		<official-title>To amend the Lacey Act Amendments of 1981 to clarify
		  provisions enacted by the Captive Wildlife Safety Act, to further the
		  conservation of certain wildlife species, and for other
		  purposes.</official-title>

		<section id="H28396685DAEE4E18BECB26DA928D0011" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Big Cats and Public Safety Protection
			 Act</short-title></quote>.</text>
		</section><section id="H2BFFCCD55B654E82B87CA07FEAFBB997"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H605A6370357E4CDE92321BBC96A47AAA"><enum>(1)</enum><text>The global illicit
			 trade in wildlife may be worth up to $20,000,000,000 annually and the value of
			 legal wildlife trade in the United States was recently estimated at
			 $2,800,000,000 annually.</text>
			</paragraph><paragraph id="HD0FB4A6025354D7D932924D8803CDD3A"><enum>(2)</enum><text>The illegal trade
			 in prohibited wildlife species (as defined in section 2(g) of the Lacey Act
			 Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3371">16 U.S.C. 3371(g)</external-xref>) stimulates demand and expands markets in
			 which those species can be illegally sold.</text>
			</paragraph><paragraph id="HF054B5601D56466C8EDC35EF53BC4109"><enum>(3)</enum><text>The private
			 possession, breeding, and sale of prohibited wildlife species has a substantial
			 and detrimental effect on the health and general welfare of the people of the
			 United States and on the conservation of the species themselves.</text>
			</paragraph><paragraph id="HCD3CD1E5FA6C4543B378BA83A9581BB4"><enum>(4)</enum><text>Private possession
			 and breeding of prohibited wildlife species have a substantial and direct
			 effect on interstate commerce because prohibited wildlife species are
			 frequently bred and possessed to be used in public exhibition or for sale or
			 transfer of ownership in the exotic pet trade, and are often transported in
			 interstate commerce for these purposes.</text>
			</paragraph><paragraph id="HA201600D61A4466DAC80EB18BE7B5D94"><enum>(5)</enum><text>Private possession
			 and breeding of prohibited wildlife species contributes to the interstate
			 traffic in those species and may contribute to illegal international wildlife
			 trade.</text>
			</paragraph><paragraph id="HF563B32DD6BC48AF9B0E1101AB1A7AFE"><enum>(6)</enum><text>Prohibited
			 wildlife species in private possession, or distributed intrastate, are fungible
			 commodities that cannot be differentiated, in terms of control, from prohibited
			 wildlife species possessed or distributed interstate.</text>
			</paragraph><paragraph id="HBAFC382986264499B984E7797719EAF2"><enum>(7)</enum><text>It is exceedingly
			 difficult to distinguish between prohibited wildlife species that are
			 possessed, bred, sold, or transported in interstate commerce from those that
			 have not been.</text>
			</paragraph><paragraph id="H91CE40F0E5164BCEA779B4532FB4CAFA"><enum>(8)</enum><text>Federal control of
			 the intrastate private possession and breeding of prohibited wildlife species
			 is essential to the effective control of the interstate incidents of traffic in
			 prohibited wildlife species.</text>
			</paragraph><paragraph id="HCB5632822E694D1A8C4E5DA7FA0E67B5"><enum>(9)</enum><text>The United States
			 is a party to the Convention on International Trade in Endangered Species of
			 Wild Fauna and Flora, which was designed to protect species of wild fauna and
			 flora against overexploitation through international trade.</text>
			</paragraph></section><section id="H8F72A79F348145E6B3885455EB7961A9"><enum>3.</enum><header>Definitions</header>
			<subsection id="H9B77BC9685C14CFEB686323B556C3CED"><enum>(a)</enum><header>In
			 general</header><text>Section 2 of the Lacey Act Amendments of 1981 (16 U.S.C.
