		<section id="H953427DC33F2420D816159BAFA559640" section-type="section-one"><enum>1.</enum><header>Short title;
			 findings</header>
			<subsection id="HA132F4C872374E89B7C67051ECFFBE5D"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote>Election Assistance Commission Termination Act</quote>.</text>
			</subsection><subsection id="HF61B3B20683B4692974E54AB4044DDFB"><enum>(b)</enum><header>Findings</header><text>Congress
			 finds the following:</text>
				<paragraph id="HC332C44AB86D4093994FBFD849146ED7"><enum>(1)</enum><text display-inline="yes-display-inline">The Help America Vote Act of 2002 (HAVA)
			 authorized annual appropriations of not more than $10,000,000 for the Election
			 Assistance Commission (EAC) for fiscal years 2003, 2004, and 2005. Funding for
			 additional years has not been authorized, and in fiscal year 2011 the EAC’s
			 budget grew to nearly $18,000,000.</text>
				</paragraph><paragraph id="H1F7FAB7B4478411695622503A35C4D66"><enum>(2)</enum><text>Between 2007 and
			 2011, the number of staff at the EAC grew from 26 to 48 without an increase in
			 statutory responsibility.</text>
				</paragraph><paragraph id="H50182CF2803A4F2CB7FF51719868BA92"><enum>(3)</enum><text>55 percent of the
			 EAC’s fiscal year 2014 budget request is devoted to management costs, the third
			 consecutive year for which management costs have exceeded one-half of the EAC’s
			 budget.</text>
				</paragraph><paragraph id="H5E35A93FC2D94ECFA78E1F46739B6D13"><enum>(4)</enum><text>The EAC has
			 distributed more than $3.2 billion in election reform grants to the States. The
			 most recent year for which appropriations for these grants were enacted or were
			 requested in the President’s annual budget was fiscal year 2010.</text>
				</paragraph><paragraph id="H9A3FE64D64CF4754B29F50060AA80B06"><enum>(5)</enum><text>The EAC last
			 issued voluntary voting system guidelines in 2005. A total of 11 voting systems
			 currently hold a certification from the EAC.</text>
				</paragraph><paragraph id="H470B3187991F4C5082C24904259A1537"><enum>(6)</enum><text>The research
			 division of the EAC has substantially completed the reports required by
			 HAVA.</text>
				</paragraph><paragraph id="HFFFDCFCB4ABD40C1A0EFCEF6F557B73C"><enum>(7)</enum><text>The National
			 Association of Secretaries of State adopted resolutions calling for the
			 dissolution of the EAC in 2005 and 2010.</text>
				</paragraph><paragraph id="H069F5C63CF2247D28A207A730EF0395A"><enum>(8)</enum><text>The EAC has not
			 had a quorum of commissioners since December 2010, and has not had any
			 commissioners since December 2011. The EAC has not had an Executive Director
			 since December 2011, and has not had a General Counsel since May 2012.</text>
				</paragraph><paragraph id="HD5CF9A818B1A4AFA9DF492E3DFE740A2"><enum>(9)</enum><text>The existence of
			 the EAC is not necessary to the conduct of Federal elections and is an
			 unnecessary expenditure of taxpayer funds. Any functions of the EAC worth
			 continuing can be performed by other government entities, consortia of
			 government entities, or private associations.</text>
				</paragraph></subsection></section><section id="H3E2456241E034B37A9D6EBFE23551C76"><enum>2.</enum><header>Termination of
			 election assistance commission</header>
			<subsection id="HF6094E56A05D40E89ECA5896444172A1"><enum>(a)</enum><header>Termination</header><text display-inline="yes-display-inline">The Help America Vote Act of 2002 (42
			 U.S.C. 15301 et seq.) is amended by adding at the end the following new
			 title:</text>
				<quoted-block display-inline="no-display-inline" id="H5FDE47D86C7D44978755DD7DC1203FEE" style="OLC">
					<title id="HE8C3E2EFC2D543768620F9BDB0F7DA79"><enum>X</enum><header>Termination of
				Commission</header>
						<section id="H808EB1FC268E433AB188C253A44D8A65"><enum>1001.</enum><header>Termination</header><text display-inline="no-display-inline">Effective on the Commission termination
				date, the Commission (including the Election Assistance Commission Standards
				Board and the Election Assistance Commission Board of Advisors under part 2 of
				subtitle A of title II) is terminated and may not carry out any programs or
				activities.</text>
						</section><section id="HB4278BC6E1EC4833865489A76BB36396"><enum>1002.</enum><header>Office of
				management and budget to perform transition functions</header><text display-inline="no-display-inline">Except as provided in section 1004, the
				Director of the Office of Management and Budget shall, effective upon the
				Commission termination date—</text>
							<paragraph id="HB9F25E7DED11444798CBC6EC10056E71"><enum>(1)</enum><text>perform the
