<enum>I</enum><header>Amendments to the
Food for Peace Act</header>
<section id="HD0AEE01CCAB74D18A6D679FC98C3DA1E"><enum>101.</enum><header>Food aid to
developing countries</header><text display-inline="no-display-inline">Section
3(b)(1)(C) of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1691a">7 U.S.C. 1691a(b)(1)(C)</external-xref>) is
amended—</text>
<paragraph id="HE5F32410ECDF415C8BDE48109701B4D7"><enum>(1)</enum><text>by striking
<quote>, provision of funds</quote> and inserting <quote>and provision of
funds</quote>; and</text>
</paragraph><paragraph id="H406C21B106C94B94AD3F9165ADA1FDF3"><enum>(2)</enum><text>by striking
<quote>, and monetization of commodities,</quote>.</text>
</paragraph></section><section id="H8D62791261BA46EF8C593797AEE6DB0E"><enum>102.</enum><header>Emergency and
private assistance programs</header>
<subsection id="H9928D83DDA824D7683E875067E38046A"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Title II of the Food
for Peace Act is amended as follows:</text>
<paragraph commented="no" id="H59A182C20E5145578AE3B6E9A1EDF16A"><enum>(1)</enum><text>In the title
heading, by striking <quote><header-in-text level="title" style="OLC">and
private</header-in-text></quote>.</text>
</paragraph><paragraph commented="no" id="H83AE352AD9894001A10B21172D096ECC"><enum>(2)</enum><text display-inline="yes-display-inline">In section 201 (<external-xref legal-doc="usc" parsable-cite="usc/7/1721">7 U.S.C. 1721</external-xref>)—</text>
<subparagraph commented="no" id="HDEA1D66149BF462F9EDA7FC579E0E8EC"><enum>(A)</enum><text>in the matter
preceding paragraph (1), by striking <quote>agricultural commodities</quote>
and inserting <quote>assistance, including agricultural commodities,</quote>;

by inserting <quote>inclusive and sustainable</quote> after

<subsection id="H4E9FAE247CD5472E995A721C38CCA390"><enum>(h)</enum><header>Applicability of
administrative authorities under the Foreign Assistance Act of
1961</header><text display-inline="yes-display-inline">The administrative
authorities contained in chapter 2 of part III of the Foreign Assistance Act of
1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2381">22 U.S.C. 2381 et seq.</external-xref>) shall apply to programs carried out under this
title to the same extent and in the same manner as such administrative
authorities apply to programs carried out under such
Act.</text>
</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</subparagraph></paragraph></subsection><subsection id="HAEAEDB4688024C92845777EC86D7B60B"><enum>(b)</enum><header>Retroactive
effective date</header><text display-inline="yes-display-inline">The amendment
made by paragraph (6)(B) shall take effect as of December 31, 2012.</text>
</subsection></section><section id="HE14A6A38897B4F0593BCAD049F0DF03C"><enum>103.</enum><header>General
authorities and requirements</header>
<subsection id="H28FBBBFFA2BC4D5886CEB56FFAF7C1C5"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Title IV of the Food
for Peace Act is amended as follows:</text>
<paragraph id="HD8270118A9EF467EABC3335AE594A8C6"><enum>(1)</enum><text>In section 402 (7
U.S.C. 1732)—</text>
<subparagraph id="HA421FCD9B07142AAB0F9A831FBF661AF"><enum>(A)</enum><text>in paragraph
(2)—</text>
<clause id="H763D680A4C854034B1103D002265BAA2"><enum>(i)</enum><text>by
striking <quote>produced in the United States</quote>; and</text>
</clause><clause id="H9A964CA80B484D05A7664B34809C37EA"><enum>(ii)</enum><text>by
striking the second sentence; and</text>
</clause></subparagraph><subparagraph id="H7EF2FB2C29174EAF930BA063DB7A7650"><enum>(B)</enum><text>in paragraph
(3)—</text>
<clause id="H47654DBC16C14A0983CB14C6C24CB0AA"><enum>(i)</enum><text>by
redesignating subparagraphs (B) and (C) as subparagraphs (C) and (D),
respectively; and</text>

by striking <quote>eligible organizations</quote> and all that follows through
<quote>under title II</quote> and inserting <quote>eligible organizations may
be made available under titles I and III</quote>.</text>

effective date</header><text display-inline="yes-display-inline">The amendment
made by paragraph (6) shall take effect as of December 31, 2012.</text>
</subsection></section><section commented="no" id="HE40A88E2B8A1408B977614CC51E0E3AE"><enum>104.</enum><header>Effective
date</header><text display-inline="no-display-inline">Except as otherwise
provided in this title, the amendments made by this title shall take effect on
the date of the enactment of this Act and shall apply with respect to the
provision of assistance under title II of the Food for Peace Act (as so
amended) beginning on the date that is 180 days after such date of
enactment.</text>
</section><enum>II</enum><header>Cargo
preferences</header>
<section id="HC39F1B0F61074FD4BF00565A098F4C36" section-type="subsequent-section"><enum>201.</enum><header>Cargo
preferences</header>
<subsection id="HDF222E4B8DFF4294A21C6E6B433913BA"><enum>(a)</enum><header>Exemption</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/55313">Section 55313</external-xref> of title 46, United States
Code, is amended—</text>
<paragraph id="H095B842077924D19B2A67B14DD8B1A49"><enum>(1)</enum><text>by striking
<quote>Sections 55304 and 55305 of this title do not apply</quote> and
inserting the following:</text>
<quoted-block display-inline="no-display-inline" id="H007D60409DB44D58B2DF08023DCBBC2E" style="USC">
<subsection id="H0628906A2432424C953D69B5EC4ED8DF"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Sections 55304 and

</paragraph><paragraph id="H4DDA934580C2408AA2EB0B776465039D"><enum>(2)</enum><text>by adding at the
end the following:</text>

<subsection id="H0EFE1C3215A24F9DA76A9B678320D6FD"><enum>(b)</enum><header>Additional
exempted activities</header><text display-inline="yes-display-inline">In
addition to the exemption under subsection (a) and notwithstanding any other
provision of law, sections 55304 and 55305 of this title do not apply to
activities carried out under title II of the Food for Peace Act (7 U.S.C. 1721
et
seq.).</text>
</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></subsection><subsection id="HE1EF20FE11EB43A694580186624617AA"><enum>(b)</enum><header>Conforming
amendment</header><text display-inline="yes-display-inline">Section 55314(b)(1)
of title 46, United States Code, is amended by inserting <quote>, except for
activities carried out under title II of that Act</quote> before the
semicolon.</text>