			 3371) is amended—</text>
				<paragraph id="H1BBCC4C94AD44443B9E2FB6060991D31"><enum>(1)</enum><text>by redesignating
			 subsections (a) through (k) as subsections (b) through (l), respectively;</text>
				</paragraph><paragraph id="H1A3C488911B7469784DA25044A88B015"><enum>(2)</enum><text>by inserting
			 before subsection (b) (as so redesignated) the following:</text>
					<quoted-block id="H008E698AAD084A72BD1716C41A35BAF4" style="OLC">
						<subsection id="HCB34C189BF48440AAFC1DF0A6CAFA6AB"><enum>(a)</enum><header>Breed</header><text>The
				term <term>breed</term> means to facilitate the propagation or reproduction
				(whether intentionally or negligently), or to fail to prevent the propagation
				or reproduction, of a prohibited wildlife species or other
				animal.</text>
						</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HD5A015F492D945398D5E8714FCDCC091"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HEBEBE233AEB645C2B2A5F2363EFF83EE" style="OLC">
						<subsection id="H03D61AA687E14CE7AF4C5C45E829DD22"><enum>(m)</enum><header>Traveling
				circus</header><text display-inline="yes-display-inline">The term
				<term>traveling circus</term> means an exhibitor holding a Class C license
				issued under the Animal Welfare Act (7 U.S.C. 2131 et
				seq.).</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HD26808E13BC04464A063595E08095E55"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H738BEDCC15C1403A9DAAE6BF13644EC0"><enum>(1)</enum><header>Consolidated
			 farm and rural development act</header><text>Section 349(a)(3) of the
			 Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1997">7 U.S.C. 1997(a)(3)</external-xref>) is amended by
			 striking <quote>section 2(a)</quote> and inserting <quote>section
			 2(b)</quote>.</text>
				</paragraph><paragraph id="H78900F2CE7014C94B94C8ABFE1226202"><enum>(2)</enum><header>Lacey act
			 amendments of 1981</header>
					<subparagraph id="HC36E78DC7FAA4CFAAF7BDFB483EBC71F"><enum>(A)</enum><text>Section 3(e)(2)(C)
			 of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3372">16 U.S.C. 3372(e)(2)(C)</external-xref>) is
			 amended—</text>
						<clause id="HFF8A4A7093D74DCC954C32FDC5CB01FE"><enum>(i)</enum><text>in
			 clause (ii), by striking <quote>section 2(g)</quote> and inserting
			 <quote>section 2(h)</quote>; and</text>
						</clause><clause id="H6B585B464FA84E47AD322F4512A9E34E"><enum>(ii)</enum><text>in
			 clause (iii), by striking <quote>section 2(g)</quote> and inserting
			 <quote>section 2(h)</quote>.</text>
						</clause></subparagraph><subparagraph id="H60BCB6E5BD3944979DAA2D7912E3598B"><enum>(B)</enum><text>Section 7(c) of
			 the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3376">16 U.S.C. 3376(c)</external-xref>) is amended by striking
			 <quote>section 2(f)(2)(A)</quote> and inserting <quote>section
			 2(g)(2)(A)</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="HDC7979E0F05A4DDDBD8F98FBF42D0235"><enum>4.</enum><header>Prohibitions</header><text display-inline="no-display-inline">Section 3(a) of the Lacey Act Amendments of
			 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3372">16 U.S.C. 3372(a)</external-xref>) is amended—</text>
			<paragraph id="H27431F46EAAA4404909FE5F3A177764A"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
				<subparagraph id="HA06B2986E9E4484E80B3431728DF004F"><enum>(A)</enum><text>in subparagraph
			 (A), by striking the semicolon at the end and inserting <quote>;
			 or</quote>;</text>
				</subparagraph><subparagraph id="H62D2CFF96F684819B344BDB54F325453"><enum>(B)</enum><text>in subparagraph
			 (B)(iii), by striking <quote>; or</quote> and inserting a semicolon; and</text>
