<official-title>To establish the Clear Creek National Recreation Area in San Benito and Fresno Counties, to designate the Joaquin Rocks Wilderness in such counties, to designate additional components of the national wild and scenic rivers system, and for other purposes.</official-title>

<section id="H4E5A6480134F4FBB87F1DD01A46A4E18" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clear Creek National Recreation Area and Conservation Act</short-title></quote>.</text></section> 
<section id="HC06B5A0C5616453E8B95D548FCAB4D5C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H8F1F9FB3443244F8B1712ED65D8F689B"><enum>(1)</enum><header>Management plan</header><text>The term <term>management plan</term> means the Plan for the Recreation Area prepared under section 4(c).</text></paragraph> 
<paragraph id="HB02DF47B16CA4BDA876E998127B48AF4"><enum>(2)</enum><header>Recreation area</header><text>The term <term>Recreation Area</term> means the Clear Creek National Recreation Area.</text></paragraph> 
<paragraph id="HDF4FE748B21C422392D8A90EBFAE07C8"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="H0B5068005CF444DEB77FF307D6170D4A"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means the State of California.</text></paragraph></section> 
<section id="HF6467595E49D4E709FB28EDC35F6D751"><enum>3.</enum><header>Establishment of Clear Creek National Recreation Area</header> 
<subsection id="H3090BF00DBB148609E277BFDC4F4E298"><enum>(a)</enum><header>In general</header><text>To promote environmentally responsible high-quality motorized and non-motorized trail based recreation, including off-highway vehicle use, scenic touring, access for hunting and gem collecting, while protecting ecological, geological, scenic, cultural, and historic resources, fish and wildlife values, and other resources of the landscape, there is established the Clear Creek National Recreation Area in the State, to be managed by the Secretary.</text></subsection> 
<subsection id="H6D6C58C90B104BF19AEE0670CE814454"><enum>(b)</enum><header>Boundaries</header><text>The Recreation Area shall consist of approximately 75,000 acres of Federal land in San Benito County and Fresno County, California, as generally depicted on the map entitled <term>Clear Creek National Recreation Area</term> and dated July 30, 2012.</text></subsection> 
<subsection id="H8DD546EBF2A84D88BD3AC4A4BBC58BFF"><enum>(c)</enum><header>Map</header> 
<paragraph id="H5566809D005D431B9094E10AF921D71B"><enum>(1)</enum><header>In general</header><text>As soon as practicable, after the date of the enactment of this Act, the Secretary shall submit a map and legal description of the Recreation Area to—</text> 
<subparagraph id="H5BEEE019C1014CEC807FE62B5E27C48D"><enum>(A)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text></subparagraph> 
<subparagraph id="HF191E0FFE17E4027AAA70136D7AA3761"><enum>(B)</enum><text>the Committee on Energy and Natural Resources of the Senate.</text></subparagraph></paragraph> 
<paragraph id="H3A66AC942F234BC1AD079F1AF82349FC"><enum>(2)</enum><header>Availability</header><text>Copies of the map submitted under paragraph (1) shall be on file and available for public inspection in—</text> 
<subparagraph id="H37235843DAFD437C863CA871C0919C15"><enum>(A)</enum><text>the Office of the Director of the Bureau of Land Management; and</text></subparagraph> 
<subparagraph id="H82DEFCB2EB4B4440A3E68EAB1E5CF2A1"><enum>(B)</enum><text>the appropriate office of the Bureau of Land Management in California.</text></subparagraph></paragraph></subsection></section> 
<section id="HFDA74F70D04F4E698D8C6448576EFC63"><enum>4.</enum><header>Management</header> 
<subsection id="H410872434E3742F782203B55889F74C7"><enum>(a)</enum><header>In general</header><text>The Secretary shall manage the Recreation Area to further the purposes described in section 3(a), in accordance with—</text> 
<paragraph id="H75AF9A74C27B4DEAA349C0D1E9AEF6D4"><enum>(1)</enum><text>this Act;</text></paragraph> 
<paragraph id="H9001C04CA0F84501A816B9F1012394D1"><enum>(2)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and</text></paragraph> 
<paragraph id="H12DAC1670A08460AAC42AEE7B8AC70E2"><enum>(3)</enum><text>any other applicable law.</text></paragraph></subsection> 
<subsection id="HA61AC16CE8544A61A69DD04967E187A6"><enum>(b)</enum><header>Uses</header><text>The Secretary shall—</text> 
<paragraph id="H914677775CF54C5485350CA0E492F64D"><enum>(1)</enum><text>allow hiking, camping, hunting, gem collecting, and sightseeing and the use of motorized vehicles, mountain bikes, and horses on designated roads, trails, and areas;</text></paragraph> 
