		<official-title>To amend section 1877 of the Social Security Act to
		  modify the requirements for hospitals to qualify for the rural provider and
		  hospital exception to physician ownership or investment prohibition in order to
		  take into account hospitals that were under construction or development at the
		  time of imposing such requirements, hospital expansions, and hospitals in
		  financial distress, and for other purposes.</official-title>

			 contents</header>
			<subsection id="H5645BC6F969340ACBBD8A12EF2B49C17"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote><short-title>Expanding Patients’ Access to
			 Quality Care Act of 2013</short-title></quote>.</text>
			</subsection><subsection id="H59A5F73BDC484701B2C5AA3FEF7E7805"><enum>(b)</enum><header>Table of
			 contents</header><text>The table of contents of this Act is as follows:</text>

			</subsection></section><section id="HC4BE7FECD62A4CA3BD9051F4E1FAAFF4"><enum>2.</enum><header>Modification of
			 Stark requirements for certain hospitals that were under construction or
			 development as of December 30, 2010</header><text display-inline="no-display-inline">Section 1877(i) of the Social Security Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395nn">42 U.S.C. 1395nn(i)</external-xref>) is amended—</text>
			<paragraph id="HB1C9A64E594A47DCAE4AD2682A07174F"><enum>(1)</enum><text>in paragraph
			 (1)(A)—</text>
				<subparagraph id="HF97CD3B5E43A4E39ABABCD5BCDDC3F3F"><enum>(A)</enum><text>in the matter
			 preceding clause (i), by striking <quote>had</quote>;</text>
				</subparagraph><subparagraph id="HEA921A224B6A454F8231638556A996DD"><enum>(B)</enum><text>in clause (i), by
			 striking <quote>; and</quote> and inserting the following: <quote>, and had a
			 provider agreement under section 1866 in effect on such date or was under
			 construction or was under development (as defined in paragraph (7)(A)) on such
			 date; or</quote>; and</text>
				</subparagraph><subparagraph id="HB1DDACB1B62340B98363155E0937BDE3"><enum>(C)</enum><text>by striking clause
			 (ii);</text>
				</subparagraph></paragraph><paragraph id="H45BC59E5F4B046419282DD882FBC075B"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (1)(B), by inserting before
			 the period at the end the following: <quote>or if the hospital was under
			 construction or under development on December 31, 2010, no greater than the
			 number of operating rooms, procedure rooms, and beds for which the hospital is
			 licensed as of the date the hospital had a provider agreement in effect under
			 section 1866</quote>;</text>
			</paragraph><paragraph id="HAEDF3B562ED442EB925CB3EB3F77942F"><enum>(3)</enum><text>in paragraph (1)(D)(i), by inserting before the period at the end the
			 following: <quote>or if the hospital was under construction or under
			 development on December 31, 2010, as of the date the hospital had a provider
			 agreement in effect under section 1866</quote>;</text>
			</paragraph><paragraph id="H7995E064119B404686A2BE316BF688A2"><enum>(4)</enum><text>in paragraph
			 (3)(C)(iii), by inserting after <quote>December 31, 2010,</quote> the
			 following: <quote>or in the case of a hospital that did not have a provider
			 agreement in effect as of such date but was under construction or under
			 development on such date,</quote>; and</text>
			</paragraph><paragraph id="HD3D163E440754CF0B88B064CDD7C9354"><enum>(5)</enum><text>by adding at the
			 end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H40A16133D7194EF28444469C6817190F" style="OLC">
					<paragraph id="H0E71C3411B6E4416B9AFC1928A4813C6"><enum>(7)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subsection:</text>
						<subparagraph id="HECBD67F5FF654BAAA7F04AAE5F9C01DC"><enum>(A)</enum><header>Under
				development</header><text display-inline="yes-display-inline">A hospital shall
				be treated as being <quote>under development</quote> on December 31, 2010, if
				on or before such date the hospital—</text>
							<clause id="HD2FD850A9DD7443CA2B43D2069D59A2A"><enum>(i)</enum><text>submitted its
				enrollment application for a Medicare provider agreement;</text>
							</clause><clause id="HD6B60030AB734E10AE6F7FDE36D7B2A8"><enum>(ii)</enum><text>had a binding
				written agreement with an outside, unrelated party for the actual design,
				construction, renovation, lease, or demolition for a hospital, and has expended
				at least 10 percent of the estimated cost of the project (or, if less,
				$1,000,000); or</text>
							</clause><clause id="H34367CDEC327418FAE36958E6AA8ABC1"><enum>(iii)</enum><text>obtained a
				certificate of need in a State where one is
				required.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H2F6E113DD5174E2D9F6873B3D663A76E"><enum>3.</enum><header>Modifying Stark
			 requirements for applicable hospitals to qualify for expansion of facility
			 capacity</header><text display-inline="no-display-inline">Section 1877(i)(3) of
