<section id="H787277A6ECB3448D913346E3A2DF0979" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Valley-Wide Noise Relief Act of 2013</short-title></quote>.</text></section> 
<section commented="no" id="H62825784161341819FF71DB75675F79D"><enum>2.</enum><header>Mandatory nighttime curfews</header> 
<subsection commented="no" id="HA19EF6F1FC8B4D23A3BB106E97378DFB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, including any written assurances under <external-xref legal-doc="usc" parsable-cite="usc/49/47107">section 47107</external-xref> of title 49, United States Code, an airport sponsor may not be prohibited from, or interfered with, implementing any of the following:</text> 
<paragraph commented="no" id="H83C5C6939BEB486BB0DAF017CBB2F9AF"><enum>(1)</enum><text>A total mandatory nighttime curfew for an airport of the sponsor that is described in paragraph (1) of subsection (b).</text></paragraph> 
<paragraph commented="no" id="H190685EA2C454FD2A5DA23B9A876F170"><enum>(2)</enum><text display-inline="yes-display-inline">A partial mandatory nighttime curfew for an airport of the sponsor that is described in paragraph (2) of subsection (b).</text></paragraph></subsection> 
<subsection commented="no" id="H91CE77E5726B4DFBBA34787C55177F38"><enum>(b)</enum><header>Covered airports</header> 
<paragraph commented="no" id="HF6652F1E3FB44C189AB6BCA1602F6F04"><enum>(1)</enum><header>Paragraph (1) airports</header><text display-inline="yes-display-inline">An airport described in this paragraph is an airport that—</text> 
<subparagraph commented="no" id="HB026159298124E4C8D92C6D4952C1F8C"><enum>(A)</enum><text display-inline="yes-display-inline">had a voluntary curfew in effect for certain aircraft on November 5, 1990; and</text></subparagraph> 
<subparagraph commented="no" id="H9363FCC7D55F4362B80936EA20557E23"><enum>(B)</enum><text display-inline="yes-display-inline">was created by an intergovernmental agreement established pursuant to a State statute enacted before November 5, 1990, that, along with the statute, imposes obligations with respect to noise mitigation.</text></subparagraph></paragraph> 
<paragraph commented="no" id="HC71CA41A229D4C909A66979B811173A1"><enum>(2)</enum><header>Paragraph (2) airports</header><text>An airport described in this paragraph is an airport that—</text> 
<subparagraph commented="no" id="HAE0A32B29286418F9F7E333246C29B1A"><enum>(A)</enum><text>had a partial curfew in effect prior to November 5, 1990;</text></subparagraph> 
<subparagraph commented="no" id="H6A87A4E65FC345FABAEE00E742265332"><enum>(B)</enum><text display-inline="yes-display-inline">operates under the supervision of a board of airport commissioners that, on January 1, 2010, oversaw operation of 3 or more airports, at least 2 of which have airport operating certificates pursuant to part 139 of title 14, Code of Federal Regulations; and</text></subparagraph> 
<subparagraph commented="no" id="HAC81A88E06774EA280E3FF012F1AB58A"><enum>(C)</enum><text>on January 1, 2010, failed to comply with a cumulative noise standard established by a State law for airports in that State.</text></subparagraph></paragraph></subsection> 
<subsection commented="no" id="H70FAFFCDC34547519E331460AA177653"><enum>(c)</enum><header>Notice requirements</header> 
<paragraph commented="no" id="H9467C0B1E309409099987ECC0186017B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">At least 90 days before implementing a curfew under subsection (a), an airport sponsor shall provide to airport users and other interested parties reasonable notice of—</text> 
<subparagraph commented="no" id="H9E0225939E424CFEABC9958CC9F3FA00"><enum>(A)</enum><text>the terms of the curfew; and</text></subparagraph> 
<subparagraph commented="no" id="HFB266FC391164AC3B3A01694B4FC35DD"><enum>(B)</enum><text>the penalties for violating the curfew.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H88FB83F4901144BA818545DB0B2681BD"><enum>(2)</enum><header>Reasonable notice</header><text>An airport sponsor shall be treated as satisfying the requirement of providing reasonable notice under paragraph (1) if the sponsor—</text> 
<subparagraph commented="no" id="H61C49AB0945F422694C519376EE73146"><enum>(A)</enum><text>includes the terms of the curfew and penalties for violating the curfew on the Internet Web site of the sponsor for the applicable airport; and</text></subparagraph> 
<subparagraph commented="no" id="HE41AC45854684F6B95EB8B6A7A52B56E"><enum>(B)</enum><text display-inline="yes-display-inline">provides the terms of the curfew and penalties for violating the curfew to tenants of the sponsor who operate aircraft at the airport, either at their leasehold or the address provided to the airport sponsor for the receipt of notices under their lease.</text></subparagraph></paragraph></subsection> 
<subsection commented="no" id="HD21EEA487909406B91413CBFF1447BC5"><enum>(d)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text> 
<paragraph commented="no" id="HB906882620954A2DBAE814CD3EB6E79B"><enum>(1)</enum><header>Total mandatory nighttime curfew</header><text display-inline="yes-display-inline">The term <term>total mandatory nighttime curfew</term> means a prohibition on all aircraft operations at an airport each night during the 9-hour period beginning at 10 p.m.</text></paragraph> 
<paragraph commented="no" id="H84A5D6FEAAA5432DB124698F56A11991"><enum>(2)</enum><header>Partial mandatory nighttime curfew</header><text>The term <term>partial mandatory nighttime curfew</term> means a prohibition on certain aircraft operations at an airport each night for not longer than the 9-hour period beginning at 10 p.m.</text></paragraph></subsection></section>
