		<section id="HBEC820BDEC3A4B16AED35B2DA6125DBE" section-type="section-one"><enum>1.</enum><header>Short title;
			 references</header>
			<subsection id="HA581A56CB0F749A59C893CBA89A478CD"><enum>(a)</enum><header>Short
			 title</header><text>This Act may be cited as the <quote><short-title>International Child Support Recovery Improvement Act of
			 2013</short-title></quote>.</text>
			</subsection><subsection id="HAEB7971252B643799B611930F743682F"><enum>(b)</enum><header>References</header><text>Except
			 as otherwise expressly provided in this Act, wherever in this Act an amendment
			 is expressed in terms of an amendment to a section or other provision, the
			 amendment shall be considered to be made to a section or other provision of the
			 Social Security Act.</text>
			</subsection></section><section id="H672B50F4E5A34EC59DE5F95188282314"><enum>2.</enum><header>Amendments to
			 ensure access to child support services for international child support
			 cases</header>
			<subsection id="H20A9F938647548C39C43201A3C4BBDE1"><enum>(a)</enum><header>Authority of the
			 secretary of HHS To ensure compliance with multilateral child support
			 conventions</header>
				<paragraph id="H36B257B733FC48E88733D7180CB92213"><enum>(1)</enum><header>In
			 general</header><text>Section 452 (<external-xref legal-doc="usc" parsable-cite="usc/42/652">42 U.S.C. 652</external-xref>) is amended—</text>
					<subparagraph id="HA435436FD2674D6CA4C401ED26A716EA"><enum>(A)</enum><text>by redesignating
			 the second subsection (l) (as added by section 7306 of the Deficit Reduction
			 Act of 2005) as subsection (m); and</text>
					</subparagraph><subparagraph id="HFE91AF44B4E5493B9214B8EAC8EBEAA6"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H2103403883924370A9E45FA52D2FCF9A" style="OLC">
							<subsection id="H25EE7FB3D1734D54A150EFA2FC344176"><enum>(n)</enum><text>The Secretary
				shall use the authorities otherwise provided by law to ensure the compliance of
				the United States with any multilateral child support convention to which the
				United States is a
				party.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H51C4FCFA79804AF281D51440B19F5662"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 453(k)(3) (<external-xref legal-doc="usc" parsable-cite="usc/42/653">42 U.S.C. 653(k)(3)</external-xref>) is amended by
			 striking <quote>452(l)</quote> and inserting <quote>452(m)</quote>.</text>
				</paragraph></subsection><subsection id="H40856442E9154942BEB96E261B64CA8D"><enum>(b)</enum><header>Access to the
			 federal parent locator service</header><text>Section 453(c) (<external-xref legal-doc="usc" parsable-cite="usc/42/653">42 U.S.C. 653(c)</external-xref>)
			 is amended—</text>
				<paragraph id="HCB2972AE5FB04FF7B018A15222C16DA0"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (3);</text>
				</paragraph><paragraph id="H92B89304B82B46F8AEFDB6E100F65F02"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (4) and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="HECF84C40016549648EFAACB8C46B8B2E"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="HDA43C6B7EC7D416F99E6FA67877847D7" style="OLC">
						<paragraph id="HB9BE4DDA7C4C4892BC54B093450B126F"><enum>(5)</enum><text>an entity
				designated as a Central Authority for child support enforcement in a foreign
				reciprocating country or a foreign treaty country for purposes specified in
				section
				459A(c)(2).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HB57DE51B8B6F448A9017A6A2853180A4"><enum>(c)</enum><header>State option To
			 require individuals in foreign countries To apply through their country’s
			 appropriate central authority</header><text>Section 454 (<external-xref legal-doc="usc" parsable-cite="usc/42/654">42 U.S.C. 654</external-xref>) is
			 amended—</text>
				<paragraph id="H61A091F1A18C47D9973307D0B1CCE1E4"><enum>(1)</enum><text>in paragraph
			 (4)(A)(ii), by inserting before the semicolon <quote>(except that, if the
			 individual applying for the services resides in a foreign reciprocating country
			 or foreign treaty country, the State may opt to require the individual to
			 request the services through the Central Authority for child support
