		  guarantees for purposes of financing improvements to school lunch facilities,
		  training school food service personnel, and for other

		<section id="H5E4753A49BBA4F8A8F60C9189A8A1FD7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>School Food Modernization
			 Act</short-title></quote>.</text>
		</section><section id="H98F8E5ECBF9249FC91B7A5B44D9FACC2"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H86B0BA3664404CD7991A80B369E09402"><enum>(1)</enum><header>Durable
			 equipment</header><text display-inline="yes-display-inline">The term
			 <term>durable equipment</term> means durable food preparation, handling,
			 cooking, serving, and storage equipment.</text>
			</paragraph><paragraph id="H1A87300134D345E08075CF90A360811E"><enum>(2)</enum><header>Eligible
			 entity</header><text>The term <term>eligible entity</term> means—</text>
				<subparagraph id="H3362C299094C4029B5F91FF88AA1C3CC"><enum>(A)</enum><text display-inline="yes-display-inline">a local educational agency operating a
			 school lunch program;</text>
				</subparagraph><subparagraph id="HD29195D756BC417AB0FCD6A01CFDBFE0"><enum>(B)</enum><text>a tribal
			 organization; or</text>
				</subparagraph><subparagraph id="HB49D67FDF81B4476AA7384738CB397EB"><enum>(C)</enum><text>a consortium that
			 includes a local educational agency described in subparagraph (A), a tribal
			 organization, or both.</text>
				</subparagraph></paragraph><paragraph id="H0E55C161614744EDB46D722DC794DE99"><enum>(3)</enum><header>Infrastructure</header><text display-inline="yes-display-inline">The term <term>infrastructure</term> means
			 a food storage facility, kitchen, food service facility, cafeteria, dining
			 room, or food preparation facility.</text>
			</paragraph><paragraph id="H42B3F6BF563F485E9BEAAD5131AB721F"><enum>(4)</enum><header>Local
			 educational agency</header><text>The term <term>local educational agency</term>
			 has the meaning given such term in section 9101 of the Elementary and Secondary
			 Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
			</paragraph><paragraph id="H0A2DAD6C72FD4894A7DC2616D93C5720"><enum>(5)</enum><header>School lunch
			 program</header><text display-inline="yes-display-inline">The term <term>school
			 lunch program</term> means the school lunch program established under the
			 Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>).</text>
			</paragraph><paragraph id="H0CA1D4BCB2A540A1BE70AEF79C413991"><enum>(6)</enum><header>Tribal
			 organization</header><text>The term <term>tribal organization</term> has the
			 meaning given the term in section 4 of the Indian Self-Determination and
			 Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text>
			</paragraph><paragraph id="H1CECDD47F4EF458F9938FEBB1CBE0171"><enum>(7)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture.</text>
			</paragraph></section><section id="H8F4FDFEDCDA7440D853D708CD91F323E" section-type="subsequent-section"><enum>3.</enum><header>Loan guarantee for
			 assistance to schools for infrastructure improvements and durable equipment
			 necessary to provide healthy meals through school food programs</header>
			<subsection id="H5F142FE5C06E42D080612D03A6312305"><enum>(a)</enum><header>Authority To
			 guarantee loans</header><text display-inline="yes-display-inline">The Secretary
			 of Agriculture shall issue a loan guarantee to an eligible entity for purposes
			 of financing the construction, remodeling, or expansion of infrastructure or
			 the purchase of durable equipment that the Secretary determines will assist
			 such entity in providing healthy meals through the school food programs.</text>
			</subsection><subsection id="H67BAFBA1B9084ECA82C6DFA2BA001DFA"><enum>(b)</enum><header>Competitive
			 basis</header><text>Subject to subsection (c), the Secretary shall select
			 eligible entities to receive a loan guarantee under this section on a
			 competitive basis.</text>
			</subsection><subsection id="H39ACF53DC8E0458D90B97C1F4449A13E"><enum>(c)</enum><header>Preferences</header><text display-inline="yes-display-inline">In issuing a loan guarantee under this
			 section, the Secretary shall give a preference to an eligible entity that,
			 compared with other eligible entities seeking a loan guarantee under this
			 section, the Secretary determines demonstrates substantial or disproportionate
			 need for—</text>
				<paragraph id="HA60AFB157ABF44F4B4B1D1A186E3FC7C"><enum>(1)</enum><text>infrastructure
			 improvement; or</text>
				</paragraph><paragraph id="H730ECF6889F64687941AD6AD9CC2EA05"><enum>(2)</enum><text>durable equipment
			 need or impairment.</text>