<paragraph id="H865A43A01C2A4E3180869A89591841D9"><enum>(2)</enum><text>issue special recreation permits for motorized and non-motorized events; and</text></paragraph> 
<paragraph id="HBF56555F506C4C18BD6E88D8ECB45E07"><enum>(3)</enum><text>reopen the Clear Creek Management Area to the uses described in this subsection as soon as practicable following the enactment of this Act and in accordance with the management guidelines outlined in this Act and other applicable law.</text></paragraph></subsection> 
<subsection id="H2B82A00C81E949469F50C7769CD66041"><enum>(c)</enum><header>Interim management plan</header><text>The Secretary shall use the 2005 Clear Creek Management Area Travel Management Plan as modified by this Act, or by the Secretary to incorporate natural resource protection information not available in 2005, as the basis of an interim management plan to govern motorized recreation within the Recreation Area pending the completion of the long-term management plan required in subsection (d).</text></subsection> 
<subsection id="HA790EDDF65614D569C38DB7FBE9D018F"><enum>(d)</enum><header>Permanent management plan</header><text>Not later than 2 years after the date of the enactment of this Act, the Secretary shall create a comprehensive management plan for the Clear Creek Recreation Area that—</text> 
<paragraph id="HA21BF7458F994275BF170CFB825994B3"><enum>(1)</enum><text>shall describe the appropriate uses and management of the Recreation Area in accordance with this Act;</text></paragraph> 
<paragraph id="HA89CD15CA6214BAB8D5285484D61D133"><enum>(2)</enum><text>shall be prepared in consultation with—</text> 
<subparagraph id="H30B4636722D54649940E91BEE4867A85"><enum>(A)</enum><text>appropriate Federal, State, and local agencies (including San Benito, Monterey, and Fresno Counties);</text></subparagraph> 
<subparagraph id="H6882F320415345FCA06E4A4F300207BD"><enum>(B)</enum><text>adjacent land owners; and</text></subparagraph> 
<subparagraph id="HE5960F06CD0841639C250BF0D125C8A4"><enum>(C)</enum><text>other stakeholders (including conservation and recreational organizations);</text></subparagraph></paragraph> 
<paragraph id="H84B7FA92B600420F9F7E1515E2A25CD0"><enum>(3)</enum><text>shall include a hazards education program to inform people entering the Recreation Area of the asbestos related risks associated with various activities within the Recreation Area, including, but not limited to, off-highway vehicle recreation;</text></paragraph> 
<paragraph id="H25DC9F4A88B54F7D8F9738A4D35474AF"><enum>(4)</enum><text>shall include a user fee program for motorized vehicle use within the Recreational Area and guidelines for the use of the funds collected for the management and improvement of the Recreation Area;</text></paragraph> 
<paragraph id="H84602B9E519A432C8A5F93B903727935"><enum>(5)</enum><text>may incorporate any appropriate decisions, as determined by the Secretary, in accordance with this Act, that are contained in any management or activity plan for the area completed before the date of the enactment of this Act;</text></paragraph> 
<paragraph id="H196E83746182426E81A4A17F8271699B"><enum>(6)</enum><text>may incorporate appropriate wildlife habitat management plans or other plans prepared for the land within or adjacent to the Recreation Area before the date of the enactment of this Act, in accordance with this Act;</text></paragraph> 
<paragraph id="H68E7E344C5F044AB80BDB07C9C357837"><enum>(7)</enum><text>may use information developed under any studies of land within or adjacent to the Recreation Area carried out before the date of enactment of this Act; and</text></paragraph> 
<paragraph id="H172FA11E2B49426EBC7243D2B39B6C64"><enum>(8)</enum><text>may include cooperative agreements with State or local government agencies to manage all or a portion of the recreational activities within the Recreation Area in accordance with an approved management plan and the requirements of this Act.</text></paragraph></subsection> 
<subsection id="H487846B1E40F4DF2AA69CB414D4195AC"><enum>(e)</enum><header>Acquisition of property</header> 
<paragraph id="HEF9A6FEF5A86491EB3E5E5FFDC8DAFA8"><enum>(1)</enum><header>In general</header><text>The Secretary may acquire land adjacent to the National Recreation Area by purchase from willing sellers, donation, or exchange.</text></paragraph> 
<paragraph id="HACC3EF228A0F4765903E6686E64372CA"><enum>(2)</enum><header>Management</header><text>Any land acquired under paragraph (1) shall be managed in accordance with—</text> 
<subparagraph id="HE03FB9E71CBA474E9198C8F4FF7D006B"><enum>(A)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text></subparagraph> 