			 enforcement in the foreign reciprocating country or the foreign treaty country,
			 and if the individual resides in a foreign country that is not a foreign
			 reciprocating country or a foreign treaty country, a State may accept or reject
			 the application)</quote>; and</text>
				</paragraph><paragraph id="H720C250E11234EBFABEDD13E63C9D859"><enum>(2)</enum><text>in paragraph
			 (32)—</text>
					<subparagraph id="HBFA53CD5389449B3B0DF042DF037E9EA"><enum>(A)</enum><text>in subparagraph
			 (A), by inserting <quote>, a foreign treaty country,</quote> after <quote>a
			 foreign reciprocating country</quote>; and</text>

			 international support enforcement provisions</header><text>Section 459A (42
			 U.S.C. 659a) is amended—</text>

			 end the following:</text>

				this part:</text>
							<paragraph id="H3517039516324DBBB94BEE6A2A51C761"><enum>(1)</enum><header>Foreign
				reciprocating country</header><text>The term <term>foreign reciprocating
				country</term> means a foreign country (or political subdivision thereof) with
				respect to which the Secretary has made a declaration pursuant to subsection
				(a).</text>
							</paragraph><paragraph id="HF663EBA0A799482AAB661AE641DEB023"><enum>(2)</enum><header>Foreign treaty
				country</header><text>The term <term>foreign treaty country</term> means a
				foreign country for which the 2007 Family Maintenance Convention is in
				force.</text>
							</paragraph><paragraph id="H8D28A3C8FFA4479AB1A70B9517DD9FE4"><enum>(3)</enum><header>2007 family
				maintenance convention</header><text>The term <term>2007 Family Maintenance
				Convention</term> means the Hague Convention of 23 November 2007 on the
				International Recovery of Child Support and Other Forms of Family
				Maintenance.</text>
							</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF6FB1A8C02EC46FC96B73DEC34C8782B"><enum>(2)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="H795A6439994845EBA997FA9F7F6E6037"><enum>(A)</enum><text>in the matter
			 preceding paragraph (1), by striking <quote>foreign countries that are the
			 subject of a declaration under this section</quote> and inserting
			 <quote>foreign reciprocating countries or foreign treaty countries</quote>;

			 past-Due support from federal tax refunds</header><text>Section 464(a)(2)(A)
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/664">42 U.S.C. 664(a)(2)(A)</external-xref>) is amended by striking <quote>under section
			 454(4)(A)(ii)</quote> and inserting <quote>under paragraph (4)(A)(ii) or (32)
			 of section 454</quote>.</text>
			</subsection><subsection id="HEB8F02AEBF654A55B5D31B6B667649AC"><enum>(f)</enum><header>State law
			 requirement concerning the uniform interstate family support act
			 (UIFSA)</header>
				<paragraph id="HB5D973C36E0B44559A8EA2387E7CBDCF"><enum>(1)</enum><header>In
			 general</header><text>Section 466(f) (<external-xref legal-doc="usc" parsable-cite="usc/42/666">42 U.S.C. 666(f)</external-xref>) is amended—</text>
					<subparagraph id="H883F1B2875254DBAAAC2426ED19E4ED2"><enum>(A)</enum><text>by striking
			 <quote>on and after January 1, 1998,</quote>;</text>
					</subparagraph><subparagraph id="H9AB460FA74234111AE5443690FFF2C68"><enum>(B)</enum><text>by striking
			 <quote>and as in effect on August 22, 1996,</quote>; and</text>
					</subparagraph><subparagraph id="HE5A7D75BA45F4BEEBA6233A553C93E82"><enum>(C)</enum><text>by striking
			 <quote>adopted as of such date</quote> and inserting <quote>adopted as of
			 September 30, 2008</quote>.</text>
					</subparagraph></paragraph><paragraph id="H0B626F5E2D26456CB4FDEF29F4B40EE4"><enum>(2)</enum><header>Conforming
			 amendments to title 28, united states code</header><text>Section 1738B of title
			 28, United States Code, is amended—</text>
					<subparagraph id="HB46A914751AD4CF5879204B85A8BA3F1"><enum>(A)</enum><text>in subsection (d),
			 by striking <quote>individual contestant</quote> and inserting
			 <quote>individual contestant or the parties have consented in a record or open
			 court that the tribunal of the State may continue to exercise jurisdiction to
			 modify its order,</quote>;</text>
					</subparagraph><subparagraph id="H0A96D7DDBC644AB8BD46CB655A1CB39D"><enum>(B)</enum><text>in subsection
