			 period to be subsequently determined by the Speaker, in each case for
			 consideration of such provisions as fall within the jurisdiction of the
			 committee concerned</action-desc>

		<section id="H5EAD54E5F1F74D5A85D5ACDAAF1A6F9D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Advanced Composites Development Act of
			 2013</short-title></quote>.</text>
		</section><section id="H84DE131C724F47C1A83EA31C657AE02D"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress makes the following
			 findings:</text>
			<paragraph id="H4EB4576DC373487A8A2021C61B7B2C85"><enum>(1)</enum><text display-inline="yes-display-inline">Compared to traditional metals and woods,
			 reinforced composite materials are lightweight, corrosion resistant, high
			 strength, and durable.</text>
			</paragraph><paragraph id="H58B1322A46554346BF6B22FED0D1A201"><enum>(2)</enum><text>Because of their
			 intrinsic physical qualities, composites have the ability to address national
			 priorities in infrastructure, energy, defense, and natural disaster mitigation
			 with innovative solutions.</text>
			</paragraph><paragraph id="HF5C631F4A8044CAD8BEA875B6BDB899E"><enum>(3)</enum><text>To this end,
			 research on advancement in composite material development, new applications for
			 composites, or advanced manufacturing processes serves a critical national
			 interest.</text>
			</paragraph></section><section id="H71912F8B6EA14DD4B1422BB742B464DE" section-type="subsequent-section"><enum>3.</enum><header>Advanced Composites
			 Development Centers</header>
			<subsection id="HF61341E4E62D4F6F95BB942262A0B44B"><enum>(a)</enum><header>Establishment of
			 program</header>
				<paragraph id="H10004887507A4735BAFB7A056B709CC8"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Transportation, the Secretary of Energy, the Secretary of Defense, and the
			 Secretary of Homeland Security shall carry out a program to improve our
			 Nation’s transportation infrastructure, advance the technologies used to
			 produce alternative energy, enhance our military security, and develop new
			 disaster mitigation systems by making grants to consortia to establish and
			 operate Advanced Composites Development Centers. In doing so, they shall work
			 with stakeholders to identify problems that can be solved over a period of 5
			 years through the development of an advanced composite material. By working
			 with the private sector and focusing on solutions to problems that can be
			 researched, developed, and demonstrated over a short period of time, each
			 Center will strive to produce new composite materials, including related
			 manufacturing processes or applications, that are lighter, stronger, and more
			 durable than existing materials, have lower life-cycle costs or lower overall
			 environmental impacts, and have an immediate practical application.</text>
				</paragraph><paragraph id="HE426CF65491846FD89D041BDA9BE25B9"><enum>(2)</enum><header>Designation of
			 Centers</header><text>The Centers shall be designated as follows:</text>
					<subparagraph id="H8DB6F6B544BE4DBEB06446692E384227"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary of Transportation shall
			 designate 1 Center for the development of advanced composites in civil
			 infrastructure and transportation.</text>
					</subparagraph><subparagraph id="H44C859F1DAD84239A8EAEF61995D89E0"><enum>(B)</enum><text>The Secretary of
			 Energy shall designate 1 Center for the development of advanced composites in
			 energy technology.</text>
					</subparagraph><subparagraph id="HBF2D49278B50416AA94569E551874BCC"><enum>(C)</enum><text>The Secretary of
			 Defense shall designate 1 Center for the development of advanced composites in
			 military operations.</text>
					</subparagraph><subparagraph id="H0F33A1CEBFBD400484F0B3D3F9B5D1CF"><enum>(D)</enum><text>The Secretary of
			 Homeland Security shall designate 1 Center for the development of advanced
			 composites in disaster prevention and response.</text>
					</subparagraph><subparagraph id="H1147536E9CDF4B24B145898227F8E4C5"><enum>(E)</enum><text display-inline="yes-display-inline">Any 2 or more of the Secretaries described
			 in subparagraphs (A) through (D) may work together to explore opportunities to
			 designate a single Center that addresses issues of importance to the