<subparagraph id="HA020FF02D20741E2B90503E1A1BE1C64"><enum>(B)</enum><text>this Act; and</text></subparagraph> 
<subparagraph id="H8A718595F495478995FAC8F6F85EA325"><enum>(C)</enum><text>any other applicable law (including regulations).</text></subparagraph></paragraph> 
<paragraph id="HFBC26DD197D24370B8D58047295A6D51"><enum>(3)</enum><header>Improved access</header><text>The Secretary may acquire by purchase from willing sellers, donation, exchange, or easement, land, or interest in land to improve public safety in providing access to the Recreation Area.</text></paragraph></subsection> 
<subsection id="HE1E722B07CE44AFA97AC50517C79B463"><enum>(f)</enum><header>Private property</header> 
<paragraph id="H436CE4D1FABE4396AB51A29112862A25"><enum>(1)</enum><header>Access to private property</header> 
<subparagraph id="HEA7E3949A6214036A9F11ABA074CB16A"><enum>(A)</enum><header>In general</header><text>The Secretary shall provide landowners adequate access to in­holdings within the Recreation Area.</text></subparagraph> 
<subparagraph id="H663B297CBD80448EAF92ED623583B5C1"><enum>(B)</enum><header>Inholdings</header><text>For access purposes, private land adjacent to the Recreation Area to which there is no other practicable access except through the Recreation Area shall be managed as an inholding.</text></subparagraph></paragraph> 
<paragraph id="H9F8D614FD4CE45108FA5DE07449AA6D4"><enum>(2)</enum><header>Use of private property</header><text>Nothing in this Act affects the ownership, management, or other rights relating to any non-Federal land (including any interest in any non-Federal land).</text></paragraph> 
<paragraph id="H9EB8622B56014788B04B4B41371DBCB2"><enum>(3)</enum><header>Buffer zones</header><text>Nothing in this Act creates a protective perimeter or buffer zone around the Recreation Area.</text></paragraph> 
<paragraph id="HDF188188BFA644DCB83E8EEEAA04EB28"><enum>(4)</enum><header>Valid rights</header><text>Nothing in this Act affects any easements, rights-of-way, and other valid rights in existence on the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="HA57F1ABDD2BF4761AE58FBA0F1354072"><enum>(g)</enum><header>Water right exclusion</header><text>Nothing in this Act—</text> 
<paragraph id="HA5C6756BC3CC4CD09D35F04EBAEA3A8A"><enum>(1)</enum><text>shall constitute or be construed to constitute either an express or implied reservation by the United States of any water or water rights with respect to the Recreation Area; or</text></paragraph> 
<paragraph id="HF5F2871362DC4317B234BAC1D7C19D3E"><enum>(2)</enum><text>shall affect any water rights existing on the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="H5EE66D85179C4BB4AA63F7A1079BBFA9"><enum>(h)</enum><header>Hunting and fishing</header><text>Nothing in this Act—</text> 
<paragraph id="H465D1B79C3A64B698AA07E3FBD92C7E9"><enum>(1)</enum><text>limits hunting or fishing; or</text></paragraph> 
<paragraph id="H144BDB6670C045149C105BF9D9542FD1"><enum>(2)</enum><text>affects the authority, jurisdiction, or responsibility of the State to manage, control, or regulate fish and resident wildlife under State law (including regulations), including the regulation of hunting or fishing on public land managed by the Bureau of Land Management.</text></paragraph></subsection> 
<subsection id="HCD39A44D373F45159179CD4F19226EEC"><enum>(i)</enum><header>Motorized vehicles</header><text>Except in cases in which motorized vehicles are needed for administrative purposes or to respond to an emergency, the use of motorized vehicles on public land in the Recreation Area shall be permitted only on roads, trails, and areas designated by the management plan for the use by motorized vehicles.</text></subsection> 
<subsection id="H327C6971F43A4D9393ABCC8EC0DE6C32"><enum>(j)</enum><header>Grazing</header><text>In the Recreation Area, the grazing of livestock in areas in which grazing is allowed as of the date of the enactment of this Act shall be allowed to continue, consistent with—</text> 
<paragraph id="H0778F69DD6804B91B7E1E58D0327E836"><enum>(1)</enum><text>this Act;</text></paragraph> 
<paragraph id="H711E2CCBE5E041B1868ED583573DA1EA"><enum>(2)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and</text></paragraph> 
<paragraph id="HCF4F7FF62B934AD2909EBB7E7759AB30"><enum>(3)</enum><text>any regulations promulgated by the Secretary, acting through the Director of the Bureau of Land Management.</text></paragraph></subsection> 
<subsection id="H48ABDB3F6CD74426B6AB07D97F937B9B"><enum>(k)</enum><header>Withdrawal</header><text>Subject to valid existing rights, all Federal land within the Recreation Area is withdrawn from—</text> 
