defined in
			 section 673(2) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902(2)</external-xref>),
			 including any revision required by that section) by participating
			 contractors.</text>
					</subparagraph></paragraph></subsection><subsection id="H01D0483F1836426B9B60307C6E8DF4DA"><enum>(d)</enum><header>Noncompliance</header><text>If
			 the Secretary determines that a State or Indian tribe has not taken the steps
			 required under this section, the Secretary shall provide to the State or Indian
			 tribe a period of at least 90 days to comply before suspending the
			 participation of the State or Indian tribe in the program.</text>
			</subsection></section><section id="HC405291AD4364D548F9E108D82FED926"><enum>11.</enum><header>Evaluation
			 report to Congress</header>
			<subsection id="HBCFF0F3031CB4E84BB7C3767EEB82E37"><enum>(a)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act and annually thereafter until the termination of the program under this
			 Act, the Secretary shall submit to the Committee on Energy and Natural
			 Resources of the Senate and the Committee on Energy and Commerce of the House
			 of Representatives a report on the use of funds under this Act.</text>
			</subsection><subsection id="HC3D6A1B8DF584D9289C1F335E4536464"><enum>(b)</enum><header>Contents</header><text>The
			 report submitted under subsection (a) shall evaluate—</text>
				<paragraph id="H4D713E4C47194ABDA80658F54134058E"><enum>(1)</enum><text>how many eligible
			 participants have participated in the program;</text>
				</paragraph><paragraph id="HE3E2B6626FB24F18A2432C39C77EEDE3"><enum>(2)</enum><text>how many jobs have
			 been created through the program, directly and indirectly;</text>
				</paragraph><paragraph id="H2AFEBACA6A9D43F99569FF49AA4339D9"><enum>(3)</enum><text>what steps could
			 be taken to promote further deployment of energy efficiency and renewable
			 energy retrofits;</text>
				</paragraph><paragraph id="HFDEFB08E12404EB8A6C4DCB1D9A1C0C9"><enum>(4)</enum><text>the quantity of
			 verifiable energy savings, homeowner energy bill savings, and other benefits of
			 the program;</text>
				</paragraph><paragraph id="H5327E817E2D8432AA0E22D673E22D4B2"><enum>(5)</enum><text>any waste, fraud,
			 or abuse with respect to such funds; and</text>
				</paragraph><paragraph id="H6350EA6288C84E58A2F1533EE82A04DE"><enum>(6)</enum><text>any other
			 information the Secretary considers appropriate.</text>
				</paragraph></subsection><subsection id="H06A1A03BBB0C400D95DA62929EB415F0"><enum>(c)</enum><header>Noncompliance</header><text>The
			 Secretary shall require rebate aggregators, States, and Indian tribes to
			 provide the information required to enable the Secretary to carry out this
			 section. If the Secretary determines that a rebate aggregator, State, or Indian
			 tribe has not provided such information on a timely basis, the Secretary shall
			 provide to the rebate aggregator, State, or Indian tribe a period of at least
			 90 days to provide any necessary information, subject to withholding of funds
			 or reduction of future grant amounts, or decertification of rebate
			 aggregators.</text>
			</subsection></section><section id="H9449B664B29B421183852B5819A2DBF3"><enum>12.</enum><header>Administration</header>
			<subsection id="H39A393D4A4474775BF139CB287FB7F11"><enum>(a)</enum><header>In
			 general</header><text>Subject to section 15(b), not later than 30 days after
			 the date of enactment of this Act, the Secretary shall provide such
			 administrative and technical support to rebate aggregators, States, and Indian
			 tribes as is necessary to carry out this Act.</text>
			</subsection><subsection id="H9988CFCA51BB483FBF4BB7A88D988C33"><enum>(b)</enum><header>Appointment of
			 personnel</header><text>Notwithstanding the provisions of title 5, United
			 States Code, governing appointments in the competitive service and General
			 Schedule classifications and pay rates, the Secretary may appoint such
			 professional and administrative personnel as the Secretary considers necessary
			 to carry out this Act.</text>
			</subsection><subsection id="H91E5B8F5F12C4ECFA18890D94DCB542B"><enum>(c)</enum><header>Rate of