				</subparagraph><subparagraph id="HCE87C1FD030B4BAC912E7E892DC544EC"><enum>(C)</enum><text>by striking
			 subparagraph (C);</text>
				</subparagraph></paragraph><paragraph id="HE888327AB87A4C9D98F261EE7612F053"><enum>(2)</enum><text>in paragraph
			 (3)(B)(iii), by striking <quote>; or</quote> and inserting a semicolon;</text>
			</paragraph><paragraph id="H0D1D7A8AEE9F4D8BB24D07E26292FBC7"><enum>(3)</enum><text>by redesignating
			 paragraph (4) as paragraph (5);</text>
			</paragraph><paragraph id="HAFE8867068DE4C17BA4EDFC6F876F168"><enum>(4)</enum><text>by inserting after
			 paragraph (3) the following:</text>

			</paragraph><paragraph id="H911A20D73A45468C938F9E691704954F"><enum>(5)</enum><text>in paragraph (5),
			 (as so redesignated), by striking <quote>(1) through (3)</quote> and inserting
			 <quote>(1) through (4)</quote>.</text>
			</paragraph></section><section id="H60E66D6D13BD45CFA0E4A0070836296C"><enum>5.</enum><header>Nonapplicability
			 of offenses</header>
			<subsection id="H11BB9693DBBB47BC808F505C6094AB10"><enum>(a)</enum><header>In
			 general</header><text>Section 3(e) of the Lacey Act Amendments of 1981 (16
			 U.S.C. 3372(e)) is amended—</text>
				<paragraph id="HE25F41C776CB41F19B5E1B5146E93792"><enum>(1)</enum><text>by striking
			 paragraph (1) and inserting the following:</text>
					<quoted-block id="H85CDDB203B374FBFBC4DF848E0A71DD4" style="OLC">
						<paragraph id="H0E0CD637273E41D18389AA79A8E892B5"><enum>(1)</enum><header>In
				general</header><text>Subsection (a)(4) shall not apply to—</text>
							<subparagraph id="HCE787B75CF17437F91192732DDC516B6"><enum>(A)</enum><text>the importation,
				exportation, transportation, sale, receipt, acquisition, purchase, breeding, or
				possession of an animal of a prohibited wildlife species, by any person that,
				under any regulation promulgated under paragraph (3), is described in
				subparagraph (A), (B), (C), (D), or (F) of paragraph (2) with respect to that
				species; and</text>
							</subparagraph><subparagraph id="H0E018A0173CC4B649DCCB7E02AA1077D"><enum>(B)</enum><text>the transportation
				or possession of an animal of a prohibited wildlife species, by a person that,
				under any regulation promulgated under paragraph (3), is described in paragraph
				(2)(E) with respect to that species.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H8DB16342FDC04E5E88B221AB02F63344"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="H6FB7427EE8C54812A2AC361C6709B7F7"><enum>(A)</enum><text>by striking
			 subparagraph (A) and inserting the following:</text>
						<quoted-block id="H6C6288A90A524F908E88D426A8E2E597" style="OLC">
							<subparagraph id="HDE72EB8044534308B71EE427D46F2652"><enum>(A)</enum><text>is an institution
				accredited by the Association of Zoos and Aquariums (AZA) or certified related
				facilities that coordinate with an AZA Species Survival Plan for breeding of
				species listed as threatened or endangered pursuant to the provision of law
				codified at <external-xref legal-doc="usc" parsable-cite="usc/16/1533">section 1533</external-xref> of title 16, United States
				Code;</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HED045D310C4D4055ABC9E9E52FEDB912"><enum>(B)</enum><text>in subparagraph
			 (C)—</text>
						<clause id="H68F36F2E968843DCA0A4B9B73AA9B00B"><enum>(i)</enum><text>by
			 striking <quote>is an accredited</quote> and inserting <quote>is a</quote>;</text>
						</clause><clause id="H83F36754A89A41CC8E02B16C00CDFCC9"><enum>(ii)</enum><text>in
			 clause (iii), by striking <quote>and</quote>;</text>
						</clause><clause id="HE4528B769F114B489197E865D85C970A"><enum>(iii)</enum><text>in
