		<official-title>To amend the Endangered Species Act of 1973 to promote
		  sustainable-use conservation, to harmonize that Act with the Convention on
		  International Trade in Endangered Species of Wild Fauna and Flora, and for
		  other purposes.</official-title>

		<section id="H87CD8FE0FF8E4A60AAF0246608D4F98A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Enhancement of Species Survival
			 Act</short-title></quote>.</text>
		</section><section id="H66387A1BE8644254B92565937758A73A"><enum>2.</enum><header>Definition</header><text display-inline="no-display-inline">Section 3 of the Endangered Species Act of
			 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1532">16 U.S.C. 1532</external-xref>) is amended by redesignating paragraphs (7) through (10)
			 as paragraphs (8) through (11), and inserting after paragraph (6) the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="HA9AB5BAA7E694BA2AABAD70B398F9A54" style="OLC">
				<paragraph id="HDDF673F8823A44CF96716DCEACCFE42D"><enum>(7)</enum><text display-inline="yes-display-inline">The term <term>enhancement of propagation
				or survival</term> means directly or indirectly improving a species’
				sustainability in the wild, including any measure that—</text>
					<subparagraph id="H6127424A66E64EA3A29161BDA5DF882A"><enum>(A)</enum><text>benefits the
				species’ population numbers, health, or habitat;</text>
					</subparagraph><subparagraph id="H4E7B0F5297B7484FAEA2F64041D0C16D"><enum>(B)</enum><text>reduces a threat
				to the species; or</text>
					</subparagraph><subparagraph id="H9777A6774DF64350A0006122C890C85A"><enum>(C)</enum><text>increases the
				social tolerance of the
				species.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HD8150EF6D8AA44A9A3F715EF15883C70"><enum>3.</enum><header>Enhancement
			 finding</header><text display-inline="no-display-inline">Section 10(a)(1) of
			 the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1539">16 U.S.C. 1539(a)(1)</external-xref>) is amended—</text>
			<paragraph id="H85BB6AC9AB634946B2E8BA9876135DF4"><enum>(1)</enum><text>in the matter
			 preceding subparagraph (A), by striking <quote> may permit</quote>;</text>
			</paragraph><paragraph id="H2FBA1A6CBC1E4459B786CFF88970E579"><enum>(2)</enum><text>in subparagraph
			 (A)—</text>
				<subparagraph id="HB29401B9F09B4DECB6AAD5B205DECEF4"><enum>(A)</enum><text>by inserting
			 <quote>shall permit</quote> before <quote>any act</quote>; and</text>
				</subparagraph><subparagraph id="H5E7EBA7D1711444F874A16FB2505D70A"><enum>(B)</enum><text>by striking
			 <quote>or</quote> after the semicolon at the end;</text>
				</subparagraph></paragraph><paragraph id="H66902B1DB15C4DABAB624F584EE418FB"><enum>(3)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text>
				<subparagraph id="H2FA0A2F9F89C40A986E2BE86AC69884C"><enum>(A)</enum><text>by inserting
			 <quote>may permit</quote> before <quote>any act</quote>; and</text>
				</subparagraph><subparagraph id="H1B88C83785D947FEBD873B069E53550D"><enum>(B)</enum><text>by striking the
			 period at the end and inserting a semicolon; and</text>
				</subparagraph></paragraph><paragraph id="H19DE95BD815648C68360810B1065B1A6"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF984289CAF014E248EE60CAB5403A300" style="OLC">
					<subparagraph id="HE4C217B203CC464795763830C56DA97B"><enum>(C)</enum><text display-inline="yes-display-inline">shall permit importation of a sport-hunted
				trophy or other specimen that was legally taken from a population of a species
				that is not native to the United States (including a domestic population of
				such a species), if—</text>
						<clause id="HD86E88EF7085451288C7BF582B5A2961"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="HF5A2AF54B4BD47458CB64102F84C2CEF"><enum>(I)</enum><text>the population is listed
				as an endangered species or threatened species under section 4 and is listed
				under Appendix II to the Convention; and</text>
							</subclause><subclause id="H93D015E5AAB744038D6FA0E60D1A4D6A" indent="up1"><enum>(II)</enum><text>all trade in the trophy or specimen is
				in accordance with all requirements in Article IV of the Convention and any
				relevant resolutions adopted by the Convention Conference of the Parties;
				or</text>
							</subclause></clause><clause id="H3FC0DE1BBB584FFCBAD1BF68EC6F0758"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HD54851019D7B4BB2B98CF60BC960BD98"><enum>(I)</enum><text>the population is listed
				in Appendix I to the Convention;</text>
							</subclause><subclause id="HBBDAE1FE32844F2C960FE6D2564177B7" indent="up1"><enum>(II)</enum><text>in the case of a sport-hunted trophy or
				other specimen, all trade in the trophy or specimen is in accordance with all
				requirements of Article III of the Convention and all relevant resolutions and
				quotas adopted by the Convention Conference of the Parties; and</text>
							</subclause><subclause id="H09D7128B879744E4878C501AD8E8DC1D" indent="up1"><enum>(III)</enum><text>in the case of a ranched or captive
				bred specimen, all commercial trade in such specimen is in accordance with
				clause 4 of Article VII of the Convention and with all relevant clarifying
				resolutions and quotas adopted by the Convention Conference of the Parties;
				and</text>
							</subclause></clause></subparagraph><subparagraph id="H6DA5A01ECFD24ECA8702F3B5C90AC3AB"><enum>(D)</enum><text>shall permit under
				subparagraphs (A) and (C), notwithstanding sections 3(1)(C) and 101(a)(1) of
				the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1362">16 U.S.C. 1362(1)(C)</external-xref>, 1371(a)(1)),
				importation of a sport-hunted trophy or other specimen of a marine mammal that
				has been legally taken from a population that is depleted under such Act solely
				by reason of section 3(1)(C) of that
				Act.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H52C1B75D742B40B9A0C539457679F0A1"><enum>4.</enum><header>Implementation</header><text display-inline="no-display-inline">The Secretary, as that term is used in the
			 Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>), shall, by not later
			 than 120 days after the date of enactment of this Act, promulgate regulations
			 implementing the amendments made by this Act, including criteria for the
			 issuance of permits under section 10(a)(1)(A) of such Act (16 U.S.C.
			 1539(a)(1)), as amended by this Act.</text>