				</paragraph></subsection><subsection id="HB3DB4513CFA64B53AA7628C07CB69B22"><enum>(d)</enum><header>Oversight</header><text display-inline="yes-display-inline">The Secretary shall establish procedures to
			 enable the Secretary to oversee the construction, remodeling, or expansion of
			 infrastructure or the purchase of durable equipment for which a loan guarantee
			 is issued under this section.</text>
			</subsection><subsection id="H36849351358A4A388E69A87009E8A2FF"><enum>(e)</enum><header>Guarantee
			 amount</header><text>A loan guarantee issued under this section may not
			 guarantee more than 90 percent of the principal amount of the loan.</text>
			</subsection><subsection id="HB4A05E00EE404C6F896D78D29DCA37E0"><enum>(f)</enum><header>Use of Commodity
			 Credit Corporation</header><text display-inline="yes-display-inline">The
			 Secretary shall use the funds, facilities, and authorities of the Commodity
			 Credit Corporation to carry out this section.</text>
			</subsection></section><section commented="no" id="H2DEB9BB5CA634EC5BA726AA552B71302"><enum>4.</enum><header>Equipment grant
			 program</header><text display-inline="no-display-inline">Section 7 of the Child
			 Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1776">42 U.S.C. 1776</external-xref>) is amended—</text>
			<paragraph commented="no" id="HEA6B2E78EB1A492295D550DA97B6FB4F"><enum>(1)</enum><text>by redesignating
			 subsection (j) as subsection (k); and</text>
			</paragraph><paragraph commented="no" id="HA17751E0BFDA4160A00FB6F39A2B5554"><enum>(2)</enum><text>by inserting after
			 subsection (i), the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC5EC278EE7FF4C1DBE76C24C3883B548" style="OLC">
					<subsection commented="no" id="H6D78DE336F30444D9A558D80440108D2"><enum>(j)</enum><header>Equipment
				grants</header>
						<paragraph commented="no" id="HA87AEA213D804FB782A6033622CC47A3"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Beginning fiscal year
				2015 and subject to the availability of appropriations, the Secretary shall
				make grants, on a competitive basis, to eligible entities to assist such
				entities in purchasing the durable equipment and infrastructure needed to serve
				healthier meals and improve food safety.</text>
						</paragraph><paragraph commented="no" id="H3798F406455642CF95A56D6A3081A7B0"><enum>(2)</enum><header>Priority</header><text>In
				awarding grants under this subsection, the Secretary shall give priority to
				eligible entities serving a high percentage of students eligible for free or
				reduced price under the Richard B. Russell National School Lunch Act.</text>
						</paragraph><paragraph commented="no" id="HE1B273CBDC934412B8AD527F015E4FC8"><enum>(3)</enum><header>Definitions</header><text>For
				purposes of this subsection:</text>
							<subparagraph commented="no" id="HCCB4527A59874C80B75C96348302AD7C"><enum>(A)</enum><header>Durable
				equipment</header><text display-inline="yes-display-inline">The term
				<term>durable equipment</term> means durable food preparation, handling,
				cooking, serving, and storage equipment.</text>
							</subparagraph><subparagraph commented="no" id="H43AA70C945154BD6A798277639A85B19"><enum>(B)</enum><header>Eligible
				entity</header><text>The term <term>eligible entity</term> means—</text>
								<clause commented="no" id="H11CA1E274739438389F9F7BF0C1C1404"><enum>(i)</enum><text display-inline="yes-display-inline">a local educational agency operating a
				school lunch program;</text>
								</clause><clause commented="no" id="H2B444CBC41404BC682793BACF285E81C"><enum>(ii)</enum><text>a tribal
				organization; or</text>
								</clause><clause commented="no" id="HF3518CD2CE8A4C659F58F97EA371A0B2"><enum>(iii)</enum><text>a consortium
				that includes a local educational agency described in clause (i), a tribal
				organization, or both.</text>
								</clause></subparagraph><subparagraph commented="no" id="H602D574D3851402AA339AD172725587C"><enum>(C)</enum><header>Infrastructure</header><text>The
				term <term>infrastructure</term> means a food storage facility, kitchen, food
				service facility, cafeteria, dining room, or food preparation
				facility.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HBFCA9C7911604F87A5189C3EE8278821" section-type="subsequent-section"><enum>5.</enum><header>Training and technical
			 assistance for school food service personnel</header>
			<subsection id="HD172EDAB220D4FE99F4D2AAA4EE56A0A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 carry out a grant program under which the Secretary shall award grants, on a