				functions of the Commission with respect to contracts and agreements described
				in subsection 1003(a) until the expiration of such contracts and agreements,
				but shall not renew any such contract or agreement; and</text>
							</paragraph><paragraph id="H4493B25558DD41F0B476A7802931BE1E"><enum>(2)</enum><text>take the necessary
				steps to wind up the affairs of the Commission.</text>
							</paragraph></section><section id="H0923A4A21FB44BC8BC0B59D0A7719F71"><enum>1003.</enum><header>Savings
				provisions</header>
							<subsection id="H5DC8385BBCFD4E69B7B63AA5F173CDD0"><enum>(a)</enum><header>Prior
				contracts</header><text display-inline="yes-display-inline">The termination of
				the Commission under this title shall not affect any contract that has been
				entered into by the Commission before the Commission termination date. All such
				contracts shall continue in effect until modified, superseded, terminated, set
				aside, or revoked in accordance with law by an authorized Federal official, a
				court of competent jurisdiction, or operation of law.</text>
							</subsection><subsection id="H0AE1B68ABE744FBCAFC4A65EADA2FB80"><enum>(b)</enum><header>Obligations of
				recipients of payments</header>
								<paragraph id="H9A1FA70392E0454E9E060A43AD43E930"><enum>(1)</enum><header>In
				general</header><text>The termination of the Commission under this title shall
				not affect the authority of any recipient of a payment made by the Commission
				under this Act prior to the Commission termination date to use any portion of
				the payment that remains unobligated as of the Commission termination date, and
				the terms and conditions that applied to the use of the payment at the time the
				payment was made shall continue to apply.</text>
								</paragraph><paragraph id="H470A821E6CE34188B0215A6BB46126FF"><enum>(2)</enum><header>Special rule for
				States receiving requirements payments</header><text display-inline="yes-display-inline">In the case of a requirements payment made
				to a State under part 1 of subtitle D of title II, the terms and conditions
				applicable to the use of the payment for purposes of the State’s obligations
				under this subsection (as well as any obligations in effect prior to the
				termination of the Commission under this subtitle), and for purposes of any
				applicable requirements imposed by regulations promulgated by the Director of
				the Office of Management and Budget, shall be the general terms and conditions
				applicable under Federal law, rules, and regulations to payments made by the
				Federal Government to a State, except that to the extent that such general
				terms and conditions are inconsistent with the terms and conditions that are
				specified under part 1 of subtitle D of title II or section 902, the terms and
				conditions specified under such part and such section shall apply.</text>
								</paragraph></subsection><subsection id="HF5375B4380C84947BA4BC368BCD9BC3D"><enum>(c)</enum><header>Pending
				proceedings</header>
								<paragraph id="H1E4DCC4D8A7B4B7CB87D92E4AAA046A4"><enum>(1)</enum><header>No effect on
				pending proceedings</header><text display-inline="yes-display-inline">The
				termination of the Commission under this title shall not affect any proceeding
				to which the Commission is a party that is pending on the Commission
				termination date, including any suit to which the Commission is a party that is
				commenced prior to such date, and the Director of the Office of Management and
				Budget shall be substituted or added as a party to the proceeding.</text>
								</paragraph><paragraph id="H41DDD23D3CFD47D3A3756B633284C89B"><enum>(2)</enum><header>Treatment of
				orders</header><text display-inline="yes-display-inline">In the case of a
				proceeding described in paragraph (1), an order may be issued, an appeal may be
				taken, judgments may be rendered, and payments may be made as if the Commission
				had not been terminated. Any such order shall continue in effect until
				modified, terminated, superseded, or revoked by an authorized Federal official,
				a court of competent jurisdiction, or operation of law.</text>
								</paragraph><paragraph id="H5AC3E97745F5474284C05B26FB12DA9D"><enum>(3)</enum><header>Construction
				relating to discontinuance or modification</header><text>Nothing in this
				subsection shall be deemed to prohibit the discontinuance or modification of
				any proceeding described in paragraph (1) under the same terms and conditions
				and to the same extent that such proceeding could have been discontinued or