			 pay</header><text>The rate of pay for a person appointed under subsection (b)
			 shall not exceed the maximum rate payable for GS–15 of the General Schedule
			 under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code.</text>
			</subsection><subsection id="HC5F08311AD6B42129AC0AF9EA62E6C10"><enum>(d)</enum><header>Consultants</header><text>Notwithstanding
			 section 303 of the Federal Property and Administrative Services Act of 1949 (41
			 U.S.C. 253), the Secretary may retain such consultants on a noncompetitive
			 basis as the Secretary considers necessary to carry out this Act.</text>
			</subsection><subsection id="H64233DFAFABF4775979AD513795FE302"><enum>(e)</enum><header>Contracting</header><text>In
			 carrying out this Act, the Secretary may waive all or part of any provision of
			 the Competition in Contracting Act of 1984 (<external-xref legal-doc="public-law" parsable-cite="pl/98/369">Public Law 98–369</external-xref>; 98 Stat. 1175),
			 an amendment made by that Act, or the Federal Acquisition Regulation on a
			 determination that circumstances make compliance with the provisions contrary
			 to the public interest.</text>
			</subsection><subsection id="HB49B84E85C6B4617BE9F4EA01ED3C056"><enum>(f)</enum><header>Information
			 collection</header><text>The Secretary shall establish, and make available to
			 homeowners, or the homeowner’s designated representative, seeking a rebate
			 under this Act, release forms authorizing access by the Secretary, or the
			 Secretary’s designated third party representative, to information in the
			 utility bills of the homeowner. The form shall not include the homeowner’s
			 name, address, or social security number, or any other personal identifying
			 information designated by the Secretary.</text>
			</subsection></section><section id="H45E036864D62401595B92F18F9E63549"><enum>13.</enum><header>Treatment of
			 rebates</header>
			<subsection id="HBF2F397F32C54BCA92ED1F937CB73372"><enum>(a)</enum><header>In
			 general</header><text>For purposes of the Internal Revenue Code of 1986,
			 rebates received for a qualified home energy efficiency retrofit under this
			 Act—</text>
				<paragraph id="H46145EDAAD03410DB56FED91085CE483"><enum>(1)</enum><text>shall not be
			 considered taxable income to a homeowner; and</text>
				</paragraph><paragraph id="H5176D053A6DC40EDA3FF07A6A1B69C17"><enum>(2)</enum><text>shall prohibit the
			 consumer from applying for a tax credit allowed under section 25C or 25D of
			 that Code for the same retrofit work performed in the home of the homeowner,
			 unless the work is additional, and not included in the rebate baseline.</text>
				</paragraph></subsection><subsection id="H9EF7AD9541AB421688F7B9DEED952083"><enum>(b)</enum><header>Notice</header>
				<paragraph id="HA0BDA38CEAB54C8C9E2FA14262B4FC33"><enum>(1)</enum><header>In
			 general</header><text>A participating contractor shall provide notice to a
			 homeowner of the provisions of subsection (a) before eligible work is performed
			 in the home of the homeowner.</text>
				</paragraph><paragraph id="HB8FA5ED37F5A4F4DAF887E0B13BDF369"><enum>(2)</enum><header>Notice in rebate
			 form</header><text>A homeowner shall be notified of the provisions of
			 subsection (a) in the appropriate rebate form developed by the Secretary, in
			 consultation with the Secretary of the Treasury.</text>
				</paragraph></subsection></section><section id="H3A2898F73C184F2B992B139E6B3EBD3A"><enum>14.</enum><header>Penalties</header>
			<subsection id="HCEF8273DEF6D4816BFF29C08C4B9960A"><enum>(a)</enum><header>In
			 general</header><text>It shall be unlawful for any person to violate this Act
			 (including any regulation issued under this Act), other than a violation as the
			 result of a clerical error.</text>
			</subsection><subsection id="H00FEAC9772544E559343E916717E4107"><enum>(b)</enum><header>Civil
			 penalty</header><text>In addition to any penalty applicable under other Federal
			 law for fraud or other crimes, any person who commits a violation of this Act
			 shall be liable to the United States for a civil penalty in an amount that is