			 competitive basis, to provide support to eligible third-party training
			 institutions described in subsection (b) to develop and administer training and
			 technical assistance for school foodservice personnel to meet updated nutrition
			 standards under section 4(b)(3) of the Richard B. Russell National School Lunch
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1753">42 U.S.C. 1753(b)(3)</external-xref>) for the school food programs.</text>
			</subsection><subsection id="HA6616BE8474C4A6BBF2B67A34F0E62E1"><enum>(b)</enum><header>Criteria for
			 eligible third-Party institutions</header><text display-inline="yes-display-inline">The Secretary shall establish specific
			 criteria that eligible third-party training institutions shall meet to receive
			 grants under this section, which shall include—</text>
				<paragraph id="H195367E8134145698A1E5395F002E342"><enum>(1)</enum><text display-inline="yes-display-inline">a demonstrated capacity to administer
			 effective training and technical assistance programming to school foodservice
			 personnel;</text>
				</paragraph><paragraph id="H3026FAC5593E4230B8C14A0C7BF5136E"><enum>(2)</enum><text display-inline="yes-display-inline">prior, successful experience in providing
			 or engaging in training and technical assistance programming or applied
			 research activities involving eligible entities, school food service
			 administrators, or directors;</text>
				</paragraph><paragraph id="H668AB992569B4FDC9DF83FB6A1197952"><enum>(3)</enum><text display-inline="yes-display-inline">prior, successful experience in developing
			 relevant educational training tools or course materials or curricula on topics
			 addressing child and school nutrition or the updated nutrition standards under
			 section 4(b)(3) of the Richard B. Russell National School Lunch Act (42 U.S.C.
			 1753(b)(3)); and</text>
				</paragraph><paragraph id="H6AC3C2E87B084E6F96133C1DDF77193F"><enum>(4)</enum><text>the ability to
			 deliver effective and cost-efficient training and technical assistance
			 programming to school foodservice personnel at training sites that are located
			 within a proximate geographic distance to schools, central kitchens, or other
			 worksites.</text>
				</paragraph></subsection><subsection id="H21581B9A1B184D46A0C73C8CBECB47D5"><enum>(c)</enum><header>Program
			 assistance</header><text display-inline="yes-display-inline">The Secretary
			 shall assist the institutions receiving grants under this section in
			 publicizing and disseminating training and other project materials and online
			 tools wherever possible.</text>
			</subsection><subsection id="H9FD9DAF18913422F846450C0DB595887"><enum>(d)</enum><header>Federal
			 Share</header>
				<paragraph id="H0A5D3690BE4C4BEBBA31B7F1011EF657"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Federal share of
			 costs for training and technical assistance funded through a grant awarded
			 under this section shall not exceed 90 percent of the total cost of such
			 training and technical assistance.</text>
				</paragraph><paragraph id="H331544D476BB4F4C991CE92011E91712"><enum>(2)</enum><header>Matching</header><text>As
			 a condition of receiving a grant under this section, the eligible third-party
			 training institution shall provide matching support in the form of cash or
			 in-kind contributions.</text>
				</paragraph></subsection><subsection id="H7EA741BFE62247E3B59A0BB554BBAAF8"><enum>(e)</enum><header>Oversight</header><text display-inline="yes-display-inline">The Secretary shall establish procedures to
			 enable the Secretary to—</text>
				<paragraph id="HB5E8D236EF6F4EB990FAB650022BB005"><enum>(1)</enum><text>oversee the
			 administration and operation of training and technical assistance funded
			 through grants awarded under this section; and</text>
				</paragraph><paragraph id="H5F207C058BAF4E3A9A689C4601E4B9DC"><enum>(2)</enum><text>ensure that such
			 training and assistance is operated consistent with the goals and requirements
			 of this Act.</text>
				</paragraph></subsection></section><section id="HEA919FB629374CA183626E2362A8F28C"><enum>6.</enum><header>Report to
			 Congress</header><text display-inline="no-display-inline">Not later than one
			 year after funds are made available to carry out this Act, and annually
			 thereafter, the Secretary shall submit to Congress a report on the Secretary’s
			 progress in implementing the provisions of this Act.</text>
		</section><section id="H8C1A9B999A4F44F9B9209E0D871237CC"><enum>7.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 Act for fiscal year 2014 and each succeeding fiscal year.</text>