			 Departments of each such Secretary.</text>
					</subparagraph></paragraph><paragraph id="HDF37FF68CF7B4884916B52AB5CB2D46D"><enum>(3)</enum><header>Additional
			 collaboration</header><text>Each Secretary designating a Center under paragraph
			 (2) may include reviewers from the Director of the National Institute of
			 Standards and Technology and the Director of the National Science Foundation to
			 leverage work that has been done at facilities supported by each of those
			 agencies.</text>
				</paragraph></subsection><subsection id="HD13CAA7CF0F34D558D9030D69BD22D9A"><enum>(b)</enum><header>Consortia</header>
				<paragraph id="H96F19D5188654353AE832BB8CA352F69"><enum>(1)</enum><header>Eligibility</header><text>To
			 be eligible to receive a grant under this section for the establishment and
			 operation of a Center, a consortium shall—</text>
					<subparagraph id="H3ECF75DAC4A94353B7E917B0E7AC8793"><enum>(A)</enum><text display-inline="yes-display-inline">be composed of qualifying entities,
			 including at least 1 prime applicant and 1 private company;</text>
					</subparagraph><subparagraph id="H9E8B35849B124184BA0101BE9BF40546"><enum>(B)</enum><text>operate subject to
			 a binding agreement entered into by its members that documents—</text>
						<clause id="H967BA5ED66EB4A539981CC39F848DA80"><enum>(i)</enum><text>the
			 proposed partnership agreement, including the governance and management
			 structure of the Center;</text>
						</clause><clause id="H1658AEFBD93B499C90E9AD9CB5862374"><enum>(ii)</enum><text>measures to
			 enable cost-effective implementation of the program under this section;</text>
						</clause><clause id="H6151FF4E31F84ED3AAD3344C04EF42BD"><enum>(iii)</enum><text>a
			 proposed budget, including financial contributions from non-Federal
			 sources;</text>
						</clause><clause id="HDBBBABA728024977AF529C38AC54AC70"><enum>(iv)</enum><text>conflict of
			 interest procedures consistent with subsection (d)(2), all known material
			 conflicts of interest, and corresponding mitigation plans; and</text>
						</clause><clause id="HD36E4FD869FD44EA82CFCE9C9E2D41F7"><enum>(v)</enum><text>an
			 accounting structure that enables the Secretary to ensure that the consortium
			 has complied with the requirements of this section; and</text>
						</clause></subparagraph><subparagraph id="H3E9B600F59444CB3824169B7B62B401A"><enum>(C)</enum><text>operate as a
			 nonprofit organization.</text>
					</subparagraph></paragraph><paragraph id="H19D22F92B8AA4AA9AC858CF629CDAC70"><enum>(2)</enum><header>Application</header><text>A
			 consortium seeking to establish and operate a Center under this section, acting
			 through a prime applicant, shall transmit to the Secretary an application at
			 such time, in such form, and accompanied by such information as the Secretary
			 shall require, including a detailed description of the elements of the
			 consortium agreement required under paragraph (1)(B). If the consortium members
			 will not be located at one centralized location, such application shall include
			 a communications plan that ensures close coordination and integration of the
			 Center’s activities.</text>
				</paragraph></subsection><subsection id="HB5108835617A4A4E8FDF5AEB68EE19D5"><enum>(c)</enum><header>Selection and
			 schedule</header>
				<paragraph id="H0537D419729C409FB24D02A9697A2186"><enum>(1)</enum><header>Selection</header><text display-inline="yes-display-inline">The Secretary shall select consortia for
			 grants for the establishment and operation of Centers through competitive
			 selection processes. In selecting consortia, the Secretary shall
			 consider—</text>
					<subparagraph id="HF90E2EB61B3B4C1CA2FD5FF68D0C5625"><enum>(A)</enum><text>the information a
			 consortium must disclose according to subsection (b);</text>
					</subparagraph><subparagraph id="H96BB47841A85445080162B239F31D3F0"><enum>(B)</enum><text>any existing
			 facilities a consortium will provide for Center activities;</text>
					</subparagraph><subparagraph id="H34CAD49C3C304541A2B63FA435D39419"><enum>(C)</enum><text>experience in
			 design, prototyping, and testing advanced composites;</text>
					</subparagraph><subparagraph id="HC04849CF2F4146F18575969E30A9A5EB"><enum>(D)</enum><text>existing ISO 17025
			 certification;</text>
