		<official-title>To ban guns for persons who have been convicted of
		  stalking or who are subject to a court order restraining the person from
		  stalking.</official-title>

		<section id="H1737D5C3E9EA4782A9FC6FF2D1044116" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Preventing Victims of Stalking Act of
			 2013</short-title></quote>.</text>
		</section><section id="HF156919FAFB4459EABCDC7D3A059C7D0"><enum>2.</enum><header>Prohibitions</header>
			<subsection id="H29E66E6566524B68A3CFD4A1FC1F2D73"><enum>(a)</enum><header>Sales or other
			 dispositions of firearms or ammunition</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/922">Section 922(d)</external-xref> of title 18, United States
			 Code, is amended in the 1st sentence, by striking paragraphs (8) and (9) and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H923AA931E76E425586B53A6CD74E3003" style="OLC">
					<paragraph id="HEDBB2F1CC83F45ABA37019F81960D1D3"><enum>(8)</enum><text display-inline="yes-display-inline">is subject to a court order that restrains
				the person from harassing, stalking, or threatening an individual or engaging
				in other conduct that would place an individual in reasonable fear of bodily
				injury, except that this paragraph shall only apply to a court order
				that—</text>
						<subparagraph id="H65C4549A62594FE0909C826B0E3E98AB"><enum>(A)</enum><text>was issued after a
				hearing of which the person received actual notice, and at which the person had
				the opportunity to participate; and</text>
						</subparagraph><subparagraph id="HD2BD7EE445BC45D5AF9E09E343480CD8"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HB3A87F70663B4E5ABF116FFC843C4F92"><enum>(i)</enum><text>includes a finding that
				the person represents a credible threat to the physical safety of the
				individual; or</text>
							</clause><clause id="H12C10AB95BF347C8AC4C1F8132EE9731" indent="up1"><enum>(ii)</enum><text>by its terms explicitly prohibits
				the use, attempted use, or threatened use of physical force against the
				individual that would reasonably be expected to cause bodily injury; or</text>
							</clause></subparagraph></paragraph><paragraph id="HF985228DA7064C2195639F2B40C4A5BB"><enum>(9)</enum><text>has been convicted
				in any court of a misdemeanor crime of domestic violence or of stalking (as
				defined under State
				law).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H95AEA67775AE4C1F9CA1CA87DE453489"><enum>(b)</enum><header>Possession,
			 etc., of firearms or ammunition</header><text>Section 922(g) of such title is
			 amended by striking paragraphs (8) and (9) and inserting the following::</text>
				<quoted-block display-inline="no-display-inline" id="HCE184E2B67E844ABA9E308FE23CBAE90" style="OLC">
					<paragraph id="H1AF267CDB1824B129F6AA7ACB5D20932"><enum>(8)</enum><text display-inline="yes-display-inline">who is subject to a court order
				that—</text>
						<subparagraph id="HFC3A32E51E64431FBD8C2DF5823BFA19"><enum>(A)</enum><text>was issued after a
				hearing of which the person received actual notice, and at which the person had
				an opportunity to participate;</text>
						</subparagraph><subparagraph id="H09AFD1CD66FA43D59EED15BD31217020"><enum>(B)</enum><text>restrains the
				person from harassing, stalking, or threatening an individual or engaging in
				other conduct that would place an individual in reasonable fear of bodily
				injury; and</text>
						</subparagraph><subparagraph id="H7A15424567154393A15B4AAC63E38B84"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H0B5A87096F054F6DBA259393744BA265"><enum>(i)</enum><text>includes a finding that
				the person represents a credible threat to the physical safety of the
				individual; or</text>
							</clause><clause id="H7E1C424661D6468E92B52D7511A691A1" indent="up1"><enum>(ii)</enum><text>by its terms explicitly prohibits
				the use, attempted use, or threatened use of physical force against the
				individual that would reasonably be expected to cause bodily injury; or</text>
							</clause></subparagraph></paragraph><paragraph id="H67F480E57E644A0AA21268A2EE13A8E8"><enum>(9)</enum><text>who has been
				convicted in any court of a misdemeanor crime of domestic violence or of
				stalking (as defined under State
				law),</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9F6C506E1C92499A99B3F9FF60A4AC86"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to conduct
			 engaged after the 90-day period that begins with the date of the enactment of
			 this Act.</text>
