		<section id="H11E19FB3198546B783476EFE505A2A16" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Offending Oil Polluters Act of
			 2013</short-title></quote>.</text>
		</section><section id="H5B6018BB239A4D50B4A05211F8C15140"><enum>2.</enum><header>Denial of certain
			 tax benefits to offending oil polluters</header>
			<subsection id="HA8F660C984064692BE03817953052643"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter B of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end
			 the following new part:</text>

				  polluters.</toc-entry>
						</toc>
						<section id="HB35A0A45E57545A2AEEBBDDD506F8B89"><enum>293.</enum><header>Denial of
				certain tax benefits to offending oil polluters</header>
							<subsection id="H1B3D419B32F8443EAB7B3499CA5296CB"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of an
				offending oil polluter, no deduction or credit shall be allowed under this
				chapter with respect to any amount paid or incurred in connection with a
				discharge of oil referred to in subsection (b)(1).</text>
							</subsection><subsection id="H95F9306D53284E4C83111952061EDFC0"><enum>(b)</enum><header>Offending oil
				polluter</header><text>For purposes of this section, the term <term>offending
				oil polluter</term> means—</text>
								<paragraph id="H88A33FE798BB47918E0DD9FE4470DB3D"><enum>(1)</enum><text display-inline="yes-display-inline">any person that is a responsible party for
				a vessel or a facility from which oil is discharged (within the meaning of
				section 1002 of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2702">33 U.S.C. 2702</external-xref>)) unless—</text>
									<subparagraph id="H98292691BA4E45829B72DB5FC46C8973"><enum>(A)</enum><text display-inline="yes-display-inline">the person has met all of its obligations
				under such Act to provide compensation for covered removal costs and damages,
				and</text>
									</subparagraph><subparagraph id="H46AB9B585737476CAF0C5124BA4CE28D"><enum>(B)</enum><text display-inline="yes-display-inline">during the 7-year period ending on the
				first date of such discharge, the person, in connection with activities in the
				oil industry (including exploration, development, production, transportation by
				pipeline, and refining)—</text>
										<clause id="H01D12115B04E4DF0938A87B0431A471A"><enum>(i)</enum><text display-inline="yes-display-inline">was not found to have committed willful or
				repeated violations under the Occupational Safety and Health Act of 1970 (29
				U.S.C. 651 et seq.) (including State plans approved under section 18(c) of such
				Act (<external-xref legal-doc="usc" parsable-cite="usc/29/667">29 U.S.C. 667(c)</external-xref>)) at a rate that is higher than five times the rate
				determined by the Secretary, in consultation with the Secretary of the
				Interior, to be the oil industry average for such violations for such
				period,</text>
										</clause><clause id="HF69D1734FA634DED89BC08F93D9E6163"><enum>(ii)</enum><text>was not convicted
				of a criminal violation for death or serious bodily injury,</text>
										</clause><clause id="HEED6375EBF5C4BC6B2D5FC4B8BB1AF1A"><enum>(iii)</enum><text>did not have
				more than 10 fatalities at its exploration, development, and production
				facilities and refineries as a result of violations of Federal or State health,
				safety, or environmental laws,</text>
										</clause><clause id="HD5C44F0FD6B24FDCA41B27BA895C7285"><enum>(iv)</enum><text display-inline="yes-display-inline">was not assessed, did not enter into an
				agreement to pay, and was not otherwise required to pay, civil penalties and
				criminal fines for violations the person was found to have committed under the
				Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) (including State
				programs approved under sections 402 and 404 of such Act (33 U.S.C. 1342 and
				1344)) in a total amount that is equal to more than $10,000,000, and</text>
										</clause><clause id="H8C238CCAEC264BBE8BA165D68E98D951"><enum>(v)</enum><text display-inline="yes-display-inline">was not assessed, did not enter into an
				agreement to pay, and was not otherwise required to pay, civil penalties and
				criminal fines for violations the person was found to have committed under the
				Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) (including State plans approved under
				section 110 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7410">42 U.S.C. 7410</external-xref>)) in a total amount that is equal to
				more than $10,000,000, and</text>
										</clause></subparagraph></paragraph><paragraph id="H3A5E89C731424B73830193E7FD50312B"><enum>(2)</enum><text display-inline="yes-display-inline">any person who is a member of the same
				expanded affiliated group (as defined in section 1471(e)(2)) as a person
				described in paragraph
				(1).</text>
								</paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9C2E2ECC4BED41FEA81ABA769DEB9BF2"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of parts
			 for subchapter B of chapter 1 of such Code is amended by adding at the end the
			 following new item:</text>

			</subsection><subsection id="H0C0815BFA3F64E0880C9E6B20D8F0CEE"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to amounts
			 paid or incurred after December 31, 2012.</text>