					</subparagraph><subparagraph id="HD215EA9FE92F4DE4A27C6293C2E9CA43"><enum>(E)</enum><text>experience and
			 achievements working with the private sector and commercializing composite
			 materials technologies; and</text>
					</subparagraph><subparagraph id="HBDA97BE8077842168AE4F133734DB32F"><enum>(F)</enum><text display-inline="yes-display-inline">opportunities to leverage previous support
			 that a member of the consortium has received from the Department or Departments
			 awarding the grant, the National Institute of Standards and Technology, or the
			 National Science Foundation to research, develop, demonstrate, or commercialize
			 an advanced composite.</text>
					</subparagraph></paragraph><paragraph id="H011D8737EBAF4AD996535E746783010E"><enum>(2)</enum><header>Schedule</header><text>Grants
			 made for the establishment and operation of a Center shall be for a period not
			 to exceed 5 years, after which the grant may be renewed, subject to a
			 competitive selection process.</text>
				</paragraph></subsection><subsection id="HC1CCC45A323D41189E412B7EE994D4BC"><enum>(d)</enum><header>Center
			 Operations</header>
				<paragraph id="H7D76397348DA4A8C8E4269FBEA3D5A7F"><enum>(1)</enum><header>In
			 general</header><text>Centers shall conduct or provide for multidisciplinary,
			 collaborative research, development, demonstration, and commercial application
			 of advanced composites technologies within the technology development focus
			 area or areas designated for the Center by the Secretary under subsection
			 (a)(2). Each Center shall—</text>
					<subparagraph id="H6E84B7AADAD14C5E835DFBBD637A52E7"><enum>(A)</enum><text>encourage
			 collaboration and communication among the member qualifying entities of the
			 consortium and awardees by conducting activities whenever practicable at one
			 centralized location;</text>
					</subparagraph><subparagraph id="H1A56823AC2F448A5BE169278AC3F856D"><enum>(B)</enum><text>develop and
			 publish on the website of the Department or Departments of the designating
			 Secretary proposed plans and programs;</text>
					</subparagraph><subparagraph id="H227518BE56584B39B1C53545A967008D"><enum>(C)</enum><text>submit an annual
			 report to the Secretary summarizing the Center’s activities, including
			 detailing organizational expenditures and describing each project undertaken by
			 the Center; and</text>
					</subparagraph><subparagraph id="H66173DE9BF2240848DA59DE3FBB155D9"><enum>(D)</enum><text>monitor project
			 implementation and coordination.</text>
					</subparagraph></paragraph><paragraph id="H78197C3DE35844F496F2928440837752"><enum>(2)</enum><header>Conflicts of
			 interest</header>
					<subparagraph id="H2CD5568F38504892AD8183521148F6D2"><enum>(A)</enum><header>Procedures</header><text display-inline="yes-display-inline">Centers shall establish conflict of
			 interest procedures, consistent with those of the Department or Departments of
			 the designating Secretary, to ensure that employees and consortia designees for
			 Center activities who are in decisionmaking capacities disclose all material
			 conflicts of interest, including financial, organizational, and personal
			 conflicts of interest.</text>
					</subparagraph><subparagraph id="H1EAF258C35F748948BF274FE910948F5"><enum>(B)</enum><header>Disqualification
			 and revocation</header><text>The Secretary may disqualify an application or
			 revoke funds distributed to a Center if the Secretary discovers a failure to
			 comply with conflict of interest procedures established under subparagraph
			 (A).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="HD65F2DF47F154FBB9E4851536AD222B1"><enum>(e)</enum><header>Oversight
			 board</header><text>Each Secretary described in subsection (a)(1) shall
			 establish and maintain within its Department an Oversight Board to oversee the
			 progress of Centers.</text>
			</subsection><subsection id="H7F269607D636497CB773E66BEF058FDE"><enum>(f)</enum><header>Priority
			 Consideration</header><text>The Secretary shall give priority consideration to
			 applications in which 1 or more of the institutions comprising the applicant
			 consortium are 1890 Land Grant Institutions (as defined in section 2 of the
			 Agricultural Research, Extension, and Education Reform Act of 1998 (7 U.S.C.