			 not more than the higher of—</text>
				<paragraph id="H56B443B941414A8DA71D62831EFA33E4"><enum>(1)</enum><text>$15,000 for each
			 violation; or</text>
				</paragraph><paragraph id="HC92F81A94E4540A38A86FDAD884C7742"><enum>(2)</enum><text>3
			 times the value of any associated rebate under this Act.</text>
				</paragraph></subsection><subsection id="H2DDF840239934F8BB6ECDF8B356E3C63"><enum>(c)</enum><header>Administration</header><text>The
			 Secretary may—</text>
				<paragraph id="HB788E73A26C346F5B27201FE3A0E95DF"><enum>(1)</enum><text>assess and
			 compromise a penalty imposed under subsection (b); and</text>
				</paragraph><paragraph id="H26C4739B65084C87833924ACCFA350BA"><enum>(2)</enum><text>require from any
			 entity the records and inspections necessary to enforce this Act.</text>
				</paragraph></subsection></section><section id="HE30AFBB619D74BF885028FB424452D0E"><enum>15.</enum><header>Funding</header>
			<subsection id="H06D80376B71046BDB14C90E45A1AD120"><enum>(a)</enum><header>Authorization of
			 appropriations</header>
				<paragraph id="H9524C685F30042A49E418BD4A72EDBC4"><enum>(1)</enum><header>In
			 general</header><text>There are authorized to be appropriated to the Secretary
			 to carry out this Act $500,000,000 for each of fiscal years 2014 through 2017,
			 to remain available until expended.</text>
				</paragraph><paragraph id="HD0E4CA5B901A47E0BE353159C08035D9"><enum>(2)</enum><header>Maintenance of
			 funding</header><text>Funds provided under this section shall supplement and
			 not supplant any Federal and State funding provided to carry out energy
			 efficiency programs in existence on the date of enactment of this Act.</text>
				</paragraph></subsection><subsection id="H0B35F99FDE224FEC9865E69AA57C328B"><enum>(b)</enum><header>Grants to
			 States</header>
				<paragraph id="H1F6ED67424764835B938F8C580440CD7"><enum>(1)</enum><header>In
			 general</header><text>Of the amounts provided under subsection (a), not more
			 than 6 percent shall be used to carry out section 9.</text>
				</paragraph><paragraph id="HB8E1655E1BD54BBC9B9EE8DA841FE986"><enum>(2)</enum><header>Distribution to
			 state energy offices</header><text>Not later than 45 days after the date of
			 enactment of this Act, the Secretary shall determine a formula to provide funds
			 described in paragraph (1) to State energy offices, in accordance with the
			 allocation formula for State energy conservation plans established under part D
			 of title III of the Energy Policy and Conservation Act (42 U.S.C. 6321 et
			 seq.).</text>
				</paragraph></subsection><subsection id="H5D8DA9B9DCC44C1DA1AB153C2C49B107"><enum>(c)</enum><header>Tracking of
			 rebates and expenditures</header><text>Of the amount provided under subsection
			 (a), not more than 2.5 percent are authorized to be appropriated to the
			 Secretary to be used for costs associated with tracking rebates and
			 expenditures through the Federal Rebate Processing System under this Act,
			 technical assistance to States, and related administrative costs incurred by
			 the Secretary.</text>
			</subsection><subsection id="H2277CF9B1C33492AA804BCD89A5D9302"><enum>(d)</enum><header>Program review
			 and backstop funding</header>
				<paragraph id="H328307CDA7434226857D24AC28769724"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Secretary shall perform a State-by-State analysis and review the
			 distribution of Home Energy Savings Retrofit Rebates under this Act.</text>
				</paragraph><paragraph id="H73F27207C8A548D3B4AF3BB24E6162D8"><enum>(2)</enum><header>Adjustment</header><text>The
			 Secretary may allocate technical assistance funding to assist States that have
			 not sufficiently benefitted from the Home Energy Savings Retrofit Rebate
			 Program.</text>
				</paragraph></subsection><subsection id="HA6D8D965C5954A98A91EEE89A157B371"><enum>(e)</enum><header>Return of
			 undisbursed funds</header><text>If the Secretary has not disbursed all the
			 funds available for rebates under the Home Energy Savings Retrofit Rebate
			 Program by September 30, 2017, any undisbursed funds shall be returned to the
			 Treasury.</text>
