R. 1818</legis-num><associated-doc display="yes" role="report">[Report No. 113–202]</associated-doc><current-chamber display="yes">IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20130426">April 26, 2013</action-date><action-desc><sponsor name-id="Y000033">Mr. Young of Alaska</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><action><action-date date="20130910">September 10, 2013</action-date><action-desc>Additional sponsors: <cosponsor name-id="K000363">Mr. Kline</cosponsor>, <cosponsor name-id="C000556">Mr. Coble</cosponsor>, and <cosponsor name-id="Y000065">Mr. Yoho</cosponsor></action-desc></action><action><action-date date="20130910">September 10, 2013</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed<pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Marine Mammal Protection Act of 1972 to allow importation of polar bear trophies taken in sport hunts in Canada before the date the polar bear was determined to be a threatened species under the Endangered Species Act of 1973.<pagebreak></pagebreak></official-title></form><legis-body id="H0B9E6CFEB9F34993B84C02C83FC8EDD5" style="OLC"><section id="HAA49479A9367437BB961DCBC9231EC3E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Polar Bear Conservation and Fairness Act of 2013</short-title></quote> .</text></section><section id="HE92FC4B5FD4E483CBA15E3A7A6109A21" section-type="subsequent-section"><enum>2.</enum><header> Permits for importation of polar bear trophies taken in sport hunts in Canada</header><text display-inline="no-display-inline">Section 104(c)(5)(D) of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1374">16 U.S.C. 1374(c)(5)(D)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H29432CB34AA04602A9C42C06FF5491F6" style="OLC"><subparagraph id="H2B43713B08C24FDAA205D68A6F4C8C16" indent="up1"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="HCE92240AEBC64515895AF25E725D0F51"><enum>(i)</enum><text display-inline="yes-display-inline">The Secretary of the Interior shall, expeditiously after the expiration of the applicable 30-day period under subsection (d)(2), issue a permit for the importation of any polar bear part (other than an internal organ) from a polar bear taken in a sport hunt in Canada to any person—</text><subclause id="H68448424E7CA41D1A25CB6C5B0D4D4FA" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">who submits, with the permit application, proof that the polar bear was legally harvested by the person before February 18, 1997; or</text></subclause><subclause id="H5E51DE25B2D84C3EB8B58E9D020872BD" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">who has submitted, in support of a permit application submitted before May 15, 2008, proof that the polar bear was legally harvested by the person before May 15, 2008, from a polar bear population from which a sport-hunted trophy could be imported before that date in accordance with <external-xref legal-doc="regulation" parsable-cite="cfr/50/18.30">section 18.30(i)</external-xref> of title 50, Code of Federal Regulations.</text></subclause></clause><clause id="H3CA3F4E4F0FB43B6B3B81207EAE0D186" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The Secretary shall issue permits under clause (i)(I) without regard to subparagraphs (A) and (C)(ii) of this paragraph, subsection (d)(3), and sections 101 and 102. Sections 101(a)(3)(B) and 102(b)(3) shall not apply to the importation of any polar bear part authorized by a permit issued under clause (i)(I). This clause shall not apply to polar bear parts that were imported before June 12, 1997.</text></clause><clause id="HC407AB16A0524657B138C517F5CC7070" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">The Secretary shall issue permits under clause (i)(II) without regard to subparagraph (C)(ii) of this paragraph or subsection (d)(3). Sections 101(a)(3)(B) and 102(b)(3) shall not apply to the importation of any polar bear part authorized by a permit issued under clause (i)(II). This clause shall not apply to polar bear parts that were imported before the date of enactment of the <short-title>Polar Bear Conservation and Fairness Act of 2013</short-title>.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body><endorsement display="yes"><action-date date="20130910">September 10, 2013</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