			 (e)(2)(A), by striking <quote>individual contestant</quote> and inserting
			 <quote>individual contestant and the parties have not consented in a record or
			 open court that the tribunal of the other State may continue to exercise
			 jurisdiction to modify its order</quote>; and</text>
					</subparagraph><subparagraph id="HFA9F1FF8F842489496DF446DD8F9C4C5"><enum>(C)</enum><text>in subsection

			 <quote><quote>modification</quote> means</quote> and inserting <quote>(8) The
			 term <term>modification</term> means</quote>; and</text>
						</clause><clause id="HE3FA09106D0D448AB357C1D3D0141E54"><enum>(ix)</enum><text>by
			 striking <quote><quote>State</quote> means</quote> and inserting <quote>(9) The
			 term <term>State</term> means</quote>.</text>
						</clause></subparagraph></paragraph><paragraph id="HCE15CAA3D9D64724A6E774D708AE7916"><enum>(3)</enum><header>Effective date;
			 grace period for state law changes</header>
					<subparagraph id="H008090DA8FDD4E1EA75571D6162D639F"><enum>(A)</enum><header>Paragraph
			 (1)</header><clause commented="no" display-inline="yes-display-inline" id="H86D1889DBBE342879C3BE6FA2725D22A"><enum>(i)</enum><text>The
			 amendments made by paragraph (1) shall take effect with respect to a State no
			 later than the effective date of laws enacted by the legislature of the State
			 implementing such paragraph, but in no event later than the first day of the
			 first calendar quarter beginning after the close of the first regular session
			 of the State legislature that begins after the date of the enactment of this
			 Act.</text>
						</clause><clause id="H258802D9C6424C7FA9064071FFDEDA03" indent="up1"><enum>(ii)</enum><text>For purposes of clause (i), in the
			 case of a State that has a 2-year legislative session, each year of the session
			 shall be deemed to be a separate regular session of the State
			 legislature.</text>
						</clause></subparagraph><subparagraph id="HB070526D103C4797ABB04D9CDB7EA753"><enum>(B)</enum><header>Paragraph
			 (2)</header><clause commented="no" display-inline="yes-display-inline" id="H33B1905572504340AA997E6C8B81FED2"><enum>(i)</enum><text>The
			 amendments made by subparagraphs (A) and (B) of paragraph (2) shall take effect
			 on the date on which the Hague Convention of 23 November 2007 on the
			 International Recovery of Child Support and Other Forms of Family Maintenance
			 enters into force for the United States.</text>
						</clause><clause id="HD4958D05F66A44DFB7F752A67926DFF6" indent="up1"><enum>(ii)</enum><text>The amendments made by
			 subparagraph (C) of paragraph (2) shall take effect on the date of the
			 enactment of this Act.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="H6ABE53B818394CEDBDE1A7302F2091F3"><enum>3.</enum><header>Data exchange
			 standardization for improved interoperability</header>
			<subsection id="H533634B545FA45519E7325948F553347"><enum>(a)</enum><header>In
			 general</header><text>Section 452 (<external-xref legal-doc="usc" parsable-cite="usc/42/652">42 U.S.C. 652</external-xref>), as amended by section
			 2(a)(1) of this Act, is amended by adding at the end the following:</text>
				<quoted-block id="HA7ADE13B0B87496B89D546661D24CAD0" style="OLC">
					<subsection id="H6A581A4BDB0A42B2A70F5C6710B1DCF8"><enum>(o)</enum><header>Data exchange
				standards for improved interoperability</header>
						<paragraph id="HA0E47BAE5CBA4FD9813FAD368E8EC2DA"><enum>(1)</enum><header>Designation</header><text>The
				Secretary shall, in consultation with an interagency work group established by
				the Office of Management and Budget and considering State government
				perspectives, by rule, designate data exchange standards to govern, under this
				part—</text>
							<subparagraph id="HC63B06D2AABA4BD6AC7895AC5D4EA2AC"><enum>(A)</enum><text>necessary
				categories of information that State agencies operating programs under State
				plans approved under this part are required under applicable law to
				electronically exchange with another State agency; and</text>
							</subparagraph><subparagraph id="H05A1DC20CC584A2EBD7F5F1A56DFB3FE"><enum>(B)</enum><text>Federal reporting
				and data exchange required under applicable law.</text>