<paragraph id="H9F4CDFE22DFC49C7BC96783972D33B8F"><enum>(1)</enum><text>all forms of entry, appropriation, and disposal under the public land laws;</text></paragraph> 
<paragraph id="H3717C2FCED704E499E661EF00FEFAE45"><enum>(2)</enum><text>location, entry, and patenting under the mining laws; and</text></paragraph> 
<paragraph id="HAE3CD0D7C6E042D7BA6AD22CC3BEEE68"><enum>(3)</enum><text>operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text></paragraph></subsection> 
<subsection id="H3187186C12D342DDA6D48E7F80056284"><enum>(l)</enum><header>Fees</header><text>Amounts received by the Secretary under the fee structure required by subsection (c)(3)(G) shall be—</text> 
<paragraph id="H4AA8C81710C34F55A669AA34E1A64BB2"><enum>(1)</enum><text>deposited in a special account in the Treasury of the United States; and</text></paragraph> 
<paragraph id="HE4E5A489AA234F30A14840C49011827E"><enum>(2)</enum><text>made available until expended, without further appropriation, to the Secretary for use in the Recreation Area.</text></paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H55DAC033008047B8BC78D0D395F4361E"><enum>(m)</enum><header>Risk Standard</header><text display-inline="yes-display-inline">The National Oil and Hazardous Substances Pollution Contingency Plan (40 C.F.R. 300), published pursuant to section 105 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9605">42 U.S.C. 9605</external-xref>), shall not apply to the Secretary’s management of asbestos exposure risks faced by the public when recreating within the Clear Creek Recreation Area described in section 3(b).</text></subsection></section> 
<section commented="no" id="H424F44C8DDC3493BA2846495F87C651B"><enum>5.</enum><header>Joaquin Rocks Wilderness</header><text display-inline="no-display-inline">In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the approximately 21,000 acres of Federal lands located in Fresno County and San Benito County, California, and generally depicted on a map entitled <term>Proposed Joaquin Rocks Wilderness</term> and dated April 16, 2013, is designated as wilderness and as a component of the National Wilderness Preservation System and shall be known as the <term>Joaquin Rocks Wilderness</term>.</text></section> 
<section id="HCE9A74058DFA4B11B295C74D53FDE2E3"><enum>6.</enum><header>Clear creek management area wild and scenic rivers</header><text display-inline="no-display-inline">Section 3(a) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>) is amended by adding at the end the following paragraphs:</text>

<paragraph id="HDB669AB05C7C4DE39089F6A981F8B7DB"><enum>(__)</enum><header>Larious Canyon</header><text>The approximately 5.25 miles of Larious Canyon Creek from its source near Idria Peak in Section 6, R12E, T18S, to the boundary of the Clear Creek Special Recreation Management Area in Section 23, R11E, T17S.</text></paragraph> 
<paragraph id="HB9634D5FA7F148B5BF3E54A62D90B2E5"><enum>(__)</enum><header>San Carlos Creek</header><text>The approximately 5.51 miles of the East Fork San Carlos Creek from its source near San Benito Mountain in Section 10, R12E, T18S, to the boundary of the Clear Creek Special Recreation Management Area in Section 22, R12E, T17S.</text></paragraph> 
<paragraph id="HC8A7878929BA474CA9508CC16F53D440"><enum>(__)</enum><header>Cantua Creek</header><text>The approximately 7.68 miles of Cantua Creek from its source north of Santa Rita Peak in Section 24, R12E, T18S, to the public land boundary in Section 3, R13E, T18S.</text></paragraph> 
<paragraph id="H4D97A455756A4692A1CBF37F968823FA"><enum>(__)</enum><header>Picacho Creek</header><text>The approximately 2.65 miles of Picacho Creek, from its source spring in Section 20, R12E, T18S, to its confluence with the San Benito River.</text></paragraph> 
<paragraph id="H99385D4B8E034DD18D7C831DCA581D7A"><enum>(__)</enum><header>White Creek and Tributaries</header> 
<subparagraph id="HC3311468D40E45B7A056C6A70A1671F9"><enum>(A)</enum><text>The approximately 5.37 miles of White Creek, from its source in Section 36, R12E, T18S, to the boundary of the Clear Creek Special Recreation Management Area in Section 17, R13E, T19S.</text></subparagraph> 
<subparagraph id="HC171BFD1AFAB443C93AB89FF4FE50CF8"><enum>(B)</enum><text>The approximately 2.29 miles of the unnamed tributary of White Creek from its source just south of Spanish Lake in Section 29, R13E, T18S, to its confluence with White Creek.</text></subparagraph> 
<subparagraph id="HB39D0D436D9647FA876E52DCE69C49A4"><enum>(C)</enum><text>The approximately 2.45 miles of the unnamed tributary of White Creek from its source in Section 33, R13E, T18S, to its confluence with White Creek.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