				modified if the Commission had not been terminated.</text>
								</paragraph><paragraph id="H4D65EF05BFB3465E847AA7BCCA4F4291"><enum>(4)</enum><header>Regulations for
				transfer of proceedings</header><text>The Director of the Office of Management
				and Budget may issue regulations providing for the orderly transfer of
				proceedings described in paragraph (1).</text>
								</paragraph></subsection><subsection id="HD7BC79D50FAC4AEDBD1EE541AC8E9BE6"><enum>(d)</enum><header>Judicial
				review</header><text display-inline="yes-display-inline">Orders and actions of
				the Director of the Office of Management and Budget in the exercise of
				functions of the Commission under section 1002 shall be subject to judicial
				review to the same extent and in the same manner as if such orders and actions
				had been issued or taken by the Commission. Any requirements relating to
				notice, hearings, action upon the record, or administrative review that apply
				to any function of the Commission shall apply to the exercise of such function
				by the Director.</text>
							</subsection></section><section id="H0DE8005FFA69425889A80CA1B4646778"><enum>1004.</enum><header>Return to
				Federal Election Commission of authority to carry out certain functions under
				National Voter Registration Act of 1993</header><text display-inline="no-display-inline">Effective on the Commission termination
				date, there are transferred to the Federal Election Commission any functions
				transferred to the Election Assistance Commission under section 802 (relating
				to functions described in section 9(a) of the National Voter Registration Act
				of 1993).</text>
						</section><section id="H4EC0DFC2D5DA4AF3AD30D15BA5F5EB26"><enum>1005.</enum><header>Commission
				termination date</header><text display-inline="no-display-inline">The
				<quote>Commission termination date</quote> is the first date following the
				expiration of the 60-day period that begins on the date of the enactment of
				this title.</text>
						</section></title><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF505C148950B4BE69BE53685CE1FB490"><enum>(b)</enum><header>Termination of
			 Technical Guidelines Development Committee</header><text>Section 221 of such
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15361">42 U.S.C. 15361</external-xref>) is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H6BE3A20129914FCB859E3E7350C54714" style="OLC">
					<subsection id="HE1EDC432399D4876B5C10BC23B610B50"><enum>(g)</enum><header>Termination</header><text display-inline="yes-display-inline">Effective on the Commission termination
				date described in section 1005, the Development Committee is
				terminated.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="HE7F5E3AAE1F04D87B9BF3A41A7A9C69F"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of contents of such Act is amended by adding
			 at the end the following:</text>

			 amendments relating to return of certain authority to federal election
			 commission</header>
			<subsection id="H91808A56C12F4DBCB9CF1A81418F284A"><enum>(a)</enum><header>Federal Election
			 Campaign Act of 1971</header><text>Section 311(a) of the Federal Election
			 Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/438">2 U.S.C. 438(a)</external-xref>) is amended—</text>
				<paragraph id="HD85670C92E904DE284DF8FDE950BDCE8"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (8);</text>
				</paragraph><paragraph id="HEF9D9710C7B945C5AB1D54A3C726CDFD"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (9) and inserting a semicolon; and</text>
				</paragraph><paragraph id="H655A57A9E6CD4E3FB253AFEB41FE33D6"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H6C75BC7F5E294F4091B03B098B0D54A1" style="OLC">
						<paragraph id="H713E1C87D03C4152BAF3920C3C562E52"><enum>(10)</enum><text>carry out the
				duties described in section 9(a) of the National Voter Registration Act of
				1993.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H7B1AF47E4C9343D38AE4132ECA844F46"><enum>(b)</enum><header>National voter
			 registration act of 1993</header><text>Section 9(a) of the National Voter
			 Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973gg-7">42 U.S.C. 1973gg–7(a)</external-xref>) is amended by striking
			 <quote>Election Assistance Commission</quote> and inserting <quote>Federal
			 Election Commission</quote>.</text>
			</subsection><subsection id="H45B68F6AC38747DFBD69764CAA0BC693"><enum>(c)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall take effect on the
			 Commission termination date described in section 1005 of the Help America Vote
			 Act of 2002 (as added by section 2(a)).</text>
