R. 1900</legis-num><current-chamber display="yes">IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20131209">December 9, 2013</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To provide for the timely consideration of all licenses, permits, and approvals required under Federal law with respect to the siting, construction, expansion, or operation of any natural gas pipeline projects.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="H83FD939EDA5640BF93D6849457F171DD" style="OLC"><section id="HF6ACD1852B114A1095930D6FCE0A223A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Natural Gas Pipeline Permitting Reform Act</short-title></quote>.</text></section><section id="H5DFAADE12BF04510B221EE34D1DCCEB6"><enum>2.</enum><header>Regulatory approval of natural gas pipeline projects</header><text display-inline="no-display-inline">Section 7 of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HB2CAA801FA524CB5BDCD4CDEE3EEA096" style="traditional"><subsection id="H44C7EF53FD3D4BD5899AE2E206C74200"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HE16E8187DC7F41F7B30DE06B79C6FE5F"><enum>(1)</enum><text display-inline="yes-display-inline">The Commission shall approve or deny an application for a certificate of public convenience and necessity for a prefiled project not later than 12 months after receiving a complete application that is ready to be processed, as defined by the Commission by regulation.</text></paragraph><paragraph id="H5D14E2C53A914CA7BCD275257F9299D7" indent="up1"><enum>(2)</enum><text>The agency responsible for issuing any license, permit, or approval required under Federal law in connection with a prefiled project for which a certificate of public convenience and necessity is sought under this Act shall approve or deny the issuance of the license, permit, or approval not later than 90 days after the Commission issues its final environmental document relating to the project.</text></paragraph><paragraph id="HA610E8F294144DDE979269CD07F14413" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Commission may extend the time period under paragraph (2) by 30 days if an agency demonstrates that it cannot otherwise complete the process required to approve or deny the license, permit, or approval, and therefor will be compelled to deny the license, permit, or approval. In granting an extension under this paragraph, the Commission may offer technical assistance to the agency as necessary to address conditions preventing the completion of the review of the application for the license, permit, or approval.</text></paragraph><paragraph id="H6AD105E05785487AA5113D8DB31C4527" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">If an agency described in paragraph (2) does not approve or deny the issuance of the license, permit, or approval within the time period specified under paragraph (2) or (3), as applicable, such license, permit, or approval shall take effect upon the expiration of 30 days after the end of such period. The Commission shall incorporate into the terms of such license, permit, or approval any conditions proffered by the agency described in paragraph (2) that the Commission does not find are inconsistent with the final environmental document.</text></paragraph><paragraph id="HE54AE936276F4140BFA6E5D759354D12" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">For purposes of this subsection, the term <quote>prefiled project</quote> means a project for the siting, construction, expansion, or operation of a natural gas pipeline with respect to which a prefiling docket number has been assigned by the Commission pursuant to a prefiling process established by the Commission for the purpose of <pagebreak></pagebreak>facilitating the formal application process for obtaining a certificate of public convenience and necessity.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body><attestation><attestation-group><attestation-date chamber="House" date="20131121">Passed the House of Representatives November 21, 2013.</attestation-date><attestor display="yes">Karen L.