							</subparagraph></paragraph><paragraph id="H7AC5DA0A21FC4B32B4711F6B7A980A49"><enum>(2)</enum><header>Requirements</header><text>The
				data exchange standards required by paragraph (1) shall, to the extent
				practicable—</text>
							<subparagraph id="H7E89D58ED241411A8CDB08BDE4CEE5E0"><enum>(A)</enum><text display-inline="yes-display-inline">incorporate a widely accepted,
				non-proprietary, searchable, computer-readable format, such as the eXtensible
				Markup Language;</text>
							</subparagraph><subparagraph id="H1E162896BBD9412989E96F0841378687"><enum>(B)</enum><text>contain
				interoperable standards developed and maintained by intergovernmental
				partnerships, such as the National Information Exchange Model;</text>
							</subparagraph><subparagraph id="HDB9478DC967249E091B50ADB82F7FF97"><enum>(C)</enum><text>incorporate
				interoperable standards developed and maintained by Federal entities with
				authority over contracting and financial assistance;</text>
							</subparagraph><subparagraph id="HD8E83F5C5FE440C8A2333DBA783691EA"><enum>(D)</enum><text>be consistent with
				and implement applicable accounting principles;</text>
							</subparagraph><subparagraph id="H2F8E5CFA832440EDBEF4616CD2CFA4D9"><enum>(E)</enum><text>be implemented in
				a manner that is cost-effective and improves program efficiency and
				effectiveness; and</text>
							</subparagraph><subparagraph id="HA62B6A00A85F4872AA996D3E11BA9D5D"><enum>(F)</enum><text>be capable of
				being continually upgraded as necessary.</text>
							</subparagraph></paragraph><paragraph id="H34C462CC459446B2ACF94825F09B1AF5"><enum>(3)</enum><header>Rule of
				construction</header><text>Nothing in this subsection shall be construed to
				require a change to existing data exchange standards found to be effective and
				efficient.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9EC5572661264BAD885EEB3BA770F77D"><enum>(b)</enum><header>Effective
			 date</header><text>The Secretary of Health and Human Services shall issue a
			 proposed rule within 24 months after the date of the enactment of this section.
			 The rule shall identify federally-required data exchanges, include
			 specification and timing of exchanges to be standardized, and address the
			 factors used in determining whether and when to standardize data exchanges. It
			 should also specify State implementation options and describe future
			 milestones.</text>
			</subsection></section><section id="H5EC79578EDDF40439B87623408EA62AA"><enum>4.</enum><header>Efficient use of
			 the national directory of new hires database for federally sponsored research
			 assessing the effectiveness of federal policies and programs in achieving
			 positive labor market outcomes</header><text display-inline="no-display-inline">Section 453 (<external-xref legal-doc="usc" parsable-cite="usc/42/653">42 U.S.C. 653</external-xref>) is
			 amended—</text>
			<paragraph id="H6C0C3F83FF9E4E039571B664185F9DCE"><enum>(1)</enum><text>in subsection
			 (i)(2)(A), by striking <quote>24</quote> and inserting <quote>48</quote>;
			 and</text>
			</paragraph><paragraph id="H38266C9D54CE46428D25BC220B1D6D92"><enum>(2)</enum><text>in subsection (j),
			 by striking paragraph (5) and inserting the following:</text>
				<quoted-block id="H9E116F7E22DC43E0BD529E18D392CF04" style="OLC">
					<paragraph id="H84359457596D407C831EC5EED3570A0C"><enum>(5)</enum><header>Research</header>
						<subparagraph id="H3A60F02F6B224B1DB20CEB00B11A8923"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraph (B) of this paragraph, the
				Secretary may provide access to data in each component of the Federal Parent
				Locator Service maintained under this section and to information reported by
				employers pursuant to section 453A(b), for—</text>
							<clause id="H82C290773AEB4498801A4C981E80A84E"><enum>(i)</enum><text>research
				undertaken by a State or Federal agency (including through grant or contract)
				for purposes found by the Secretary to be likely to contribute to achieving the
				purposes of part A or this part; or</text>
							</clause><clause id="H11ED7F13C126465CA14F6FE86351EC51"><enum>(ii)</enum><text>an evaluation or
