<legis-type>A BILL</legis-type> 
<official-title>To prohibit employers from compelling or coercing any person to authorize access to a protected computer, and for other purposes.</official-title>

<legis-body id="H81E028DD265747CAA33923D9DD16ECD0" style="OLC"> 
<section id="H7FFE794F58CB4F9787968CB5CB191B2C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Password Protection Act of 2013</short-title></quote>.</text></section> 
<section id="HE6ACAA8FF48B4F02989826672B538E57"><enum>2.</enum><header>Prohibited activity</header> 
<subsection id="H74D9C8FAA55044B7B593437F6BFF5FB7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1030">Section 1030(a)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H7992854CA4A8464DA95F212F7839DA20"><enum>(1)</enum><text>in paragraph (7)(C), by inserting <quote>or</quote> after the semicolon; and</text></paragraph> 
<paragraph id="H7C0A3FC2E1074651AEAA00C7DC496625"><enum>(2)</enum><text>by inserting after paragraph (7)(C) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H850C687ADB2246B390F34EF19D4CE6B8" style="OLC"> 
<paragraph id="H069629F40D294011813BFC1FEE88688C"><enum>(8)</enum><text>acting as an employer, knowingly and intentionally—</text> 
<subparagraph id="H4D7293D8036141458B057441075A0356"><enum>(A)</enum><text>for the purposes of employing, promoting, or terminating employment, compels or coerces any person to authorize access, such as by providing a password or similar information through which a computer may be accessed, to a protected computer that is not the employer's protected computer, and thereby obtains information from such protected computer; or</text></subparagraph> 
<subparagraph id="H3BE051B3E2FA4820BFBDB13B9CE02738"><enum>(B)</enum><text>discharges, disciplines, discriminates against in any manner, or threatens to take any such action against, any person—</text> 
<clause id="HA8540D66109F415B986087A8193902E4"><enum>(I)</enum><text>for failing to authorize access described in subparagraph (A) to a protected computer that is not the employer’s protected computer; or</text></clause> 
<clause id="H756B95F1EBC7472496445DA3D4956240"><enum>(ii)</enum><text>who has filed any complaint or instituted or caused to be instituted any proceeding under or related to this paragraph, or has testified or is about to testify in any such proceeding;</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HAB2A7C56FF8E496ABB242D3DEADA74E7"><enum>(b)</enum><header>Fine</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1030">Section 1030(c)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="HAE9F81F1963E4C2AB710E8329D6E7EBA"><enum>(1)</enum><text>in paragraph (4)(G)(ii), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H0257AE802CC249A59E8805EE37CCC516"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H692A3623552F497DB61B4302AD496502" style="OLC"> 
<paragraph id="H7BC42E49EED74422B0996626B4075798"><enum>(5)</enum><text>a fine under this title, in the case of an offense under subsection (a)(8) or an attempt to commit an offense punishable under this paragraph.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HFFCDB5804BB3494B92348B77BED1DEE0"><enum>(c)</enum><header>Definitions</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1030">Section 1030(e)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="HA1C2422D61474844AA028234C23CC5CB"><enum>(1)</enum><text>in paragraph (11), by striking <quote>and</quote> after the semicolon;</text></paragraph> 
<paragraph id="HCF9AB3FC68DF422CA03596AF34C8FE95"><enum>(2)</enum><text>in paragraph (12), by striking the period and inserting a semicolon; and</text></paragraph> 
<paragraph id="H273A876067D144EB986F67071CE1BACA"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HF409298180B8454AA9D889584ADFB47F" style="OLC"> 
<paragraph id="H9362ACC4090B4C8DB78807876F5BE087"><enum>(13)</enum><text>the term <term>employee</term> means an employee, as such term is defined in section 201(2) of the Genetic Nondiscrimination Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000ff">42 U.S.C. 2000ff(2)</external-xref>);</text></paragraph> 
<paragraph id="H03209FE680AB43CAACC1473373C7E52E"><enum>(14)</enum><text>the term <term>employer</term> means an employer, as such term is defined in such section 201(2); and</text></paragraph> 
<paragraph id="H1E31DD038B99421DA2DA7F683053F589"><enum>(15)</enum><text>the term <term>employer’s protected computer</term> means a protected computer of the employer, including any protected computer owned, operated, or otherwise controlled by, for, or on behalf of that employer.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HAFB43973CDE34069BC275AF5AC155D7A"><enum>(d)</enum><header>Exceptions</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1030">Section 1030(f)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="HBAB8A27173034BE380F201C360B4E325"><enum>(1)</enum><text>by striking <quote>(f) This</quote> and inserting <quote>(f)(1) This</quote>; and</text></paragraph> 
<paragraph id="HD77D6F7206D14A1BBE6703C9B4BD4689"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H4EB3B5A51440440D9EF84690B58680AD" style="OLC"> 
<paragraph id="H48BBFDC8A458412792464824AD4F7BBB" indent="up1"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H61C7C4A9957244378AF6AA149A95DE80"><enum>(A)</enum><text display-inline="yes-display-inline">Nothing in subsection (a)(8) shall be construed to limit the authority of a court of competent jurisdiction to grant equitable relief in a civil action, if the court determines that there are specific and articulable facts showing that there are reasonable grounds to believe that the information sought to be obtained is relevant and material to protecting the intellectual property, a trade secret, or confidential business information of the party seeking the relief.</text></subparagraph> 
<subparagraph id="H9505D76E45D94E7688AB34BEC1C532FC" indent="up1"><enum>(B)</enum><text>Notwithstanding subsection (a)(8), the prohibition in such subsection shall not apply to an employer’s actions if—</text> 
<clause id="HEFF6CABED66E4EA89155AED1247E44E5"><enum>(I)</enum><text>the employer discharges or otherwise disciplines an individual for good cause and an activity protected under subsection (a)(8) is not a motivating factor for the discharge or discipline of the individual;</text></clause> 
<clause id="H035B004B97E24EE69F571684DC56C680"><enum>(ii)</enum><text display-inline="yes-display-inline">the employer is complying with the requirements of Federal or State law, rule or regulation, or a rule of a self-regulatory organization, as defined in section 3(a)(26) of the Securities and Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78c">15 U.S.C. 78c(a)(26)</external-xref>), applicable to brokers, dealers and investment advisers;</text></clause> 
<clause id="H755DEFFD860F488FA3968B3005D3F4FE"><enum>(iii)</enum><text>a State enacts a law that specifically waives subsection (a)(8) with respect to a particular class of State government employees or employees who work with individuals under 13 years of age, and the employer’s action relates to an employee in such class; or</text></clause> 
<clause commented="no" id="H2C5C3FCF4E4C4C0F86F7A85C1BD18376"><enum>(iv)</enum><text>an Executive agency (as defined in <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5), a military department (as defined in section 102 of such title), or any other entity within the executive branch that comes into the possession of classified information, including the Defense Intelligence Agency, National Security Agency, and National Reconnaissance Office, specifically waives subsection (a)(8) with respect to a particular class of employees requiring eligibility for access to classified information under Executive Order 12968 (60 Fed. Reg. 40245), or any successor thereto, and the employer's action relates to an employee in such class.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
