		<official-title>To amend the Elementary and Secondary Education Act of
		  1965 to prohibit Federal mandates, direction, or control, and for other
		  purposes.</official-title>

		<section id="H96980E367BA6487FA12625E7F65A5144" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Defending State Authority Over Education Act of
			 2013</short-title></quote> .</text>
		</section><section id="H325820AEB95C49BCBC2CEEE3DDD37781"><enum>2.</enum><header>Voluntary
			 partnerships</header><text display-inline="no-display-inline">Section 1111(k)
			 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(k)</external-xref>) is
			 amended by adding at the end the following: <quote>Except that the Secretary
			 shall not attempt to influence, incentivize, or coerce State participation in
			 any such partnerships.</quote>.</text>
		</section><section id="H034656832D334774B80CE61F98C22B29"><enum>3.</enum><header>Specific
			 limitations</header><text display-inline="no-display-inline">Section 9401 of
			 the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7861">20 U.S.C. 7861</external-xref>) is
			 amended—</text>
			<paragraph id="HC74D201455CE418AB7F32DF740D613A5"><enum>(1)</enum><text>by redesignating
			 subsections (e), (f), and (g), as subsections (f), (g), and (h), respectively;
			 and</text>
			</paragraph><paragraph id="HC112141BC52F4A4A82F8B6BDFD9EF86A"><enum>(2)</enum><text>by inserting after
			 subsection (d) the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H4B7F2461B41B41C69CAEE691FF6FF749" style="OLC">
					<subsection id="H9D8AD5137A9A437BBA2BE5C10950233C"><enum>(e)</enum><header>Specific
				limitations</header><text>The Secretary shall not require a State educational
				agency, local educational agency, or Indian tribe, as a condition of approval
				of a waiver request, to—</text>
						<paragraph id="H38A5B6AE710D4266B4C4617B29D9B656"><enum>(1)</enum><text>include in, or
				delete from, such request, specific academic standards;</text>
						</paragraph><paragraph id="HA3BA7049543642E1BE69FE79E92657A8"><enum>(2)</enum><text>use specific
				academic assessment instruments or items; or</text>
						</paragraph><paragraph id="H3DA5918A4121485BB50AF18DCDB5239B"><enum>(3)</enum><text>include in, or
				delete from, such waiver request any criterion that specifies, defines, or
				prescribes the standards or measures that a State or local educational agency
				or Indian tribe uses to establish, implement, or improve—</text>
							<subparagraph id="H84F7D704F3EF442D84F4EA818989F5DE"><enum>(A)</enum><text>State academic
				standards;</text>
							</subparagraph><subparagraph id="HC6460F5D9E714DDEB24C58F3F3C54DEA"><enum>(B)</enum><text>academic
				assessments;</text>
							</subparagraph><subparagraph id="H77BB60AB25F548D495E066B33EEE892E"><enum>(C)</enum><text>State
				accountability systems; or</text>
							</subparagraph><subparagraph id="H3BE680C2336F4E3588A94B088262FD83"><enum>(D)</enum><text>teacher and school
				leader evaluation
				systems.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H1A199A0EB96348708C512135D7A47299"><enum>4.</enum><header>Prohibition
			 against Federal mandates, direction, or control</header>
			<subsection id="H82BEB638E252487181F9280F1864B016"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subpart 2 of part E
			 of title IX of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 7901 et seq.) is amended by inserting after section 9526 the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="HA3EB2EC1383045ECA28F1FB336D3CEB8" style="OLC">
					<section id="H805F768170F744999ED3985686980BA6"><enum>9526A.</enum><header>Prohibition
				against Federal mandates, direction, or control</header>
						<subsection id="HA4914156838A4D0B97D099C398FCF891"><enum>(a)</enum><header>In
				general</header><text>No officer or employee of the Federal Government shall,
				directly or indirectly, through grants, contracts, or other cooperative
				agreements, mandate, direct, or control a State, local educational agency, or
				school’s specific instructional content, academic standards and assessments,
				curricula, or program of instruction, nor shall anything in this Act be
				construed to authorize such officer or employee to do so.</text>
						</subsection><subsection id="H9A34F5F018A4499C9F82E7F682DA42AC"><enum>(b)</enum><header>Financial
				support</header><text>No officer or employee of the Federal Government shall,
				directly or indirectly, through grants, contracts, or other cooperative
				agreements, make financial support available in a manner that is conditioned
				upon a State, local educational agency, or school’s adoption of specific
				instructional content, academic standards and assessments, curriculum, or
				program of instruction even if such requirements are specified in an Act other
				than this Act, nor shall anything in this Act be construed to authorize such
				officer or employee to do
				so.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5492DE27C9994E6483C373CB230C84C7"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 contents for the Elementary and Secondary Education Act of 1965 is amended by
			 inserting after the item relating to section 9526 the following:</text>
