		<section id="HD825C15B7BB24B22BB6B6EB74E2A355D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>End Anonymous Patents
			 Act</short-title></quote>.</text>
		</section><section id="H270C94ADB5C34FC49ABB7E3377642186"><enum>2.</enum><header>Disclosure of
			 ownership of patents</header>
			<subsection id="H84D712B6EDD44BE180A75FC070A5C399"><enum>(a)</enum><header>Disclosure of
			 ownership of patents</header><text display-inline="yes-display-inline">Section
			 261 of title 35, United States Code, is amended—</text>
				<paragraph id="HD0F7EEA5A3DA47BB82FD9C25991654D3"><enum>(1)</enum><text>in the first
			 paragraph, by striking <quote>Subject</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">Personal
			 property.—</header-in-text>Subject</quote>;</text>
				</paragraph><paragraph id="HD2EA50F23B244A72A7FC6CEFB76D3015"><enum>(2)</enum><text>in the second
			 paragraph, by striking <quote>Applications</quote> and inserting <quote>(b)
			 <header-in-text level="subsection" style="OLC">Assignment.—</header-in-text>Applications</quote>;</text>
				</paragraph><paragraph id="H8C8EEB5CA4BE403DB1D8E32DD0112267"><enum>(3)</enum><text>in the third
			 paragraph, by striking <quote>A certificate</quote> and inserting <quote>(c)
			 <header-in-text level="subsection" style="OLC">Evidence of execution of
			 transfer.—</header-in-text>A certificate</quote>;</text>
				</paragraph><paragraph id="H3F9BA9568CE24474847E3358AEE6A10E"><enum>(4)</enum><text>In the fourth
			 paragraph, by striking <quote>An assignment</quote> and inserting <quote>(d)
			 <header-in-text level="subsection" style="OLC">Notice or recordation
			 required.—</header-in-text>An assignment</quote>; and</text>
				</paragraph><paragraph id="H07D27B8C1CBF4DB49B15C6B431E58037"><enum>(5)</enum><text>by adding at the
			 end the following:</text>

						<subsection id="H56442FD2E7744C1FB732C887384DC9C3"><enum>(e)</enum><header>Disclosures of
				ownership</header>
							<paragraph id="H03F097C12D864B74A9E65D3DDAFBF89E"><enum>(1)</enum><header>New
				patents</header><text display-inline="yes-display-inline">Upon the issuance of
				a patent under this title, the entity to which the patent is issued shall file
				with the Office a disclosure of the owner of the patent and any real party in
				interest in the patent.</text>
							</paragraph><paragraph id="H46C716BBFC214FC8A7CDB54826B00B37"><enum>(2)</enum><header>Payment of
				maintenance fees</header><text>Upon the payment of the maintenance fee required
				under section 41(b), the owner of the patent shall file with the Office a
				disclosure of the identity of the owner of the patent and any real party in
				interest in the patent.</text>
							</paragraph><paragraph id="H4AA81FA89B774692801DBF4A1E703F92"><enum>(3)</enum><header>Notice of
				transfer of ownership</header><text>Whenever any patent, any application for
				patent, or any interest therein, is sold, granted, or conveyed, the entity to
				which the patent, application, or interest is sold, granted, or conveyed shall,
				within 90 days after the date of the sale, grant, or conveyance, file with the
				Office a disclosure of the sale, grant, or conveyance, and any real party in
				interest in the patent, application, or interest.</text>
							</paragraph><paragraph id="HF3DB8821F277459D8F9790656D4A1925"><enum>(4)</enum><header> Form and manner
				of disclosures</header><text display-inline="yes-display-inline">The Director
				shall prescribe by regulation the form and manner in which disclosures are to
				be made under paragraphs (1), (2), and (3). The Director shall include, among
				the real parties in interest, for purposes of such disclosures—</text>
								<subparagraph id="HB2491B3E3D0F4DFAB5E529110B7DEA00"><enum>(A)</enum><text display-inline="yes-display-inline">any entity that has the legal right to
				enforce the patent through an infringement action;</text>
								</subparagraph><subparagraph id="HC866DF4124F548DD8FBDCE4123915E1E"><enum>(B)</enum><text>any ultimate
				parent entity of an entity described in subparagraph (A); and</text>
								</subparagraph><subparagraph id="H9B348C53E445467EACC922C501EC9AA9"><enum>(C)</enum><text>any entity that
				has a controlling interest in the enforcement of the patent, including any
				ultimate parent entity not included under subparagraph (A) or (B).</text>
								</subparagraph></paragraph><paragraph commented="no" id="H91BF7825588A4860A524932482C561EF"><enum>(5)</enum><header>Limitation on
				damages</header><text>Any entity that fails to comply with any of the
				requirements under this subsection with respect to a patent or application for
				patent may, in any action brought by the person or entity for infringement of
				the patent, only collect damages from the date on which such requirement is
				met. The Director shall by regulation specify what constitutes noncompliance
				for purposes of this paragraph.</text>
							</paragraph><paragraph id="HB8BA14C623734466AEB5FE9DAECE47AC"><enum>(6)</enum><header>Definition</header><text>In
				this subsection, the term <quote>ultimate parent entity</quote> means an entity
				that is not controlled by any other entity.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HAC616A49E60A4C84A006E08AE743F191"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect upon
			 the expiration of the 180-day period beginning on the date of the enactment of
			 this Act.</text>