			 clause (iv), by striking <quote>or</quote> and inserting <quote>and</quote>;
			 and</text>
						</clause><clause id="H35A19553FF6C4300BBDF25F0A551514B"><enum>(iv)</enum><text>by
			 adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="H8D193BEB8E8444A88BA7ACDD7403CC06" style="OLC">
								<clause id="H4A25D8BA672C44989B36078E7FD40721"><enum>(v)</enum><text display-inline="yes-display-inline">does not allow the transportation and
				display of animals
				off-site;</text>
								</clause><after-quoted-block>;</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="H92F59F7FF08843CB8934D810C50B8AE9"><enum>(C)</enum><text>in subparagraph
			 (D), by striking the period at the end and inserting <quote>; or</quote>;
			 and</text>
					</subparagraph><subparagraph id="HD391B629DBBC47A5BDB8E19C721936FC"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H262CF1A2298A47C2ACDA22A02FEF520E" style="OLC">
							<subparagraph id="H3BF44628410C444E9BF7CB2623CD9B5B"><enum>(E)</enum><text>is in possession
				of any animal of any prohibited wildlife species, that—</text>
								<clause id="HA66AE2665BA549C29794945BC5F5B6D5"><enum>(i)</enum><text>is
				born before the date of enactment of this subparagraph; and</text>
								</clause><clause id="H6E5D09A9E29B465B9989CF99CF488B5B"><enum>(ii)</enum><text>not later than
				180 days after the date on which regulations are promulgated implementing this
				subparagraph, is registered with the Animal and Plant Health Inspection
				Service; or</text>
								</clause></subparagraph><subparagraph commented="no" id="H001B848F85274CA3BE9342E7CEC43F8B"><enum>(F)</enum><text>is a traveling
				circus that—</text>
								<clause commented="no" id="H050FAA2B6D734408B471F7F9079A143D"><enum>(i)</enum><text>regularly travels
				in interstate commerce to conduct performances featuring live prohibited
				wildlife species and multiple trained human entertainers, including clowns and
				acrobats;</text>
								</clause><clause commented="no" id="HCA747838C987496CAD132E20B92AA37A"><enum>(ii)</enum><text>does not allow
				members of the public to be in direct contact with or unsafe proximity to a
				prohibited wildlife species of any age, including offering photographic
				opportunities or interactive sessions; and</text>
								</clause><clause commented="no" id="HFEB8638405DA458B827A49FA5FDD6225"><enum>(iii)</enum><text>during the
				3-year period preceding the date of the enactment of this subparagraph, has not
				been determined by the Secretary of Agriculture to have violated the Animal
				Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2131">7 U.S.C. 2131 et seq.</external-xref>) by reason of jeopardizing the health and
				well-being of a prohibited wildlife species, including jeopardizing such health
				and well-being by providing—</text>
									<subclause commented="no" id="HEFCD791DA7814187A65E9DF4CF6ACA38"><enum>(I)</enum><text>inappropriate
				veterinary care;</text>
									</subclause><subclause commented="no" id="HC7C3BFC6E3D6464EB75B6BB341AB3FD4"><enum>(II)</enum><text>inappropriate
				handling of the species causing stress or trauma to the species or a threat to
				public safety; or</text>
									</subclause><subclause commented="no" id="H34CA945DC75847E5811B04E963B1E511"><enum>(III)</enum><text>insufficient
				food, water, shelter, or
				space.</text>
									</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="HDA43BA5A7EA94E878A7C5BA25E5E7CFA"><enum>(b)</enum><header>Regulations</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Secretary of
			 the Interior, acting through the Director of the United States Fish and
			 Wildlife Service, and the Secretary of Agriculture, acting through the