			 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395nn">42 U.S.C. 1395nn(i)(3)</external-xref>) is amended—</text>
			<paragraph display-inline="no-display-inline" id="H8BBDD704935B4E20BCB0186EE153E834"><enum>(1)</enum><text>by striking
			 subparagraphs (A), (E), (F), (H), and (I);</text>
			</paragraph><paragraph id="HF23D8E35A2964180993AAA82C0085E14"><enum>(2)</enum><text>by amending
			 subparagraph (B) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H7949DA2FF5F04ECDBF1906BA0818CFE2" style="OLC">
					<subparagraph id="H0C973F42027A4078A46A517102B6513C"><enum>(B)</enum><header>Limitation on
				frequency of increases</header><text display-inline="yes-display-inline">A
				hospital may not effect an increase described in subparagraph (C) more often
				than once every 2
				years.</text>
					</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HE13A07C0C6B6430EA8F7ABC6F7986324"><enum>(3)</enum><text>in subparagraphs
			 (C) and (D), by striking <quote>an applicable hospital</quote> and <quote>the
			 applicable hospital</quote> and inserting <quote>a hospital</quote> and
			 <quote>the hospital</quote>, respectively, each place it appears;</text>
			</paragraph><paragraph id="H672FDD8E22BE4964933178101F7579C1"><enum>(4)</enum><text>in subparagraph
			 (C)(i)—</text>
				<subparagraph id="HD2A33B92E11247C2AC9710AB36664050"><enum>(A)</enum><text>by striking
			 <quote>granted an exception under the process described in subparagraph
			 (A)</quote>;</text>
				</subparagraph><subparagraph id="H789F3B182376458BB2E534E8F60235CB"><enum>(B)</enum><text>by striking
			 <quote>has been granted a previous exception under this paragraph</quote> and
			 inserting <quote>has had a previous increase under this subsection</quote>;
			 and</text>
				</subparagraph><subparagraph id="H7633030FF34149A98A05F0E56143A661"><enum>(C)</enum><text>by striking
			 <quote>such an exception</quote> and inserting <quote>this paragraph</quote>;
			 and</text>
				</subparagraph></paragraph><paragraph id="H41747566BEEA4F538909E291340E9487"><enum>(5)</enum><text>in subparagraph
			 (C)(ii), by striking <quote>The Secretary shall not permit an increase
			 in</quote> and inserting <quote>A hospital may not increase</quote>.</text>
			</paragraph></section><section id="HB951CA59A2424E0ABA05F2E58D1769C5"><enum>4.</enum><header>Additional
			 exception for physician ownership and investment for hospitals in financial
			 distress</header><text display-inline="no-display-inline">Section 1877(i) of
			 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395nn">42 U.S.C. 1395nn(i)</external-xref>) is amended—</text>
			<paragraph id="HF45EC7E8E0B740A6BD1FEA9014C1EBF4"><enum>(1)</enum><text>in paragraph
			 (1)(A), as amended by section 2(1), by inserting after clause (i) the following
			 new clause:</text>
				<quoted-block display-inline="no-display-inline" id="H9CF61FC7DC1F4BD28B545FCD91136CDA" style="OLC">
					<clause id="HD26764610FC243519FC65EAE4562BE29"><enum>(ii)</enum><text display-inline="yes-display-inline">had a provider agreement under section 1866
				in effect December 31, 2010, as of such date did not have physician ownership
				or investment, but after such date is determined to be in financial distress
				(as defined in paragraph
				(7)(B)).</text>
					</clause><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H2C649A800B9F4C2185BBC6AAC6BE3C24"><enum>(2)</enum><text>in paragraph
			 (1)(D)(i), by inserting before the period at the end the following: <quote>,
			 except that such percentage limitation shall not apply to a hospital determined
			 to be in financial distress (as defined in paragraph (7)(B))</quote>; and</text>
			</paragraph><paragraph id="H9DFDC5E0E1924FDCAE0BDEB27CEE113F"><enum>(3)</enum><text>in paragraph (7),
			 as added by section 2(5), by adding at the end the following new
			 paragraph:</text>
				<quoted-block id="H67D5AA46623447CF9C8839EEDA0F3E13" style="OLC">
					<subparagraph id="HF516A9A0AF494286813469F63C6834FD"><enum>(B)</enum><header>Financial
				distress</header><text display-inline="yes-display-inline">A hospital shall be
				treated as being <quote>in financial distress</quote> for a cost reporting
				period if the Secretary determines that the hospital has had an overall
				negative combined Medicare inpatient prospective payment system and outpatient
				prospective payment system operating margin for the most recent 3 consecutive
				cost reporting periods for which data are available. Once the Secretary makes a
				determination that a hospital has such a negative operating margin for a cost
				reporting period, the Secretary may not reverse such determination for such
				period. A hospital that is treated as being in financial distress under this
				subparagraph for a cost reporting period shall continue to be so treated for
				all subsequent cost reporting periods as being in financial distress without
				regard to changes in the hospital’s operating margin.</text>
