		<official-title display="yes">To ensure that the Federal Aviation
		  Administration advances the safety of small airplanes, and the continued
		  development of the general aviation industry, and for other
		  purposes.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H9AB19FAAFB564DD4AD6B946CF4122B32" style="OLC">
		<section id="H3687B4AC2C8540B089310E5D9789C241" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Small Airplane Revitalization Act of
			 2013</short-title></quote>.</text>
		</section><section id="H90DBFF5BDE314C7C98EB2478636D73D6"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="HE3CE4DBD8D694B60BF586E30C8ECA448"><enum>(1)</enum><text>A
			 healthy small aircraft industry is integral to economic growth and to
			 maintaining an effective transportation infrastructure for communities and
			 nations around the world.</text>
			</paragraph><paragraph id="HDD9FD39258AA44FA8294A175C11BFB00"><enum>(2)</enum><text>Small aircraft
			 comprise nearly 90 percent of FAA type certified general aviation
			 aircraft.</text>
			</paragraph><paragraph id="HD8966C1FAEE14488823BDD432FF7C913"><enum>(3)</enum><text>General aviation
			 provides for the cultivation of a workforce of engineers, manufacturing and
			 maintenance professionals, and pilots, who secure the Nation’s economic success
			 and defense.</text>
			</paragraph><paragraph id="HAC5BA4D753D1412AB60C1D5DEB584D84"><enum>(4)</enum><text>General aviation
			 contributes to well-paying manufacturing and technology jobs in the United
			 States, and these products are exported in great numbers, providing a positive
			 trade balance.</text>
			</paragraph><paragraph id="HC741572BBE6E4A9C82413D1EC6F3CF76"><enum>(5)</enum><text>Technology
			 developed and proven in general aviation aids in the success and safety of all
			 sectors of aviation and scientific competence.</text>
			</paragraph><paragraph id="HE377C22BE9C64D5995EBCA236F4C97F5"><enum>(6)</enum><text>The average small
			 airplane in the United States is now 40 years old and the regulatory barriers
			 to bringing new designs to market are resulting in a lack of innovation and
			 investment in small airplane design.</text>
			</paragraph><paragraph id="H79FF263A047D409E807BAEA486083988"><enum>(7)</enum><text>Over the past
			 decade, the United States has typically lost 10,000 active private pilots per
			 year, partially due to a lack of cost-effective, new small airplanes.</text>
			</paragraph><paragraph id="H77B075238167473CA4225DFBD94551C9"><enum>(8)</enum><text>General aviation
			 safety can be improved by modernizing and revamping the regulations for this
			 sector to clear the path for technology adoption and cost-effective means to
			 retrofit the existing fleet with new safety technologies.</text>
			</paragraph></section><section id="H859BE5B2722B447D90204CF2E69CA526"><enum>3.</enum><header>FAA safety and
			 regulatory improvements for general aviation</header>
			<subsection id="H378A4DA872CB497A8D1DE640E7A1E997"><enum>(a)</enum><header>Establishment of
			 FAA safety and regulatory improvements for general aviation</header><text>The
			 Administrator shall advance the safety and continued development of small
			 airplanes by reorganizing the certification requirements applicable to small
			 airplanes to streamline the approval of safety advancements.</text>
			</subsection><subsection id="H10A62B17FB394D4A8D9ACF173EB5B711"><enum>(b)</enum><header>Regulations</header><text>The
			 Administrator shall issue a final rule based on the FAA’s Part 23
			 Reorganization Aviation Rulemaking Committee (established in August 2011) by
			 December 31, 2015. The final rule shall meet the following objectives of the
			 Part 23 Committee:</text>
				<paragraph id="H5059CD730E9F4FE5B2EB7FA5BF023364"><enum>(1)</enum><text>Create a
			 regulatory regime for small airplanes that will improve safety and decrease
			 certification costs.</text>
				</paragraph><paragraph id="H09103C57D4C442D79846613DB4200DE7"><enum>(2)</enum><text>Set broad,
			 outcome-driven safety objectives that will spur innovation and technology
			 adoption.</text>
				</paragraph><paragraph id="H96CD6A51136B44F480186367D3694DA3"><enum>(3)</enum><text>Replace current,
			 prescriptive requirements contained in FAA rules with performance-based
			 regulations.</text>
				</paragraph><paragraph id="H9E6758D145BB44C78F3BCA8DD50DFC0E"><enum>(4)</enum><text>Use FAA-accepted
			 consensus standards to clarify how the part 23 safety objectives may be met by
			 specific designs and technologies.</text>
				</paragraph></subsection><subsection id="H118268E5FDAD4DE88C6C341F6ED4B1E8"><enum>(c)</enum><header>Consensus-Based
			 standards</header><text>The Administrator shall use acceptable consensus-based
			 standards whenever possible in the spirit of the National Technology Transfer
			 and Advancement Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/15/3701">15 U.S.C. 3701</external-xref> note), while
			 continuing traditional methods for meeting part 23.</text>
			</subsection><subsection id="H6FA212A7BD6847928D09F7753DC91BE4"><enum>(d)</enum><header>Safety
			 cooperation</header><text>The Administrator shall lead the effort to improve
			 general aviation safety by working with leading aviation regulators to assist
			 them in adopting a complementary regulatory approach for small
			 airplanes.</text>
			</subsection></section><section id="H3F34A050C34C4B4C8492D3C4560F5B97"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions
			 apply:</text>
			<paragraph id="H04ED2568A98C4D1CAD8A35FC1EBEC846"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <quote>Administrator</quote> means
			 the Administrator of the Federal Aviation Administration.</text>
			</paragraph><paragraph id="HE2E74A65B44E470CAEC5F006F0A28B79"><enum>(2)</enum><header>Consensus
			 standards</header><text>The term <quote>consensus standards</quote> means
			 standards developed by voluntary organizations which plan, develop, establish,
			 or coordinate voluntary standards using agreed-upon procedures, both domestic
			 and international. These standards include provisions requiring that owners of
			 relevant intellectual property agree to make that intellectual property
			 available on a nondiscriminatory, royalty-free or reasonable-royalty basis to
			 all interested parties. These bodies have the attributes of openness, balance
			 of interest, due process, an appeals process, and consensus.</text>
			</paragraph><paragraph id="H836F0B4BE9414696A4633CA46A4C8BAD"><enum>(3)</enum><header>FAA</header><text>The
			 term <quote>FAA</quote> means the Federal Aviation Administration.</text>
			</paragraph><paragraph id="H7892DC3370C64D558A0D9325F0D3193F"><enum>(4)</enum><header>General
			 aviation</header><text>The term <quote>general aviation</quote> means all
			 aviation activities other than scheduled commercial airline operations and
			 military aviation.</text>
			</paragraph><paragraph commented="no" id="HF7B708B048A54EDFAADBD9E39D4A631C"><enum>(5)</enum><header>Part
			 23</header><text>The term <quote>part 23</quote> means part 23 of title 14,
			 Code of Federal Regulations.</text>
			</paragraph><paragraph id="HCE56DD26171049C3B47CA1D34FC43835"><enum>(6)</enum><header>Small
			 airplane</header><text>The term <quote>small airplane</quote> means FAA type
			 certificated airplanes that meet the parameters of part 23 of title 14, Code of
			 Federal Regulations.</text>
			</paragraph></section></legis-body>