			 Administrator of the Animal and Plant Health Inspection Service, shall
			 promulgate regulations implementing the amendments made by this section.</text>
			</subsection></section><section id="H674B2B08B08D4FC9A8C4472C803F6164"><enum>6.</enum><header>Penalties</header>
			<subsection id="HF7C3A70F4132498BAC5EE6C117A5BC21"><enum>(a)</enum><header>Civil
			 penalties</header><text>Section 4(a)(1) of the Lacey Act Amendments of 1981 (16
			 U.S.C. 3373(a)(1)) is amended—</text>
				<paragraph id="HA923F4A4CCED471A904930D12622DE2D"><enum>(1)</enum><text>by inserting
			 <quote>(a)(4),</quote> after <quote>subsections</quote>; and</text>
				</paragraph><paragraph id="HBEB4B67DA8324C4BAB4FCFACE6C1D47F"><enum>(2)</enum><text>by striking
			 <quote>subsection (d)</quote> and inserting <quote>subsection (a)(4),
			 (d),</quote>.</text>
				</paragraph></subsection><subsection id="HB1AC6707FAD240D7A56BC61E266B97B8"><enum>(b)</enum><header>Criminal
			 penalties</header><text>Section 4(d) of the Lacey Act Amendments of 1981 (16
			 U.S.C. 3373(d)) is amended—</text>
				<paragraph id="H322BADEBD93547A1A0F394CAC690AF40"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="H479A36EC21F44360BB2E45F6164D7A4A"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>or</quote> after the comma at the end;</text>
					</subparagraph><subparagraph id="H2C1FD10AE9A94BB299F89859438EC645"><enum>(B)</enum><text>in subparagraph
			 (B), by adding <quote>or</quote> after the comma at the end; and</text>
					</subparagraph><subparagraph id="HEDEFEE4847D94CC48E0F6DCF9ED4BBB2"><enum>(C)</enum><text>by inserting after
			 subparagraph (B) the following:</text>
						<quoted-block id="H6BBA878BFFDA4B91A178596264F52984" style="OLC">
							<subparagraph id="HB63D576AC71D416CA44773B12F348130"><enum>(C)</enum><text>knowingly violates
				section 3(a)(4),</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HF7EE97C70F0143B19EAB7E8DC0BBE759"><enum>(2)</enum><text>in paragraph (2),
			 by inserting <quote>, or in the exercise of due care should know that the
			 conduct violates section 3(a)(4),</quote> after <quote>treaty or
			 regulation</quote>.</text>
				</paragraph></subsection></section><section id="H0AC37A3E177C4AA58026FD58CFD02D3B"><enum>7.</enum><header>Forfeiture</header><text display-inline="no-display-inline">Section 5(a) of the Lacey Act Amendments of
			 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3374">16 U.S.C. 3374(a)</external-xref>) is amended—</text>
			<paragraph id="H5B306DFA30CE400DA9175697D1DF392D"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>or purchased</quote> and inserting <quote>purchased, bred,
			 or possessed,</quote>; and</text>
			</paragraph><paragraph id="HEF8662CA57184EB08EDCCEFDEF856700"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
				<subparagraph id="H51F6264717DE47C58D4C050691A6EADD"><enum>(A)</enum><text>by striking
			 <quote>or purchasing</quote> and inserting <quote>purchasing, breeding, or
			 possessing,</quote> and</text>
				</subparagraph><subparagraph id="H64EB44D404F84E8D866CEDA58AECD70A"><enum>(B)</enum><text>by striking
			 <quote>sale or purchase of, the offer of sale or purchase of, or the intent to
			 sell or purchase</quote> and inserting <quote>importation, exportation,
			 transportation, sale, receipt, acquisition, purchase, breeding, or possession
			 of, the offer of importation, exportation, transportation, sale, receipt,
			 acquisition, purchase, breeding, or possession of, or the intent to import,
			 export, transport, sell, receive, acquire, purchase, breed, or
			 possess</quote>.</text>
				</subparagraph></paragraph></section></legis-body>