				statistical analysis undertaken to assess the effectiveness of a Federal
				program in achieving positive labor market outcomes (including through grant or
				contract), by—</text>
								<subclause id="HC58368221DA04F2EA0E7BABA4B148E8A"><enum>(I)</enum><text>the Department of
				Health and Human Services;</text>
								</subclause><subclause id="H690C0620D17C4B79B767B58E9EE3B16B"><enum>(II)</enum><text>the Social
				Security Administration;</text>
								</subclause><subclause id="HA079C22A4E10488DB9B30812373F2D93"><enum>(III)</enum><text>the Department
				of Labor;</text>
								</subclause><subclause id="HA57DB050EEB34DA19F80F16860CC42A1"><enum>(IV)</enum><text>the Department of
				Education;</text>
								</subclause><subclause id="HE51675EC7FAB46FDB60B746638A21CCD"><enum>(V)</enum><text>the Department of
				Housing and Urban Development;</text>
								</subclause><subclause id="H02CE695D630D4A95A4F92590AE6E5C43"><enum>(VI)</enum><text>the Department of
				Justice;</text>
								</subclause><subclause id="HFEB829CB4ED24022AB3E10B563E723F3"><enum>(VII)</enum><text>the Department
				of Veterans Affairs;</text>
								</subclause><subclause id="HD11372F6213143AAB13D0674DF30107E"><enum>(VIII)</enum><text>the Bureau of
				the Census;</text>
								</subclause><subclause id="H92EAC48EAFD245CBAD484E52265CF690"><enum>(IX)</enum><text>the Department of
				Agriculture; or</text>
								</subclause><subclause id="H0BF3AC324BE144A1BDD4A16FDB8A2F2F"><enum>(X)</enum><text>the National

								</subclause></clause></subparagraph><subparagraph id="HC2BBA6C4F93E4BBC8EB7DB03F0966CFF"><enum>(B)</enum><header>Personal
				identifiers</header><text>Data or information provided under this paragraph may
				include a personal identifier only if, in addition to meeting the requirements
				of subsections (l) and (m)—</text>
							<clause id="H50CD87158AC649E68374AC9FA0D41F62"><enum>(i)</enum><text>the State or
				Federal agency conducting the research described in subparagraph (A)(i), or the
				Federal department or agency undertaking the evaluation or statistical analysis
				described in subparagraph (A)(ii), as applicable, enters into an agreement with
				the Secretary regarding the security and use of the data or information;</text>
							</clause><clause id="HFCC12A3E736C4DB3AD347EBC0FACEEC7"><enum>(ii)</enum><text>the agreement
				includes such restrictions or conditions with respect to the use, safeguarding,
				disclosure, or redisclosure of the data or information (including by
				contractors or grantees) as the Secretary deems appropriate;</text>
							</clause><clause id="H0F1995B268BB4CDE8786A98A6CCEC19D"><enum>(iii)</enum><text>the data or
				information is used exclusively for the purposes defined in the agreement;
				and</text>
							</clause><clause id="HC5B0056EBD894857B194831C59530DB0"><enum>(iv)</enum><text>the Secretary
				determines that the provision of data or information under this paragraph is
				the minimum amount needed to conduct the research, evaluation, or statistical
				analysis, as applicable, and will not interfere with the effective operation of
				the program under this part.</text>
							</clause></subparagraph><subparagraph id="H633DCFBA26EE42CDBDF48A9E24637D7D"><enum>(C)</enum><header>Penalties for
				unauthorized disclosure of data</header><text>Any individual who willfully
				discloses a personal identifier (such as a name or social security number)
				provided under this paragraph, in any manner to an entity not entitled to
				receive the data or information, shall be fined under title 18, United States
				Code, imprisoned not more than 5 years, or
				both.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H6C6A80C6F878476385A01B3E924AF4B1"><enum>5.</enum><header>Budgetary
			 effects</header><text display-inline="no-display-inline">The budgetary effects
			 of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act
			 of 2010, shall be determined by reference to the latest statement titled
			 <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted
			 for printing in the Congressional Record by the Chairman of the Senate Budget
			 Committee, provided that such statement has been submitted prior to the vote on
			 passage.</text>