			 7061)), Predominantly Black Institutions (as defined in section 318 of the
			 Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059e">20 U.S.C. 1059e</external-xref>)), Tribal Colleges or
			 Universities (as defined in section 316(b) of the Higher Education Act of 1965
			 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>), or Hispanic Serving Institutions (as defined in section
			 318 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059e">20 U.S.C. 1059e</external-xref>)).</text>
			</subsection><subsection id="H5946D3D378EC450E826CDE99AD6BE4D8"><enum>(g)</enum><header>Definitions</header><text>For
			 purposes of this section:</text>
				<paragraph id="H0D26F7653E2E42D780B511F6D02702D4"><enum>(1)</enum><header>Advanced
			 composites</header><text display-inline="yes-display-inline">The term
			 <term>advanced composites</term> means polymer matrix composite materials,
			 including synthetic and natural fibers, as well as synthetic and bio-based
			 resins, used in structural, load-bearing applications. These materials may be
			 enhanced with nano-additives, and may be used in combination with traditional
			 and other advanced materials.</text>
				</paragraph><paragraph id="H18D61580AB894C9A9ABFCA5125D3CFC1"><enum>(2)</enum><header>Center</header><text>The
			 term <term>Center</term> means an Advanced Composites Development Center
			 established in accordance with this section.</text>
				</paragraph><paragraph id="H7E74A7B827B840309533785F0AC9254C"><enum>(3)</enum><header>Institution of
			 higher education</header><text>The term <term>institution of higher
			 education</term> has the meaning given that term in section 101(a) of the
			 Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text>
				</paragraph><paragraph id="HBB73EF3804D240CF9400A7BB0B1B1EC5"><enum>(4)</enum><header>Prime
			 applicant</header><text>The term <term>prime applicant</term> means an
			 institution of higher education serving as the lead entity applying for a grant
			 under this section.</text>
				</paragraph><paragraph id="H36B75E62480A4BAFBE51D0C0EF8A34AA"><enum>(5)</enum><header>Qualifying
			 entity</header><text display-inline="yes-display-inline">The term
			 <term>qualifying entity</term> includes—</text>
					<subparagraph id="HA779E385D5E04D8091BCC0773BCC6353"><enum>(A)</enum><text display-inline="yes-display-inline">an appropriate State or Federal
			 entity;</text>
					</subparagraph><subparagraph id="H65B651A97A6E48EBA667CDEA64EB7143"><enum>(B)</enum><text>a nonprofit
			 nongovernmental organization with expertise in advanced composites technology
			 research, development, demonstration, or commercial application;</text>
					</subparagraph><subparagraph id="H085E481EF22A400380ED9F165C323898"><enum>(C)</enum><text>any other relevant
			 entity the Secretary considers appropriate; or</text>
					</subparagraph><subparagraph id="H34F6886232D349058A78CAEDEF407733"><enum>(D)</enum><text display-inline="yes-display-inline">a United States private company with
			 expertise in advanced composites technology research, development,
			 demonstration, or commercial application.</text>
					</subparagraph></paragraph><paragraph id="H685466A053B8400DAFA5C592C967E411"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary or Secretaries designating a
			 Center under subsection (a)(2).</text>
				</paragraph></subsection><subsection commented="no" id="HDCE5A9899A47468384A525C6CBE9768D"><enum>(h)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">From the funds
			 appropriated to research budgets of their respective departments, each
			 Secretary described in subsection (a)(1) is authorized to expend the following
			 amounts to carry out this section:</text>
				<paragraph commented="no" id="H9CEE20BEC9BD4A169CC5E10281C2E0B5"><enum>(1)</enum><text display-inline="yes-display-inline">$15,000,000 for fiscal year 2014.</text>
				</paragraph><paragraph commented="no" id="HBF4F27FC4B8F4CE3BFC3247E92126DD2"><enum>(2)</enum><text>$16,000,000 for
			 fiscal year 2015.</text>
				</paragraph><paragraph commented="no" id="HB64A2B8030234DE3B2FC785D931B201C"><enum>(3)</enum><text>$17,500,000 for
			 fiscal year 2016.</text>
				</paragraph><paragraph commented="no" id="H3D782314C36A401895C2BE8579A3602F"><enum>(4)</enum><text>$19,000,000 for
			 fiscal year 2017.</text>
				</paragraph><paragraph commented="no" id="HF755C02C65CD4EB8AB21633E3C2F2990"><enum>(5)</enum><text>$20,000,000 for
			 fiscal year 2018.</text>
				</paragraph></subsection></section></legis-body>
