		<official-title>To amend title XIX of the Social Security Act to provide
		  access to certified professional midwives for women enrolled in the Medicaid
		  program.</official-title>

		<section id="H225733A749F9484CB8283423BB4466BD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Access to Certified Professional
			 Midwives Act of 2013</short-title></quote>.</text>
		</section><section id="H35CA24319D6245E193DEAF04E31A8F05"><enum>2.</enum><header>Requirements for
			 coverage of services provided by certified professional midwives under
			 Medicaid</header>
			<subsection id="H243BB38CD18E4C7383F52AAA55EFE00E"><enum>(a)</enum><header>Coverage of
			 certified professional midwife services</header><text display-inline="yes-display-inline">Section 1905(a) of the Social Security Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended—</text>
				<paragraph id="H4C7A34103FFC4F0FAE8FD8B40B80CC3A"><enum>(1)</enum><text>in paragraph (28),
			 by deleting <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H5FEB6E22227E434A80D0B89F4B78D44F"><enum>(2)</enum><text>by redesignating
			 paragraph (29) as paragraph (30); and</text>
				</paragraph><paragraph id="H4CA4E1CFC6F74509B8D6386222C509F6"><enum>(3)</enum><text>by inserting after
			 paragraph (28) the following paragraph:</text>
					<quoted-block id="H76A158416F8644FE8B1295C5E0856807" style="OLC">
						<paragraph id="H72B17DBCCE264A2CAF44F9B851D27996"><enum>(29)</enum><text>services
				that—</text>
							<subparagraph id="H94E20D2AC0A14948AD9F78CF94AA1342"><enum>(A)</enum><text>are furnished by a
				certified professional midwife (as defined by the Secretary); and</text>
							</subparagraph><subparagraph id="HC123B47A3B6F43B5BFCBB6BC96BD2F90"><enum>(B)</enum><text display-inline="yes-display-inline">the certified professional midwife is
				legally authorized to perform under State law (or the State regulatory
				mechanism provided by State law);
				and</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H2267B1AF75CD42F9ACAED0F382489A3E"><enum>(b)</enum><header>Inclusion in
			 mandatory services</header><text display-inline="yes-display-inline">Section
			 1902(a)(10)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)</external-xref>) is
			 amended, in the matter before clause (i)—</text>
				<paragraph id="H62475310C01147AAA17DBEABD3DC2929"><enum>(1)</enum><text>by striking
			 <quote>and</quote> before <quote>(28)</quote>; and</text>
				</paragraph><paragraph id="HBF7BF8E663B243A88FB0EB0FE8EC93A5"><enum>(2)</enum><text>by inserting
			 <quote>, and (29)</quote> after <quote>(28)</quote>.</text>
				</paragraph></subsection><subsection id="H4578D6222DE2498AB9BCAD7CFB57F74A"><enum>(c)</enum><header>Effective
			 date</header>
				<paragraph id="H0A0F08FD01A24AC5BD1A84241A117EBB"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 paragraph (2), the amendments made by this section shall take effect on January
			 1, 2015.</text>
				</paragraph><paragraph id="HDC0592F003AA4550BB6300746A6183CE"><enum>(2)</enum><header>Rule for changes
			 requiring State legislation</header><text>In the case of a State plan for
			 medical assistance under title XIX of the Social Security Act which the
			 Secretary of Health and Human Services determines requires State legislation
			 (other than legislation appropriating funds) in order for the plan to meet the
			 additional requirements imposed by the amendments made by this section, the
			 State plan shall not be regarded as failing to comply with the requirements of
			 such title solely on the basis of its failure to meet these additional
			 requirements before the later of the following dates:</text>
					<subparagraph id="HFBE055419C3A471EBB243461A3D0D8BD"><enum>(A)</enum><text>The first day of
			 the first calendar quarter beginning after the close of the first regular
			 session of the State legislature that begins after the date of the enactment of
			 this Act.</text>
					</subparagraph><subparagraph id="H4604945718164C368668593A35BD786F"><enum>(B)</enum><text>The date in
			 <internal-xref idref="H0A0F08FD01A24AC5BD1A84241A117EBB" legis-path="2.(c)(1)">paragraph (1)</internal-xref>.</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">For purposes
			 of the previous sentence, in the case of a State that has a 2-year legislative
			 session, each year of such session shall be deemed to be a separate regular
			 session of the State legislature.</continuation-text></paragraph></subsection></section></legis-body>
